ORDINANCE NO. 31 SERIES 2002 AN ORDINANCE AMENDING TITLE 3, CHAPTER 6 OF THE VAIL TOWN CODE, (COMMISSION ON SPECIAL EVENTS), AND SETTING FORTH DETAILS IN REGARD THERETO. WHEREAS, it is the Town Council's opinion that this amendment to Title 3, Chapter 6 of the Vail Town Code is necessary to avoid potential conflicts of interest and to allow the Commission on Special Events ("CSE") to more effectively administer special events in the Town of Vail. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Title 3, Chapter 6 of the Vail Town Code is hereby amended as follows: (deletions are shown in c+ri4cn~h) Section 3. Members -Appointments -Terms The CSE shall consist of five (5) voting members appointed by the Town Council to be designated as follows: 1 Retail; 1 Restaurant; 1 Lodging; 1 (from any of 3 categories previously stated); 1 at large. All five voting members shall be residents of the Town of Vail, own real property within the Town of Vail, own a business in the Town of Vail, or be employed within the Town of Vail. No current event promoters, producers or board members of organizations requesting funding, or their employees, may serve as voting members. The initial terms of two members of the CSE shall be for one year, and the initial term of three members shall be for two years, to be appointed in 2002. Thereafter, the council shall annually appoint CSE members to two year terms every January. Ordinance 31, Series of 2002 .r NOTE: All other provisions and Sections of Title 3, Chapter 6 of the Vail Town Code shall remain unchanged. Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. Section 4. The amendment of any ordinance or any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision amended. The amendment of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 5. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repealed. Ludwig Kurz, Mayor ATTEST: Lorelei Donaldson, Town Clerk READ AND APPROVED ON SECOND READING AND ORDERED PUBLISHED by title only this day of December, 2002 Ludwig Kurz, Mayor ATTEST: Lorelei Donaldson, Town Clerk Ordinance 31, Series of 2002 ~9 ORDINANCE NO. 30 SERIES OF 2002 ANNUAL APPROPRIATION ORDINANCE: ADOPTING A BUDGET AND FINANCIAL PLAN AND MAKING APPROPRIATIONS TO PAY THE COSTS, EXPENSES, AND LIABILITIES OF THE TOWN OF VAIL, COLORADO, FOR ITS FISCAL YEAR JANUARY 1, 2003 THROUGH DECEMBER 31, 2003 WHEREAS, in accordance with Article IX of the Charter of the Town of Vail, Colorado, the Town Manager prepared and submitted to the Town Council a proposed long-range capital program for the Town and a proposed budget and financial plan for all Town funds and activities for the fiscal year; and WHEREAS, notice of public hearing on the proposed Town budget and capital program was published on the 4t" of November, 2002, more than seven (7) days prior to the hearing held on the 19t" of November, 2002, pursuant to Section 9.5 of the Charter; and WHEREAS, it is necessary for the Town Council to adopt a budget and financial plan for the 2003 fiscal year, to make appropriations for the amounts specified in the budget; and NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail, Colorado, that: 1. The procedures prescribed in Article IX of the Charter of the Town of Vail, Colorado, for the enactment hereof have been fulfilled. 2. Pursuant to Article IX of the Charter, the Town Council hereby makes the following annual appropriations for the Town of Vail, Colorado, for its fiscal year beginning on the first day of January, 2003, and ending on the 31St day of December, 2003: Ordinance No. 30, Series of 2002 i` FUND AMOUNT General Fund 20,491,710 Capital Projects Fund 7,208,321 Real Estate Transfer Tax Fund 4,488,465 Vail Marketing Fund 320,720 Debt Service Fund 1,878,449 Heavy Equipment Fund 1,796,486 Health Insurance Fund 1,743,985 Dispatch Services Fund 1,436,195 Total Before Interfund Transfers 39,364,331 Less Interfund Charges & Transfers 5,814,366 NET EXPENDITURE BUDGET 33,549,965 3. The Town Council hereby adopts the full and complete Budget and Financial Plan for the 2003 fiscal year for the Town of Vail, Colorado, which are incorporated by reference herein and made part hereof, and copies of said public records shall be made available to the public in the Municipal Building of the Town. If you would like to review a copy of the report, I will have them available on Tuesday. MEMORANDUM TO: Vail Town Council FROM: Bob McLaurin, Town Manager RE: Town Manager's Report DATE: November 19, 2002 WATER SAVINGS . For the period of May-September 2002, TOV used 10.6 million gallons less water than the same time period in 2001, or a reduction of 34.5 percent of water use. This translated into a savings of $14,381 over 2001. VAIL VALLEY ATHLETE COMMISSION -WINTER 2002/03 CONTRIBUTIONS The Vail Valley Athlete Commission convened for its upcoming winter sponsorships of individual athletes on Wednesday, November 6. The funding partners and representatives are as follows: - Vail Valley Foundation, Kurt Krieg - Beaver Creek Resort Company, Jean Dennison - Town of Vail, Pam Brandmeyer - Vail Resorts, Inc., Jimmy Roberts Because the Commission had not yet received VRI's contribution, we were reluctant to fund more than our starting balance of $15,074 + we wanted to hold some funds in reserve for the summer'03 requests. The funding decisions can be found on the second to last page of the attached handout. This line item is funded through Council contributions and was reduced by 5% for'03. Please let staff know if you have any questions. IGA WITH EAGLE COUNTY FOR 2003 ANIMAL CONTROL SERVICES Council approval is requested for an Intergovernmental Agreement with Eagle County for Animal Control Service. The agreement has no substantial changes from the 2002 agreement. (copy attached) COMMERCIAL VEHICLE SAFETY INSPECTIONS The Colorado State Patrol's Motor Carrier Safety Program and Vail Police Department Officers conducted commercial vehicle safety inspections on the Interstate November 11 and 12t". Due to the in climate weather only thirty-three trucks were inspected, sixteen of these had equipment violations. No muffler or "Jake Brake" violations were found. It is the Police Department's intention to run a similar program in the spring with a larger sample of trucks being stopped. Athlete Commission, ,~ INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF EAGLE, STATE OF COLORADO AND THE TOWN OF Vail This Agreement made this day of , 2002, by and between the Town of Vail (the "Town") and the County of Eagle, State of Colorado (the "County"). WHEREAS, the Town desires to contract with the County for the performance of the hereinafter described Animal Control Services on the terms and conditions hereinafter set forth; and WHEREAS, the County is agreeable to rendering such Animal Control Services on the terms and conditions hereinafter set forth; and WHEREAS, this Intergovernmental Agreement is authorized pursuant to Section 30-11-101, as amended. NOW, THEREFORE, in consideration of the mutual covenants, conditions and promises contained herein, the parties hereto agree hereby as follows: WITNESSETH: SECTION 1. TERRITORY COVERED. The territory covered by this Agreement is all of that certain property legally described as the Town of Vail. SECTION 2. DEFINITIONS Emergency on Call services is defined as emergency calls received by the County for which Animal Control assistance is required and no Animal Control Officer is on duty to respond. Shelter means The Eagle County Animal Shelter located at 1400 Fairgrounds Road, Eagle; Colorado, and any other shelter facility operated or designated by County. Unclaimed Day is defined as a calendar day or any part thereof during which an unclaimed animal is confined in Shelter on behalf of the Town. SECTION 3. SCOPE OF SERVICES. The County agrees to provide general .Animal Control Services within the Town of Vail The County shall provide: A) A minimum of 2.5 hours patrol per day, consisting of inspection tours looking for violations or responding to complaints. B) Twenty-four hours per day Emergency On Call service (via County answering service when not open). C) Administration and enforcement of the current Title 6, Animals of the Municipal Code of the Town of Vail presently in effect, and as may be subsequently amended. D) The County shall provide the Town with monthly reports and an annual report of services provided pursuant to this Agreement. Such reports shall include, by way of example only, the number of calls for service, number of animals sheltered, number of Unclaimed Days, and number of citations issued, as they apply to the Town of Vail. E) Emergency on Call service will be provided during the period when an Eagle County Animal Control Officer is not on duty. In the event that an Eagle County Animal Control Officer is not immediately available to respond to an incident or emergency, the Town of Vail will provide available personnel to secure the scene and administer control of the situation until the Eagle County Animal Control Officer arrives to resolve said incident. F) Animal sheltering services for animals attributable to the Town, of the nature and quality customarily provided at the Shelter. Animals attributable to the town are animals impounded within the Town of Vail and animals owned by persons dwelling, perma nently or temporarily, in the Town of Vail. SECTION 4. OFFICIAL STATUS. For the purpose of performing the Animal Control Services and functions set forth in this agreement, Eagle County Animal Control shall enforce, as the Town's agent, the Municipal Ordinances relating to animals now in effect and as amended from time to time. a SECTION 5. EQUIPMENT. The County shall furnish and supply, at its sole expense, all necessary labor, supervi- sion, equipment, motor vehicles, office space, and operating and office supplies necessary to provide the services to be rendered hereunder. SECTION 6. COMPENSATION. The Town of Vail agrees to pay the County, monthly, the sum of $3,250.00 based on estimated patrols and on estimated sheltering requirements of 600 animal days. _ -- The Town of Vail agrees to pay the County, on or before the fifteenth of each month, for services rendered the previous month plus any additional billing received for Response to On Call Emergencies. Responding to On Call Emergencies: $50.00/incident All fees and expenses recovered at or for the Shelter will remain with the County. All court fines and costs will remain with the court of venue. The County shall administer the County's Dog Tag Program for the Town. Monies collected from residents of the Town shall belong to the County. SECTION 7. PERSONNEL. The Eagle County Animal Control Officer shall have full cooperation from the Town of Vail, its public works, its police officers and/or their respective officers, agents, and employees, so as to facilitate the performance of this Agreement. The rendition of Animal Control Services provided for herein, the standards of perform- ance, the discipline of officers, and other matters incident to the performance of such services and the control of personnel so employed, shall remain in the County. All persons employed in the performance of such Animal Control Services for the Town of Vail, pursuant to this agreement, shall be County employees, except for Town personnel used to secure the scene as described in Section 3. SECTION 8. LIABILITY AND INSURANCE. A. The County, its officers and employees, shall not be deemed to assume any liability for intentional or negligent acts, errors, or omissions of the Town or of any officer or employee thereof. Likewise, the Town, its officers and employees, shall not be deemed to assume any liability for intentional or negligent acts, errors or omissions. of the County or by any officer or employee thereof. B. The County agrees to indemnify, defend and hold harmless to the extent allowed by law, the Town, its respective agents,. officers, servants and employees of and from any and all loss, costs, damage, injury, liability, claims, liens, demands, action and causes of action whatsoever, arising out of or related to the County's intentional or negligent acts,. errors or omissions or that of its agents, officers, servants, and employees, whether contractual or otherwise. Likewise, the Town agrees to indemnify, defend and hold harmless to the extent allowed by law, the County, its respective agents, officers, servants and employees of and from any and all loss, costs, damage, injury, liability, claims, liens, demands, action and causes of action whatsoever arising out of or related to the Town's intentional or negligent acts errors or omissions or that of its agents officers, servants and employees, whether contractual or otherwise. C. The County and the Town shall respectively provide its own public liability, property damage, and errors and omissions insurance coverage as each party may deem adequate and necessary for any potential liability arising from this Agreement. Further, the County and the Town, respectively, shall name, subject to the approval of each respective party's insurance carriers, the other respective party as a co-insured under such insurance policies to the extent of any potential liability arising under this Agreement and, upon reasonable written request, shall furnish evidence of the same to the other respective patty. 1 SECTION 9. TERM AND TERMINATION. This Agreement is effective January 1, 2003, and shall end on the 31st day of December, 2003. Either party shall have the right to terminate this agreement with or without cause at any time by giving the other party thirty days' prior written notice of termination. Upon termination, the County shall be entitled to compensation for services performed prior to such termination, and both parties shall be relieved of any and all duties and obligations under this Agreement. Obligations of the Town of Vail and the County, .respectively, after the current fiscal year, are contingent upon funds for the purpose set forth in this Agreement being appropriated, budgeted and otherwise made available. SECTION 10. GENERAL PROVISIONS. A. Notices. All notices, requests, consents, approvals, written instructions, reports or other communication by the Town of Vail and the County, under this Agreement, shall be in writing and shall be deemed to have given or served, if delivered or if mailed by certified mail, postage prepaid or hand delivered to the parties as follows: Town of Vail: Town Attorney Town of Vail .75 S. This agreement does not•and shall not be deemed to confer upon or grant to any third party any right to claim damages or to bring any lawsuit, action or other proceedings against either the Town or the County because of any breach hereof or because of any terms, covenants, agreements or conditions contained herein. 5 C. No modification or waiver of this Agreement or of any covenant, condition, or provision herein contained shall be valid unless in writing and duly - executed by the party to be charged therewith. D. This written Agreement embodies the whole agreement between the parties hereto and there are no inducements, promises, terms, conditions, or obligations made or entered into either by the County or the Town other than those contained herein. E. This Agreement shall be binding upon the respective parties hereto, their successors or assigns and may not be assigned by anyone without the prior written consent of the other respective party hereto. F. All agreements and covenants herein are severable, and in the event that any of them shall be held invalid by a court of competent jurisdiction, this Agreement shall be interpreted as if such invalid Agreement or covenant were not contained herein. G. The Town has represented to the County and, likewise, the County has represented to the Town, that it possesses the legal ability to enter into this Agreement. In the event that a court of competent jurisdiction determines that either of the parties hereto did not possess the legal ability to enter into this Agreement, this Agreement shall be considered null and void as of the date of such Court determination. Work Session * I very much support a new indoor athletic facility. (We should stop calling it a gymnastics facility.) If we can get a better deal out of the Water & Sanitation District, that would be great, but the town should be prepared to be the developer and try to get it built in 2003. Above the gym at Red Sandstone Elementary is still my No. 1 choice, unless someone has a site I'm not aware of. * I think the Vail Chamber should fund activities like this out of their budget. They spend nearly everything on administration and almost nothing on events. If they don't have the money, they should get a sponsor. * I haven't thoroughly reviewed the proposed sign code to give meaningful comments. * I would be opposed to differentiating the building fees between primary homeowners (locals) ad second-home owners. That would be very divisive and unfair. Evening Meeting * On the Conference Center, there is a lot of work to be done. Here are a few of my thoughts: - Discuss merits of hiring an "Owners Representative" to assist us for this complicated and large project. Page 2 district use "Owner Reps" on their projects. , It is very common practice for public entities who don't have the skills or manpower to manage large construction projects.' - Discuss and prepare preliminary timeframe for the project. - Review all data available, i.e., feasibility study, schematic plans, etc. Determine program for the project, i.e. size of rooms, etc. - Do the RFP for an architectural firm. We should have determined the architectural style we want prior to sending the RFP. - Discuss merits of "design build" versus bidding the project. My first inclination is to bid the project. It will take a little more time but should result in a lower cost. * I support Ordinances 31 & 30. * In Bob's report, I compliment the Town of Vail. on its 34.5% reduction in water use. Denver had a goal of 30%, but only reduced consumption by 18%.
