BACKG120UN® RATIONALE:
Council received an email from Dennis Stein, Director of the Vail
Recreation District (VRD), indicating the VRD board as a whole
will not continue to support operations and maintenance of the
bubble facility for the '04-'05 season. Arrangements are already
underway by TOV personnel to take down the bubble March 29,
2004, and to store it. at the Public Works facility. Staff would like
direction on next steps for the disposition of the bubble, to include:
a. A nonofficial proposal from Western Eagle County
Metropolitan Recreation District (WECMRD) has been
relayed to the Vail Town Council for purchase and
installation of the bubble mid-valley, should staff follow-up?
b. Develop a proposal to sell the bubble .to the highest
bidder.
c. Prepare a Request for Proposal (RFP) for an '04-'05
operator.
d. Re-discuss with the VRD another season's operation
and maintenance for the facility based on a bona fide
marketing and programming effort on behalf of the VRD.

Staff reviewed the memorandum and a letter provided by Jim Lamont, Vail Village Homeowner's
Association, from Fredrick Wyman III, President of All Seasons Condominium Association. The
applicant reviewed the goals of the project and displayed multiple visual simulations of the proposal
and how it affected different views.
Jim Lamont complimented the visual simulations and then expressed concern about the proposed
parking structure within the required setback from Mill Creek. Mr. Lamont also expressed concern
about the parking lot access and asked why the loading and delivery was not covered. He asked
about employee housing in the parking structure and whether it could be moved. He suggested
putting it over the loading and delivery area. Mr. Lamont asked about pubic improvements and
whether there were other pubic improvements that could be required or should be required. Jim
Lamont indicated that improving access to Ford Park could be pursued.
The Commission commented that the setback from Mill Creek was a concern and the prposed

parkinct structure should be pulled away. There was also general concern over the access to the
proposed parking structure. The new floor on Building "C"was identified as a concern as the height
would block a large portion of the view to the Gore Range. The new floor increased the height by
approximately 22 feet. It was suggested that Building "C" should taper down to Vail Valley Road.
There needs to be some planting pockets located on top of the parking structure to provide winter
interest.. The existing-trees along-the-bike path should remain. The relocation of the access gate
further not the property from its current location will help circulation on Vail Valley Road. There was
some indifference about covered loading and delivery and its value as a public benefit. The
proposed new units should not be required to be placed in a rental pool. The Commission asked the
applicant why they wanted so much floor area and questioned where the public benefits were in the
project which would warrant such a large increase over the maximum GRFA permitted. The
Commission liked the turn-around area provided off of Vail Valley Drive on the south lot and the
proposed garden on top of the parking structure. The Commission stated that they liked the plan
from a year ago when a variance for GRFA to be located within a setback was being requested.
The applicant was directed to remove all improvements from the 100-year floodplain. Improvements
to Mill Creek could be a significant public improvement. The Commission concluded by requesting a
complete application with no more work sessions: Staff was directed to review the next submittal for
completeness very thoroughly. The Commission acknowledged that the photography simulation
used in the presentation worked better than a model. However, the photos need to be realistic
about Landscaping and what is impacted with development.
2. A request for final review of a variance from Section 12-6H-6, Setbacks, Section 12-6H-10:
Landscaping and Site Development, and Section 12-6H-11: Parking and Loading, Vail Town
Code, to allow for a residential addition, located at 303 Gore Creek Drive/Lot 7, Block 5, Vail
Villages 1St Filing, and setting forth details in regard thereto..

Due to the similar nature of the applications, items #2 and #3 (Hughes Residence and Shirley
Residence) were reviewed concurrently.
Staff presented an overview of the request and the staff memorandum.
The applicant's architect, Shepard Resources, Inc., had no additional comment. The
applicant's attorney, Murray Franke Greenhouse List & Lippitt LLP, stated their objection to
Staffs recommended condition #2 for the Hugh's proposal.
Virginia Wells, adjacent property owner Rowhouse #6, stated that they did not support the Hugh
Residence variance request and did not support the final design of the proposal. Ms. Wells
requested that the PEC adopted and broaden the language of Staffs recommended condition
#2 for the Hugh's proposal.
Commissioner Shirley stated his objection to Staffs recommended condition #2 for his
proposal
Th.' PEC noted the special circumstances and hardships related to the Hughes and Shirley
variance requests. The PEC noted that Staffs recommended condition #2 was not necessary
as any risk of construction impacting neighboring properties would be addressed by the existing
private party-wall agreements.

willingness to decrease the amount deviation from the setback being requested.
Karen Scheideger, adjacent property owner, stated that they did not support the Yare's variance
request.
The Commission commented that the existing aspen stand did constitute a hardship. The PEC
noted that design alternatives complying with the setback requirements exist and the trees can
be removed or relocated.
5. A request for final review of a variance from Title 14, Development Standards Handbook, Vail Town
Code, to allow for retaining walls in excess of six (6) feet in height, located at Tract K, Glen Lyon
Subdivision and Unplatted Parcels, a more complete legal description is on file at the Community
Development Department, setting forth details in regard thereto.

Staff presented an overview of the request and the staff memorandum.
The applicant's representative, Jay Peterson, summarized the applicant's proposal and
requested minor changes to Staffs recommended conditions. Staff was agreeable to the
requested changes to the conditions.
The PEC commented on the special circumstances and hardship of this request and noted that if
the proposed walls were constructed in a Town right-of-way, rather than in a Town granted
easement, that this variance request would not be necessary.
6. A request for a recommendation to the Vail Town Council for a text amendment to Section 12-
7H-3, Permitted and Conditional Uses; First Floor or Street Level and Section 12-71-3, Permitted
and Conditional Uses; First Floor and Street Level, pursuant to Section 12-3-7, Amendment, Vail
Town Code, to allow for temporary real estate sales offices on the first floor or street level of a
building, in the Lionshead Mixed Use I & 2 zone districts, and setting forth details in regard
thereto.

1. .That the applicant reduces the size of the proposed awning to extend no more
than four feet from the face of the building.
Staff gave a presentation per the memorandum. The applicant and the owner of the business
which uvill be occupying the tenant space, Tom Yoder, gave a presentation explaining the need
to remove the architectural "notch" from the building due to the way it breaks-up the interior retail
space ~rohich is the reason previous tenants have not be able to "make-it" in the space. They
continued by describing the notch as a health hazards as people late at night urinate and vomit
in the "notch". Rod Slifer reviewed the application and how the application would comply with
the goals of the Master Plan and hovv the proposal is not a special privilege.
The Commission was in favor of granting the variance as the notch does not serve a
positive purpose. They agreed strongly about the negative health issues associated
with the unintended consequences of the notch being there (i.e. public urination and
vomiting). Many of the Commissioners believed this was a special case which had a
hardship due to the age of the building and it's existence prior to Town of Vail zoning.

Commissioner, Doug Cahill asked how this will help the retail space and achieve the goals the
applicant stated at the outset. The applicant replied that he is primarily interested in the exterior
modifications and will work out the interior remodel issues after getting the variance.
Staff asked for a point of clarification regarding the awning and whether the PEC agrees with the
additional site coverage it creates. The Commissioners, except for- Chas Bernhardt, stated that
the awning should not extend any further from the face of the building than four feet so as to not
count towards site coverage:

change the zoning of the West Vail Lodge Properties from Commercial Core 3 (CC3) to High Density

I am applying to serve on the Art in Public Places Board. I meet
the criteria of being a resident and owning property in the Town of
Vail.
As an artist myself, I'm interested in serving on the Board and I
believe in giving back to my community. Working in collaboration
with other like-minded people to increase awareness of visual arts
and importance of civic improvement also appeals.
My relevant experience for serving on a board includes studying
at the Minneapolis College of Art & Design in the early eighties,
serving as a member of my condo association, being a largely self-
taught painter, eighteen years in the restaurant industry and
management, a strong sales background, experience in fundraising
and increasing issue awareness for various programs. I'm

Art in Public Places board for the next three years: I am just
finishing my first three year term on the AIPP board and I would very
much like to continue working on the board.
I have enjoyed participating in the accomplishments of the AIPP board
Considering the various ways that the board can influence artful
decisions for the town in a variety of projects has been very
challenging and satisfying. The Vail Village Streetscape project, the
Vail Resorts Front Door project, and East and West Meadow Drive
projects make the next three years seem particularly exciting for the
AIPP board and I would very much like to be involved.
I have lived in Vail since 1970, when I graduated from college. My
husband and I own property in the town. I was co-owner of an art
gallery in town for seven years, during which time I participated on
the Vail Valley Gallery Association. I continued to broker art for
two years after the closing of the gallery. I am currently a CASA,
court appointed special advocate for children involved in dependency
and neglect issues, and I serve as secretary-treasurer for a local
homeowner's association.
Vail is my home. Having the opportunity to positively impact the
continued attraction of this valley would be a privilege.

Dear Town Council,
I am writing to seek reappointment to the Town's Design Review Board. I have attended
all Design Review Board meetings since I was appointed last year, except for one I
missed due to a scheduling conflict with the Conference Center Oversight Committee.
From what I see in our meetings, I am a member who has a unique presence on the
Board. I maintain the town's aesthetic standards, but I feel I act to "move things along"
in a manner that will help Vail be less notorious of a place to build and renovate property.
As I have learned, many people view Design Review Board as an unproductive pothole
in the proverbial road to construction that must be dealt with, rather than as a beneficial
partner in the design process. As such, Design Review Board has a strong potential to be
an inefficient mechanism that simply adds further cost, but little value, to what are
already expensive projects in Vail. I believe I push to reiterate to Design Review
applicants that the purpose of Design Review Board is to help them and to help the
Town. I am polite and respectful to applicants and avoid abusing the power associated
with being on the Town's side of the DRB table. Most importantly, I believe I help
applicants improve their projects in a manner that makes them appreciative of and
pleased with the Town of Vail's design review process.
I am seeking reappointment because I believe my presence on the Design Review Board
is productive for the Town for the reasons outlined above. Thank you very much for

Boazd. I have been a registered voter iri the Town,of Vail since i 990, and a full time resident

I am completing my first term on the boazd, and I am eager to continue in the process.
The past two yeazs have seen tremendous growth in the town. The members of the Design
Review Boazd have considered a variety of projects ranging from small home additions to the
plans for redevelopment of Lionshead and the Front Door Project. We have worked closely with
the developers of several projects of significance to the town, including the Donovan Pavilion,
ftiliddle Creek and the Four Seasons. Personally, I have become very familiaz with the design
review guidelines and development standards, and with the assistance of the excellent staff, I

Environmental Commission.
It is my belief that being a member of a community carves with it a responsibility to give
back to the conunutity. ~7ith the many projects scheduled for the coming several years,
we as a commutity have an opportunity to set the tone and viability of Vail for decades
to come. I believe that the PEC will play an important role in these projects and would
like to be part of the process.
I have been a resident of Vail since 1976 and currently am an owner of Bart ~ Yeti's
restaurant in Lionshead. ley background includes a degree in Political Science, as well
as two years' service on the Vail Town Council. I currently serve on the Lionshead Task
Force as well as being a regular attendee of meetings of the Conference Center
Committee and the Town Council.
As a member of the council I developed a general understanding of most of the larger
projects which will require PEC attention and the framework of codes which govern PEC
decisions. I also believe that I have a good working relationship with the members of the
Community Development Department and other staff at the T®V.
