Bill Gibson ITEM/TOPIC: Ordinance No. 10, Series of 2004, an ordinance amending Title 12, Zoning Regulations, Vail Town Code, to amend the Gross Residential Floor Area (GRFA) regulations in the Hillside Residential (HR), Single-Family Residential (SFR), Two-Family Residential (R), Two-Family Primary/Secondary .Residential (PS), Residential Cluster (RC), Low Density Multiple- Family (LDMF), Medium Density Multiple-Family (MDMF), High Density Multiple-Family (HDMF), and Housing (H) zone districts, and setting forth details in regard thereto. (45 min.) ACTION REQUESTED OF COUNCIL: Approve, approve with modifications, or deny Ordinance No. 10, Series of 2004 on first reading. BACKGROUND RATIONALE: On September 8, 2003, the Town of Vail Planning and Environmental Commission voted 6-0 to forward a recommendation of approval for proposed text amendments to the gross residential floor area (GRFA) regulations for Vail's residential zone districts. 7. Russ Forrest ITEM/TOPIC: Request for the Town Council to approve the execution of three easements to facilitate snowmaking on Vail Mountain and the creation of a bridge. (15 min.) These easements include: - easement for the vault (encloses snowmaking pumps) is on an unplatted parcel -Book 272, Page 663 (this is the stream tract/hillside parcel) -description is NW 1/4 of NW 1/4 of section 7, township 5 S, range 80 west), - easement for the snowmaking line is on Tract K, and - easement for the bridge and snow making utilities are on both Tract K and the unplatted parcel ACTION REQUESTED OF COUNCIL: Authorize the Town Manager to execute above mentioned easement for snow making facilities on Town Land on the South Side of Gore Creek and for the creation of a bridge that would carry the snowmaking line and provide access across Gore Creek for the potential future development of a snowcat access BACKGROUND RATIONALE: Vail Resorts needs to create a water connection to Vail Mountain. The pump house located on Forest Road which has provided snow making capacity on Vail Mountain has now been demolished. Vail. Resorts and Town Staff have agreed that given a letter sent to the Glen Lyon Subdivision homeowners in 1996, that Vail Resorts should pursue a amendment to a Special Development District to obtain final approval for snow cat access across Tract K, Glen Lyon Subdivision. In addition, Vail Resorts would like to first obtain the support of the subdivision to amend the covenants which prevent the creation of the planned snow cat access. However, this may take 2-4 months and VR needs to move forward with snow making facilities this summer. The bridge would provide the means to bring a water line across the creek to interconnect into a new pump system (i.e. underground in a vault). Vail Resort could place a water pipe under Gore Creek. However, they anticipate building a bridge for the snow cat access which would also support the snowmaking utilities. 8. Todd Oppenheimer ITEM/TOPIC: Approval of guard rails and handrails for Wall Street. (7.5 min.) Railings and Guardrails The Art in Public Places board has made a recommendation for a design for a hand forged steel guardrail for Vendetta's deck on Wall Street and for handrails for Wall Street. Both are an organic design in keeping with the overall design. for the village and will be fabricated by Freils Ironworks in Arvada. Handrails and guardrails will be installed in June. 9. Todd Oppenheimer ITEM/TOPIC: Wall Street Improvements including Earl Eaton Plaza Playground. (7.5 min.) BACKGROUND RATIONALE: Earl Eaton Plaza In response to direction from the town council an RFP was sent out to six artists asking for designs for sculptural pieces that could be used as play pieces in Eaton Plaza. Five artists submitted their ideas which were reviewed by the Art in Public Places (AIPP) Board. AIPP asked artist Robert Tully to study Eaton Plaza and the Wall Street redevelopment and then to further refine his proposal. Robert is proposing whimsical composition including two limestone sculptures depicting a big horn sheep and a bear along with a marble cloud. The play surface will be a combination of colored "spectraturf' and grass. 10. FEBRUARY 18, 2004 REQUEST FOR PROPOSAL FOR CHILDREN'S SCULPTURES AT EATON PLAZA VAIL, COLORADO Project Description: The Town of Vail is soliciting proposals from qualified artists to provide sculptural pieces to be used as children's play elements in Eaton Plaza, Vail Colorado. The pieces are to be installed during the Fall construction period of 2004 as part of the larger Vail Village Streetscape Project. The Town Council design committee, with input from town staff and the Art in Public Places Board, will review the proposals and select the artist for the work. The committee is most interested in animal forms for the pieces. Black bears, being a frequently observed species in the Vail Village, aze of particular interest. Other indigenous animal forms will be considered as well. The pieces will be placed in Eaton Plaza within an azea of resilient rubber playground surfacing. The artist may also be asked to provide input on the color selection for this material. The committee is expecting about 3 separate pieces although the final number will depend on the size and spacing. Attached is a plan indicating the layout of Eaton Plaza. Design Criteria: Sculptural pieces used as children's play elements must comply with the general requirements of the applicable Consumer Product Safety Commission (CPSC) standards for playground equipment. Generally, these standards will relate to protrusions, sharp edges, places that may cause entrapment or entanglement, spacing and safety zones, and fall heights. Town of Vail staff will review the applicable standards with the selected artist prior to beginning design. Compliance with the CPSC standards will not be difficult to achieve. Generally, the sculptures should not exceed about 3 feet in height and should be proportional in width and length. Most layouts will require a minimum of 6 feet of clear space between individual pieces. Schedule: Design of the pieces should begin immediately following artist selection and contracting. Conceptual sketches and layouts will be approved by the committee with direction to proceed to final design and fabrication. The dimensions and layout of the concrete footings will be required several weeks prior to installation of the pieces. Anchor bolts will be drilled and cemented in place with the installation. Following is the preliminary schedule. RFP issued to select artists February 18, 2004 Proposals due to Town of Vail March 5, 2004 Selection of artist by committee March 12, 2004 Contract signed, artist to proceed March 19, 2004 Preliminary designs submitted and approved April 16; 2004 Final design submitted and approved May 14, 2004 Footing dimensions and layout submitted June 4, 2004 Installation of finished pieces October 15, 2004 This is a preliminary schedule and is subject to change based on the streetscape contractor's work schedule. Budget: The Town of Vail has allocated $50,000 from the Village Streetscape Project for Eaton Plaza.children's play elements. This amount includes all costs associated with design, fabrication, delivery, and installation of the pieces. The costs of play surfacing, concrete footings, and anchor bolt installation are not included in the budget amount. Proposal submittal: Proposal submittals for the Eaton Plaza play elements are due to the town on March 5, 2005. Please submit the following information in 81/2' x 11" format 1. Photographs of previously executed pieces by the proposing artist similar in nature to the work described above. Include the date and location of the examples. 2. A written description of the artists approach to the project including design subject ideas, comments regarding the preliminary schedule, and comments regarding the stated budget. 3. References from 3 individuals or firms who the artist has worked with in the past. Please include names, addresses, and phone numbers as needed. The Advisory Committee voted 9-1 to fund this easement (proposed letter of support attached). - DISCUSSION OF COUNCIL PACKET DISTRIBUTION SCHEDULE At the time Council reduced their regular meeting schedule from four Tuesdays a month to twice a month, a request was made for earlier delivery of the packet and for that delivery to be by hand. Staff is finding it increasingly more difficult to meet a timely delivery by "close of business" on the Thursday prior to a Council meeting. Because of the volatile and constantly changing nature that many of Council's items require, we are challenged to provide an accurate agenda and are finding our work product is often compromised because of lack of time to appropriately scrutinize the materials produced. Therefore, staff is requesting the hand delivery time be amended to "close of business," or as early in the day as practicable, on the Friday prior to the Tuesday Council meeting. Allowing additional time Thursday afternoon and Friday morning would allow staff to re-check submittals and the agenda to make certain we're presenting the most accurate and complete information. We would ask Council to consider a trial. three-month period to see if this timing change is productive and achieves our desired outcomes. Proposed Letter of Support DRAFT Dear Commissioners, We are writing to express the Town of Vail's support of the Eagle County Open Space Advisory Committee's recommendation to fund the Bair Ranch conservation project. We note that the Advisory Committee voted 9-1 in favor of the Bair Ranch project, and hope that you agree with them that it is meritorious. As the Bair Ranch project is the first one to be funded with the open space tax proceeds. we believe it is particularly important to look at the excellent work the Advisory Committee has done in evaluating the Bair Ranch in accordance with the evaluation criteria which you approved. The Committee members, including the Town of Vail's representative on the Committee. have put a lot of extra time and effort into evaluating the project, and feel it would send a negative message to the community if the Committee's recommendation was ignored. We state this because it appears that at least one of the Commissioners is preparing to reject the Committee's work in favor of his own personal views on the project. We also note that the Bair Ranch project has extraordinary support from other funding partners, including the State of Colorado, the BLM, the Gates.Foundation, Coloredo Conservation Trust, hundreds of individual donors, and our congressional delegation, which secured the BLM funding. Those of us who serve in elected government know how difficult it is to put coalittons together, and once again, we feel it would set an adverse precedent for future funding, if the proposal is rejected. In summary, the Bair Ranch protect appears to be an excellent collaborative effort by many different interests, and an example of how the County's open space program should work through a dedicated and involvedf citizens advisory committee. Town of Vail: Commission on Special Events Overview: CSE Purpose, Strategic Plan and Decision Making Criteria Prepared for joint meeting with Council on May 18, 2004 The CSE was formed for the following purposes: (quoted directly from Ordinance No.7, Series 2002): ^ It is the Town Council's opinion that the health, safety and welfare of the citizens of the . Town of Vail would be enhanced by the establishment of a special events program setting forth policies and guidelines relating to the funding, reviewing, oversight and orchestration of special events to be presented in the Town of Vail. ^ To insure a single contact point for special event operations in Vail. ^ To be supportive of providing street entertainment and special events for vitality, economic viability, and fun year `round. ^ To increase the Town of Vail's lodging occupancy and sales tax collections. ^ To create a sense of community in Vail and increase the quality of experience for guests and residents. Therefore: The mission of the Vail Commission on Special Events (CSE) is to support street entertainment and special events for vitality, year-round fun, sense of community and increased quality of experience for guests and residents. The CSE's strategic priorities are: ^ To ensure that visitors leave Vail with the intention to "definitely return." ^ To attract new and to facilitate existing events that have a large number of participants who will return year after year. (Participatory events) ^ To develop and maintain a calendar of events that will ensure a balance of activity and entertainment options for visitors throughout the year and that will help to stimulate the economic vitality of the community year round. (Ambient and Community Events) ^ To evaluate and advocate for icon events that are attracted and funded by others. The CSE will measure events using the following criteria: ^ To qualify for funding review, the event must take place primarily within the Town of Vail ^ Potential for positive economic impact to the retail, restaurant and lodging sectors of the community Alignment with the target market as defined by the Vail Local Marketing District: o Priority will be given to events that attract and entertain visitors with the following demographic profile: ^ 35-64 Years of Age. ^ High Level of Education ^ White Collar Manager/Owner/Professional ^ Household Income > $ l OOK o Events that appeal to visitors who have an interest in cultural activities as well as participant events that occur annually are strongly encouraged. Experience and qualifications of the event producer Opportunity to leverage funding with sponsorships and/or media exposure so as to "stretch" the impact of the CSE's contribution TOV/CSE - 1 - Report to Council 18May04 ^ The event is proposed for a time of year that supports the CSE's goal of ensuring a calendar of events that will stimulate the local business economy throughout the year ^ Contribution to Sense of Community. The CSE does not produce events, or fully fund any single event; rather it seeks to leverage the dollars allocated by the Council to get as much "bang for the buck" as is possible. The CSE can fill one or more of the following roles relative to the funding of a specific event: ^ Provide Seed money to get an event off the ground, i.e. Vail Film Festival, Spring Back to Vail Become a sponsor of an existing event, i.e. TEVA Mountain Games Fund events that foster Vail's sense of community, i.e. America Days, New Year's Eve for Youth, Family Carnival Become a Host site for an existing "turn-key" event, i.e. 3 on 3 Soccer, Western Regional Softball Championships All event producers receiving funding will be expected to present to the Commission on Special Events within 90 days of the close of their event a written, post-event follow-up document which must include: ^ An overview outlining the event's strengths and weaknesses: specifically, what went well and what measures could be taken to improve the event ^ An event budget showing actual profit and loss numbers and how the CSE funding was utilized ^ A detailed overview of the marketing that was implemented to promote the event ^ Survey results showing the estimated effect on the following, per the CSE Criteria: o Attendance numbers and demographic profile o Economic impacts to the retail, restaurant and lodging sectors of the community o Visitor Intent to Return ^ Potential for growth and the development of sponsorships and media exposure ^ How did the event impact Vail's Sense of Community? The Town of Vail Council has defined the following events as "qualifying cultural events." These events fall outside the funding authority of the Commission, and their producers should address any funding needs directly to the Town Council. ^ DEFINITION: Vail Town Code 3-6-2 Qualifying Cultural Event: A function whose primary purpose is cultural in nature rather than economic. These events are typically, not necessarily, held in a performing arts venue such as the Ford Amphitheater or Dobson Arena. The town council shall establish by resolution a nonexclusive list of qualifying cultural events. ^ This list presently includes: ^ BRAVO! ^ Vail International Dance Festival ^ Skating Club of Vail/ 8 Days at Dobson ^ Hot Summer Nights ^ Budweiser Street Beat QUESTION: Do we want to add America Days and/or Holidays in Vail to this list? TOV/CSE - 2 - Report to Council 18May04 Town of Vail: Commission on Special Events CSE :Accomplishments to Date and Areas for Improvement Prepared for joint meeting with Council on May 18, 2004 Accomplishments: ^ Single Point of Contact has been established. ^ A Strategic Plan is in place and criteria for the funding and evaluation of events has been developed. ^ Independent event promoters have taken over the "community" events which were formerly produced and subsidized by the Vail Valley Chamber and Tourism Bureau. o America Days o Oktoberfest o Holidays in Vail ^ Successful new events have been funded that have significant growth potential: o Spring Back to Vail o Vail Film Festival ^ Existing events have been raised to a higher level: o Summer Street Entertainment program o Big Wheel, Brews `n Chili ^ An ongoing event recruitment program is being funded, with the goal of attracting existing, and or "turn-key" participant events to Vail. The following events have resulted from these efforts: o Western Fly Fishing Qualifier o Western Regional Softball Championships Negotiations are underway with several additional events for 2005 and 2006. ^ On site intercept surveys will be conducted at 8 of the events that received funding this year, with the goal of being able to accurately measure the effectiveness of the CSE's funding. ^ A post-event report is required of every event receiving CSE funding ^ The number of special events in Vail continues to grow- to the point where our venue infrastructure is stressed to the limit. We should continue to seek opportunities to develop viable venues for future use. ^ Excellent alignment and communication with the VLMD, the VCBA and the WCTB, and the Liquor Board; in great part due to the make-up of the CSE Board. i.e. Steve Rosenthal, Ian Anderson and Dave Chapin.
