Furthermore, the new building site is too close to our property borderline and t e underground construction will severely damage the existing trees along our property. FLVIitA MmRAN UIv SE.V[LI.A January 13, 2005 Members of the Vail Town Council Town of Vail Municipal Building Vail, Colorado 81657 RE: Crossroads Re-Development Dear members of the Vail Town Council: am a homeowner at Village Inn Plaza, Phase III, Condominiums right next door to Crossroads. The proposal at Crossroad includes many points that directly harm my property at the VVI because is too big, too oversized, too out-of-scale for Vail. It is also too high, especially along our joint property line and it comes way too close to the property line. Its underground construction right up to the property line will kill the many large trees we have along our side of the property line. The architectural style (the design, the look of the new building, the style of the building) is not compatible with the other buildings in Vail, including ours. The exhaust from the large underground garage is being blown right at our building. -The proposed building does not step down to heights compatible with our building. Moreover, there is too little green space (or landscaped area) between the new Crossroads building and their property line. This is the case on all sides of the proposed building, but especially next to us. They do not plan to have their ground at its present level so there will need to be many steps leading from Crossroads to the existing walkways on our side of the property line. The proposed building occupies too much of the total acreage of their land and leaves too little ground for landscaping, especially next to us. The large loading dock, which is placed adjacent to our building, has the potential to create a major noise and vehicle exhaust nuisance for us. I hope this letter can help you to make a decision not only for our benefit but for the benefit of the Town of Vail. We are not opposed to redevelopment of the site, but we object to the current proposal because it does not comply with planning guidelines and, as a result, unfairly affects our use and enjoyment of our home. Specifically, we object to the following aspects of the proposal: 1) The proposed 600,000 sq.ft. building is too high, too large in scale, covers too much of the site area and is set too close to the property line. Increased setbacks are required to mitigate the effects of its bulk and height on our building as well as on the surrounding streetscape. 2) The proposed new loading and delivery area in the north west corner adjacent to our building will service other businesses in the area as well as Crossroads. From early morning until evening, there will be large numbers of slow moving and stationary heavy vehicles emitting noise and toxic fumes right outside our ground floor apartment. This will adversely affect enjoyment of our home in winter and render our patio, living room and bedroom almost unusable in summer. 3) Large, ugly exhaust vents from the huge underground garage on the western boundary face our apartment and will further concentrate toxic fumes being blown directly at our apartment and outdoor living area. Instead, these exhaust vents should be located on the Eastern side of the development adjacent to the existing Town Parking Garage. 4) Inadequate tree barrier planned between the Crossroads building and the western boundary. Underground construction right up to the property line will kill existing trees on the Crossroads side, as well as the fine, mature trees outside our apartment on our side of the boundary. The existing trees took more than 10 years to reach their present size and even large replacements will not mitigate this loss. I have seen the proposal for the re-development of Crossroads, and I am strongly against this gigantic structure, especially since it is projected to come all the way to the property line, with practically little (for practical matters almost no} scaling down of its height. I am also opposed to having the garage exhaust to be blown right onto the little space that will remain between the proposed structure and our building. Please note that I am not against the re-development. It is obvious that Crossroads needed this a long time ago. I.would like to make the following suggestions: 1. The height of the building is a huge issue since the stepping down towards the town is so subtle, it is practically non-existent. 2. The project should be scaled down somewhat so that the construction will not go all the way up to the property line, otherwise, it will look crowded. 3. The venting of the garages should be re-designed to vent, maybe to the east side, or towards I-70, where there are no immediate neighbors. 4. The proposed style of this building does not match the style of Vail Village. It should be designed to be in accord to what a village or mountain resort should be. 5. I would like to see more green landscaped areas in this project. People like to live and/or visit Vail because we are looking for that old country alpine look, for clean air, nature and alpine vegetation. This all translates in that we are looking for the "village" part of Vail Village. This is what Vail is about and I assume this is why it is called Vail Village. The "village" part of its name is what makes Vail Village unia~u~. Otherwise, we could all very well go to other ski resorts. They do not have the charm of a "village". I sincerely hope you give serious thought to these ideas I have exposed and take your time to think upon what you really want Vail Village to look like, which will translate into what it will make people feel like. In the end, this feeling is what makes people come back again and again. Since 1980, the residents of Vail have been collecting atown-wide Real Estate Transfer Tax (RETT) which is mandated for specific use for acquisition of open space and recreation. Not only this, but the taxpayers of Vail whole-heartedly supported the countywide implementation of the Open Space Tax of 1.5 mils in 2003. Of the latter, Vail supplies 26% of the total) collections, or approximately $790,000 of the collection of almost $3,000,000 annually. As a long time major investor in open space in Eagle County, both within our own community and countywide, we would like to offer our strong endorsement of such an expenditure and acquisition. In al{ the years we have done business in the City of Vail we have seen many projects brought before the city for review and development permits. The City has a process in which a developer must go thru to have his/her project reviewed before a building permit is issued for the project. The process I am speaking of is approval of the project by the PEC which is a critical and a vitally necessary commission and which is very knowledgeable in the development guidelines and the pulse of the community. We have been blessed to have such a wonderful commercial core by in large thru the efforts of the PEC and city councils that have followed their recommendations. While times charige and our community needs change we still have the INTEGRITY of the entire community to always be of vital concern when any single project is proposed for review. COMMUNITY INTEGRITY has always been maintained thru the development review process and this includes the PEC !! Our community is responding to changes and if.you examine the projects that have obtained approval and the construction in process. One cannot help but conclude that the COMMUNITY is changing and changing for the better. Each of the projects currently underway in our core area had to work with the PEC to get approval which in turn led to Council approval and most importantly retaining the INTEGRITY of the COMMUNITY. I believe that it is critical that the developer of the CROSSROADS PROJECT first obtain the approval of the PEC before council approves the project otherwise our development process becomes POLITICAL and not accompanied by the Integrity of the process that has been in place long before the new owner/redeveloper of the Crossroads project. We have in the past 23 years conducted business in Asperi, Vail, Breckenridge, Telluride Sun Valley , Id. and Scottsdale, Arizona all destination resort communities. What makes each of these communities unique to the destination visitor is the INTEGRITY of the Commercial Core of each community. Size and scope of any project by themselves do not enhance the experience The last thing that the CORE area of Vail needs is a COMMUNITY RETAIL project that attempts to solve the community needs in one big sweep of the demolition ball. More importantly is how the project interacts with the surrounding building in the village. We wish to express the following concerns about the project, as follows: 1.. This project as designed is WAY too big for the COMMERCIAL CORE and surrounding buildings 2.. This project as designed is WAY too tall for the COMMERCIAL CORE and surrounding buildings 3.. Increased setbacks are required to mitigate the effects of its bulk and height on our. building as well as on the surrounding streetscape. 2) The proposed new loading and delivery area in the north west corner adjacent to our building will service other businesses in the area as well as Crossroads. From early morning until evening, there will be large numbers of slow moving and stationary heavy vehicles emitting noise and toxic fumes right outside our ground floor apartment. This will. adversely affect enjoyment of our home in winter and render our patio, living room and bedroom. almost unusable in summer. 3) Large, ,ugly exhaust vents from. the huge underground garage on the western bomldary face our apartment and will further concentrate toxic fumes being blown directly at our apartment and outdoor living area. Instead, these exhaust vents should be located on the Eastern side of the development adjacent to the existing Town Parking Garage. 4) Inadequate tree barrier planned between the Crossroads building and the western boundary. Underground construction right up to the property line will kill existing trees on the Crossroads side, as well as the fine, mature trees outside our apartment on our side of the boundary. The existing trees took more than 10 years to reach their present size and even large replacements will not mitigate this loss. c 5) Alteration of ground level in the new development will result in many steps from Crossroads to existing walkways on our side of the property line. I have seen the proposal for the re-development of Crossroads, and I am strongly against this gigantic structure, especially since it is projected to come all the way to the property line, with practically little (for practical matters almost no} scaling dawn of its height. I am also opposed to having the garage exhaust to be blown right onto the little space that wiil remain between the proposed structure and our building. Please note that I am not against the re-development. It is obvious that Crossroads needed this a long time ago. I would like to make the following suggestions: 1. The height of the building is a huge issue since the stepping down towards the town is so subtle, it is practically non-existent. 2. The project should be scaled down somewhat so that the construction will not go all the way up to the property line, otherwise, it will look crowded. 3. The venting of the garages should be re-designed to vent, maybe to the east side, or towards I-70, where there are no immediate neighbors. 4. The proposed style of this building does not match the style of Vail Village. It should be designed to be in accord to what a village or mountain resort should be_ 5. I would like to see more green landscaped areas in this project. People like to live and/or visit Vail because we are looking for that old country alpine look, . for clean air, nature and alpine vegetation. This all translates in that we are looking for the "village" part of Vail Village. This is what Vail is about and I assume this is why it is called Vail Village. I am enthusiastically in favor of re-developing Cross Roads, but as it is currently proposed, it is not in keeping with either the scale of the TOV, nor the Alpine nature of the architecture . Both of which have contributed to the charm and success of the resort and community. Height and mass are over whelming..the lack of set backs is forbidding and contributes to early shadows canyons and winter icy conditions. Second floor retail has historically not worked at either the current Cross Roads, Bridge Street, nor at the Gateway complex!. "Warm beds" would be preferable to the traditionally empty-unrented beds of the luxury condominiums. What about the problems created for the fire department? Please we definitely need the re-development and re-gentrification, but not at the expense of changing the precedents forever. When I walk by the new Tivoli, I'm glad it's off to the side of the village as its size seems oppressive from the street. In all the years we have done business in the City of Vail we have seen many projects brought before the city for review and development permits. The City has a process in which a developer must go thru to have his/her project reviewed before a building permit is issued for the project. The process I am speaking of is approval of the project by the PEC which is a critical and a vitally necessary commission and which is very knowledgeable in the development guidelines and the pulse of the community. We have been blessed to have such a wonderful commercial core by in large thru the efforts of the PEC and city councils that have followed their recommendations. While times change and our community needs change we still .have the INTEGRITY of the entire community to always be of vital concern when any single project is proposed for review. COMMUNITY INTEGRITY has always been maintained thru the development review process and this includes the PEC !! Our community is responding to changes and if you examine the projects that have obtained approval and the construction in process. One cannot help but conclude that the COMMUNITY is. changing and changing for the better. Each of the projects currently underway in our core area had to work with the PEC to get approval which in turn led to Council approval and most importantly retaining the INTEGRITY of the COMMUNITY. I believe that it is critical that the developer of the CROSSROADS PROJECT first obtain the approval of the PEC before council approves the project otherwise our development process becomes POLITICAL and not accompanied by the Integrity of the process that has been in place long before the new owner/redeveloper of the Crossroads project. We have in the past 23 years conducted business in Aspen, Vail, Breckenridge, Telluride Sun Valley , Id. and Scottsdale, Arizona all destination resort communities. What makes each of these communities unique to the destination visitor is the INTEGRITY of the Commercial Core of each community. Size and scope of any project by themselves do not enhance the experience ! The last thing that the CORE area of Vail needs is a COMMUNITY RETAIL project that attempts to solve the community needs iri one big sweep of the demolition ball. More importantly is how the project interacts with the surrounding building in the village. We wish to express the following concerns about the project, as follows: 1. This project as designed is WAY too big for the COMMERCIAL CORE and surrounding buildings 2. This project as designed is WAY too tall for the COMMERCIAL CORE and surrounding buildings 3. This project attempts to solve way too many commercial functions 4. This project does not have enough GREEN landscaped areas to retain the GREEN environmental beauty of our Commercial Core 5. This project lacks areas for the display of sculpture that is a HUGE PART of the visitor experience in Vail 6. The building is too tall and too massive without the required setbacks, The density and GRFA are off the map, and the landscape area is basically nonexistent. I am enthusiastically in favor of re-developing Cross Roads, but as it is currently proposed, it is not in keeping with either the scale of the TOV, nor the Alpine nature of the architecture . Both of which have contributed to the charm and success of the resort and community. Height and mass are over whelming..the lack of set backs is forbidding and contributes to early shadows canyons and winter icy conditions. Second floor retail has historically not worked at either the current Cross Roads, Bridge Street, nor at the Gateway complex!. "Warm beds" would be preferable to the traditionally empty-unrented beds of the luxury condominiums. What about the problems created for the fire department? Please we definitely need the re-development and re-gentrification, but not at the expense of changing the precedents forever. We are not opposed to redevelopment of the site, but we object to the current proposal because it does not comply with planning guidelines and, as a result, unfairly affects our use and enjoyment of our home. Specifically, we object to the following aspects of the proposal: l) The proposed 600,000 sq.ft. building is too high, too large in scale, covers too much of the site area and is set too close to the property line. Increased setbacks are required to mitigate the effects of its bulk and height on our building as well as on the surrounding streetscape. 2) The proposed new loading and delivery area in the north west corner adjacent to our building will service other businesses in the area as well as Crossroads. From early morning until evening, there will be large numbers of slow moving and stationary heavy vehicles emitting noise and toxic fumes right outside our ground floor aparrinent. This will adversely affect enjoyment of our home in winter and render our patio, living room and bedroom almost unusable in summer. 3) Large, ugly exhaust vents from the huge underground garage on the western boundary face our apartment and will further concentrate toxic fumes being blown directly at our apartment and outdoor living area. Instead, these exhaust vents should be located on the Eastern side of the development adjacent to the existing Town Parking Garage. 4) Inadequate tree barrier planned between the Crossroads building and the western boundary. Underground construction right up to the property line will kill existing trees on the Crossroads side, as well as the fine, mature trees outside our apartment on our side of the boundary. The existing trees took more than 10 years to reach their present size and even large replacements will not mitigate this loss. c 5) Alteration of ground level in the new development will result in many steps from Crossroads to existing walkways on our side of the property line. I have seen the proposal for the re-development of Crossroads, and I am strongly against this gigantic structure, especially since it is projected to come all the way to the property line, with practically little (for practical matters almost no) scaling down of its height. I am also opposed to having the garage exhaust to be blown right onto the little space that will remain between the proposed structure and our building. Please note that I am not against the re-development. It is obvious that Crossroads needed this a long time ago. I would like to make the following suggestions: 1. The height of the building is a huge issue since the stepping down towards the town is so subtle, it is practically non-existent. 2. The project should be scaled down somewhat so that the construction will not go all the way up to the property line, otherwise, it will look crowded. 3. The venting of the garages should be re-designed to vent, maybe to the east side, or towards I-70, where there are no immediate neighbors. 4. The proposed style of this building does not match the style of Vail Village. It should be designed to be in accord to what a village or mountain resort should be. 5. I would like to see more green landscaped areas in this project. People like to live and/or visit Vail because we are looking for that old country alpine look, for clean air, nature and -alpine vegetation." This all translates in that we are looking for the "village" part of. Vail Village. This is what Vail is about and I assume this is why it is called Vail Village. Its underground construction right up to the property line will kill the many large trees we have along our side of the property line. The architectural style (the design, the look of the new building, the style of the building) is not compatible with the other buildings in Vail, including ours. The exhaust from the large underground garage is being blown right at our building. The proposed building does not step down to heights compatible with our building. Moreover, there is too little green space (or landscaped area) between the new Crossroads building and their property line. This is the case on all sides of the proposed building, but especially next to us. It seems to me that we should see how comfortable we are with the scale of these projects before the town permits a rebuild of Crossroads that does not follow the current town zoning code. When I walk by the new Tivoli, I'm glad it's off to the side of the village as its size seems oppressive from the street. Even if the architecture is supposed to be pleasing, when viewed from the roads it's like viewing a large painting from two feet away. The Crossroads redevelopment is an integral part Vail's Revitalization, helping to maintain our image as a vibrant and competitive destination. In all the years we have done business in the City of Vail we have seen many projects brought before the city for review and development permits. The City has a process in which a developer must go thru to have his/her project reviewed before a building permit is issued for the project. The process I am speaking of is approval of the project by the PEC which is a critical and a vitally necessary commission and which is very knowledgeable in the development guidelines and the pulse of the community. We have been blessed to have such a wonderful commercial core by in large thru the efforts of the PEC and city councils that have followed their recommendations. While times change and our community needs change we still have the INTEGRITY of ths;~-::;;tire community to always be of vital concern when any single project is proposed for review. COMMUNITY INTEGRITY has always been maintained thru the development review process and this includes the PEC !! Our community is responding to changes and if you examine the projects that have obtained approval and the construction in process. One cannot help but conclude that the COMMUNITY is changing and changing for the better. Each of the projects currently underway in our core area had to work with the . PEC to get approval which in turn led to Council approval and most importantly retaining the INTEGRITY of the COMMUNITY. I believe that it is critical that the developer of the CROSSROADS PROJECT first obtain the approval of the PEC before council approves the project otherwise our development process becomes POLITICAL and not accompanied by the Integrity of the process that has been in place long before the new owner/redeveloper of the Crossroads project. We have in the past 23 years conducted business in Asperi, Vail, Breckenridge, Telluride Sun Valley , !d. and Scottsdale, Arizona all destination resort communities. What makes each of these communities unique to the destination visitor is the INTEGRITY of the Commercial Core of each community. Size and scope of any project by themselves do not enhance the experience ! The last thing that the CORE area of Vail needs is a COMMUNITY RETAIL project that attempts to solve the community needs in one big sweep of the demolition ball. More importantly is how the project interacts with the surrounding building in the village. We wish to express the following concerns about the project, as follows: 1.. This project as designed is WAY too big for the COMMERCIAL CORE and surrounding buildings 2.. This project as designed is WAY too tall for the COMMERCIAL CORE and surrounding buildings 3.. This project attempts to solve way too many commercial functions 4.. This project does not have enough GREEN landscaped areas to-retain the-GREEN- environmental beauty of our Commercial Core 5.. This project lacks areas for the display of sculpture that is a HUGE PART of the visitor experience in Vail 6.. This project because of the scope will displace many small Vail business- owners who have been an integral part of the community for many many years due to the COST of the project as it translates to LEASE RATES ! This project will attract mostly commercial chain store operations which is not in the best interest of the integrity of our community. We strongly recommend that the City Council of Vail Colorado DENY the project as presented to you and return it to the PEC for further work with the developer to create a project that is more appropriate to the needs of our quaint village ! Currently the site of the gravel pit, it will soon be reclaimed, revegetated and restored to its natural condition. But then what? It could easily be developed-more homes, more shops, more restaurants, more offices, more traffic. Or, it could be protected as open space, which is the goal of the Vail Valley Foundation, Eagle County, Gore Range Natural Science School and the Eagle Valley Land Trust who envision this as green.-space where wildlife will be the only residents-forever. W~~lin ~,lon the ~~nk of the Eagle River, dotted with boulders and harboring rainbow and brown trout, a family weaves in between aspen and cottonwood trees, carrying their picnic lunch. The sounds of everyday life are drowned out by the running water; the sky opens up and it's raining sunshine. We are a more enriched community when we preserve accessible open space lands in the heart of our residential and commercial areas. Eagle River Preserve provides this opportunity. The parcel will be owned by the people of Eagle County and ruled by the deer, elk, fox and occasional bear. To insure the ranch's green future, clear, strong and legally enforceable provisions will run with the land. They will be written so that the land will remain open space-permanently. A limited number of passive improvements to the property are being considered, including: nature trails; walking and biking paths; ponds and fishing areas; as well as shelters and facilities that are ADA friendly.
