Vail, Colorado faces many challenges in tlae arena of air quality protection. In an
e#%rt to preserve our vaiiey's alpi�e environment, Vail has taken steps to protect its
air quality for present and future generations of residents and guests,
�n September of 1991, the Vaii Town Council adopted an ordinance that restricts
the construction and use af open-hearth fireplaces within municipal boundaries.
Since that time, the ordinance has undergone numerous changes and revisions,
striving for compramise, yet ei%ctiveness in addres4ing the air quaiitp issue.
The Town of Vail Community Development Department has prepared this handotit
to simpiify the langu$ge of the fireplace ordinnnce �nd enhance understanding af its
goals. The Community Developmenk staff is av�ilable at 479-2134 for further
questions or assistance with this issue.
1. Construction of open-I�earth wood-burning fircplaces is no longer permitted
within Town of Vail municipal boundaries.
2. Dwelling Units — Each new dwelling unit may contAin:
One (1) EPA Phase II ceriified so{id fuel burning device and no more than twa
(2) gas appliances (B vent);
OR
'1'WO (Z) gas log firepiaces and no more than two (2) gac appliances (B vent}.
3. Restricted Dwelling Units — Each new restricted dweliing unit may contain:
One (1) gas !og fireplace and not more tlian one (l) gas appliance.
4. Accommodation Units - Each new accommodation unit may c�n�ain:
�ne (1) gas 1ag tireplace OR one (1) gas appliance.
5• N two or more separute dwelling units or accommodation units are combined to
form one larger unit, tl�e combined unit ma,y retain ane wood-burning fireplacc
(If one already exists) and no more than 2 gRS Appliances, or may convert up to
two existing fireplaces to gas.
6. If, during the course of a remodel an existing woud-burning fireplace is altered
(` ! or moved, the unit must lhen comply with all provisions of'the ordinance. Tl�at
is, the freplace must be converted to natural gas replaced by an EPA Phase il
certified unit.

The original apening was appraximately 12'-0". Ths beam that spanned this apening was a 5 i/8"x92° gl�lam
beam running in th� northlsauth dlr�ckian, 7he n�w �pening �nds to the north 1'-8" making the new opening
a total of 13'-9". In my apinlon the W 8x21 a#e�l beam will be s#ru�turally adequate for the new opening. I woufd
�cammend that a four pack af 2x6 �tuds he plsced under each end af the s�eel beam and t�at the stud p�ek is
