Board Interviews. (15 min.)
ACTION REQUESTED OF COUNCIL: Appoint three (3)
applicants to the LLA; all three members shall be appointed to
two-year terms through May, 2007.
BACKGROUND RATIONALE: All applicants to the LLA must be
citizens of the United States, qualified electors of the Town of Vail,
and have .resided in the Town of Vail for not less than two years
preceding appointment, and shall have no direct financial interest
in any license to sell alcoholic beverages or any location having
any-such license. Duties of the five-member board include review
of all Town of Vail liquor license applications.
There are currently three vacancies on the LLA. The .town
received three (3) applications for the vacancies. .Two applicants
are incumbent members of the LLA (noted by asterisks below).
One member, Dave Chapin, was term-limited (8 years) and could
not serve on this board another term.. The Council needs to
interview each applicant at the work session and then
appointment three applicants to the LLA at the evening meeting.

as past Chairman of the LLA board.

Warren Campbell gave a presentation per the staff memorandum. -
Jay Scolnick, the applicant, introduced himself and stated he had nothing to add to the
presentation.
There was no public comment.
The Commissioners were agreed with the findings in the staff memorandum.
2. A request for a final review of variances from Section 12-6D-6, Setbacks, and Section 12-6D-7,
Height, Vail Town Code, pursuant to Chapter 12-17, Variances, to allow for the construction of
gross residential floor area within the side setback and to exceed the height limitation within the
Two-Family Primary/Secondary zone district, located at 1783 Shasta Place/Lot 14, Vail Village
West Filing 2, and setting forth details in regard thereto.

Elisabeth Eckel gave a presentation per the staff memorandum.
Chris Heckmann, the applicant, stated that he has tried to minimize the requested variances.
Lee Wittington of Arroyo Engineering, spoke on behalf of Eagle River Water and Sanitation
District, stating that the District has a minimum requirement of 4.5 feet coverage of earth above
the sewer line, which is what this pipe is currently covered with. To reduce the depth in an effort
to create positive drainage on the west side of the lot would necessitate a variance from ERWSD
requirements.
The Commission felt there was a relationship between the access and pump house easements
on the lot and the requested side setback variance. However, they felt that a design solution
could resolve the need for a height variance.
David Viele clarified that he is on the Board of Directors for ERWSD, but felt there was no
conflict of interest. Mr. Viele admitted a lack of understanding ,regarding the relationship
between the sewer line and the height variance request.
Anne Gunion stated she does not believe a variance from the. maximum height standard was
warranted in this situation.
Chas Bernhardt stated he did not see a problem with the side setback variance and furthermore
agreed with the opinion of the other Commissioners regarding the lack of a compelling need for a
height variance.
Doug Cahill agreed with the sentiments of the other Commissioners and proceeded to ask if the
applicant had pursued other drainage options, to which the applicant replied in the negative.
Elisabeth Eckel suggested there are possible design alternatives that may exist which have not
yet been pursued. Therefore, perhaps the variance request was not the only available option for
the property. ,
Chas Bernhardt asked the applicant when he became aware of the necessary variance requests.
The applicant responded that he was not aware of the need to pursue variance requests until
after the proposal underwent conceptual review by the Design Review Board in January, at
which time discussions with ERWSD began.

Site Coverage, Vail Town Code, pursuant to Chapter 12-7, Variances, to allow for the
construction of a residential addition within .the side setback, located at 400 East Meadow Drive,
Unit 6/Tyrolean Condominiums, and setting forth details in regard thereto.

Matt Gennett introduced the project according to the memorandum.
Mike Suman further explained the project.
Chas Bernhardt commented that the example of similar deck enclosures had already occurred.
David Viele had no additional comment.
Anne Gunion expressed the concern that abox-like; lifeless structures might result from approval
of too many deck enclosures. She requested that staff consider the design effects of such
proposals in the future.
Doug Cahill asked if this proposal had been seen by the Design Review Board and requested
that the Commissioners previous comments on this item be passed along to the DRB. Because
similar variance requests had been approved for the same structure; this request should be
approved as well.
4. A request for a final review of variances from Section 12-6H-6, Setbacks, Vail Town Code,
pursuant to Chapter 12-7, Variances, to allow for the construction of a residential addition within
the side setback, located at 400 East Meadow Drive, Unit 7/Tyrolean Condominiums, and setting
forth details in regard thereto.

Matt Gennett introduced the project according to the memorandum. This project differs from the
one previous: in the sense that there is no need for a site coverage variance, and the amount of
GRFA requested in the eastern setback is less than that of Unit 6.
5. A request for a correction to the Vail Land Use Plan to designate the Lionshead
Redevelopment Master Plan Area and an amendment to the Lionshead Redevelopment Master
Plan to amend, in part, Chapter 5, Vail Civic Center Detailed Plan Recommendations, and
setting forth details in regard thereto.

of Vail Liquor Board. I have lived in Vail since 1979 and have a
thorough knowledge of the Colorado Revised Statutes as they
pertain to the sale and service of alcohol. I have worked over 30
years in the Food &t Beverage Industry, and feel my qualifications
are sufficient to serve on this board.
I am currently employed as the Resident Manager of the
Lifthouse Condominiums. I have no direct financial interest in a
liquor license in the Town; however, my brother has a 10% interest
in Bart &t Yeti's restaurant.

Dear Council Members and Ms. Donaldson:
Please accept this letter as my application for a renewal of my membership on the Town
of Vail "Local Licensing Authority" Board. As I stated on my original application, I
continue to meet the citizenship, Vail residency, and primary home owner requirements,
and I have no financial interest in any liquor licenses nor any businesses that have liquor
licenses. To the Board position, I will continue to bring the business, management, and
personal judgment skills honed over a long term successful business career, as well as a
sincere commitment to serve the Community. In addition to those basic criteria, my
qualifications to serve on the Board include experience as a senior executive in major
public and private companies and as President and CEO of my own Company, and -
more recently - as Sole Proprietor of my Management Consultant Firm through which I
serve, from time to time, as a Board Member, Interim CEO.and/or Consultant for various
private and public companies. These experiences and qualifications are detailed on the
attached resume' .
I believe that my public and private business experience has provided a unique `value
add' to the LLA Board. An example of some of these contributions was my involvement
in assisting the Board with decisions regarding disciplinary actions necessitated by liquor
code violations by certain local establishments. In addition to Board Meeting attendance,
I have contributed incrementally by drafting letters for the Town and for the Police
Department in support of municipal grants and related objectives. Consistent with the
commitment I made when initially applying for this Board position two years ago, I have
studied the codes and regulations pertaining to licensing and assessing the legal operation
of local restaurants, bars, and taverns, and I attended a "TIPS" training class, thereby
learning some of the unique aspects of the position necessary to fulfill my responsibilities
as a LLA Board Member. In turn, on a more personal note, I have thoroughly enjoyed
serving on this Board as I have found it to be an "eye" on community businesses and
activity, both present and planned. This service has also provided insight into public
administrative practices, policies, and personnel. I would like to continue this
involvement.
As you consider my application to serve an additional term. on this Board, please also be
aware that I have a near 100% attendance record, having attended all of the LLA Board
meetings since joining the Board in May, 2003, except for one meeting (April, 2005)
when I was out of the State. This reflects the fact that for the past few years I have

purposefully limited my consulting practice and Corporate Board Memberships to a level
that requires a maximum of only about 20% of my time; I therefore have the time for, and
am desirous of providing, additional service to the Vail Community.

Mr. Louthan is a seasoned high technology and computer industry executive and
consultant. His responsibilities have included executive, corporate level vice president
line management positions in sales, marketing, and divisional P8~L management with a
major F500 Corporation and with other private and public companies. At Control Data
Corporation these positions included Vice President and General Manager, Professional
Services Division, Vice President, Sales 8~ Marketing, .and Vice President, Petroleum
Industry Marketing, Worldwide. In these positions, he directly managed operating units
with up to 2500 employees and revenues of over $500,000,000. Mr. Louthan was
subsequently President & CEO of Solis, Inc., an early stage, emerging growth software
company which he subsequently sold to Oracle Corporation in 1986 in a profitable
acquisition.
In recent years Mr. Louthan has operated his own executive management consulting
firm; in this capacity he typically has assumed an executive management or Directorship
role within a client company for the purpose of accomplishing certain, predefined specific
goals including management tum-around tasks, strategic business planning, raising
equity capital, negotiating intellectual property rights licenses, and/or negotiating the sale
of the company. Recent assignments with USA- and Internationally-based companies
have included President, CEO, and Chairman of the Board of Terma North America,
Inc., President, NetTest Americas, Interim President/CEO and Director of Danavox, Inc.,
