Vail, CO 81657 1:30 P.M., TUESDAY, SEPTEMBER 5, 2006 NOTE: Times of items are approximate, subject to change, and cannot be relied upon to determine at what time Council will consider an item. 1. Lorelei Donaldson ITEM/TOPIC: Commission on Special Events (CSE) Interview. (20 min.) ACTION REQUESTED OF COUNCIL: Appoint one applicant to the CSE; one member shall be appointed to fill the vacancy which exists and ends on December 31, 2006. BACKGROUND RATIONALE: One vacancy exists on the Town of Vail Commission on Special Events (CSE). Applicants must be residents of the Town of Vail, own real property within the Town of Vail, own a business in the Town of Vail, or be employed within the Town of Vail. Members of the CSE shall serve at the will of the Town Council. The CSE shall support the Town Council's goals and objectives and makes decisions in alignment with the Town Council's marketing direction. The mission of the CSE is to support street entertainment and special events for vitality, year-round fun, sense of community and increased quality of experience for guests and residents. The Functions and/or duties of CSE shall include, but are not limited to: hiring and overseeing a director and/or staff, as welt as event producers and/or promoters; creating, funding and seeking special events for the Town of Vail; evaluating event applications and event success; submitting an annual budget for operations and events; coordinating the community calendar for special events; seeking out additional funding for special events through sponsorships and donations; evaluating and executing contracts for special events; and all other functions as directed by the Town Council. The Town received three (3) applications for the vacancy. The Council needs to interview each applicant at the work session and then appointment one applicant to the CSE at the evening meeting. :. CSE meetings are generally held on the morning of the fourth Tuesday of each month. Although the position is voluntary, the Town provides each member with a blue parking pass in appreciation of the contribution to our community. The applicants are as follows: Rayla Kundolf Tom Neyens Heather Trub RECOMMENDATION: Appoint one member to the CSE, to fill a vacancy, term ending December 31, 2006. 2. George Ruther ITEMlTOPIC: PEC/DRB Update. (15 min.) 3. Russ Forrest ITEM/TOPIC: LionsHead Parking Structure RFP. (15 min.) ACTION REQUESTED OF COUNCIL: 1) Review and receive direction on funding for resources to assist in the due diligence of the LionsHead Parking Structure RFP process; 2) Review how the project goals are, proposed to be reformatted as criteria for a selection process; and 3) Review next steps. BACKGROUND: On August 1St the Vail Town Council directed staff to invite Open Hospitality Partners and East West Partners to prepare proposals consistent with the LionsHead Parking Structure RFP. Staff has provided a revised schedule to allow for additional public input and consideration. In addition, the Town Council asked that an appraisal be completed on the property and that resources be obtained to review the financial plan and construction plans for the proposals as part of the selection process. The memorandum for this item includes a proposed budget that is also included in the 2"d reading of the supplemental budget to be considered on September Stn 4. Gregg Barrie ITEMlTOPIC: Bighorn Park Playground Improvements. (15 min.) ACTION REQUESTED OF COUNCIL: During the Work Session, staff will be requesting the Council to choose an option for proceeding with the Bighorn Park Playground Renovation. Depending on the outcome of the Work Session, staff is requesting approval of a project budget and approval for the Town Manager to enter into a contract for construction of the project. BACKGROUND RATIONALE: In February of 2006, town Staff presented a Plan for the renovation of the Bighorn Park Playground to the Town Council. Feedback was generally positive and the Council informally approved the design. Only one proposal for construction was received and it was substantially higher than the cost estimate. Several options for proceeding with the project are outlined in the attached memo. As with our past several playground renovations, custom play structures and the inclusion of artwork are the basis for the design. The Bighorn Park proposal involves the construction of artistic wooden sculptures, "Bloom", that would serve as play structures. Slides, custom climbers, and bridges connect the Blooms to each other and to the existing play structures. The design creates a unique playground that blends with Bighorn Park's natural setting, reuses some of the existing play structure and site elements, and generally follows the comments we received from the Neighborhood Open House. STAFF RECOMMENDATION: Review the Alternatives outlined in the attached memorandum and provide a recommendation to staff for proceeding with the. project. Staff can look within existing budgets to pay for increased costs. 5. Stan Zemler ITEM/TOPIC: Discussion and direction regarding bear ordinance. Matt Mire (30 min.) BACKGROUND RATIONALE: In August of 2002, and in response to a dramatic increase in human-bear conflicts, the Vait Town Council (the "Council") adopted Ordinance No. 19, Series 2002, which amended the Vail Town Code (the "Code") to include a Chapter regarding Wildlife Protection. The stated purpose of the Wildlife Protection chapter was to "protect and maintain wildlife in the Town of Vail and surrounding areas and to minimize the risk of dangerous interaction between humans and wildlife." On July 11, 2006, Council directed staff to prepare amendments to current wildlife protection ordinance. On July 18, 2006, the Council passed an emergency measure which .removed the warning requirement for first time offenders from the current Wildlife Protection regulations and also eliminated the maximum fine amounts set forth in the Code. Accordingly, first time offenders of .the current Wildlife Protection regulations are now subject to the General Penalty provision of the Code (up to $999 in fines and incarceration of up to 180 days, or both). On August 1, 2006, the council heard testimony and evidence from Town Staff, members of the community, licensed waste haulers and the Colorado Division of Wildlife. The Council then provided direction to amend the current regulations. Options As you are aware, the options discussed below are not the only options available to you, and they are generally not mutually a exclusive. A. Current -. Requires all Town of Vail residents to use existing container and the said container when not in use must be stored in a house, garage or other enclosure. There is no language in current ordinance regarding multi-family/commercial usage. Construction sites must use a designated refuse container for refuse edible by wildlife. B. Version #1 -Requires all Town of Vail residents to obtain by April 15, 2007, at aminimum, AWildlife-Resistant Refuse Container (sturdy plastic with lid and latching mechanism). Multi- family/commercial must use either awildlife-Proof container or Wildlife-Resistant enclosure. Construction sites must use a designated "bear prooY' container for refuse edible by wildlife. C. Version #2 -Requires residents to obtain aWildlife- Resistant Refuse Container. In addition, said container when not in use must be stored in a house,. garage or other enclosure. If unable to store as such, then must have Wildlife-Proof Refuse Container (metal), or an approved enclosure. Multi- family/commercial must use either awildlife-Proof container or Wildlife-Resistant enclosure. Construction sites must use a designated "bear proof' container for refuse edible by wildlife D. All Versions -Require the following: • The "Dawn to Dusk" (6:00 am - 7:00 pm) regulation to be followed on a year round basis. • Special Event Refuse must be emptied at the end of each day and stored in the appropriate type of refuse container. • Resistant Enclosure. • Intentional and unintentional feeding of Wildlife is prohibited. • Compliance period is April 15, 2007, for those requiring special containers or enclosures. 6. Judy Camp ITEM/TOPIC: DISCUSSION OF ORDINANCE NO. 21, Series of 2006, AN ORDINANCE MAKING SUPPLEMENTAL APPROPRIATIONS TO THE TOWN OF VAIL GENERAL FUND, CAPITAL PROJECTS FUND, REAL ESTATE TRANSFER TAX FUND, HEAVY EQYUIPMENT FUND, AND DISPATCH SERVICES FUND OF THE 2006 BUDGET FOR THE TOWN OF VAIL, COLORADO; AND AUTHORIZING THE EXPENDITURES OF SAID APPROPRIATIONS AS SET FORTH HEREIN; AND SETTING FORTH DETAILS IN REGARD THERETO. (15 min.) ACTION REQUESTED OF COUNCIL: Discuss the second reading of Ordinance No. 21, Series of 2006. BACKGROUND RATIONALE: To be provided in a separate memo. STAFF RECOMMENDATION: Staff recommends that the Town Council provide direction to staff regarding Ordinance No. 21 for the evening session discussion. 7. Matt Mire ITEMROPIC: Ordinance No. 23, Series of 2006, AN ORDINANCE SUBMITTING A PROPOSED. AMENDMENT TO THE TOWN OF VAIL HOME RULE CHARTER TO THE VOTERS OF THE TOWN PURSUANT TO COLORADO REVISED STATUTES, SECTION 31-2-210 AND DECLARING AN EMERGENCY. (15 min.) ACTION REQUESTED OF COUNCIL: Approve or deny Ordinance No. 23, Series 2006. BACKGROUND RATIONALE: Section 31-2-210 of the Colorado Revised Statutes authorizes the governing body of a Colorado home rule municipality to submit. proposed Home Rule Charter amendments to the voters of such municipality by ordinance. The Town of Vail (the "Town") Town Council (the "Council") has requested to review proposed language amending Section 3.2 concerning terms of council members. The proposed language would make all terms of council members to be four (4) years starting in 2009. The proposed language will NOT change the current term limits of 8 years (or with the new language = 2 terms). STAFF RECOMMENDATION: Approve Ordinance No. 23, Series 2006. 8. Anne Gunion asked if an EIR (Environmental Impact Report) had been submitted. Matt Gennett clarified that the Public Works Department had waived that requirement due to the fact that the applicant had already received Army Corps approval for the proposal. Matt Gennett presented the project according to the memorandum. Dominic Mauriello, the applicant's representative, explained the project in further detail through story boards and a digital rendering. Greg Beamis, a neighbor to the north, expressed continued concern about the side of the building. He recommended that the. PEC take some time to review the new plans in detail. Jim Lamont, Vail Village Homeowners, expressed concern about the turn lanes, the median, the bus stop, and the general interaction between the proposed structure and the existing Frontage Road and I-70 corridor. Dominic Mauriello commented that they were actually not even required to provide left turn lanes, but were, regardless. Jim Lamont again expressed the concern that the road may eventually carry far more traffic than it does today. Wendy Erb commented that she thought that the developer was moving towards a better structure. However, she was still concerned about the bulk and mass of the structure. She expressed further concern about the amount of shadow cast during the winter on surrounding areas. She felt that some drainage mistakes existed on the road to the north, regardless. Finally, Ms. Erb commented that she thought there might be an error regarding hearing dates in the memo. Bill Pierce asked Greg Hall how and when the Frontage Road improvements would occur. Greg commented that the traffic impact fee could be raised, but Council approval would be required for any change. Anne Gunion agreed with the Staff's recommendation, but also agreed with the developer's request to change the conditions of approval. She commented that the developer has proposed more than should have been required as part of today's application. Page 2 Chas Bernhardt agreed with the suggestion to modify the conditions. He commented favorably on the modification of the bulk and mass, the changes to the fagade, ete. Dick Cleveland asked the applicant if the for sale units would be operated under a rental program. The applicant replied in the affirmative. He also asked if the bike would truly be a bike/recreational path, and not simply a pedestrian path. Dominic replied that the path was meant for "recreation". Mr. Cleveland asked if the developer was asking for an offset to the traffic impact fee to cover the amenities proposed. The applicant replied that the offset to the traffic impact fee would help in the construction of the proposed improvements. Dick Cleveland said that he did not see a problem with the continuation of the bike path. He thought that the trash shelters did not necessarily need to be combined: As large as the project is, he thought its proximity to the Frontage Road could be tolerated. Bill Jewitt also supported modifying conditions #20, #14, and #21. This process has shown that the changes to the building spoke well for the ongoing review process that existed in the Town, since the building has become substantially better. He also thanked the neighbors for their input. Rollie Kjesbo. agreed that the developer had traveled far in the review process. He had no issues with the changes proposed to conditions #20 and 21. He thought that condition #14 should stay active. Doug Cahill seconded the opinions offered by his colleagues. He thought that the building complied with the criteria for approval. He worried about the proximity of landscaping to the roadway, but was still in favor of the project. Dick Cleveland mentioned that Jim's comments had merit. He proposed that the Town provide for the possible eventual construction of a median. Chas Bernhardt asked if the continuation of the walk would contribute to the discounted impact fee. His question was verified affirmatively. Following the motion and second, Dominic commented that there were a number of large trees that would likely need to be removed if the sidewalk was continued. Bill Gibson commented in the affirmative. Gregg Barrie commented that when the park was originally constructed, there were high hopes regarding its future. He said that numerous analyses had been completed regarding improving the site. He said that any additional permanent structures or boulders could impact the floodplain. The reason the bladders are being proposed is the can be deflated at times of high water flow to not impact the floodplain. He commented that most people who walk by will likely not notice the bladders. Doug Cahill asked how the floodplain would be affected by rocks within the stream. Gregg responded that the flow would be displaced and therefore cause a floodplain issue. He continued by saying that only a couple of inches of height could be permanently placed in the stream without negatively effecting the flow. Bill Jewitt questioned the original decision to construct the whitewater park in' it present location. He quested if a different section of the creek would be more appropriate and no have the potential floodplain impacts of the current site. Bill Pierce did not have issue with the un-natural appearance of the bladders since the creek was not currently a pristine environment. However, he did not support the expenditures necessary to implement this proposal. Anne Gunion believed that the proposal complied with the review criteria. Chas Bernhardt commented that this proposal was similar to the terrain park on the ski mountain. The whitewater park should be visible, easily accessed, and improved in order to bring people to town. Dick Cleveland stated that there is no question that this met all the floodplain issues. He did think it was unreasonable to expect this area of the creek to be a whitewater park. The negative impacts of the bladders would not outweigh the convenience of the higher water level. Bill Jewitt agreed with Mr. Cleveland 'and -felt that the proposal did not- meet the criteria for modifications to the floodplain. 10 minutes 4. Bill Jewitt commented that in a different situation, the adjacent property owner. might be badly effected. Bill Gibson commented that easements which allow for certain improvements are beneficial in that they allow for legal means for an encroachment. The encumbrance would be in perpetuity, or at least last for the duration of the existing structure, in answer to Anne Gunion's question. Doug Cahill asked about the extension of the existing GRFA into the setback. Chip Melick commented that the building footprint currently existed two feet (2') within the setback. Chas Bernhardt commented that this concept was a step forward for the whole Town in implementing the intent of the Town's regulation, rather than just the black and white. He noted that achieving consensus between two parties was invaluable. Dick Cleveland asked if this change was approved if this property was the only property entitled this privilege. Bill Gibson commented that, as proposed, this would only apply to Lions Square Lodge. Any other property would need to undergo the same process for a similar request. He commented that the 4th paragraph of the proposed text was excessive and should be deleted. Page 5 Bill Jewitt commented that the proposal met the intent of the setback area. Doug Cahill asked if the building code non-conformities were being addressed through this proposal, which Mr. Melick clarified in the affirmative. He then asked why this was not addressed as a variance. Bill Gibson commented that staff felt that a variance from the setbacks would not be appropriate and the more appropriate process would be to amend the master plan. Doug Cahill asked that the finding be added to Rollie's motion that stated the increased conformance of the project with applicable codes. George Ruther commented that still photo images from the model could be provided, but not necessarily the computer files. Jim Lamont, Vail Village Homeowners Association, asked what the applicant's strategy was for the final phase of redevelopment of this project. Bill Anderson, general manager of the Lion Square Lodge, commented that the applicant was willing to work on the landscaping near the ski yard. They were more than happy to make the connection in that area work well Jim Lamont asked if anything could be done to reduce the amount of surface asphalt. Bill Anderson noted commented that a large portion of the parking lot was just rebuilt with the Arrabelle project, but that the three condominium associations were working together to provide a better transition area. Dick Cleveland also expressed concern about the areas that Jim mentioned. He also asked about future parking being located below grade. Overall, he was supportive of the project. Bill Pierce expressed some concern about the parking as well. Bill Anderson expressed that they, too, had the desire to reduce the surface parking area.. He stated that is was quite complicated to complete the reconstruction that had been prompted by the Arrabelle reconstruction as well. To do anything now would be prohibitive for several years. Doug Cahill commented that is was refreshing to see a project that was not proposing substantial new height increases, etc. He asked what public value was being added as a part of this request. Chip Melick commented that the exterior changes to the building were likely valuable enough. Page 6 MEMORANDUM TO: Town Council FROM: .Community Development Department DATE: September 5, 2006 SUBJECT: Lionshead Parking Structure Request for Proposals Staff: Stan Zemler and Russ Forrest PURPOSE The purpose of the evening meeting with the Vail Town Council is to: 1) Review and receive direction on funding for resources to assist in the due diligence of the Lionshead Parking Structure RFP process; 2) Review how the project goals are proposed to be reformatted as criteria for a selection process; and 3) Review next steps. II. BACKGROUND A. Goals The Town of Vail owns and operates an 1150 space parking structure and an unimproved charter bus parking lot, located at 395 South Frontage Road in Vail, Colorado (See Section 7 of RFP). This site is 6.6 acres in size and is located in the Lionshead Redevelopment Master Plan Area, one of two pedestrian retail areas in Vail. In addition, this site is included in the Lionshead Urban Renewal Area. A draft master plan for the parking structure was completed during the process of considering a conference center; the Town identified at that time, the following needs for the site: • The existing parking structure needs both capital and operational improvements to maintain its effectiveness in the future, • The Town currently needs 400-500 additional public parking spaces to minimize overflow parking on the Frontage Road for 15 days- per winter season, • Redevelopment of the parking structure should include retail development on the south side of the parking structure as called for in the Lionshead Redevelopment Master Plan, • Pedestrian access needs to be improved between the parking structure and the Lionshead retail area, and • Improve the Lionshead Information Center. In the last year, private developers have approached the Town of Vail and proposed redevelopment of the site to accommodate both public and private uses. To ensure a fair and equitable process, the Vail Town Council directed that a "Request for Proposals" be issued to solicit development proposals that meet the project goals of the Town for this site. The Request for Proposals seeks qualified developers who can develop the Lionshead Parking Structure consistent with the .project goals of this Request for Proposals stated below. The following are project goals for any developer considering submitting a proposal: A. Development proposals shall comply to the Lionshead Redevelopment Master Plan (See http://www.vailgov.com/docs/dl forms/lionshead master plan.pdf)) and. be consistent with Lionshead Mixed Use 1 Zoning (See http://www.sterlingcodifiers.com/CONaiI/ for Title 12 in the Vail Town Code). B. Development proposals consistent with the Lionshead Redevelopment Master Plan and the Lionshead Mixed Use 1 Zone District shall help pay for the public improvements. A strong preference is given to uses that generate "hot beds" such as accommodation units (hotels) and Employee Housing Units. Parking generated by private development shall be provided and paid for by the developer. C. Meeting/event/conference facilities accessory to hotel and lodging uses. D. The Town anticipates extensive improvements to the Lionshead. Parking Structure in the near future. Creation of a new public parking structure, paid for through the redevelopment of the site, should include a minimum of 1150 public parking spaces that would improve the operational performance of the structure compared to current operation (See 2005 Walker Parking Study in Attachment B). The Town is assuming that it would continue to own and operate public parking in Lionshead. E. Creation of new public parking in excess of the 1150 existing spaces on the site based on circulation viability. F. Creation of a new Lionshead Information Center with public reStrooms. G. Redevelopment of the Lionshead Annex with consideration given to the relocation of a Youth Recreation Center and the Colorado Mental Health offices. H. Improvement of the pedestrian, transit, and vehicular circulation between the parking structure and the Lionshead retail mall. I. Provide loading and delivery for uses created on-site which can also be used by adjacent Lionshead retail uses. J. Improve hotel shuttle bus circulation which currently drops guests at the southwest corner of the Lionshead parking structure. The Town of Vail is interested in siting a Lionshead transit facility to accommodate 5 buses for regional bus traffic. The parking structure area is one of the locations under consideration for that use (See Draft Master Plan for Parking Structure). K. Creation of a retail connection along the-south side of the project site that is consistent with the Lionshead Redevelopment Master Plan. L. Frontage Road Improvements consistent with the Lionshead Redevelopment Master Plan and acceptable to the Colorado Department of Transportation. M. Other public amenities that would augment the vitality and economic impact of the development. N. Use of the U.S. Green Building Council's LEED Green Building Rating System, or a comparable alternative, to guide project design. Attachment A includes the RFP. It should be noted that proposed schedule changes are proposed below. B. Projected Costs for Maintaining the Lionshead parking structure and other associated improvements. The Lionshead parking structure was built in 1980 and is projected to have 25 years more of life before major reconstruction is required. However, significant capital investments will be required to reach the 25 years. Necessary improvements to the Lionshead parking structure can be placed in the following categories: Structural/Capital Maintenance, • Repair all the stairs and stairways: $350,000 due next couple of years • Ongoing expansion Joint work: $50,000/yr • Top deck slab: re-topping within the next eight years: $2,500,000 • Salt penetration repairs: $150,000 due next couple of years • Water infiltration repairs: $250,000 within 5 years • Painting/lighting/system maintenance: $150,000/yr • Parking equipment replacement: now $ 300,000, also every 5-7 years, will request for 2007 Operational: The current structure does not function well as designed: • Install pay on foot stations: $200,000 • Provide another exit to East Lionshead Circle: $750,000 • Convert the garage to one-way circulation and lose 100 spots: cost to replace the 100 spots: $3,500,000 • Roadway improvements for better ingress/egress: $3,000,000 Code/regulatory: Required improvements to meet current codes will be required with any enhancement or remodel: • Elevator to meet ADA: $400,000 apiece • Sprinkler and detection systems: $1,000,000 • Increase ventilation on certain levels: $350,000 • Egress and proper emergency access issues: $150,000 Enhancements: Keeping up with the customer expectations, matching the new neighborhood and keeping the Vail experience: • Bathrooms: $500,000 • Information Booth: $900,000 • Auxiliary Building: $1,700,000 • Heated Entry Stairs: $1,000,000 verses $300,000 • Elevators: See above • Streetscape: $1,000,000 • New heated streetscape entry/Bus Plaza: $3,000,000 Expansion we have stated the need to expand the supply by 400 spaces • 400 new spaces: $12,000,000 Currently, some of the structural and capital maintenance issues are budgeted over the next 5 years (*). Operational issues are not budgeted except the possibility of roadway improvements using TIF funds. Enhancements are not budgeted except to use TIF funds for streetscape and entry plaza. The conference center, if approved, would have addressed all these issues with the exception of the topping slab, one-way circulation, the information booth and expanded capacity by only 250 spaces verses 400 spaces. The revised capital budgets for 2007-2010 will need to reflect increased costs to take care of the shortcomings. III. ACTION REQUESTED FROM COUNCIL AND DRB 8~ PEC REPRESENTATIVES A. Supplemental Budget Request for completing Due Diligence The Vail Town Council has requested that the following resources be obtained to critique and better evaluate the proposals once they are submitted. The Town Attorney has requested that outside counsel also be involved to review the proposals and that cost is included. Circulation and Parking • Replacement of existing parking without affecting parking availability in the ski season, • Mitigation of lost parking during the construction of the parking facility, • Number of additional public parking spaces (beyond 1150 spaces) provided upon completion of construction, • Provide for loading-and delivery for the site and surrounding area, • Provide for mass transit access to the Lionshead area, • Enhance circulation for pedestrians and vehicles, • Provide necessary improvements to Frontage Road in compliance with CDOT standards. Uses • Number of "live beds" and degree to which they provide diversity to the Vail bed base, • Provide retail opportunities on East Lionshead Circle which complement existing retail areas, • Provide public amenities: Recreation, Entertainment, Event/Meeting Facilities proposed on the site, • Provide a new Lionshead information center, • Consideration of the relocation for the VRD, Colorado Mental Health, and other tenant uses. Financial Considerations • Financial return to the Town through lease payments, air rights purchase or other payments, • Town's financial commitment for construction and maintenance of public improvements, • Financial viability of the project, • Financial capability of the developer to construct and operate the project, • Financial guarantees for timely completion. Environmental/Carrying Capacity • Overall environmental sensitivity and ability to achieve an established environmental certification for the design and construction of the facility, • Overall innovation and creativity. Legal • Ownership structure for the parking facilities and private improvements, 5 • Contractual arrangements necessary for joint ownership and operation of public amenities, • Assurance of completion and operational commitments. Staff and consultants will review the proposals and make a recommendation to Town Council regarding the extent to which each proposal meets the criteria. The Town Council will make a final decision in its sole judgment as to which proposal is in the best interests of the Town. The Town Council will reserve the right to reject all proposals. C. Feedback was generally positive and the Council approved the design to move forward with construction documents and bidding. Bids were solicited from three contractors, however, only one bid was received for the work, and it is substantially higher than the cost estimate. Several alternatives for reducing the project cost are described below. Bighorn Design As with our past several playground renovations, custom play structures and the inclusion of artwork are the basis for the design. The Bighorn Park proposal involves the construction of artistic wooden sculptures, "Blooms", that serve as play structures. Slides, custom climbers, and bridges connect the Blooms to each other and to the existing play structures. The design creates a unique playground that blends with Bighorn Park's natural setting, reuses some of the existing play structure and site elements, relays an environmental message, and generally follows the comments we received from the Neighborhood Open House. Alternatives Each of the following options will each provide an adequate and safe neighborhood playground for Bighorn Park. Staff will look within existing budgets for possible funding sources. The stated purpose of the Wildlife Protection chapter was to "protect and maintain wildlife in the Town of Vail and surrounding areas and to minimize the risk of dangerous interaction between humans and wildlife." On July 11, 2006,Council directed staff to prepare amendments to current wildlife protection ordinance. On July 18, 2006, the Council passed an emergency measure which removed the warning requirement for first time offenders from the current Wildlife Protection regulations and also eliminated the maximum fine amounts set forth in the Code. Accordingly, first time offenders of the current Wildlife Protection regulations are now subject to the General Penalty provision of the Code (up to $999 in fines and incarceration of up to 180 days, or both). On August 1, 2006, the council heard testimony and evidence from Town Staff, members of the community, licensed waste haulers and. the Colorado Division of Wildlife. The Council then provided direction to amend the current regulations. Options : As you are aware, the options discussed below are not the only options available to you, and they are generally not mutually exclusive. A. Current -. Requires all Town of Vail residents to use existing container and the said container when not in use must be stored in a house, garage or other enclosure. There is no language in current ordinance regarding multi-family/commercial usage. Construction sites must use a designated refuse container for refuse edible by wildlife. B. Version #1 -Requires all Town of Vail residents to obtain by April 15, 2007, at a minimum, AWildlife-Resistant Refuse Container (sturdy plastic with lid and latching mechanism. Multi-family/commercial must use either awildlife-Proof container or Wildlife-Resistant enclosure. Construction sites must use a designated "bear proof" container for refuse edible by wildlife. C. Version #2 -Requires residents to obtain awildlife-Resistant Refuse Container. In addition, said container when not in use must be stored in a house, garage or other enclosure. If unable to store as such, then must have Wildlife-Proof Refuse Container (metal), or an approved enclosure. Multi-family/commercial must use either awildlife- Proof container or Wildlife-Resistant enclosure. Construction sites must use a designated "bear proof" container for refuse edible by wildlife D. Expected revenue for the month of July is $1.2 million, and increase of $78,865 or 6.8% over last year. The year-over-year increase in the consumer price index through July is 4.1%. Construction Permit Fee Revenue Construction permit revenue of $1.3 million through August 29, 2006 is up 7.9% from last year. This year's revenue includes $842,754 (67% of the total) from eight large redevelopment projects -Forest Place, Front Door (The Lodge at Vail), Gore Creek Place, Lodge Tower, One Willow Bridge Road, Sonnenalp, Vail Plaza Hotel, and Westhaven Condos. Major redevelopment projects accounted for $786,379 (67% of total) at this time last year. Construction permit fees include building, electrical, mechanical, plumbing, and sprinkler permits. Real Estate Transfer Tax (RETT) RETT collections of $3.7 million through August 29, 2006 are down $286,858 or 7% from last year. Last year's collections included over $1 million of .tax from major transactions (over $10 million selling price) including: the Chateau; units at Crossroads; Vail Mountain Lodge timeshares; Founders' Park Garage; and the Vail Marriott.
