1. George Ruther ITEMlTOPIC: Site visit. An appeal, pursuant to Section 12-3-3,
Appeals, Vail Town Code, of the Town of Vail Planning &
Environmental Commission's decision to uphold an administrative
action determining that Condominium Unit E within the Covered
Bridge Building is the "street level" of the building, located at 227
Bridge Street Lots C & D, and the southwesterly four feet of Lot B,
Block 5-B, Vail Village First Filing, and setting forth details in
regard thereto. (PEC06-0070, 0071, 0072) (30 min.)
ACTION REQUESTED OF COUNCIL: Uphold, overturn, or modify
the Planning & Environmental Commission's decision to uphold
an administrative action determining that Condominium Unit E
within the Covered Bridge Building is the "street level" of the
building.
BACKGROUND RATIONALE: On February 12, 2007, the Town
of Vail Planning & Environmental Commission held a public
meeting to hear an appeal of an administrative action determining
that Condominium Unit E within the Covered Bridge Building is the
"street level" of the building. Upon presentation of evidence and
testimony, the Commission made eight findings of fact and voted
unanimously to uphold the previous decision of the administrator.
On April- 3, 2007, the Vail Town Council granted a continuance of
the public hearing on the appeal to the May 1, 2007, Town Council
meeting at the request of the staff and the appellant.
A copy of the memorandum to the Planning & Environmental
Commission, dated February 12, 2007,and a copy of the approved
meeting minutes have been attached for reference.
.STAFF RECOMMENDATION: The Community Development
Department recommends that the Vail Town Council upholds the
February 12, 2007, decision of the Planning & Environmental
Commission, based upon the evidence and testimony presented
and the eight findings of fact made by the Planning &
Environmental Commission.

3. Nina Timm ITEM/TOPIC: Establish criteria for the Town of Vail's "Buy Down
Program" for employee housing. (30 min.)
BACKGROUND: The Town of Vail has a "Buy Down Program" to
create additional deed restricted employee housing units
throughout the Town of Vail. The goal of the program is to
purchase deed restrictions on existing units throughout the town.
Historically the town has purchased units on the free market, deed
restricted them and then resold them at a reduced price to
qualified purchasers.
With afee-in-lieu option for the town's commercial linkage and
inclusionary zoning programs there is potential for additional
dollars to expand the program. Wi#h the additional dollars the
town has considered purchasing deed restrictions from current or
soon-to-be homeowners in the Town of Vait. In order to have an
equitable program, criteria needs to be established to determine
appropriate units and deed restriction purchase prices.
ACTION REQUESTED OF COUNCIL: Provide staff direction on
the above mentioned issues.

SUBJECT: Proposed Criteria for the Town of Vail Buy Down Program
I. Introduction
The Town of Vail established a buy down program for employee housing in 1999.
The goal of the program is to disperse deed restricted employee housing units
throughout the Town of Vail. The Town budgets $100,000 per year. If the
money is not spent in a year it is rolled over to the next year.. Currently, there is
$365,000 in the buy down fund. To date, seven units have been purchased and
deed restricted.
Historically, the Town has purchased units on the free market, deed restricted
them and then resold them through the lottery process, at a reduced price to
qualified purchasers. With afee-in-lieu option for the Town's commercial
linkage and inclusionary zoning programs there is potential for additional dollars
to expand the program. With the additional dollars, the Town has considered
purchasing deed restrictions from current or soon-to-be homeowners in the Town
of Vail. In order to have an equitable program, criteria needs to be established to
determine appropriate units and deed restriction purchase prices.
II. Potential Buy Down Types
A. Town of Vail purchases a unit, deed restricts it and sells it at a reduced
price through the lottery process
B. Town of Vail purchases a deed restriction from an existing or soon-to-be
owner of a unit in the Town of Vail
C. Town of Vail purchases a unit, deed restricts and sells it to an employee of
the Town of Vail
III. Proposed Unit Criteria
A. Location of the unit within the Town of Vail
a. Consideration for units outside of the Town of Vail, but at reduced
price for the deed restriction
B. Total cost of the unit
a. Purchase price
b. Condition of the unit
c. Association fees, if any

C. Proximity of the unit to public transportation
a. Further reduces the need for parking in Town
b. Reduces green house gas emissions
D. Useful life of the unit is greater than 10 years
a. This will be challenging to determine, but will greatly impact the long-
term affordability of a unit
b. Would prevent the buying down ofdemo-rebuild units
E. If the unit is part of a Home Owner's Association, the HOA is in
reasonable financial condition related to the age and repair of the
building(s)
a. This will be challenging to determine, but will greatly impact the long-
term affordability of a unit
F. The unit adds to the diversity of the Town's deed restricted employee
housing stock

IV. Proposed Occupant Criteria
A. The unit is the full-time permanent residence of the owner
a. Precludes rental properties being created with Town funds
b. Does not preclude developers from creating rental units as part of their
employee housing obligation
B. Owner is employed full-time at a business located in Eagle County and
remains employed in Eagle County for at least five years
C. The owner/occupant does not own other residential real estate in Eagle
County
V. Proposed Deed Restriction Purchase Prices
A. The Town of Vail will consider paying a maximum of $236.65 per square
foot for a deed restriction that includes a price appreciation cap
B. The Town of Vail will consider paying a maximum of $132.00 per square
foot for a deed restriction that does not include a price appreciation cap
C. If the unit is purchased and deed restricted for an employee of the Town of
Vail, it will be priced to be affordable to the then current median full-time
salary of Town of Vail employees
a. The deed restriction will contain a price appreciation cap as well as
first option for the Town of Vail to repurchase the unit upon sale
b. The unit must sold within three years of no longer working for the
Town of Vail
D. Initially the Town of Vail will seek to maximize the total number of units
deed restricted on an annual basis
a. This will limit the size of the units initially deed restricted
VI. Action Requested of Town Council
A. Provide staff with direction on the proposed unit and occupant criteria
B. Provide staff with direction regarding the proposed deed restriction
purchase prices
C. Provide staff with direction on the types of units Town Council would like
