ACTION: Denied
MOTION: Kjesbo SECOND: Viele VOTE: 7-0-0
Bill Gibson gave a presentation per the staff memorandum.
Bill Hein, architect, representing the owner, gave a presentation describing the proposed
additions and their rational for approval of the variance.
Commissioner Gunion stated that she sympathized with the applicant and understood the
arguments made; however, the Commission is charged with enforcing Title 12 of the Code. She
referenced the non-conforming sites and structures portion of the Vail Town Code and noted that
approval of this variance would not be consistent with the stated purpose of the Code and the
proposal would increase the discrepancy of non-conformity.
Commissioner Pierce stated that he agreed with Commissioner Gunion, and furthermore he
identified areas on the site where garage and GRFA additions could be constructed without
encroaching into any setbacks.
Commissioner Kurz stated that the applicant was improving several encroachments such as the
removal decks on the west side.
Commissioner Proper stated that the lack of due diligence by the current owners when they
acquired the property is not a concern of the Commission when reviewing a variance application.

Commissioners Kjesbo and Viele had no additional comments
Commissioner Cleveland stated that he believed this variance could not be approved as it further
increased the encroachments into the setbacks.
