BACKGROUND RATIONALE: On October 8, 2007,, the Town of Vail Planning and Environmental Commission held a public hearing on a request to amend the Official Zoning Map for the Town of Vail in accordance with Title 12, Zoning Regulations, Chapter 5, Zoning Map; Rezoning Lot 86, Block 2, Vail Potato Patch, from High Density Multiple Family (HDMF) District to Housing (H) District, and setting forth details in regard thereto. (PEC07-0059). Upon review of the request, the Planning and Environmental Commission voted unanimously (5-0-0) to forward a recommendation of approval of the request to amend the Official Zoning Map to the Vail Town Council STAFF RECOMMENDATION: Staff recommends that Town Council -approves Ordinance No. 34, Series of 2007, on first reading. 5. Scot Hunn ITEM/TOPIC: Discussion of the first reading of Ordinance No. 35, Series of 2007, an ordinance amending Sections 12-61-3, Conditional Uses, and 12-16-7, Use Specific Criteria and Standards, Vail 'Town Code, to add "Professional Offices and Business Offices" to the list of allowable conditional uses in the Housing (H) District, and setting forth details in regard thereto. BACKGROUND (RATIONALE: On October 8, 2007, the Town of Vail Planning and Environmental Commission (PEC) held a public hearing on the rf;quest for a text amendment to the Vail Town Code. Upon consideration of the request, the Commission unanimously (5-0-0) to forward a recommendation of approval of the text amendment requE~st to the Vail Town Council. STAFF RECOMIMENDATION: Staff recommends that Town Council approves Ordinance No. 35, Series of 2007, on first reading. 6. ITEM/TOPIC: Information Update. (10 min.) 7. ITEMlTOPIC: Matters from Mayor & Council. (10 min.) 8. Nina Timm 25 minutes A request for a final review of a variance from Section 12-6D-6, Setbacks, Vail Town Code, pursuant to Chapter 12-17, Variances, to allow for an addition within the west side setback, located at 2570 Baid Mountain RoadlLot 33, Block 2, Vail Village Filing 13, and setting forth details in regard thereto. (PEC07-0036) Applicant: Ed Williams, represented by William Hein Associates Planner: Bill Gibson ACTION: Denied MOTION: Kjesbo SECOND: Viele VOTE: 7-0-0 Bill Gibson gave a presentation per the staff memorandum. Bill Hein, architect, representing the owner, gave a presentation describing the proposed additions and their rational for approval of the variance. Commissioner Gunion stated that she sympathized with the applicant and understood the arguments made; however, the Commission is charged with enforcing Title 12 of the Code. She referenced the non-conforming sites and structures portion of the Vail Town Code and noted that approval of this variance would not be consistent with the stated purpose of the Code and the proposal would increase the discrepancy of non-conformity. Commissioner Pierce stated that he agreed with Commissioner Gunion, and furthermore he identified areas on the site where garage and GRFA additions could be constructed without encroaching into any setbacks. Commissioner Kurz stated that the applicant was improving several encroachments such as the removal decks on the west side. Commissioner Proper stated that the lack of due diligence by the current owners when they acquired the property is not a concern of the Commission when reviewing a variance application. Page 1 Commissioners Kjesbo and Viele had no additional comments Commissioner Cleveland stated that he believed this variance could not be approved as it further increased the encroachments into the setbacks. A request for final review of a major exterior alteration, pursuant to Section 12-7H-7, Vail Town Code, to allow for the continuation of operation of a temporary skier ticketing office and loading and delivery facilities, located at Tracts C and D (Arrabelle), Lionshead Filing 1, and Tracts G and H, Vail Lionshead Filing 3; and a request for final review of a major exterior alteration, pursuant to Section 12-7H-7, Vail Town Code, and setting forth details in regard thereto. The temporary facilities shall adhere to all Town of Vail Code requirements regarding noise and lighting. 2. The temporary facilities shall be removed entirely within 30 days of receiving a Temporary Certificate of Occupancy for that portion of the Arrabelle which will permanently contain the uses identifiE:d in this application as being temporary. This approval shall expire and require a ne~nr review and approval regardless of the state of the Arrabelle Hotel project on July 31, 2008. 3. There shall be no outdoor storage of goods or materials at the loading and delivery facility. 4. There shall be no vehicle parking perrriitted in the turnaround area located beneath the Lionshead Skier Bridge. Bill Gibson gave a presentation per the staff memorandum. Commissioner Kurz asked about access to the temporary ticket office and restroom. Bill Gibson stated that the Building Department will be examining the project for access. Brian McCartney, Vail Resorts, described the proposed temporary ramping system that will be utilized for access until enough snow is available to groom an access. There was no other Commissioner comment. There was no public comment. 15 minutes 3. A request for final review of a conditional use permit, pursuant to Section 12-7D-2, Conditional Uses, Vail Town Code, to allow for the development of public buildings, grounds and facilities (parking lot) located on Parcel A, Vail das Schone Filing 1, and setting forth details in regard thereto. That the approval of this conditional use permit shall expire on November, 11, 2009. Nicole Peterson gave a presentation per the staff memorandum. Commissioner Cleveland asked if the town had originally considered the parking for permit only. John Gallegos, of the Public Works Department, stated that the parking lot is proposed to be open to the public. There was no other Commissioner comment. There was no public comment. 4. A request for a worksession to discuss a major amendment to a Special Development District (SDD), pursuant to Section 12-9A-10, Amendment Procedures, Vail Town Code, to allow for an amendment to Special Development ,District No. 17, Ramshorn, to allow for the redevelopment of Ramshorn Lodge, located at 416 Vail Valley Drive/Block 3, Vail Village 5th Filing and Tract F-1, Vail Village Filing 5, and setting forth details in regard thereto. Information Update Commissioner Pierce made a motion to direct staff to bring forward suggested amendments to Ordinances 7 and 8, Series of 2007, in an effort to better define the Commission's role in reviewing the employee housing plans required by these ordinances. The Commission asked Staff to provide suggestions for prioritizing the four mitigation methods with regards to projects and guidelines on where collected pay-in-lieu funds would be allocated. Commissioner Kjesbo talked about the lack of land in Town and the need to put employee housing on site. Commissioner Viele stated that pay-in-lieu affords an opportunity for the Town to possibly create mortgage assistance programs or some other subsidies for employees. Seconded by Kurz Unanimously approved. 7.
