3. George Ruther ITEMITOPIC: A request for direction on whether to proceed with
Checkpoint Charlie improvements during the fall of 2009 and a
determination on the preferred location of the one, unisex, public
restroom. (30 min.)
ACTION REQUESTED OF COUNCIL: After listening to a brief staff
presentation, staff and VRDC are asking the Vail Town Council to
answer the following questions:
• Should Vail Resorts Development Company (VRDC)
proceed with completing the required streetscape

improvements during the fall of 2009?

• Should VRDC proceed with constructing a public
restroom in the proposed location given the existing
site constraints or should alternate arrangements for
providing the public restroom be considered (i.e.,
payment in lieu)?
BACKGROUND RATIONALE: As required by the approved
development agreement for Vail's Front Door Project, VRDC is
required to complete certain improvements at Checkpoint Charlie to
mitigate the development impacts of the project. Those
improvements generally include streetscape, landscaping, drainage,
utilities, lighting, sgnage, and a public restroom. Due to several
challenging site constraints, such as the depth and location of certain
public utilities and the loss of the large evergreen tree growing in the
circle at the west end of Gore Creek Drive, VRDC is questioning the
appropriateness of constructing the public restroom in that location
pursuant to the Agreement.

4. Warren Campbell ITEM/TOPIC: A presentation to the Vail Town Council on the
proposed Ever Vail development application including: (60 Min.)
• Update of the Planning and Environmental Commission's
public hearing on March 23, 2009.
• The proposed South Frontage Road design,
• The proposed public improvements (i.e., skier drop -off,
charter bus parking, public transit facility, loading and
delivery facility, and public parking structure).
• Next steps in the review process.
ACTION REQUESTED OF COUNCIL: Listen to the presentation and
ask questions for clarification and/or provide feedback
BACKGROUND RATIONALE: The redevelopment of the area
known as Ever Vail is an intricate project with many applications and
steps within the development review process. The purpose of this
presentation is to update the Vail Town Council on progress made to
date in the development review process and inform the Town Council
on the South Frontage Road design and status of the ,public
improvements planning. Staff will also provide a brief overview of the
next steps in the review process as they are anticipated over the next
45 -60 days.
5. Nina Timm ITEMITOPIC: Establish the 2009 Employee Housing Fee -in -Lieu
for Commercial Linkage and Inclusionary Zoning. (10 min.)

BACKGROUND: On April 4, 2007, the Vail Town Council
adopted Ordinances Nos. 7 and 8, establishing Chapter 23,
Commercial Linkage, and Chapter 24, Inclusionary Zoning, Vail
Town Code. In accordance with Sections 12 -23 -6 and 12 -24 -6,
the fee -in -lieu for each employee to be housed and for each
square foot of employee housing required shall be established
annually by resolution of the Vail Town Council.
ACTION REQUESTED OF COUNCIL: Approve, approve with
modifications, or deny Resolution No. 9, Series of 2009.
STAFF RECOMMENDATION: Staff recommends that the Vail
Town Council approve Resolution No. 9, Series of 2009.
6. Matt Mire ITEM/TOPIC: Discussion of Ordinance No. 9, Series of 2009, an
Ordinance Amending Title 1, Administration, Vail Town Code by
the Addition if a New Section, "Restitution Orders" to Chapter 4,
General Penalty; and Setting Forth Details in Regard Thereto. (10
min.)
ACTION REQUESTED OF COUNCIL: Approve, approve with
modifications, or deny Ordinance No. 9, Series of 2008, on first
reading.
BACKGROUND RATIONALE: The Vail Municipal Court requires
the ability to impose restitution in criminal actions where a defendant
has been adjudged guilty for violating an ordinance of the town for
any actual damage or loss caused by the offense or infraction for
which the conviction or judgment of liability was had. The victim of a
crime is entitled to be compensated for his/her losses and hereby
finds that it is in the best interest of the citizens of the town to revise
the Town Code by amending Title 1 with the addition of a new
subsection, "Restitution Orders" to Chapter 4, General Penalty.
STAFF RECOMMENDATION:
Approve, approve with modifications, or deny Ordinance No. 9,
Series of 2009, on first reading.

CONDITION(S):
1. That this approval is solely for the establishment of the width of the Colorado
Department of Transportation (CDOT) right -of -way containing the relocated South

Frontage Road, the location of the 20 -foot right -of -way, and a the location of a 3 -foot
signage, lighting, and sidewalk easement.
2. The design submitted is preliminary in nature and to this point there is still significant
further design and review which may modify the overall final design of the roadway.
This includes the proposed development uses, access points and traffic operations of
the development accesses, drainage design, structural design, as well as review by
the Vail Town Council, Town of Vail Design Review Board, Planning and
Environmental Commission, Town Staff, Colorado Department of Transportation and
Federal Highway Administration and their consultants. There will also be a review for
environmental clearances by outside agencies and subsequent referral agencies such
as the Corps of Engineers and Division of Wildlife. Furthermore, the two roundabouts
will be reviewed by a third party roundabout expert and optimized for traffic
operations. This may cause adjustments in the geometries of the roundabout designs.
The applicant shall return before the appropriate Town reviewing authority(s) for
review and approval of any changes required by any of the reviewing parties listed
above that affect the elements approved within this request for the preliminary plan.
3. The developer may enter into a license agreement with the Town of Vail to allow for
temporary shoring and temporary construction activities to occur within the area of
the platted 20 -foot wide Town of Vail right -of -way. The Town of Vail agrees to not
unreasonably withhold the developer's request to utilize the right -of -way for
temporary shoring and temporary construction activity.
Warren Campbell made a presentation per the Staff memorandum. He added that staff was
requesting that Condition 3 be replaced by an amended condition.
Tom Kassmel, Town Engineer, stated that the current plan reflects all the changes discussed by
the Commission and Staff and the result is a design which the Staff supports.
Warren Campbell added that Attachment C includes the Simba Run roundabout and potential
road design if the Frontage Road was not constructed at the time of the realigned Frontage
Road. The Town has yet to decide whether the roundabout and underpass will occur and the
plans show both options to allow the PEC to make decisions on both options.
Tom Miller, representative of Vail Resorts Development Company, made a presentation on items
that have been resolved from the last PEC meeting, including Frontage Road retaining wall
design, snow storage, and revised round -about design.
Dominic Mauriello, of Mauriello Planning Group, a representative of the Vail Resorts
Development Company, showed the preliminary plan and noted that this preliminary plan would
proceed to a final plan in the future. If the Town would get the ROW, then the applicant would
reserve the right to use the property for shoring, etc. Mauriello asked that the PEC approve the
preliminary plan, including the roadway configuration, etc.
There was no public comment.
The Commissioners expressed their support for the design and felt that the changes and
compromises made over the past months resulted in a favorable road design.
Commissioner Kurz asked what the purpose is of the shoring that was being discussed.

Tom Miller responded that the temporary shoring will be the first step in construction of the
improvements such as parking structures and buildings on the site.
Commissioner Paladino asked if the Town has guaranteed the land for shoring, and what impact
would this have on the project.
Tom Miller responded that the Town has not guaranteed the right to shore within the right -of -way
and if the soil nail were not permitted, the project may not occur as other shoring systems were
much more costly.
Commissioner Tjossem asked what the timeline was for granting permission to shore in the right -
of -way.
Warren Campbell responded that the Town is working with the applicant and this issue will likely
be discussed when the proposed frontage road design is reviewed by the Town Council prior to
submittal to CDOT.

Rachel Friede made a presentation per the Staff memorandum.
On the topic of Staff review of signage, Commissioner Pierce suggested that there might be
benefits to allowing for Staff review of all sign applications, while Commissioner Viele suggested
that the applicant should have the ability to have Staff review their application or request review
by the Design Review Board.
On the topic of window signage, Commissioner Kurz suggested that having graphics were
preferred over seeing actual merchandise. Commissioner Tjossem suggested that businesses
apply for variances to allow for window signage to cover entire windows, noting that goods can
be damaged via window display. Commissioner Pierce suggested that graphics over the entirety
of the window was inappropriate. Commissioner Proper noted that individual business owners
should be able to determine the use of their windows to either reap the benefits of
consequences_
With regard to whether balloons should be allowed, Commissioners Kurz, Kjesbo and Pierce
suggested that no balloons should be permitted. Commissioner Tjossem said she does not
believe that we should be doing things to sterilize the Town, noting that balloons add energy to
the Town. Commissioner Viele also supported the use of balloons.
Lighting requirements for signs were the final discussion topic, and most Commissioners felt that
the newly adopted lighting standards should also apply to signage. However, Commissioners
Tjossem and Pierce support increased lighting of signage for vitality and safety.

Tom Kassmel, Public Works, and Chris Fasching gave a presentation per the staff
memorandum.
Commissioner Paladino asked for clarification about the employment, housing, and population
projections provided as background information.
Commissioner Tjossem asked for clarification of how the parking demand projections
corresponded to the existing, and any future changes to, the U.S. Forest Services' daily skier
number limits for the ski mountain.
Commissioner Viele asked for clarification about the intended benefits of the Simba Run
underpass. He also discussed the negative impacts of constructing additional roadway lanes on
the character of the community.
Commissioner Kurz asked for clarification about how the traffic projections addressed the Town's
current and future public transit usage. He recommended exploring means to increase the use
of transit
Commissioner Tjossem noted that she is not a proponent of building roads, parking, etc. to
address only peak days. She recommended exploring alternatives to "manage" traffic /parking,
rather than only constructing more infrastructure.
Commissioner Proper asked if the inconvenience of Vail's traffic /parking will eventually
discourage people from coming to Vail, and ultimately self - regulate the demand. He also
questioned if the Town will need to undertake this task of addressing traffic /parking needs again
in another 20 years.
Commissioner Viele asked for the details about how the levels of service are calculated, and
what levels are actually perceived as problematic by the Commission and the public. He asked
for clarification about how these levels relate to actual travel times. He also noted concerns that
the studies associated with this master plan update were intentionally drafted to support the
construction of the Simba Run underpass.
Commissioner Pierce identified the location of the trip time analysis is in the reports, and noted
that the studies do not appear to be based simply on Staff's guesses about traffic. Instead, the
projections are based upon mathematical analysis and industry standards.
Tom Kassmel and Chris Fasching emphasized that the master plan is a long term plan. If
certain development is never constructed, or if other factors change, there may not be a need for
some of the improvement identified in the plan.
Commissioner Paladino again questioned the source and validity of the population projections
included as background for the transportation master plan.

Commissioner Tjossem asked how the traffic projections addressed people's changes in
behavior due to future traffic conditions. Commissioner Kurz recommended the plan be
tempered with consideration of future behavior changes.
Warren Campbell clarified that the goals of the plan are to achieve level of services identified in
the Vail 20/20 Plan and the Council's direction to address the 15" peak traffic day. He noted that
changes to these goals could significantly change the recommended outcomes from the
transportation master plan.
Chris Fasching again noted that this is a long range plan, and that the identified traffic
improvements would not be constructed immediately and would be evaluated in greater detail
prior to implementation.
Tom Kassmel summarized the information discussed to this point at the work session. He noted
that at the time of implementation, each element of the plan would require additional detailed
analysis. He then continued with a presentation about the transit and parking elements of the
transportation master plan. He also discussed next steps in the review process.
Commissioner Kjesbo asked how the Simba Run underpass alone could affect the Town's traffic
issues as a whole.
Commissioner Tjossem expounded that an analysis of a "staged" or "stepped" implementation of
the master plan would be helpful to review.
Commissioner Viele noted the need for a policy discussion about just how convenient Vail
should be for vehicles and parking.

SUBJECT: A request for direction on whether to proceed with Checkpoint Charlie
Improvements during the fall of 2009 and a determination on the
preferred location of the public restroom.
I. DESCRIPTION OF THE REQUEST
Vail Resorts Development Company (VRDC) and the Town of Vail Community
Development and Public Works Departments are requesting direction from the
Vail Town Council on whether to proceed with completing the required
Checkpoint Charlie improvements during the fall of 2009 and a determination on
the preferred location of the public restroom.
As required b the approved development agreement for Vail's Front Door

Project, VRDC is required to complete certain improvements at Checkpoint
Charlie to mitigate the development impacts of the project. Those improvements
generally include streetseape, landscaping, drainage, utilities, lighting, signage,
and a public restroom. Due to several challenging site constraints, such as the
depth and location of certain public utilities and the loss of the large evergreen
tree growing in the circle at the west end of Gore Creek Drive, VRDC is
questioning the appropriateness of constructing the public restroom in that
location pursuant to the Agreement.
After listening to a brief staff presentation, staff and VRDC are asking the Vail
Town Council to answer the following questions:
• Should VRDC proceed with completing the required streetscape
improvements during the fall of 2009?
• Should VRDC proceed with constructing a public restroom in the
proposed location given the existing site constraints or should
alternate arrangements for providing the public restroom be
considered (i.e., payment in lieu)?
III. STAFF RECOMMENDATION
Town staff evaluated a number of factors in considering its recommendations.
Those factors included:
• Time of year
• Scope of work

• Traffic flow and traffic patterns resulting from the Mountain Plaza loading
& delivery operations
• Construction activity in the area
• Impacts to business and tourism
• Public safety
• Anticipated construction schedule
• Master Plan Recommendation
Upon review of the factors outlined above, the Community Development and
Public Works Departments recommend the Town Council instructs Town staff
and Vail Resorts Development Company to explore the feasibility (i.e., availability
of water & sewer, costs, site constraints, etc) of relocating the public restroom
requirement to an alternate site near International Bridge. The feasibility work
shall be completed prior to finalizing the design, completing the entitlement
processes and commencing construction of the Checkpoint Charlie
improvements. In finalizing the design, Staff and VRDC should rely upon the
recommendations outlined in the " Town of Vail Streetscape Master Plan
Addendum " . If the public restroom was to be relocated, staff and VRDC
anticipate entering into a development agreement to clarify the responsibilities
and obligations of the two parties Further, should work begin this fall, VRDC
shall commence construction after September 20 2009, and complete all work by
December 1, 2009_ If this requirement can not be fully met with reasonable
assurances, staff then recommends a spring 2010 start to avoid unnecessary
negatives impacts to Vail Village businesses and tourism.
III. BACKGROUND
Pursuant to the Approved Development Agreement for Vail's Front Door project,
VRDC shall complete improvements to a portion of Gore Creek Drive from Willow
Circle to and through the turnaround at Checkpoint Charlie. A reduced site plan
illustrating the affected area has been attached for reference. According to the
conditions placed on the approval of the project, in part,
"The Developer agrees to provide to the Town of Vail for review and
approval by the 'Vail Town Council a comprehensive Development
Agreement for Vail's Front Door Project improvements. Said Agreement
shall be submitted to the Town by no later than October 39, 2003. The
Development Agreement shall be a legally binding agreement between
the Town of Vail and Vail Resorts. The purpose of this agreement is to
document, among other things, the manner and timeframes within which
the Town and the Developer will complete certain required aspects of the
project. The Development Agreement will include, but may not be limited
to, addressing the following aspect of the project.
A written description of all off -site improvements to be
provided by the Developer (as generally depicted on the
approved development plans), providing additional details
on the specific improvements to be provided, the manner
in which developer assurances for completion of said
improvements will be provided, acknowledgment that
design details will conform to the Town's streetscape
standards, schedules for completing said improvements,

the manner in which the Developer and Town will
coordinate streetscape improvement efforts and defining
specific terms to determine when and where Checkpoint
Charlie will be constructed by the Developer, as maybe
amended"
For reference, in part,
"Within one year from the date of the issuance of a Temporary
Certificate of Occupancy for Vail's ,Front Door Project
improvements, the Developer and the Town of Vail Public Works
Department shall evaluate and determine the appropriate location
for the Checkpoint Charlie improvements based upon traffic
circulation and patterns. Upon determination of the appropriate
location for Checkpoint Charlie, the Developer agrees to design,
obtain approval, and construct the Checkpoint Charlie
improvements. The Checkpoint Charlie improvements shall be
constructed in accordance with the provisions outlined in the
Developer Improvement Agreement for Off Site Improvements. „
The new Checkpoint Charlie building and public restroom is proposed to be
located back within the town's public right of way at the west end of Gore Creek
Drive. The public right of way beneath and adjacent to Checkpoint Charlie is
strewn with public utilities. The utilities include water, sewer, gas and electric,
with some lines buried as deeply as 20 feet beneath the surface of the street. As
a result of the presence and depth of the utilities, the utility companies are
requiring that any future improvements constructed atop the utilities must be
"moveable" and the depth of excavation to gain access to the water and sewer
lines will likely require the large evergreen tree to be removed. If a public
restroom is not constructed at the Checkpoint Charlie location, the building must
still be "moveable ", however, the depth of excavation can be reduced significantly
and the large evergreen tree could be preserved. For these reasons, VRDC is
questioning the appropriateness of the public restroom at the Checkpoint Charlie
location.
According to the "Town of Vail Streetsca a Master Plan Addendum ", adopted
November 4, 2003, additional public restrooms are needed in Vail Village. To
that end, the Restroom Coverage Diagram (figure 41) of the Master Plan
identifies several likely locations to construct restrooms. According to the
Diagram, the best options are "...near the International Bridge and the
intersection of Mill Creek and Gore Creek Drive.
The adopted Master Plan Addendum also indicates the removal of the planter
and tree to make way for the "West Gore Creek Performance & Gathering" area.

Re: A work session to discuss the proposal to relocate the South Frontage Road in
conjunction with the Ever Vail project.
I, SUMMARY
A presentation to the Vail Town Council on the proposed Ever Vail development
application including:
• an update of the Planning and Environmental Commission's public
hearing on March 23, 2009,
• the proposed South Frontage Road design,
• the proposed public improvements (i.e., skier drop -off, charter bus
parking, public transit facility, loading and delivery facility, and public
parking structure), and
• the next steps in the review process
Staff requests that the Town Council listen to the presentation and ask questions
for clarification and/or provide feedback. It is anticipated that the Applicant and
Staff could return on April 21, 2009, to request an action by Council on the
proposed South Frontage Road design.
II. PEC UPDATE
On March 23, 2009, the Planning and Environmental Commission, by unanimous
vote, gave approval of a limited element Ever Vail Preliminary Plan to establish
the relocated South Frontage Road right -of -way, a 20 -foot right -of -way, and a a-
foot sign and maintenance easement. In addition, the Commission gave
approval to the proposed design for the relocated South Frontage Road. There
were three conditions of approval attached to the motion and findings.
1. That this approval is solely for the establishment of the widih of the
Colorado Department of Transportation (CDOT) right -of -way
containing the relocated South Frontage Road, the location of the 20-
foot right -of -way, and a the location of a 3 -foot signage, lighting, and
sidewalk easement.
2. The design submitted is preliminary in nature and to this point there is
still significant further design and review which may modify the overall
final design of the roadway. This includes the proposed development
uses, access points and traffic operations of the development
accesses, drainage design, structural design, as well as review by the
Vail Town Council, Town of Vail Design Review Board, Planning and

Environmental Commission, Town Staff, Colorado Department of
Transportation and Federal Highway Administration and their
consultants. There will also be a review for environmental clearances
by outside agencies and subsequent referral agencies such as the
Corps of Engineers and Division of Wildlife. Furthermore, the two
roundabouts will be reviewed by a third party roundabout expert and
optimized for traffic operations. This may cause adjustments in the
geometrics of the roundabout designs. The applicant shall return
before the appropriate Town reviewing authority(s) for review and
approval of any changes required by any of the reviewing parties
listed above that affect the elements approved within this request for
the preliminary plan.
3. The developer may enter into a license agreement with the Town of
Vail to allow for temporary shoring and temporary construction
activities to occur within the area of the platted 20-foot wide Town of
Vail right -of -way. The Town of Vail agrees to not unreasonably
withhold the developer's request to utilize the right -of -way for
temporary shoring and temporary construction activity.
Pursuant to Section 13 -3 -4, Commission Review of Application: Criteria, Vail
Town Code, the applicant has proven by a preponderance of the evidence
before the Planning and Environmental Commission that the limited elements
of the preliminary plan are in compliance with the criteria listed in Subsection
A of this section; that the subdivision is consistent with the adopted goals,
objectives and policies outlined in the Vail comprehensive plan and compatible
with the development objectives of the town; that the subdivision is compatible
with and suitable to adjacent uses and appropriate for the surrounding areas,
and that the subdivision promotes the health, safety, morals, and general
welfare of the town and promotes the coordinated and harmonious
development of the town in a manner that conserves and enhances its natural
environment and its established character as a resort and residential
community of the highest quality.
III. PROPOSED SOUTH FRONTAGE ROAD DESIGN
Vail Resorts Development Company (VRDC), the applicant, is proposing to
relocate a portion of the South Frontage Road to facilitate the redevelopment of
West Lionshead. The Colorado Department of Transportation (CDOT) requires
that the Town of Vail submits the relocation application on behalf of VRDC. Prior
to submitting the application to CDOT, however, the Town of Vail must approve
the relocation application. The Town staff and the applicant have been actively
preparing the relocation application to submit to CDOT.
The South Frontage Road design as approved by the Planning and
Environmental Commission includes:
• a two lane round -about between Vail Spa and the proposed Ever Vail
Project where the future West Lionshead Circle would meet the realigned
South Frontage Road,
• two lanes of travel in both directions (can function as on street parking or
bike lane if necessary in the west bound direction) with turn lanes,

• a 16 -foot wide landscaped median separating the east and west bound
lanes,
• snow storage and landscaping areas of a minimum of 8 feet on the north
and south sides of the road,
• a 10 -foot wide separated pedestrian /bike path along the south side of the
road, and
• the Simba Run underpass southern round - about.
IV. PROPOSED PUBLIC IMPROVEMENTS
At a previous work session with the Town Council a request was made to have
further information provided on the location and function of certain public
improvements. The improvements identified included skier drop -off, charter bus
parking, public transit facility, loading and delivery, hotel shuttle drop -off, and the
public parking structure.
The Applicant will provide a presentation at the hearing discussing the location
and function of these proposed improvements.
V. NEXT STEPS
The next steps in the review process as they are anticipated over the next 45 -60
days are:
• April 16 and 17 meetings between Vail Resorts Development
Company and Town Staff to continue the review of the Ever Vail project
in greater detail.
• April 21" request for Town Council to take action on the proposed South
frontage Road design.
• If the South Frontage Road design is approved there would be a
subsequent submittal of the plans by the Town to CDOT to begin their
review.

SUBJECT: Annual Update to the Employee Housing Fee -in -Lieu Amount
I. INTRODUCTION
Can April 4, 2007, the Vail Town Council adopted Ordinances Nos. 7 and 8,
Series of 2007, establishing commercial linkage and inclusionary zoning. The
ordinances provide five methods of mitigation to supply the requisite employee
housing. One of the methods of mitigation is paying a fee -in -lieu of supplying the
employee housing.
In accordance with Sections 12 -23 -5 and 12 -24 -6, the fee -in -lieu for each
employee to be housed and for each square foot of employee housing required
shall be established annually by resolution.
The proposed employee housing fee -in -lieu amount reflects the gap between a
two- person household earning 120% of the 2008 Area Median Income and the
2008 median cost per unit plus an administrative fee of $3,000 per employee or
$3.65 per square foot. The two - person Area Median Income increased $2,520
from 2007 to 2008 and the Town of Vail median price per square foot increased
$301.
In 2008, the most significant impact on the median price per square foot of units
in Vail was the 63 sales at Arrabelle at Vail Square. This accounted for almost
33% of the sales that occurred in Vail. If the Arrabelle sales are not included in
the calculation, the median price per square foot for all transactions dropped from
2007 to 2008.

WHEREAS, on April 3, 2007, the Vail Town Council adopted of Ordinance Nos. 7
& 8, Series of 2007, establishing Commercial Linkage and Inclusionary Zoning
requirements in the Town of Vail; and
WHEREAS, pursuant to Sections 12 -23 -5 and 12 -24 -6, Methods of Mitigation,

WHEREAS, the Vail Town Council finds that this Resolution furthers the
development objectives of the Town and is in the best interest of the Town as it
promotes the coordinated and harmonious development of the Town in a manner that
conserves and enhances the availability of employee housing within the Town of Vail.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF VAIL, COLORADO.
1. Establishment of Fees -in -Lieu
a. The fees -in -lieu for each employee to be housed or for
each square foot of employee housing provided in accordance
with Chapters 12 -23, Commercial Linkage, and 12 -24,
Inclusionary Zoning, shall be established annually by resolution of
the Town Council, provided that, in calculating that fee, the Town
Council shall include the net cost (total cost less the amount
covered by rental or sale income) of real property and all related
planning, design, site development, legal, construction and
construction management costs of the project, in current dollars,
which would be incurred by the Town to provide housing for the
employee to be housed or for each square foot of employee
housing provided in that year,

b. An administrative fee of $3,000/per employee or $3.65 per
square foot shall be added to the amount set forth in paragraph a
hereof.
C. Fees -in -lieu shall be due and payable prior to the issuance
of a building permit for the development.
d. The Town shall only use monies collected from fees -in -lieu
to provide new employee housing.
The calculation formula for fee -in -lieu has been attached for reference
(Exhibit A).

AN ORDINANCE AMENDING TITLE 1, ADMINISTRATION, VAIL TOWN CODE BY
THE ADDITION OF A NEW SECTION, "RESTITUTION ORDERS" TO CHAPTER 4,
GENERAL PENALTY; AND SETTING FORTH DETAILS IN REGARD THERETO.
WHEREAS, the Town of Vail, in the County of Eagle and State of Colorado (the
"Town"), is a home rule municipal corporation duly organized and existing under laws of
the State of Colorado and the Town Charter (the "Charter "); and
WHEREAS, the members of the Town Council of the Town (the "Council") have
been duly elected and qualified; and
WHEREAS, the Vail Municipal Court is currently unable to impose restitution in
criminal actions where a defendant has been adjudged guilty for violating an ordinance
of the Town to any aggrieved person for any actual damage or loss caused by the
offense or infraction for which the conviction or judgment of liability was had; and
WHEREAS, the Council declares that the victims of a crime are entitled to be
compensated for their losses and hereby finds that it is in the best interest of the citizens
of the Town to revise the Town Code by amending Title 1 with the addition of a new
Section, "Restitution Orders " to Chapter 4, General Penalty.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF VAIL, COLORADO, THAT:
Section 1. Title 1 of the Municipal Code of the Town of Vail is hereby amended by the
addition to Chapter 4 to read as follows:
1-4-4: RESTITUTION ORDERS:
(a) The Municipal Court has the ability to order restitution in cases where a victim
suffers actual losses or can show future costs for treatment. Any order for
restitution entered pursuant to this Section shall be a final civil judgment in favor
of the Town and any victim. Notwithstanding any other civil or criminal statute or
rule, any such judgment shall remain in force until the restitution is paid in full.
The entry of an order for restitution under this Section creates a lien by operation
of law against the defendant's personal property and any interest that the
defendant may have in any personal property. Any order of restitution imposed
shall be considered a debt for "willful and malicious" injury for purposes of
exceptions to discharge in bankruptcy as provided in 11 U.S.C. § 523.
(b) Any order of restitution may be increased or decreased upon a showing of
good cause. If more than one (1) defendant owes restitution to the same victim
for the same pecuniary loss, the orders for restitution shall be joint and several
obligations of the defendants.

(c) Victims of traffic accidents cannot request restitution if the vehicle they drove,
regardless of ownership, did not have insurance coverage. Nothing in this
Subsection shall prohibit a passenger in the vehicle from being awarded
restitution if the driver or passenger was not covered by his or her own medical
payments coverage policy.
(d) Nothing in this Chapter shall be construed to limit or abrogate the rights and
immunities set forth in the "Colorado Governmental Immunity Act," Article 10 of
Title 24, C.R.S.
Section 2. If any part, section, subsection, sentence, clause or phrase of this
ordinance is for any reason heid to be invalid, such decision shall not effect the validity
of the remaining portions of this ordinance; and the Town Council hereby declares it
would have passed this ordinance, and each part, section, subsection, sentence, clause
or phrase thereof, regardless of the fact that any one or more parts, sections,
subsections, sentences, clauses or phrases be declared invalid.
Section 3. The amendment of any provision of the Town Code as provided in this
ordinance shall not affect any right which has accrued, any duty imposed, any violation
that occurred prior to the effective date hereof, any prosecution commenced, nor any
other action or proceeding as commenced under or by virtue of the provision amended.
The amendment of any provision hereby shall not revive any provision or any ordinance
previously repealed or superseded unless expressly stated herein.
Section 4. All bylaws, orders, resolutions and ordinances, or parts thereof,
inconsistent herewith are repealed to the extent only of such inconsistency. This
repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or
part thereof, theretofore repealed.
