1 ITEM /TOPIC: Vail Local Marketing District (VLMD) 2010 Campaign. The
Vail Town Council will meet as the VLMD prior to the Work Session. (45

ACTION REQUESTED OF COUNCIL: Listen to the presentation, ask questions
and provide feedback regarding the VLMD 2010 Marketing Tactics and Creative
Elements.
BACKGROUND:
1. BACKGROUND ON VLMD 2010 MARKETING CAMPAIGN
The mission of the Vail Local Marketing District (VLMD) is to market and promote
Vail to attract overnight guests primarily during the May - October time frame,
creating economic vitality by increasing both the visitor base and sales tax
revenues. The 2010 budget of $1,745,000 was approved by the VLMD on
September 15, 2009.
2. 2010 GOAL
The goal of the 2010 marketing campaign is to utilize the "lighthouse concept" to
develop the Vail brand as the clear leadership brand in the year round resort
business. This will be accomplished by aligning with the brand positioning and
marketing done in winter. The results of the efforts will deliver:
- A brand that shows the way and leads
- A brand that shines insistently and consistently
- A brand that consumers, undecided and looking for choices, will navigate towards

The approved marketing objectives and strategies were developed from insight
gained through James Chung Reach Advisors research, Summer 2009 results as
well as Winter 2009/10 learnings.

- Continue to build long -term brand awareness that drives short -term sales
- Increase market share by widening audience reach while maintaining loyal guest

to achieve the approved Goal, Objectives and Strategies.
STAFF RECOMMENDATION: Staff requests VLMD provide input and feedback
regarding the 2010 Marketing Tactics and Creative Elements.

ACTION REQUESTED OF COUNCIL: Staff requests that the Vail Town Council
provide 1) a general guideline on what the Council would like the Town to
achieve as a community through a green building program, and, 2) policy direction
on the appropriate approach to sustainable building design and practices.

BACKGROUND: In order to increase energy efficiency and encourage
environmentally friendly building and construction practices in the Town of Vail,
Staff has undertaken developing the Sustainable Building Initiative (SBI) as a
specific task identified under Resolution 1, Series of 2009, adopting the
Environmental Sustainability Strategic Plan. There are four policy options that the
Vail Town Council may choose to direct Staff to take to implement the program: 1 )
Incentives 2) Disincentives, 3) Voluntary guidelines, 4) Regulations, or a
combination thereof.
STAFF RECOMMENDATION: In order to make progress on developing and
implementing a sustainable building program which includes environmentally
friendly design and practices, policy direction is required. After direction is
provided, Staff will return to the Vail Town Council with recommendations for
implementation, along with pros, cons, and implications of each.
5. ITEM /TOPIC: 2011 Budget timetable and philosophy. (15 min.)
PRESENTER(S): Kathleen Halloran
ACTION REQUESTED OF COUNCIL: Discuss the proposed timeline and the
philosophy for the preparation of the 2011 budget.
BACKGROUND: At the start of each budget season, a timetable is presented to
council with future dates for next year's budget process.
STAFF RECOMMENDATION: Discuss and provide any changes or
recommendations to the budget timetable and philosophies.

I. PURPOSE

II. BACKGROUND
On January 2, 2009, the Vail Town Council adopted Resolution No. 1, Series of 2009,
which adopted the Vail Environmental Sustainability Strategic Plan. The strategic plan
called for a sustainable building initiative.
ENVIRONMENTAL SUSTA/NABILITY STRATEGIC PLAN (in part)
Goal 2: Reduce the Town of Vail municipal and community energy use by 20% below
2006 levels by 2020, in order to effectively reduce the Town's contribution to
greenhouse gas emissions (GHG) and impact on global climate change.
Objective 2: Implement a sustainable building code program that requires new
construction and major renovations to achieve designated resource and energy
efficiency targets.
Action Items 2.1 -2.3:
2.1. Implement a high performance building code or program for all new
development and Town facilities (e.g. LEED for New Construction, Green
Built Colorado, or similar program).
2.2. Develop and adopt energy and resource - efficient building standards for all
existing Town facilities.
2.2.1. Require all Town - funded remodel projects to exceed the International
Energy Conservation Code by at least 15% on retrofits.

2.2.2. Require Energy Star or better products when available for all new
equipment.
2.2.3. Utilize strategic tree planting to reduce cooling loads of buildings.
2.3. Educate the public on the adopted green building program and provide
information and services at the Department of Community Development.
Staff has undertaken developing the Sustainable Building Initiative (SBI) as a specific task
identified under Resolution 1, Series of 2009, adopting the Environmental Sustainability
Strategic Plan.
The purpose statement, goals and scope of the SBI are as follows:
Purpose: The purpose of this initiative is to protect the Town of Vail public and
environmental health, safety and welfare by regulating construction with the intent to
conserve energy, water and other natural resources, preserve and protect the health of
our environment through optional and mandatory requirements related to energy
efficiency (e.g. insulation, efficient lighting, outdoor energy use mitigation program,
minimum efficiency on HVAC equipment, etc.) construction waste management, site
disturbance, landscape and irrigation, and reclaimed /recycled /recyclable building
materials.
Goal: To both incorporate sustainable building and design practices into the Vail Town
Code and create a user - friendly guide%hecklist for Sustainable Building Initiative (SBI)
elements in order to effectively achieve the Town's adopted goals of reducing
community energy consumption by 20% by 2020, and decreasing landfill contributions
by 10% within 5 years and 25% within 10 years.
Scope: The Town of Vail SBI aims to be "practically green" by including only practical,
measurable, and enforceable actions to increase the Town's environmental
stewardship.
Why Green Building?
The built environment has a vast impact on the natural environment, human health, and the
economy. In the United States, buildings alone (not including outdoor energy use) account
for:
• 39% of total energy use
• 12% of total water consumption
• 68% of total electricity consumption
• 38% of total carbon dioxide emissions
By adopting green building strategies, we have the opportunity to maximize both economic
and environmental performance. Sustainable construction methods can be integrated into
buildings at any stage, from design and construction, to renovation and deconstruction.
However, the most significant benefits can be obtained if the design and construction team
takes an integrated approach from the earliest stages of a building project that take into
account site design and the surrounding environment, as well as indoor and outdoor energy
and water consumption. Potential benefits of green building can include:

III. PROGRAM ELEMENTS
The following topics of discussion are aspects of the proposed Sustainable Building
Initiative that are related to Title 12, Zoning Regulations, and Title 14, Development
Standards, Vail Town Code. Each of the desired outcomes can be achieved through 1)
Incentives 2) Disincentives, 3) Regulations, 4) Voluntary guidelines, or a
combination thereof. For discussion purposes, examples of implementation of these four
measures are listed below as they relate to construction waste management only.
A. Construction Waste Management
Currently, no regulations exist in the Town of Vail to address construction waste
management. Under the current building permit process, submitted plans must
indicate areas designated for dumpsters, which as a policy are only permitted on
private property. The lack of space, time, training, and associated costs are the
main barriers to recycling on construction sites. Many communities require or
incentive on -site recycling, and in some cases have percentage requirements or
guidelines for recycled and landfill content.
Environmental Issues
i. Construction waste (mostly wood, plastic, and cardboard) makes up
between 30 -50% of Eagle County Landfill total waste, depending on the
season and level of construction projects in a given year. Less than 5%
of this is currently diverted to Habitat for Humanity, or RECON. In order
to extend the life of the landfill and prevent costly expansion, increased
diversion is necessary.
ii. Hauling and generating construction waste leads to greenhouse gas
emissions and environmental stressors associated with producing new
materials instead of using existing materials.
iii. Proper construction waste management not only saves resources, but
construction costs and landfill tipping fees, thereby reducing the cost of
construction.

Policy Options
1) Incentives: Building permit applicants that submit a construction waste
management plan designating on -site construction waste recycling bins, pass a site
inspection and achieve a diversion rate reported to the Town along with landfill receipts
could receive, for example: 1) a portion or all of their building permit refunded, 2) a
partial discount on construction tax, 3) priority in the building permit review process, 4)
an exception could be made to allow containers to be placed in the public right -of -way,
and /or 5) public recognition for assisting the Town in achieving its waste diversion
goals.
2) Disincentives: Building permit applicants who choose not to recycle on -site may
continue to only store their dumpsters on private property and may be charged a
"construction waste impact fee ", as a percentage of the value of their project that may
be deposited into a fund to improve recycling in the Town of Vail.
3) Voluntary Guidelines: A voluntary construction waste management program could
include education and training at the start of the building permit process to encourage
participation, and public recognition of successful participants. The Town may also work
with the local waste haulers to provide a reduced hauling fee for recycling containers vs.
trash dumpsters.
4) Regulations: The Town Code may require on -site recycling at construction sites,
by percentage, or simply by requiring that recycling bin location be indicated on plans
and verified with inspection. The Town Code may also require trash haulers operating
within the Town of Vail to imbed the cost of recycling in the cost of trash dumpsters so
that the recycling fee is covered whether the contractor chooses to recycle or not. Note:
an allowance to place dumpsters and /or recycling bins in the right of way may
encourage compliance.

BUDGET TIMETABLE
The 2011 budget timetable (attachment A) is included for your information. This
timetable provides for approval of the 2011 budget upon second reading of the budget
ordinance on November 16, 2010.
BUDGET PHILOSOPHIES AND PRACTICES
The Vail Town Charter (attachment B) sets forth certain requirements for the budget
while the budget book (produced annually) gives further guidance to the town's
budgeting process.
In preparing for the upcoming budget discussions, staff recognizes that Council's #1
prioritized area of focus is Budget and Capital Management. The 2011 budget process
will include the following actions based on that work plan:
• Identification and ranking of the town's capital needs for the next five years
• Develop a sustainable budget that operates within annual revenue streams by
reducing operating costs and identifying appropriate staffing levels
• Consider new funding opportunities
• Outline all operating expenditures in one exhibit, including costs charged to
General Fund, Capital Fund and RETT Fund.
The budget will continue to reflect the town's vision to be the premier mountain resort
community, despite operating expenditure reductions over the past 18 months. The
budget will also continue to support areas of strategic focus identified by Council
including Parking and Transportation, Economic Development, Affordable Housing and
Environmental Stewardship.
Other budget philosophies normally included in this discussion:
• The town will develop a five -year financial projection for all major funds annually.
• The town will develop a five year plan for Capital Projects and RETT annually
and complete capital improvements in accordance with the plan.
• Revenues will be projected conservatively using analytical processes. Revenue
collections will be reviewed monthly or quarterly, depending on the revenue
source, to determine variations from the budget.

• Fund balances shall be adequate to cover short -term fluctuations in revenues,
emergencies, and planned future expenditures. It is recommended the General
Fund balance be at least 25% of the budgeted revenues. During the
redevelopment years, the Town Council directed a fund balance of 35% of
budgeted revenues while significant construction takes place in the town. The
2010 amended budget projects a 67% fund balance in the General Fund, and
staff continues to recommend strong reserve levels for 2011 and beyond.
Staff is prepared to follow the above budget philosophies during the 2011 budget
process, and is requesting feedback and direction from Council regarding this proposed
path.

Section 9.1 - Fiscal Year:
The fiscal year of the town shall commence on the first day of January or on such date
each year as shall be fixed by the council.
Section 9.2 - Provision For Tax System:
The council may by ordinance provide a system for the assessment, levy and collection of
all town taxes, not inconsistent with this Charter.
Section 9.3 - Budget:
The town manager shall annually prepare and submit to the council a budget and
accompanying message. The budget shall provide a complete financial plan of all town
funds and activities for the ensuing fiscal year and, except as required by law or this
Charter, shall be in such form as the manager deems desirable or the council may require.
In organizing the budget, the manager shall utilize the most feasible combination of
expenditure classification by fund, organization unit, program, purpose or activity and
object. It shall begin with a clear, general summary of its contents and shall be so
arranged as to show comparative figures for income and expenditures of the preceding
fiscal year.
Section 9.4 - Capital Program And Additional Cent Sales Tax:
The manager shall prepare a long -range capital program and submit same to the council
no less than two (2) weeks prior to the submission of the budget. Such program shall
include a statement as to the application of the sales tax revenues allocated by ordinance
to the special revenue fund. Expenditure of these revenues other than for capital
improvements and /or open space acquisition or improvements or for the payment of debt
service on any obligations of the Town issued to finance the same shall require not less
than five (5) affirmative votes of the council.
Section 9.5 - Budget Hearing:
A public hearing on the proposed budget and proposed capital program shall be held by
the council no later than thirty (30) days prior to the close of the fiscal year. Notice of the
time and place of such hearing shall be published one (1) time at least seven (7) days
prior to the hearing.
Section 9.6 - Council Amendments:
After the public hearing, the council may adopt the budget with or without amendment.

In amending the budget, it may add or increase programs or amounts and may delete or
decrease any programs or amounts, except expenditures required by law or for debt
service or for estimated cash deficit.
Section 9.7 - Council Adoption:
The council shall adopt the budget by ordinance on or before the final day of the fiscal
year. If it fails to adopt the budget by this date, the amounts appropriated for the current
operation for the current fiscal year shall be deemed adopted for the ensuing fiscal year
on a month -to -month basis, with all items in it pro -rated accordingly, until such time as
the council adopts the budget for the ensuing fiscal year.
Section 9.8 - Property Tax Levy:
Adoption of the budget by council shall constitute appropriations of the amounts
specified therein as expenditures from the funds indicated. Council shall cause the
property tax to be certified to the county for collection as required by law.
Section 9.9 - Public Records:
Copies of the budget and the capital program as adopted shall be public records and shall
be made available to the public in the municipal building.
Section 9.10 - Amendments After Adoption:
(a) Supplemental Appropriations. If, during the fiscal year, the manager certifies that
there are available for appropriation revenues in excess of those estimated in the budget,
the council by ordinance may make supplemental appropriations for the year up to the
amount of such excess.
(b) Emergency Appropriations. To meet a public emergency affecting life, health,
property or the public peace, the council may make emergency appropriations. Such
appropriations may be made by emergency ordinance in accordance with provisions of
Section 4.11. To the extent that there are no available unappropriated revenues to meet
such appropriations, the council may by emergency ordinance authorize the issuance of
emergency notes, which may be renewed from time to time, but the emergency notes and
renewals of any fiscal year will be paid no later than the last day of the fiscal year next
succeeding that in which the emergency appropriation was made.
(c) Reduction Of Appropriation. If, at any time during the fiscal year, it appears probable
to the manager that the revenues available will be insufficient to meet the amount
appropriated, he shall report to the council without delay, indicating the estimated amount
of deficit, any remedial action taken by him and his recommendation as to any other steps
to be taken. The council shall then take such further action as it deems necessary to
prevent or minimize any deficit and for that purpose it may by ordinance reduce one or
more appropriations.

(d) Transfer of Appropriations. Any time during the fiscal year, the manager may transfer
part or all of any unencumbered appropriation balance among programs within a
department, office, agency and, upon written request of the manager, the council may by
resolution transfer part or all of any unencumbered appropriation balance from one
department, office, agency, or object to another.
(e) Limitation; Effective Date. No appropriation for debt service may be reduced or
transferred, and no appropriation may be reduced below any amount required by law to
be appropriated or by more than the amount of the unencumbered balance thereof. The
supplemental and emergency appropriations and reduction or transfer of appropriations
authorized by this Section may be made effective immediately upon adoption.
Section 9.11 -Independent Audit:
An independent audit shall be made of all town accounts at least annually and more
frequently if deemed necessary by the council. Such audit shall be made by certified
public accountants selected by the council who shall complete the audit within four (4)
months time of the close of the fiscal year. Copies of such audit shall be made available
for public inspection at the municipal building.

I. INTRODUCTION
The Town of Vail's Environmental Sustainability Strategic Plan holds the Town to
the goal of reducing landfill contributions by 10% within five years and 25% within
ten years. To that end, several steps have been taken as part of the effort to
meet and exceed this waste diversion goal both in the Town and in Eagle,
Garfield and Pitkin Counties as a collaborative effort. Recycling can be the most
effective method to achieve diversion, and there are many opportunities in the
Eagle Valley to expand recycling programs and increase public awareness of the
benefits. This memo briefly highlights the program elements and future project
activities related to recycling education.
II. PROGRAM ELEMENTS
Recycling Education and Infrastructure Opportunities
Staff has been working with the Tri- County Waste Collaborative (Eagle, Garfield
and Pitkin County stakeholder group) along with the Vail Citizen's Recycling
Advisory Committee to develop a recycling education program for the Town, as
well as the three - country region. The following elements are included in this
outreach effort and will be funded in part by the $100,000 Waste Diversion grant
from the USDA to the three counties to be completed by September, 2010:
Youth Outreach and Education
• Public Service Announcement (radio and TV) with Vail Recreation District
summer program students or elementary students in the fall. The
students will record a script urging parents and friends to be aware of
materials, and recycle correctly.
• Recycling curriculum education program (1 day training and packet of
materials for use in the classroom).
• Red Sandstone Elementary poster contest. Artwork will be used in future
brochures and on the Town's website.
Public Outreach
Information Availability.
• Staff will create a webpage devoted specifically to recycling
opportunities.
• Informational brochures (available at Community Development and
online).
• Vail Recycles!, recycling guide currently available on website for drop
off center and hard -to- recycle materials.
• Staff will establish a presence at the Vail Farmer's Market in
conjunction with local waste haulers to inform citizens of existing and
upcoming recycling opportunities.

• Staff will work with local waste haulers to produce refrigerator
magnets for Vail citizens to with recycling schedules, times, and
instructions on proper recycling practices.
• Staff will create the "Green Phone ": a special 1 -800 phone line directly
to the Town sustainability office to answer questions specific to
recycling and other environmental issues.
• Staff will work with the Vail Daily and the Vail Mountaineer to publish
the local waste hauler recycling schedules, dos and don'ts of
recycling. Information will also be posted on the Town's website.
Information Gathering:
• Staff conducted a residential recycling survey in Eagle, Garfield, and
Pitkin counties to determine practices, knowledge, and attitudes
toward recycling in the region. The survey was completed in May and
results will be available on the Town's website near the end of June,
2010.
• Staff has completed an online survey related to volume based
programs, as well as three separate curbside trash volume surveys in
residential neighborhoods.
• Staff has completed a business cardboard recycling participation
survey in Lionshead, and will complete the same survey in Vail Village
by July.
Infrastructure Improvements:
• Staff is currently evaluating options for purchasing, or creating a
partnership with local waste haulers to bulk purchase new, larger,
wheeling recycling bins in order to make them available for Town
residents to replace the 18 gallon bins that are currently issued by
waste hauling companies.
• New and improved signage will be installed at the drop off centers.
Staff will work with Waste Management to include signage on their 40-
yard containers.
• The wooden platform at the Town's public drop off recycling center
will be raised and improved to allow for easier access to recycling
bins.
• Staff has organized monthly tours to the Eagle County Materials
Recovery Facility (MRF) and will continue to do so for Town residents,
organizations and business owners. Staff will continue to work with
Eagle County on an education campaign to raise awareness on
appropriate recycling practices.
• Staff will explore the option of installing an additional compactor for
commingled materials to increase efficiency of collection and hauling.
• In order to assist the Eagle County MRF in recycling glass, staff will
explore the option of offering a separate collection container for glass
at the Town's public drop off center.
Employee Outreach and Education
• Employee environmental bonus program - To achieve a successful recycling and
waste reduction program, all employees must be willing to participate. The EFG
has determined that in some cases, employees may not be interested or may
consider recycling and waste reduction an inconvenience. Incentive programs
will help overcome this potential problem. The EFG proposes to implement the
following:

o $10 bonus cards, similar to the safety program, that promote sustainable
practices on a daily basis, supported by Town Directors. Criteria will be
determined by the EFG.
o "Paper -less" challenge among departments to use less paper and
transition to electronic
o Increased office composting
o Employee education series — lunch and learn, film series, etc. that
engage employees in recycling education and other environmental topics.
III. NEXT STEPS
Staff will return to the Vail Town Council in July, 2010 to provide an update on the status
of the recycling education program, and to hear comments, suggestions and feedback
on program implementation.
