BACKGROUND: On September 21, 2010 Kent Logan and Town Staff presented
a recommended process for defining clear purpose and programming for each of
the physical assets identified as having the most potential to achieve the goals of
upgrading existing facilities, completing the Renaissance and putting the finishing
touches on the town, including:
Remodel the Golf Clubhouse with the addition of an events pavilion
Remodel and expansion of Vail Village Welcome Center to include community
space
Town wide signage /information /guest enhancement system
Expansion and renovation of Dobson arena to allow for more expanded uses
Ford Park expansion of fields to create an additional field and extend the season
Staff has worked with prospective partners to define clear purpose, programming
and estimated costs for projects listed above that will be presented to Council in a
separate memo.
STAFF RECOMMENDATION: Staff recommends Council listen to the update and
provide direction on next steps.

ITEM /TOPIC: Gore Creek and Eagle River Aquatic Health Index/Nutrient Study
conducted for Eagle River Water & Sanitation District (ERWSD), 2008 -2010,
preliminary data results. (60 min)

ACTION REQUESTED OF COUNCIL: Listen to the presentation, ask questions, and
engage in discussion of next steps.
BACKGROUND: ERWSD staff and consultants will present preliminary results of the
ERWSD's ongoing "Nutrient and Macroinvertebrate Sampling Study" which assesses water
quality and aquatic health conditions within Gore Creek and the Eagle River. The Town of
Vail, via the Eagle River Watershed Council, has made significant financial contributions to
this effort.
The study provides data needed by the State to develop nutrient criteria, prepares ERWSD
for future regulations, and helps anticipate potential costly changes in the ERWSD's future
discharge permits for its three wastewater treatment plants. In addition, the State's
adoption of nutrient criteria will result in greater regulatory emphasis on the control of
nonpoint sources of nutrients, such as soil erosion and urban runoff.
ERWSD's analysis of the biological data for Gore Creek through areas in East Vail and Vail
Village shows that the aquatic life use metrics are below the attainment threshold adopted
by the State, indicating stresses associated with urban runoff and nonpoint sources of
pollution. The biological metrics for Gore Creek downstream of the Vail Wastewater
Treatment Plant show somewhat improved aquatic health conditions over the areas in East
Vail and the Village. As a point source discharger, ERWSD feels it important to
communicate these results with the governmental entities that can address nonpoint
source pollution.
The Town of Vail has consistently funded stream protection efforts and actively partners on
river health matters. Watershed compliance with the recently adopted aquatic life use
thresholds will have important regulatory implications for municipal, urban, and land
management related activities.
ERWSD is committed to working with the Town of Vail and other stakeholders to refine and
implement actions listed in the attached staff memorandum, prepared by Bill Carlson.
STAFF RECOMMENDATION: Implement appropriate action steps outlined in the staff
memorandum.
4. ITEM /TOPIC: Project update for the addition of widened shoulders for bikes
and pedestrians along the South Frontage Road between Ford Park to Bald
Mountain Road. The project is budgeted in 2011. (15 min)

ACTION REQUESTED OF COUNCIL: Staff is inviting questions and feedback
from the Council on the proposed shoulder widening project. Prior to construction,
staff would return to the Council to request approval of a construction contract.
BACKGROUND: Vail has always been proactive in the planning, construction and
maintenance of recreational trail facilities. More than two decades of master
planning has resulted in a good system of separated recreation trails. The next
step to improving Vail's non - motorized transportation routes is the addition of
widened shoulders to the Frontage Roads. Phases I and II are proposed for
construction in 2011 and will provide widened shoulders between Ford Park and
Bald Mountain Road.

Bill Gibson made a presentation per the staff memorandum. Bill gave an overview of the staff
recommendation.
David Kelley, of Rodney L. Sartain Architects, representing CineBistro, stated that he works with
movie theaters on signage around the country and in most communities there are unique types
of signs allowed for movie theaters. He felt there was a way to permit movie theaters the ability
to have digital signs without opening a "box of worms ".
Peter Knobel, spoke about other businesses in Vail installing video screens three feet inside their
store windows so they won't be regulated as signs by the Town of Vail. He expressed that a
better policy would be to allow for electronic signs than to continue avoiding the issue.
Commissioner Pierce identified several aspects for discussion about electronic signs.
George Ruther reminded the Commission of their advisory role to the Town Council and that
Staff wanted to accurately forward their recommendation, so he asked the Commissioners to
also answer the five policy questions outlined in the Staff memorandum.
Commissioner Kurz stated that he felt that the electronic signs installed at Cinebistro were
appropriate, and Commission's conversation should focus on size requirements and the
brightness of signs. He disagreed with Staff recommendation to in preventing motion on the
signs. He felt motion and changing message was the primary reason for using electronic signs.
He generally felt that electronic signs were appropriate throughout the Town, so long as size is
regulated.

Commissioner Rediker noted his initial concerns about allowing electronic signs, but seeing the
sign installed at Cinebistro changed his thoughts about allowing electronic movie theater signs.
He generally felt that the proposed amendments were too broad and that electronic signs in
general were not appropriate in Vail and did not believe that allowing electronic signs supported
criterion #1 identified in the staff memorandum. He noted concern about providing a competitive
advantage to a singular business type by allowing a theater restaurant to have a digital menu
board.
Commissioner Schneidman felt that the electronic entertainment signs were appropriate, but
needed to have further regulations.
Commissioner Cartin felt the installed movie theater signs were done very well and tastefully.
He was concerned about a digital menu board. He felt that a variance may be more appropriate.
He felt that the Commission and Design Review Board need to dive into the issue as the sign
would not be a static sign. Things like brightness and sound need to be addressed. He learns
more towards a variance for this proposal. He was not opposed to allowing digital signage, but
wants to make sure the code is amended appropriately the first time.
Commissioner Viele stated that he agreed with Commissioners Cartin and Rediker. He inquired
as to the ability to apply and grant a variance for this type of signage.
George Ruther and Bill Gibson explained that what was being requested would not be eligible for
a variance as this type of signage was prohibited.
Commissioner Pierce inquired as to Staff's research on other ski communities and how they
address these types of signs.
Bill Gibson went through the research he has done and how there were differences it how
jurisdictions address these things.
Commissioner Kurz stated that while there were several Commissioners who had concerns
about electronic signs, there were no concerns with the signs at Cinebistro. He saw no need to
hold up the applicant to have a joint meeting with the DRB and Town Council to discuss this
change in policy.
George Ruther explained that Staff focused on soley on movie theater in response to the
submitted application. Staff did not review this proposal for allowing other types of electronic
signs throughout the community.
Commissioner Rediker inquired as to how to prevent other businesses from doing less tasteful
signs.
Kurz made a motion to forward a recommendation to the Town Council to allow electronic movie
theater entertainment signs and menu box signs. As part of the motion, he recommended the
Commission, Town Council and the Design Review Board hold a joint meeting to discuss the
broader policy issues about electronic signs such as brightness, motion, etc.
Rediker and Pierce opposed the motion as they felt the specific recommendations should be
made to Town Council regarding size, brightness, hours of operation, audio and motion.

SUBJECT: Update on Conference Center Funds Reallocation
BACKGROUND: On September 7, 2010 Kent Logan presented concepts for the
highest and best use of the $9.3 million conference center funds. These concepts
came out of a process directed by Council to interview a cross section of
stakeholders with the goal of utilizing the funds to increase overall economic
vitality in the Town of Vail with the funds earmarked for capital assets, either new
or existing facilities, providing a long -term benefit to the Town of Vail. On
September 21, 2010 Kent Logan and Town of Vail staff presented a
recommended process for defining clear purpose and programming for each of
the physical assets identified as having the most potential to achieve the goals of
upgrading existing facilities, completing the Renaissance and putting the finishing
touches on the town. Staff has worked with prospective partners to define clear
purpose, programming and estimated costs for these projects detailed below.
UPDATE:
• Remodel the Golf Clubhouse with the addition of an events pavilion —
estimated at $3.5 million
This project is headed by a consortium including the Recreation
subcommittee, Vail Recreation District staff and Town of Vail staff. Due
diligence has included determining if the building can be remodeled,
reviewing schematics, cost estimating and adding a pavilion to serve
golfers, Nordic users, potential special events and meetings /receptions.
Revisions are underway with completion of concepts by January 30, 2011.

• Remodel and expansion of Vail Village Welcome Center to include
community space — estimated at $2 million
This project is headed by a consortium including Colorado Ski Museum
board members and Town of Vail staff. Due diligence has included
reviewing existing plans, cost estimates and determining clarification of
uses. Additional work is underway on an engineering analysis. Completion
of concepts is scheduled for January 31, 2011.
• Town wide signage /information /guest enhancement system —
estimated at $1 million
This initiative is underway and is being managed by the Town of Vail staff
with Town Council representation (Kerry Donovan and Susie Tjossem), as
well as participation by Vail Resorts. A request for qualifications was
issued by the town on October 27 and 8 responses were received. The
review committee has since selected 4 qualified teams to submit
proposals which are due December 17. Finalists will then be selected with
interviews to take place on January 11, 2011. Announcement of the
selected team will follow with contracting and commencement of work to
begin January 25, 2011. The schedule calls for a preliminary draft of ideas
and associated costs and return on investment to be submitted on or
before March 1, 2011 for review and direction by the Town Council.
• Expansion and renovation of Dobson arena to allow for more uses —
estimated at $2 million
This project is headed by a consortium including the Recreation
subcommittee, Vail Recreation District staff and Town of Vail staff. Due
diligence has included reviewing existing program scheduling, plans for
additional seats and renovation /expansion of the entry portal. Additionally
the group has attempted to clarify potential additional uses for the ice as
well as utilization for expanded concerts and potential exhibits, e.g.
traveling antique and art shows. Another meeting is scheduled for late
December.
• Ford Park expansion of fields to create an additional field and extend
the season — estimated at $1.0 million
This project is headed by Vail Recreation District staff and Town of Vail
staff. Due diligence has included reviewing proposed realignment of the
fields and parking impacts by staffs and Ford Park consultant. A meeting
is scheduled for late December with the Recreation subcommittee.
Parking concepts will be presented to Council January 4. 2011.

BACKGROUND: ERWSD staff and consultants will present preliminary results of the ERWSD's
ongoing "Nutrient and Macroinvertebrate Sampling Study" which assesses water quality and aquatic
health conditions within Gore Creek and the Eagle River. The Town of Vail, via the Eagle River
Watershed Council, has made significant financial contributions to this effort.
The study provides data needed by the State to develop nutrient criteria, prepares ERWSD for future
regulations, and helps anticipate potential costly changes in the ERWSD's future discharge permits for
its three wastewater treatment plants. In addition, the State's adoption of nutrient criteria will result in
greater regulatory emphasis on the control of nonpoint sources of nutrients, such as soil erosion and
urban runoff.
ERWSD's analysis of the biological data for Gore Creek through areas in East Vail and Vail Village
shows that the aquatic life use metrics are below the attainment threshold adopted by the State,
indicating stresses associated with urban runoff and nonpoint sources of pollution. The biological
metrics for Gore Creek downstream of the Vail Wastewater Treatment Plant show somewhat improved
aquatic health conditions over the areas in East Vail and the Village. As a point source discharger,
ERWSD feels it important to communicate these results with the governmental entities that can address
nonpoint source pollution.
The Town of Vail has consistently funded stream protection efforts and actively partners on river health
matters. Watershed compliance with the recently adopted aquatic life use thresholds will have important
regulatory implications for municipal, urban, and land management related activities.
ERWSD is committed to working with the Town of Vail and other stakeholders to refine and implement
actions listed in the attached staff memorandum, prepared by Bill Carlson.
STAFF RECOMMENDATION: Implement appropriate action steps outlined in the staff
memorandum.

1. SUMMARY
Linn Brooks (ERWSD), Bob Weaver (Leonard Rice Engineers), and David Rees (Timberline Aquatics) will
present preliminary data analysis results of the ERWSD's ongoing assessment of stream health and
nutrient related water quality conditions in Gore Creek and the Eagle River. The Town of Vail, through
the Eagle River Watershed Council, has made significant financial contributions to this effort and is
working with the District to develop management strategies for achieving water quality and aquatic
health improvements.
2. PRELIMINARY CONCLUSIONS
The Colorado Water Quality Control Commission (WQCC) has recently adopted a "Methodology to
Determine Aquatic Life Use Attainment for Rivers and Streams" (Policy Statement 2010 -1). The aquatic
life assessment methodology is based on the characteristics of the aquatic macroinvertebrate
community such as species composition and diversity which are measured using a multimetric index
(MMI). MMI scores provide a reliable indicator of the overall biological health of the stream compared
to relatively undisturbed "reference" streams. Low MMI scores indicate the presence of biological
"stressors" such as pollution and habitat degradation (e.g. sedimentation, channelization, etc.).
ERWSD's analyses of macroinvertebrate data for 2008 and 2009 indicate that MMI scores for Gore Creek
through areas in East Vail and Vail Village were much lower than reference sites, indicating stresses
associated with urban runoff or land use activities. The MMI scores for this area were below the aquatic
life use attainment threshold adopted by the WQCC, raising the possibility that Gore Creek could be
considered for inclusion on the State's 303(d) list of impaired waters. The MMI scores for Gore Creek
downstream of the Vail Wastewater Treatment Plant (WWTP) were better than the scores in East Vail
and the Village and were generally above the aquatic life attainment threshold.
WQCC staff has also proposed the adoption of numeric water quality criteria for nutrients (phosphorus
and nitrogen) based upon a statistical correlation between MMI scores and nutrient concentrations.
Nutrients, while not directly toxic to aquatic life, can cause excess growth of algae and aquatic plants
that affect the habitat for fish and macroinvertebrates, and stream aesthetics.
Nutrient concentrations in Gore Creek generally meet the proposed criteria. Nutrient concentrations
exceed the proposed criteria upstream of the Vail WWTP in April during early spring runoff and
downstream of the Vail WWTP during the fall and winter when occupancy rates tend to be higher

(resulting in higher loading to the WWTP) and streamflows are low. For both Gore Creek and the Eagle
River, higher nutrient concentrations do not appear to be correlated with low MMI scores.
During the summer growing season for algae, nonpoint source nutrient loading to both Gore Creek and
the Eagle River is a significant portion of the total load, indicating that urban runoff and stormwater Best
Management Practices (BMPs) should be high priority management strategies for water quality
improvements.
3. NEXT STEPS
Continued efforts toward monitoring, investigation, evaluation, and mitigation, where necessary, are
key to ensuring that water quality and watershed health is protected and managed appropriately. The
ERWSD plans to continue data collection and analyses efforts through 2011 and beyond, as needed to
identify stressors and contaminant sources impacting Gore Creek and the Eagle River. This effort will
include the development and implementation of a pilot snowmelt and stormwater sampling and
analysis plan to provide better information about urban runoff contaminants and their sources.
Concurrently, ERWSD will work closely with the Town of Vail, the Eagle River Watershed Council, and
other stakeholders to develop a focused management strategy aimed at identifying and implementing
water quality improvement strategies for Gore Creek. The primary goal of this effort would be to have a
Water Quality Improvement Plan in place prior to September 2011 when the WQCC staff will finalize its
proposed 303(d) list of impaired waters. This Plan would include specific measures to reduce point and
nonpoint source pollution, improve and protect stream and riparian habitat, implement community
educational programs, and include ongoing monitoring to evaluate the effectiveness of the water quality
improvement efforts. The completion of a Water Quality Improvement Plan for Gore Creek would be an
important consideration in the WQCC's decision regarding a proposal to include Gore Creek on the
303(d) list of impaired waters or the State's Monitoring and Evaluation List of waters that require
additional study prior to determining impairment.
All of ERWSD's efforts to date have focused on gaining the best understanding possible of source water
quality and aquatic health conditions within our watersheds. Effective watershed management is an
ongoing process that requires thoughtful planning based on sound scientific investigations, stakeholder
involvement and collaboration, and the flexibility to adapt to the constantly changing regulatory, social,
economic, and natural environments.

Actions the Town can take now to protect and restore Gore Creek water quality.

I. SUMMARY
We have heard from the ERWSD and know there are water quality issues in
Gore Creek. The purpose of this memo is to outline a number of actions that can
improve the health of Gore Creek. Until we learn more about the specific
impacts from storm water discharges into Gore Creek, the Town, residents, and
community stakeholders can take actions now that will improve the water quality
of Gore Creek.
II. TEN ACTIONS THE TOWN CAN TAKE NOW
1. Financially support a partnership with the ERWSD, the Eagle River
Watershed Council, and other stakeholders to develop a focused
management strategy aimed at identifying and implementing water quality
improvement strategies for Gore Creek. Estimated cost to Town $10,000
Outcomes:
a. Develop a Water Quality Improvement Plan by September 1, 2011.
This plan would include identification of potential storm water system
structural BMPs (i.e., Wetland Basins), improvements to riparian
areas, and other urban drainage BMPs.
b. Identify and prioritize locations where several projects could be
implemented in East Vail, including conceptual design plans, project
costs, and potential funding sources; Stream bank mitigation; e.g.,
willow and tree plantings, re- vegetation, stream bank BMPs, etc.
c. Reduce point and non point source pollution, protect stream habitat,
riparian improvements to bank stabilization, community education,
ongoing monitoring, measure and evaluate program effectiveness.
2. Financially support monitoring of storm water events in Gore Creek/Eagle
River. Estimated cost sharing with ERWSD, Eagle County, and Town of
Avon $5,000.
3. Commit to pursuing educational efforts (e.g, brochures, signage, billing
inserts, work shops, guide books, PSA, etc.) focusing on the following
objectives: Estimated cost $5,000
Outcomes:
a. Educate residents about their responsibility for and stewardship of
their Gore Creek Watershed, and how people impact stream health
from their activities.
b. Educate residents on the availability, location and requirements of
facilities for disposal or drop -off of household hazardous wastes,
travel trailer sanitary wastes, chemicals, grass clippings, leaf litter,

animal wastes and motor vehicle fluids.
c. Educate residents regarding acceptable application and disposal of
pesticides, herbicides and use of non phosphate fertilizers.
d. Educate residents concerning the preferred cleaning materials and
procedures for residential car washing.
e. Educate residents concerning the presence of illicit discharges or
improper disposal of materials into the Town's separate storm water
drainage system.
f. Educate residents concerning the management of critical riparian
lands to protect water quality and habitat.
4. Support public engagement that results in a public feed back process from a
cross connection of relationships from the fly fishing community, kayakers,
and other recreational users.
5. Support the revised Eagle River Watershed Plan; completed by Spring 2011.
6. Construction site storm water runoff erosion and sedimentation control
permitting for land disturbance activities greater than one (1/2) half acre.
7. Post Construction Storm Water Management Measures
a. BMP design criteria to treat storm water and snowmelt from new
construction or significant re- development.
b. Develop a formal post construction review process to ensure BMPs
are in accordance with design criteria.
c. Develop wetland set back/ground disturbance ordinance.
8. Municipal Pollution Prevention and Good Housekeeping Measures
a. Evaluate current practices of road sand /cinders and chemical deicer
use, snow plowing removal practices.
b. Identify all Town owned BMPs with GIS database and develop a
formalized maintenance schedule.
c. Develop sustainable methods to treat storm water via wetlands.
9. Analyze Town of Vail Land Development Regulations as it relates to
management of riparian lands along Gore Creek.
10. Support the current stream tract encroachment initiatives to remove private
improvements from publicly owned stream tract properties.
III. STAFF RECOMMENDATION
Staff recommends that Council direct staff to prepare a work plan that focuses on
a Partnership with the ERWSD, ERWC and other local stakeholders that
implements the above actions that can be take now.

along the South Frontage Road between Ford Park to Bald Mountain Road. The project is

BACKGROUND: Vail has always been proactive in the planning, construction and
maintenance of recreational trail facilities. More than two decades of master planning has
resulted in a good system of separated recreation trails. The next step to
improving Vail's non - motorized transportation routes is the addition of widened shoulders to
the Frontage Roads. Phases I and II are proposed for construction in 2011 and will provide
widened shoulders between Ford Park and Bald Mountain Road.

SUBJECT: Frontage Road Shoulder Widening — Ford Park to East Vail
I. Background
The addition of widened shoulders to the Frontage Road between Ford Park and East Vail is a
significant budget item in 2011 -12. As final design work nears completion, staff felt it was
important to provide the Town Council with a project update.
For many years, the Town of Vail has been proactive in the planning, construction and
maintenance of recreational trail facilities. The trails serve residents and guests and are used for
multi -use recreation as well as for transportation. In fact, Vail's commitment to trail facilities has
earned the status of "Bicycle Friendly Community" from the League of American Bicyclists.
An important guide for this commitment has been Vail's Recreational Trails Master Plan, adopted
in 1988. Since adoption, supplements to the trails plan have been included as part of Vail's
Transportation Master Plans (1993, 2002, 2009) and the Eagle Valley Regional Trails Plan
adopted by the Vail Town Council in 2001.
These documents outline goals for creating a network of non - motorized recreation and
transportation routes as well as specific actions needed to achieve those goals. While many of
the goals have been accomplished, one significant piece has not - the addition of widened
shoulders to the Frontage Roads.
II. Explanation of Widened Shoulders
The Eagle Valley Regional Trails Plan explains shoulders as follows:
"A paved shoulder is a de facto bikeway when present, but is different from a Bike Lane in that it is not
signed nor meant exclusively for the use of bicycles. Shoulders should be provided and maintained on
roads where it is anticipated that cyclists will ride, pedestrians may walk and no off road facilities are
available. A minimum of four feet of shoulder width is recommended, six feet or greater is preferred. "
There are several important reasons to add shoulders to Vail's Frontage Roads:
1) There is demand for additional facilities. The existing recreation trails do not safely
accommodate road bikers who tend to move faster than recreational trail users. As road
biking and commuting increase in popularity, so increases the need for additional facilities.
2) The shoulders would expand the network of non - motorized facilities, providing additional
routes that favor alternative transportation options.
3) Alternate routes are important during winter months when some sections of separated trails
are not maintained or have restricted access as in the case of the Vail Nordic Center.
4) Alternate routes are also important when sections of separated trails may be closed or
impacted by summer maintenance and construction.
5) Widened shoulders have become an accepted standard for arterial roadway design by the
American Association of State Highway and Transportation Officials (AASHTO) and the
Federal Highway Administration (FHWA). In addition, the use of shoulders along State
roadways is a Colorado Department of Transportation (CDOT) Policy Directive as well as a
"policy statement" of the CDOT Statewide Plan.

III. 2011 -2012 Proposed Project
The three -mile section between Ford Park and the East Vail exit is the highest priority of the
Frontage Road sections based on length, connectivity and lack of alternate routes, especially
during winter months. Through the summer, the section is heavily used by guests, who are often
inexperienced bikers and who would benefit from the safety of additional shoulder width. The
project includes three Phases, with Phases I and II budgeted for 2011:
Phase I Ford Park to Aspen Court — 2011
The proposed project widens the pavement on the north side of the road approximately seven
feet and shifts the striping as needed to provide two twelve -foot travel lanes and two six -foot
shoulders. Between Ford Park and the Public Works facility, the town is proposing a ten -foot
wide north shoulder that could serve as overflow parking. The proposal requires approval from
CDOT and FHWA. Note that the Frontage Road between Vail Village and the east end of Ford
Park is currently being studied as part of the town -wide parking study and the Ford Park
Masterplan process. Any proposed widening would be constructed as a part of those projects at
a later date.
Phase II Bald Mountain Underpass — 2011
The reconstruction of the Bald Mountain Underpass was bid for construction in the summer of
2010. However, the cost of the project exceeded the budget. Staff believes that combining the
underpass project with Phase I will decrease the overall project cost.
Phase III Bald Mountain Road to Bighorn Road — 2012
As with Phase I, this project widens the pavement on the north side of the road, and shifts the
striping as needed to provide two twelve -foot travel lanes and two six -foot shoulders.
IV. Schedule and Budget
Design work is close to completion. Staff anticipates starting the bid process for construction in
March. Construction would occur from May through June of 2011 for Phases I and II. The
recently approved 2011 Budget includes $2,275,000 for the final design and construction of
Phases I and II. The proposed 2012 budget for Phase III is $1,150,000.
V. Conclusion
The addition of widened shoulders to the Frontage Roads would be a significant enhancement to
Vail's recreation and transportation amenities. The concept is supported by more than two
decades of master planning and is an accepted standard. In addition, the shoulders would
provide a substantial safety improvement and would be a benefit to residents and guests alike.
VI. Staff Recommendation
Provide direction to staff in continuing to finalize the design and obtain necessary CDOT and
FHWA approval and put the project out to bid for construction in the spring of 2011.
