CONDITION(S):
1. This conditional use permit approval is contingent upon the adoption of the prescribed
regulations amendments modifying the conditional use permit use specific criteria for
beauty and barber shops through the adoption of an ordinance by the Vail Town
Council.
Warren Campbell presented an overview of the staff memorandum. He requested that two
separate motions and votes be made for each application.
Commissioner Viele inquired as to the impacts to Lionshead created by the proposed
amendments.
Warren Campbell explained that staff believed the intent of the 1981 regulations adopted for
beauty and barber shops was maintained through the identification of the Lionshead

Redevelopment Master Plan exhibit identifying the primary and secondary malls within
Lionshead. He added that the proposed prescribed regulations amendments still resulted in a
beauty and barber shops being a conditional use through out all of the Lionshead Mixed Use 1
and 2 zone districts.
Commissioner Cartin stated for the record that he was employed by Vail Resorts, however he
did not stand to gain financially form this application and was able to remain unbiased.
Dominic Mauriello stated that the applicant agreed with staff's recommendation and had a
presentation if necessary. He made himself available for questions.
Commissioner Rediker stated that he had done some research in the Colorado Revised Statues
regarding the definitions for beauty shops /salons and barber shops. The CRS identifies them as
very distinct land uses. He highlighted that todays beauty shops tend to have significant retail
components with distinguished them from barber shops. He suggested that there should maybe
be two distinct defined land uses verse the combined current definition. Additionally he was
concerned about the referenced map in the Lionshead Redevelopment Master Plan clearly
identifying the primary and secondary malls. He concluded by stating that he did have questions
regarding the future changes on West Lionshead Circle when /if Ever Vail was constructed and
operational.
Warren Campbell responded that the zone districts in the Town Code identified the land use as
beauty and barber shops in conjunction when listed. Mr. Campbell stated that he understood the
differences between the land uses, however, there has been no instance, to the best of his
knowledge, where a potential business or property owner has tried to debate the existing Code
definition for a beauty and barber shop. Staff believes the definition has served the community
to date, and revising the definition to separate the two or expand upon could easily be done.
Dominic Mauriello reminded the Commission that what was being proposed was an amendment
to allow a business or property owner to to apply for a conditional use permit verse not be
allowed to apply based on the existing provision. The proposed language would still give the
Commission the ability to determine if a specific space was appropriate for a beauty or barber
shop.
Commissioner Kurz suggested that the proposed regulation amendments were appropriate as it
allowed a business or property owner to ask the Commission if a particular location was
appropriate for a beauty and barber shop. He would like to avoid restricting the ability to ask the
question of appropriateness for the land use. He further add, that the current beauty and barber
shop industry and business plan varies so greatly that he never knows what he will find when he
goes to get his hair cut. Some business have no retail and others have clothes, cosmetics, and
other beauty supplies.
Commissioner Schneidman inquired as to how Salon Axis was previously located in the Marriott
which is in the adjacent structure.
Allison Kent, representing the applicant, stated that the salon existed prior to the rezoning of the
Marriott to Lionshead Mixed Use 1, which resulted in it being allowed to continue as a legal non-
conforming use.
Commissioner Rediker suggested that the definition should be broadened and the two land uses
separated since they are different.

Commissioner Kurz stated that the traditional main street barber shop is phasing out to new
business models. He reiterated that he wished to see it beauty and barber shop proposal to be
evaluated with regards to its merits through the conditional use process.
Commissioner Viele made motions per the staff recommendations with the addition of a request
for staff to revise the definitions of beauty and barber shops when appropriate in the future.

Commissioner Pratt inquired about the a -frame sign in front of Solaris advertising parking and
pricing.
Warren Campbell explained the previous outcomes of the December 7, 2010, Town Council
hearing where staff was instructed to draft an emergency ordinance for review on the 21S
allowing for a 60 day time period for signs similar to the one displayed at Solaris. During this 60
day period staff would be bringing proposed amendments to Title 11, Sign Regulations, Vail
Town Code. The Commission will see these amendments on January 10, 2010, public hearing.

RE- VITALIZATION PROJECT
PROJECT DESCRIPTION:
In September of 2010, the Vail Valley Foundation identified a need to re -look at the
existing Gerald R. Ford Amphitheater and focus on efforts to properly position the
venue for the future of the Vail Valley. In doing so, it became eminently clear that
the value and importance of the GRFA is in direct correlation to the lower bench of
Ford Park.
The GRFA is in all reality placed in the center of a park. That park experience is
less than desired, and by looking at not only the GRFA and its role in the vitality of
the community, we must also look at the entire look and function of the Ford Park.
To that end, the VVF commissioned architect Gordon Pierce to draft a concept
that would allow Ford Park to truly become the park it is intended to be. The
project includes the following elements:
• A new and expanded entrance to the GRFA allowing for larger social
gatherings within the venue as well as a more pleasing "curb appeal"
• A new tiered lawn component at the GRFA to better serve our aging
guests
• A 40 x 100 foot informal "pavilion" located near the Betty Ford Alpine
Gardens to function in the place of temporary tents. This venue
would be open sided, without utilities other than electricity and
located near the creels to maximize the experience
• Expand the garden experience of the Betty Ford Gardens from one
end of the lower bench to the other
• Build a walking path that continues from the existing Village path
along Gore Greek to run throughout Ford Park
• Create a sense of entry at the west end of the park with an
information /guests entry
• Re- direct traffic use of the existing path to better serve pedestrians,
golf cart and needed vehicular access
BENEFITS OF THE PROJECT TO TOWN OF VAIL:
• The Amphitheater is one of the driving economic engines of Vail for the
summer season with over 6o performances in a 3 month span
• By expanding /changing the entrance of the GRFA, we provide an
opportunity to expand the uses of the Amphitheater during non

performance days and hours by offering a food a beverage experience for
park attendees
* By looking at the lower bench of Ford Park in the same way we look at
Central Park, these new amenities and experiences allow a guest to
really visit the park and gardens, rather than a single entity located on
the lower bench
• The Pavillion allows for greater uses of all that already exist in the park,
including weddings for the Betty Ford Gardens, rehearsal space for the
Orchestras and dancers using the GRFA, informal meeting spaces for
community uses and groups that have come to Vail for meetings, etc
• The Park itself becomes an experience to be visited in Vail, rather than a
location to pass through to arrive at a function within the park.
TIMELINE /COSTS:
• Total expected costs of the project are just under sio million dollars with
roughly a little less than 1 /Z of that identified as GRFA improvements
• The VVF would lead a fundraising effort to raise the funds for the GRFA
improvements as they have in the past.
• The project could begin in the fall of 2011, with potential staging of
construction over a 2 year period

SUBJECT: Formation, Function and Purpose of the Vail Local Marketing District and the
Town of Vail Commission on Special Events
The purpose of this memorandum is to provide the Town Council (the "Council ")
with some background as it relates to the formation, function and purpose of both the
Vail Local Marketing District and Town of Vail Commission on Special Events.
I. The Vail Local Marketing District (the "VLMD ")
The Vail Local Marketing District (the "VLMD ") is a Colorado Special District and is
governed entirely by a state statute known as the Local Marketing District Act (the "Act ")
(C.R.S. § 29 -25 -101 et seq.). Any and all powers of the VLMD are set forth in the Act.
(See attached C.R.S. § 29 -25 -111). The Council currently serves as the VLMD Board
of Directors.
The VLMD was established in 1999 following the process required by the Act.
Generally, the process involved a petition, the passage of an ordinance and the
submission of a lodging tax question to the electorate. (See attached Ordinance No.
21, 1999, and the 1999 ballot measure). The boundaries of the District served by the
VLMD are the boundaries of the Town of Vail.
The Legislative Declaration of the Act provides, in pertinent part, that the Act is
intended to "promote the continued vitality of commercial business areas within local
governments . . . and is essential to the continued economic growth of the state."
(C.R.S. § 29 -25 -102). The powers of the District as set forth in the Act include,
"To provide any of the following services within the district:
(A) Organization, promotion, marketing, and management of public events;
(8) Activities in support of business recruitment, management, and
development; and
(C) Coordinating tourism promotion activities.
(See attached C.R.S. 29 -25 -111, General Powers of District).
The only prohibition the Act places on the use of the restricted tax revenues in
performing the services set forth above is that no revenue collected from the marketing

tax may be used for any capital expenditures, with the exception of tourist information
centers." Id.
Finally, the Act allows the VLMD Board of Directors to "appoint an advisory board
of owners of property within the boundaries of the district and provide for the duties and
functions thereof." (C.R.S. § 29- 25- 111(1)(g)). This is important because the 1999
ordinance creating the VLMD expressly provides that the Town Council would serve as
the VLMD board only until a permanent one could be appointed.
Today the Council still sits as the Board of Directors of the VLMD. However, all
functions of the VLMD are actually performed by the above - referenced advisory board.
(the Vail Local Marketing District Advisory Council or "VLMDAC "). (See attached
Ordinance 21, 1999).
The current mission statement of the VLMD is "to market and promote Vail to
attract destination overnight guests primarily during the May — October time frame,
creating economic vitality by increasing the visitor base and sales tax revenues."
II. The Commission on Special Events (the "CSE ")
Unlike the VLMD, the CSE is a Town of Vail board or commission and not a
statutory entity. The CSE was established in 2002 by the Council and is governed
entirely by the ordinance the Council adopted in creating it. (See attached Ordinance
No. 7, 2002). The CSE has only the powers given to it by the Council, which can be
amended from time to time at the pleasure of the Council. The Town Charter allows the
Council to create and /or abolish boards and commissions of this type at will.
The function of the CSE as set forth in the ordinance is "to support the town
council's goals and objectives and align its mission with the town council's marketing
direction. The functions and /or duties of CSE shall include, but are not limited to: hiring
and overseeing a director and /or staff, as well as event producers and /or promoters;
creating, funding and seeking special events for the town of Vail; evaluating event
applications and event success; submitting an annual budget for operations and events;
coordinating the community calendar for special events; seeking out additional funding
for special events through sponsorships and donations; evaluating and executing
contracts for special events; and all other functions as directed by the town council."
The current mission statement of the CSE is "to support and assess a diverse
collection of special events, both large and small, which promote Vail's economic
vitality, sense of community, and increase the quality year -round of the experience for
guests and residents."

AN ORDINANCE CREATING THE VAIL LOCAL MARKETING DISTRICT.
WH1;RTsAS, 'Title 29, Article 25, known as the "Local .Marketing District Act," provides that
local governments have the power to create and establish Local Marketing Districts; and
WITERE'AS, such Local Marketing Districts have the power to provide the following
services:
• Organization, promotion, marketing, and management of public events;
• Activities in support of business. recruitment, management, and development;
• Coordinating tourism promotion activities; and
WHEREAS, petitions for the organization of the Vail Local Marketing District ( "District'`)
within the Town of Vail, Eagle County, Colorado have been filed in the office of the Clerk of the
"town of Vail; and
WHEREAS, Scction 29 -25 -101, et. M., C.R.S., requires a public hearing by the Vail Town
Council to consider if the petitions have been signed and presented in conformity with the Act, and
all other applicable provisions of the Act have been satisfied; and if so, to approve the organization
of the District.
NOW THEREFORE, BE 1T ORDANED RY TIII; "TOWN COUNCIL OF THE TOWN OF
VAIL, COLORADO, THAT:
Section 1.
The name of the proposed District shall be "Vail Local Marketing llistrict ".
Section 2.
There shall be submitted to the registered electors of the Town of Vail. Colorado at the next
general election to be held on November 2, 1999, ballot questions establishing the District and a
new marketing and promotion tax on the purchase Price paid or charged to persons for rooms or
accommodations at a rate not to exceed 1.4 % and whether the proceeds of such tax shall provide
revenue for organizing and operating the district and furnishing services. All registered electors
of the Town of Vail shall be entitled to vote at such election.

The Vail Town Council shall constitute the exofficio board of directors of the District until
appointment of the permanent board of directors of the District pursuant to Section 29- 25- 108(b).
Section 4.
The boundaries and service area of the District shall be the present legal boundaries of the Town
ot'Vail, Colorado, as more specifically illustrated on the Town Map on file in the Office of the
Town Clerk and as shown in the Public Records of the County of Eagle, Colorado.
Section 5.
'file term of the District is an indefinite term and shall continue until repealed, rescinded or
terminated by the Vail Town Council through the adoption of an Ordinance repealing, rescinding
or terminating said District; and upon such dissolution all assets of the District shall be
distributed to the Town of Vail.
Section 6.
The District shall have all powers granted by the Local Marketing District Act, Section 29 -25-

The District shall constitute a separate political subdivision and body corporate of the State and

Section 8.
On the conclusion of the public hearings required by the Act, the Town Council finds:
(a) that the petition submitted for the organization of the Town of Vail Local
Marketing District is signed in conformity with the Act;
(b) that the signatures contained on the petition are genuine and meet the
requirements of the Act;
(c) that there is no property within the boundaries of the district to be excluded

This Ordinance shall finally and conclusively establish the regular organization of the
Vail Local Marketing District against all persons unless an action is filed attacking the validity

(1) The general assembly declares that the organization of local marketing districts having the purposes and powers
provided in this article will serve a public purpose; will promote the health, safety, prosperity, security, and general
welfare of the inhabitants thereof, the property owners therein, and all the people of the state; will promote the

29 -25 -111. General towers of district.
(1) The district has the following powers, except as limited by the operating plan:
(a) To have perpetual existence;
(b) To have and use a corporate seal;
(c) To sue and be sued and be a party to suits, actions, and proceedings;
(d) To enter into contracts and agreements, except as otherwise provided in this article, affecting the affairs of the
district, including contracts with the United States and any of its agencies or instrumentalities;
(e) (I) To provide any of the following services within the district:
(A) Organization, promotion, marketing, and management of public events;
(B) Activities in support of business recruitment, management, and development;
(C) Coordinating tourism promotion activities.
(II) No revenue collected from the marketing and promotion tax levied under section 29-25-112 may be used for
any capital expenditures, with the exception of tourist information centers.
(f) To have the management, control, and supervision of all the business and affairs of the district and of the
operation of district services therein;
(g) To appoint an advisory board of owners of property within the boundaries of the district and provide for the
duties and functions thereof;
(h) To hire employees or retain agents, engineers, consultants, attorneys, and accountants;
(i) To adopt and amend bylaws not in conflict with the constitution and laws of the state or with the ordinances of
the local government affected for carrying on the business, objectives, and affairs of the board and of the district;
and
6) To exercise all rights and powers necessary or incidental to or implied from the specific powers granted in this
article. Such specific powers shall not be considered as a limitation upon any power necessary or appropriate to
carry out the purposes and intent of this article.

AN ORDINANCE ADOPTING THE TOWN OF VAIL COMMISSION ON SPECIAL
EVENTS ( "CSE ") AND; ESTABLISHING A COMMISSION FOR THE PROCESS OF
REVIEWING AND /OR FACILITATING PUBLIC SPECIAL EVENTS IN THE TOWN OF
VAIL;AND SETTING FORTH DETAILS IN REGARD THERETO.
WHEREAS, it is the Town Council's opinion that the health, safety and welfare of
the citizens of the Town of Vail would be enhanced by the establishment of a special
events program setting forth policies and guidelines relating to the funding, reviewing,
oversight and orchestration of special events to be presented in the Town of Vail.
WHEREAS, to insure a single contact point for special event operations in Vail; and
WHEREAS, to be supportive of providing street entertainment and special events
for vitality, economic viability, and fun year 'round; and
WHEREAS, to increase the Town of Vail's lodging occupancy and sales tax
collections; and
WHEREAS, To create a sense of community in Vail and increase the quality of
experience for guests and residents; and
WHEREAS, in order to administer Special Events, the Town Council, in
accordance with Section 8.6 of the Charter of the Town of Vail, wishes to create a
Commission on Special Events ( "CSE ").
NOW, THEREFORE, be It ordained by the Town Council of the Town of Vail,
Colorado, that: Title 3 of the Municipal Code of the Town of Vail is hereby amended by
the addition of Chapter 6, Commission on Special Events, to read as follows:
Section 1. Board Established
The Town Council hereby establishes the Town of Vail Commission on Special Events
( "CSE ") composed of five (5) voting members who shall act in accordance with the
Charter, this Chapter, the direction of the Town Council, as outlined in this ordinance, the
ordinances of the Town of Vail, and shall be appointed and serve at the pleasure of the
Town Council as provided in this Chapter.
Section 2. Definitions
A. Special Event — A Special Event is a function whose primary purpose is to
promote an exciting, lively, fun and /or prosperous business climate within the Town of
Vail.

B. Qualifying Cultural Event — A Qualifying Cultural Event is a function whose
primary purpose is cultural in nature rather than economic. These events are typically, but
not necessarily, held in a performing arts venue such as Ford Amphitheater or Dobson
Arena. The Town Council shall establish by Resolution a non - exclusive list of Qualifying
Cultural Events.
Section 3. Members — Appointments — Terms
The CSE shall consist of five (5) voting members appointed by the Town Council to be
designaled as follows: 1 Retail; 1 Restaurant; 1 Lodging; 1 (from any of 3 categories
previously stated); 1 at large. All five voting members shall be residents of the Town of
Vail, own real property within the Town of Vail, own a business in the Town of Vail, or be
employed within the Town of Vail. No current event promoters, producers or board
members of organizations requesting funding, or their employers, may serve as voting
members. The initial terms of two members of the CSE shall be for one year, and the
initial term of three members shall be for two years, to be appointed in 2002. Thereafter,
the council shall annually appoint CSE members to two year terms every January.
In addition to the five voting members of the CSE, up to ten (10) honorary advisory
member groups may be included by Council invitation. In order to act as an honorary
advisory member of the CSE, each member group shall nominate one representative
within that group to be ratified by Council. Honorary advisory member groups shall be
approved by council and may include:
Vail Resorts, Inc. (VRI)
Vail Valley Foundation (VVF)
Vail Valley Chamber and Tourism Bureau (VVCTB)
Vail Chamber and Business Association (VCBA)
Vail Recreation District (VRD)
Town Council
Town of Vail staff
VLMDAC
Ratified, honorary advisory members shall assist the CSE by providing information,
coordination and consultation and shall not have the power to vote on issues that come
before the CSE. The number and terms of such advisory members shall be at the
discretion of the Town Council. Advisory members of the CSE should be individuals who
have a demonstrated expertise in special event production, establishment of criteria by
which to gauge event success, or knowledge of and /or a strong interest in special events.
Section 4. Removal From Office
Members of the CSE shall serve at the will of the Town Council and shall be subject to
removal by the Town Council for inefficiency, neglect of duty, failure to attend meetings
(70% mandatory attendance at scheduled meetings), malfeasance in office, or any other
reasons the Town Council deems proper.

Section 5. Vacancy
Vacancies on the CSE shall occur whenever a member of the CSE reaches the end of his
term, is removed by the Town Council, dies, becomes incapacitated and unable to
perform his or her duties for a period of sixty (60) days, resigns, ceases to meet the
qualifications for CSE members or is convicted of a felony. Vacancies shall be filled by a
majority vote of the Town Council.
Section 6. Officers - Meetings — Rules
The CSE shall be chaired by the advisory Town Council member until the
commission decides a director is appropriate or decides otherwise as to a different
chairperson. The term of the Chairman shall be for one two -year term to coincide with
the Town's regular municipal election, with eligibility for re- election for three additional
two -year terms. The CSE shall meet as it determines to be necessary, and its meetings
shall be in accordance with Roberts Rules of Procedure unless it adopts other rules for
the transaction of business. Three or more members must vote for any action for it to
pass. The CSE shall keep a record of its resolutions, transactions, findings and
determinations. The CSE will provide quarterly informational reports to the Vail Town
Council, in addition to a full annual financial report at budget time. An annual evaluation
of events shall be included.
Section 7. Functions of the CSE
The CSE shall support the Town Council's goals and objectives and align its
mission with the Town Council's marketing direction. The Functions and /or duties of CSE
shall include, but are not limited to: Hiring and overseeing a director and /or staff, as well

A. An appeal to the Town Council may be made by an adjacent affected
property owner or by the Town Council itself by a majority vote.
B. Any appeal must be filed in writing within ten (10) days following the decision
of the CSE, or must be called up by the Town Council within 10 days of the
decision..

C. The Council shall hear the appeal within 30 days of its being filed or called
up with a possible 30 -day extension if the Council finds that there is
insufficient information.

Michael Imhof presented highlights of the 2010 Vial International Dance Festival which
included total attendance of more than 15,000 and an economic impact to Vail estimated
at $1,045,683. Highlights of the 2010 Teva Mountain games included an 11 % growth in
registrants; 39,000 spectators over the 4 days; 314 million marketing impressions and
community economic impact estimated at $3.7 million. Highlights of 2010 Hot Summer
Nights included continuing to bring locals into Vail to see and catch up with old friends
and enjoy a free concert; largest attendance was 4,600 for BreakEFX; the estimated
community economic impact was $1.4 million. A preview of the 2011 Quiznos Pro
Challenge Bike Race includes expected 120 international world class athletes; 15,000 —
25,000 on -site spectators. Time trial from Vail Village to Vail Pass; an estimated $3 — 6

- Winter Service at Eagle Airport
Adam Sutner of Vail Mountain Marketing gave an overview of winter service at Eagle
Airport including Saturday flights from Cincinnati and Detroit will be discontinued;
Minn /St. Paul service will operate on Saturday from Feb 19 — March 26; Miami will
operate as a daily service Dec 16 — Feb 14 and Thursday — Monday Feb 17 — April 4;
United will operate 5 daily flights from Denver; eleven non -stop markets include Atlanta,
Chicago, Dallas /Ft. Worth, Denver, Houston, Los Angeles, Miami, Minn /St. Paul,
Newark, New York /JFK and New York /LGA; There are 14 daily flights with 5 additional
flights on the weekends; overall seat capacity loss is 3.5% or about 9,000 seats;
Mexicana Airlines back fill is proceeding nicely with UA, AA and CO reacting. More

VLMD Summer Intercept Research Results
Adam Sutner presented the results of the 2010 intercept research commissioned by the
VLMD. There were 1,200 surveys completed between early June and Labor Day
weekend in both Vail Village and Lionshead. Highlights included an increase in in -state
visitors and international visitors on the radar; Net Promoter Score (NPS) has increased
dramatically in the summer — 2005 was 47, 2007 was 62 and 2010 rose to 72; paid
lodging decreased from 2007; 65% of the respondents stay in Vail an average of 6.3

nights; rest and relaxation remains the main reason for visiting Vail at 55.5 %; 45% of the
respondents feel it is very important to have summer events and they would like to see

and shopping has dropped to the #3 spot; construction has had less of an impact; more
than half of the guests would still come to Vail in the summer if they had to pay a
minimal amount for parking; there was a decrease in high income visitors. The entire

- Financial Reports
Finance Director Judy Camp presented revenue highlights from September 2010. Sales
tax collections for the month are expected to be $761,977 up 2.7 percent from budget
and 1.1 percent from last year. Year -to -date sales tax collections are expected to be up
3.7 percent from budget and up 2.1 percent from last year. Use tax collections as of
October 27, 2010 total $1,014,840 as compared with $672,760 at this time last year and
a full year budget of $600,000... Construction permit fee revenue through October 27,
2010 totals $605,847, down 19 percent from last year. RETT collections through October
27, 2010 total $5,830,251 compared with $3,417,000 budgeted and $2,168,000 at this
time last year. The full year budget for RETT is $4,283,000 and we have surpassed that
by $1.5 million. Across all funds and revenue accounts through September 30, 2010,
total revenue of $40 million is up 19.5 percent year -to -date from this time last year and
up 15 percent from the budget. More details on financial reports can be found on the

- Lodging Occupancy
Lodging occupancy was presented as of September 30, 2010. September 30 occupancy
was 36% vs. 28% last year, up 30% over 2009 while the industry average was only up
16 %. October occupancy is pacing at 19% vs. 17% last year at the same time, up 11 %
over 2009 while the industry average was up 8 %. More details on lodging occupancy

A question for the finance department was raised whether the same store sales report is
still relevant given that there are only 18 businesses in 3 categories surveyed in each
neighborhood. A review will be done and a report will be issued at the next meeting.
