(10 minutes) PRESENTER(S): Molly Eppard, AIPP Coordinator ACTION REQUESTED OF COUNCIL: Listen to staff presentation and update on the public art selected by the Art in Public Places Board for the Lionshead Transit Center. Authorize Town Manager to enter into an agreement approved by Town Attorney for the Lionshead Transit Center public art project. BACKGROUND: Upon approval by Town Council on April 5, 2010 for the budget and contract of the Lionshead Transit Center, AIPP was informed of the allocated amount of $96,000 to be used towards public art within the Lionshead Transit Center budget. Several public AIPP meetings from November 1, 2010 until the present, including a DRB meeting on December 1, 2010, ensued discussion of the Lionshead Transit Center public art opportunities. A call to artists for a request of qualifications with parameters including aesthetics, budget, materials, fabrication, installation, and maintenance was issued on February 10, 2011. After the review of over 90 artist submissions, three finalists were selected to present their proposals to the AIPP Board. In a meeting on June 10, the AIPP Board selected the proposal by artist Michael Krondl for the Lionshead Transit Center. STAFF RECOMMENDATION: To move forward with the public art project for the Lionshead Transit Center created by artist Michael Krondl, as selected by the Art 6/21/2011 in Public Places Board. 4. BACKGROUND ON VLMD 2011 MARKETING CAMPAIGN The mission of the Vail Local Marketing District (VLMD) is to market and promote Vail to attract overnight guests primarily during the May — October time frame, creating economic vitality by increasing both the visitor base and sales tax revenues. She identified that the regulations state that the garage gets deducted, then the portion of the lowest level below grade, including the garage if on that level, gets deducted. She stated that Rollie Kjesbo and David Viele, former PEC members, were present to show their support of Kathy's interpretation of the GRFA regulations. She further stated that Staff's interpretation was incorrect and created inequity among properties. She stated that she discussed this issue with two former council members who remembered the debate about only one level of a structure being allowed a basement deduction, but they did not remember a discussion about how garages on the lowest level are calculated. He stated that his house was calculated using a third methodology. Rollie Kjesbo, former member of the PEC, stated that he was involved in the amendments to GRFA regulations. He said that the regulations intended to follow Kathy's appeal. Commissioner Hopkins returned shortly after the appellant's presentation. Commissioner Pierce stated that in his experience, the regulations have been consistently applied by Staff. He asked about the possibility of a negative GRFA on the lowest level. Kathy Langenwalter stated that the point of the amendments was to be equal not to be unequal. Bill Gibson added that the rules are applied the same, but the outcomes are different due to the different topography of lots. Kathy Langenwalter stated that the contention is with the deductions. Commissioner Pratt asked about how the below grade percentage is calculated with a party wall. Gibson responded that the below grade percentage is calculated by the exterior walls of the structure. Kathy Langenwalter stated that if you have to remove the garage from the lowest level, having a garage in that location is going to lower the basement deduction. Commissioner Pierce stated that the GRFA calculations should result in the same number for uphill and downhill lots. Commissioner Pratt stated that with David Viele's home, the deductions appear to have been applied using Staff's methodology. Commissioner Pratt stated the ordinance needs to be clarified, but that the Staff's intent is correct. He noted that the deductions appear to be listed in order, and the appellant's methodology was not the intended method. Kathy Langenwalter noted that the calculations should be the same for both uphill and downhill lots. Commissioner Kurz asked Kathy Langenwalter if she thought the intent of the regulations was to prevent garages from creating larger floor areas. Kathy Langenwalter stated that garages can exceed the deduction amount, which would counts towards GRFA. Pa gg 6 6/21 /2� 11 2 -1 -6 Commissioner Pierce stated that inequity should not occur and that this inequity should be fixed. Commissioner Cartin express concern about lowest level counting as a negative GRFA number, and suggested that basement deduction be capped at 100% so the GRFA is not negative. . Commissioner Pierce stated that it is ok to have a negative GRFA in a basement because overall it comes from the total GRFA. Commissioner Cartin stated that the garage and basement are two separate entities and that are used differently. Commissioner Pierce stated that if you remove the deductions from total GRFA, it will remove inequities. Kathy Langenwalter stated that all levels get calculated together, then deductions occur. Commissioner Pratt stated that there are holes in the regulations, but Staff has applied the rules consistently. Gibson stated that Staff has been interpreting the regulations as the Town Council directed. He stated that Staff recommends the PEC upholds Staff interpretation However, if the PEC disagrees with the current policy, they should recommend amending the code, rather than re- interpreting the code. Commissioner Pierce stated that Staff has applied the rules consistently. Commissioner Kurz stated that the regulations should be amended. He noted concern about the legal impacts of deciding that the code has been misinterpreted since its adoption seven years ago. Commissioner Pratt clarified that the appeal requires the PEC to determine if the policy implemented by Staff does, or does not, align with the code. Kathy Langenwalter stated that former council member Diana Donovan agrees with her interpretation and the council wouldn't have adopted a regulations that wasn't equitable. Bill Gibson stated that the effects of the same basement deduction rule are different for different properties and that these issues were discussed by the Town Council in 2004. Commissioner Kurz asked procedural questions. Commissioner Pierce stated that a new ordinance should change the policy to equalize the uphill and downhill lots. Pa gg 7 6/21 /2� 11 2 -1 -7 He agreed with other Commissioner comments that the deductions are listed in order in the code. He also agreed with Commissioner Kurz's comments. Commissioner Kurz again expressed concern about disregarding seven years of consistent implementation. Commissioner Schneidman that is difficult to uphold or overturn Staff's interpretation because the code isn't clear. He stated that legally speaking, just because the code doesn't say something, doesn't mean the opposite is true. Kathy Langenwalter asked where the ambiguity is and Commissioner Kurz responded with "your presentation." Commissioner Pratt brought up the equality issue again. He stated he wants the Town Council to determine their intent was equality among all lots. Kathy Langenwalter stated that she wanted to clarify that the garage wouldn't be deducted twice, but that garage would be included in basement deduction. Commissioner Hopkins clarified that Langenwalter wants clarity and equity. Kathy Langenwalter stated that the garage should be counted towards the basement deduction. Bill Gibson stated that should the PEC wish to change the policy, then the PEC should recommend amending the code. Gibson asked the PEC if the proposed policy change would also apply to crawlspaces, attics, employee housing units, and other deductible floor areas that may be located on the lower level of a building. Commissioner Cartin stated that the scope of review of this appeal should be limited to garage and basement deductions, and not equity among different lots. Commissioner Kurz made a motion to overturn staff's interpretation and to forward a recommendation for amendments to the code. Commissioner Pratt seconded the motion. Commissioner Kurz was asked about the intent of the motion. He clarified that he intended to uphold the Staff's interpretation but the code should be amended. After the review of over 90 artist submissions, three finalists were selected to present their proposals to the AIPP Board. In a meeting on June 10, the AIPP Board selected the proposal by artist Michael Krondl for the Lionshead Transit Center. The viewer will see a panorama of the valley that approximates the view if the building (and other man -made structures) were absent. The piece will be approximately 7 by 37 feet size made up of 10 -12 panels of laminated float glass bolted to the wall. Conceptually the piece works in several ways. Its primary impact is one of erasure, as if part of the building had been made to disappear, or as if a window now allowed you to peer directly through the garage structure revealing the ravishing view that it blocks. As the architects note in their rationale for the rebuilding of the Transit Center, part of their motivation was to reintegrate the structure back into the landscape, to "engage with nature" and "focus on the mountain." My piece does this in an immediate and graphic way. This act of erasure has been a recurring theme in my work over the last dozen years. Another way in which the piece works is as a reminder of the passage of the seasons. While in the winter, the trompe I'oeil effect is dominant, in the summer, the image serves as a sort of souvenir, a window into another time. The visitor may see this is an echo of the season past or, equally, as a teaser for the upcoming winter season. For visitors entering and exiting the garage, there is a physical interaction as well. Mounting the stairs is a little analogous to climbing the mountain: as you go higher you leave the town behind and are surrounded by trees with ever more expansive views. As you descend the effect is reversed. While Vail has an impressive collection of public art, photography is woefully underrepresented. This is no doubt due to the technical issues of the past, which used to make it difficult to reproduce large -scale photos on a durable, material. Now due the advances of digital 6/21/2011 3 -2 -1 L imaging this is no longer an issue. Of course photography was enormously influential in introducing the Rockies to Easterners some 150 years ago. On some level, my piece is also an homage to those intrepid photographers with their glass plates. Even the technique used to produce the installation is reminiscent of the heavy negatives that were once hauled up mountain peaks, and the result will not be unlike the hand - colored photos that brought the awe - inspiring landscape that surrounds present -day Vail to the attention of the world. Finally, from a purely graphic standpoint the grid of the trees echoes both the materials and lines of the building. Previous Experience I have worked on several large -scale projects both in the United States and abroad. In terms of budget and materials, the project I did for New York's Metropolitan Transportation Authority in 2004 comes closest. There the material was beveled glass and the budget $44,000. The project involved working with the MTA, fabricators in Pennsylvania and Minnesota and an installation crew in Brooklyn. Other projects I have worked on have had more modest budgets (ranging from $2000 - $24,000) but have often involved even more complex logistics. (For example, I had to supervise the creation and installation of a 56 by 36 foot artwork, that was mounted several stories up on a building close to New York's former World Trade Center.) Materials and Fabrication To fabricate the piece, I would like to use Mayer of Munich, one of the world's top fabricators working in glass and mosaic. The German company has an impressive record of making pieces for challenging environments, whether the Arab dessert, a Florida airport or the New York City subway. I have worked with the company in the past and found that they are remarkably adept at translating the artist's vision into permanent art works. I would travel to Munich to supervise the crucial stages of the fabrication process. The medium in this case would be laminated float glass 5/8 -inch thick. The glass is tempered and laminated and fulfils the European Safety Code for outdoor glazing. 6/21/2011 3 -2 -2 J Technically, the process of creating the image takes several steps. First a screen print is applied to a piece of clear glass (a little like those negatives of the early era of photography), the image is then hand - tinted and then finally sandwiched with a piece of opaque white glass. This is then heated in a kiln to completely fuse the two pieces. The colors are as light resistant as you can get. To quote the company: "the ceramic melting colors are based on metal oxides, which can chemically not change due to UV- Lighting. There is no other color in the world which is as UV- resistant as our melting colors." The glass will be bolted to the wall, either directly or by way of a support frame —after consulting with the building's engineers. I currently anticipate the areas not covered with the image to be covered with the flagstone used for the remainder of the building but concrete is also a possibility. Glass, as is evident from at least one public art piece in Vail, is highly permanent, strong and very easily cleaned. (Consider the tempered glass used in trains, cars —and Vail's gondolas —but four times as thick!) This is one reason that New York's MTA has worked with Mayer of Munich on projects both indoors and out. There are probably few places in the world as subject to vandalism as the New York subway, yet these very thick sheets of glass hold up. Though the temperature extremes in Vail do mean that issues of expansion and contraction have to be taken into account in the mounting process, glass is highly resistant to temperature extremes as is evident from the thousands of square feet of glass all around Vail. Once the regulations are established, a lottery will be held with the publishers to determine which publications are placed in the newsracks. The major change to the newsrack regulations is the definition of publication, which is more narrowly defined than in previous regulations. New newsracks will be ordered after the lottery process and will be installed in the Fall. II. ATTACHMENTS A. Proposed Newsrack regulations 621 2011 -1 -i AN ADMINISTRATIVE HEARING TO REVIEW THESE PROPOSED REGULATIONS WILL BE HELD ON WEDNESDAY JUNE 29 AT IPM Town of Vail Newsrack Regulations Effective July 4, 2011 THESE REGULATIONS (the "Regulations ") are hereby adopted this day of , 2011, by the Town Manager of the Town of Vail pursuant to Section 8 -6 -4 of the Vail Town Code (the "Code "). These regulations on time, place and manner are necessary to carry out the purpose and intent of the Code and are not intended to impose any prior restraints on materials protected by the United States Constitution. I. Purpose and Intent A. In 1999 the Town of Vail (the "Town ") adopted Ordinance No. 20, Series of 1999 (the "Ordinance ") which set forth certain time, place and manner restrictions relating to the placement of newsracks on Town owned property and public rights -of -way. Among other things, the Ordinance established two specific Newsrack Boundaries (the "Boundaries ") in Vail Village and Lionshead respectively. For the reasons set forth in the recitals of the Ordinance, and incorporated into these regulations by this reference, the Town has a continued obligation and responsibility to regulate newsracks located on Town owned property and public rights -of -way for protection of the public health, safety and welfare. B. In connection with the adoption of the Ordinance, the Town established various newsrack "clusters" within both of the Boundaries. The clusters as they currently exist are shown in the attached Exhibit A . C. Recently the Town conducted an audit of all the newrsack clusters located within the Boundaries in an effort to determine compliance with the Code and to determine the amount of available newsrack space in each cluster in relation to the current demand for available newsrack space within the Boundaries. IL Regulations A. Definitions: For purposes of these regulations: "Publisher" means the person or entity who pays to have a publication printed or otherwise causes a publication to be printed or otherwise reproduced. "Publication" means a periodical which (a) Is published at least two times a year in different issues with sufficiently different content or format so each issue can be readily distinguished from previous or subsequent issues; and (b) Is published as a stand alone publication that is not included as an insert in other publications at any time (c) Is a minimum dimension of 7.5 inches wide and 11 inches tall and (d) Is formed of printed 6/21/2011 4 -2 -1 sheets. The sheets may be die cut or deckle - edged, and may be made of paper, cellophane, foil, or other similar materials. 54 B. Initial Lottery Requirements: 1. Publishers who wish to enter publications into the initial newsrack lottery shall make a request in writing to ssilverthornLvailgov.com prior to 12:00 p.m. MST on TBD. The request shall set forth the name of the publisher, name of the publication, size of the publication, frequency of the publication, whether the publication is a paid or free publication, and shall specify the requested clusters, as detailed on Attachment A. 2. Each publication can request up to one space per cluster. 3. There is no limit to the number of publications per publisher. 4. A lottery drawing will be held on TBD, at 1pm in the Vail Town Council Chambers. There will be two tiers of lottery drawings for each cluster. The first tier of drawing will be for publications that are published at least once per month. The second tier of drawing will be for publications published less than once per month, but at least twice per year, per the definition of a publication. 5. Publication names will be drawn and publishers may choose their location within the cluster in the order their publication is drawn, until no spaces within the cluster remain. 6. Publications not selected for spaces within a cluster will be drawn to determine the order of the cluster waiting list. 7. Should additional spaces remain, publishers will be permitted to reenter their publications into the drawing for each cluster. However, no duplicate publications are permitted within the same cluster. C. Additional Lotteries: The Town of Vail will hold a lottery every three years only if at least six (6) publishers provide written notice to the Town of Vail of their desire to hold the lottery by June 1 of the lottery year. D. Request for vacant space: 1. Should any cabinet within a newsrack become vacant, the Town of Vail will select the first person on that cluster's waiting list. Should there be no publications on the waiting list, the Town of Vail will hold a lottery within 30 days of vacancy to fill the space with a publication not already located within that cluster. 2. Any publisher interested in vacant newsrack space shall make a request in writing to ssilverthornLvailgov.com prior to the date posted. The request shall set forth the name of the publisher, name of the publication, size of the publication, frequency of the publication, whether the publication is a paid or free publication, and shall specify the location(s) within the cluster(s) for which application is made. 3. Requirements for Newsracks: 1. Coin Lock Mechanism: Should the publisher change a fee for the publication, the Town of Vail will supply a cabinet that is compatible with a coin lock mechanism. However, the publisher is required to supply and maintain their own coin lock mechanism. Notification of the desire to have a coin -op compatible unit must be made at the lottery. 2. Exterior signage on cabinets: The Town of Vail will place signage on the exterior of the cabinet in cooperation with the publisher. The signage shall be the minimum amount necessary to display the name of the publication. The publisher shall not place anything on the exterior of the cabinet. The Town shall determine the uniform size, color and font of the publication name. 3. One cabinet per publication within a cluster: Each publication shall be eligible for only one cabinet in each cluster. A publisher with duplicative publications within any one cluster must remove one of the publications if notice is given to do so. Notice may be given by the Town and if the publisher fails to remove the duplicative publication, the publication may be removed pursuant to Section 8 -6- 10 of the Code. 4. Change of location within a cluster: No location changes are permitted, unless changed during the regularly scheduled lottery process. 5. Change of publication: Publishers are not permitted to change publications within an individual newsrack cluster or cabinet. 6. Type of cabinet: The Town of Vail will have final determination of which publication is eligible for which cabinet type. 7. Maintenance of boxes: The publisher shall maintain the interior of the cabinet to be free of old material, stickers or any other unapproved materials, and shall maintain all mechanical workings of the individual box, including, without limitation, the window and face plate, the coin mechanism, the coin tray, and the lock, if any. The Town of Vail is responsible for the maintenance of the exterior of the cabinets and pedestals, including painted surfaces, door springs, hinges, and view panels, anchor points, and fasteners. 8. Publication in the face plate: The publisher shall maintain a copy of the publication within the box vertically inside the face plate so it is visible to customers, and shall not place anything other than the publication in said location. Any publisher that does not maintain a copy within the face plate for more than 15 days may be removed from the cabinet space. 9. Occupancy Requirements: Permission to occupy a newsrack may be revoked, as set forth Section 8 -6 -10 Vail Town Code if the newsrack in question is not stocked with the subject publication for a period of fifteen (15) days or more, or if the interior of the cabinet is not maintained. 10. Disposal of Publications: Old or out -of -date material removed from any newsrack by any person who owns, maintains or stocks the newsrack shall be recycled or disposed of in a lawful manner. Such material shall not be disposed of on -site in any trash or recycle receptacle owned or rented by others including the Town, without the express written consent of the owner or renter of such receptacle. 11. It is prepared monthly by town staff in conjunction with MTRIP, and is intended to provide summary information for town management, Town Council, the Vail Economic Advisory Council (VEAC), and Vail Local Marketing District Advisory Council (VLMDAC). 1. Series One is an "All Store" series of sales tax collections from all businesses. The report series is best used to evaluate total sales activity for the current season, compared to last season, and is broken down by both geographic and business segments. 2. Barnes explained there are 23 properties in Vail that submit their lodging information to MTRIP. Since new properties, the Four Seasons and the Ritz - Carlton, have not been operating for a full year their data was not incorporated in the MTRIP update. There was a 1 % increase from last year in the months of January, February and March. December thru March occupancy and rates were both up. Greg Moffet thought this was great news. December, February and March occupancy was above other mountain destinations. Barnes reviewed the Town of Vail Sales Summary which was provided in the committees' packets. This monthly Sales Tax Collection Summary provides both graphic and brief supporting narrative summaries of sales tax collections for all stores and gross sales for a sample of 36 businesses in 3 categories (restaurant, retail and lodging) in both Vail Village and Lionshead in the Town of Vail. It is prepared monthly by town staff in conjunction with MTRIP, and is intended to provide summary information for town management, Town Council, the Vail Economic Advisory Council (VEAC), and Vail Local Marketing District Advisory Council (VLMDAC). Winter total sales tax collection and gross sales to date are up in all categories. The summer months show both occupancy and rates up, but full bookings are not really good at this time. Vail's summer occupancy is below some mountain destinations. While Vail ranks 1 St or 2 nd in winter months, it ranks 3 rd or 4 th in summer months. Brett Schoenfield stated his hotel is seeing groups booking their events three weeks prior to the event date rather than booking their events far in advance. Laurie Mullen pointed out Vail has more lodging capacity than some of the other mountain destinations, such as Telluride. Steve Rosenthal would like to see an event happen on Memorial Day weekend. Rayla Kundolf said it was difficult to find an event promoter for that weekend. Rosenthal thought maybe the Town could put the event on and just commit. Schoenfield mentioned 4 th of July is on Wednesday, next year due to a leap year and maybe it would be a good idea to work on ideas to help with that difficult booking time. • Conference Opportunity: Rob Levine spoke to the committee about the Denver Metro Leadership Foundation two -day conference, the Colorado Experience, he attended in Colorado Springs. The program brought 140 Denver -area leaders to discuss the economic impacts of Colorado Springs. Levine thought the Foundation would be interested in coming to Vail in 2012. Levine went on to say it would be an opportunity to heighten awareness on tourism, water shed, environment and education on the western slope. Michael Kurz thought it was a great idea and suggested Levine start with the VLMDAC, VVP and Vail Chamber & Business Association. • Conference Center Funds Update: Finance Director Judy Camp presented the Town Manager's memorandum to Town Council, which was provided to the committee in their packets. The Memorandum dated June 1, 2011 6/21/2011 4 -4 -1 outlined the project recommendations for Conference Center funds election. Camp discussed the summary of project costs and funding for recommended projects. Also outlined were the several additional projects that had been identified that complement the proposed Ford Park improvements. Camp stated this ballot issue is different from many others in that the Town was not asking for a tax increase, just what is the best use of the money already collected. Rosenthal suggested not talking about the ancillary projects at all so there would be no confusion. Kundolf said the most important thing is to make sure people know if the $9.4 million doesn't get spent — you lose it. Schoenfield suggested Suzanne Silverthorn do a communication to the Vail residents about the polling that will be done so that voters know the polling is legitimate. Financial Reports: Camp presented the revenue highlights from April 2011, which was provided in the committees' packets. Camp stated that April sales tax was up 2.4% from last year. The ski season to date (November - April) is up 11.3% from prior year. Ski Season Lift Tax is up 11.1% from last season, which compares favorably with the 9% increase in skier visits reported by Vail Resorts. RETT collections through May 30 were down 7.6% from this time last year, but are still expected to meet the full -year budget of $4.7 million as compared to $6.1 million for the full year in 2010. Across all funds and revenue accounts through May 31, 2011, total revenue is up 1.2% year -to- date from this time last year and up 3.5% from the budget. • Citizen Input: None • Other Business: Kundolf informed the committee she was working with Cascade to host variety shows July — August. The shows will be featuring 15 kids from the Valley who she has been working with since they were in high school. The shows will have guest artists and local celebrities. Kurz reported a new business will be opening in the Village on Gore Creek Drive, Vail Fine Wines and Sushi Oka & Hibachi is now open in the space previously occupied by To Catch A Cook. Mullen inquired about Timber Ridge. Camp explained the developer financing has been held up at HUD due to a number of changes at HUD. The pre - development agreement between the Town and developer expires in November 2011. Economic Development Manager Kelli McDonald informed the committee of a new web page Silverthorn has called vaileventparking.com which provides a map of the bus route and detailed information concerning event parking.
