ITEM /TOPIC: A site visit to Ever Vail to view locations of proposed view corridors in order to address questions raised at the July 19th Town Council public hearing. (60 min.) ITEM /TOPIC: A discussion of allowable uses of Real Estate Transfer Tax (RETT) revenue, in concert with the 2012 Budget process as requested by Council. (20 min.) PRESENTER(S): Kathleen Halloran ACTION REQUESTED OF COUNCIL: Review history of RETT ordinances and allowable uses to provide staff with feedback regarding appropriateness of funding projects within the RETT Fund. BACKGROUND: To be provided in separate memo. STAFF RECOMMENDATION: Provide feedback to staff in preparation of the August 16th capital budget discussion. 4. ITEM /TOPIC: BBQ Lunch with Vail Valley Foundation staff to Celebrate the Teva Mtn. Games(Placeholder) (60 min.) PRESENTER(S): Vail Valley Foundation staff /Town of Vail staff 5. ITEM /TOPIC: Ski Concierge Services Policy Discussion (20 minutes) PRESENTER(S): Rachel Dimond ACTION REQUESTED OF COUNCIL: Staff requests that the Vail Town Council listen to the presentation, ask pertinent questions and provide policy direction on 8/2/2011 ski concierge services. BACKGROUND: Hotels have introduced ski concierge services in close proximity to ski lifts to improve customer service. These ski concierge services often include the temporary outdoor storage of skis and snowboards on rolling racks to facilitate distribution of equipment to guests. Ski concierge services are not contemplated by the Vail Town Code, as this type of service did not exist when the current regulations were adopted As a result, the Town has no underlying policy direction on this subject, and thus, Staff cannot make a determination on how to handle this use. Without clear policy direction, interpretations by Staff may result in arbitrary rulings, inequities, unfairness or inconsistencies. STAFF RECOMMENDATION: The Community Development Department requests that the Vail Town Council provide policy direction and instruct Staff to prepare proposed amendments to the Vail Town Code for review by the Planning and Environmental Commission and the Vail Town Council. 6. ITEM /TOPIC: An update from the Urban Runoff Group on the Water Quality Improvement Plan (WQIP), including recent water quality monitoring activities, Gore Creek reach characterization and assessment mapping, a summary of preliminary findings and observations from the work completed to date and an update on the status of work products and milestones. (30 min.) PRESENTER(S): Linn Brooks, Eagle River Water and Sanitation District ACTION REQUESTED OF COUNCIL: There is no action being requested at this time. BACKGROUND: Unknown impacts to Gore Creek in East Vail, indicated by lack of macro invertebrate diversity, have led Eagle County stakeholders in forming an Urban Runoff Group to develop a Water Quality Improvement Plan (WQIP). The Plan specifies development of a program based upon the analysis of data obtained from sampling sites coupled with data from landowners and property managers, primarily upstream and through the affected areas of East Vail sites. On March 15, 2011, the Town Council authorized $20,000 toward the cost of developing the WQIP. At the June 22, 2011 Planning and Environmental Commission hearing, the Urban Runoff Group gave this presentation to provide the Commission members insight into purpose, goals, and activities of the Water Quality Improvement Plan. 7. Bill Gibson made a presentation per the Staff memorandum. Henry Pratt asked how the Town can make a recommendation since the Town is the applicant. Wendy St. Charles, representative of the Briar Patch Association, stated that the associate is in agreement with the Town's application. Commissioner Rediker asked if the Town has worked out negotiations for the land purchase. Wendy St. Charles responded that most negotiations were completed, but the sale was not complete. Commisioner Rediker asked if the land sale was contingent upon the approval of new parcels and building envelopes. Bill Gibson responded that the new envelopes were not related to the land purchase. P a g e 1 8/2/2011 2 -2 -1 Commissioner Rediker asked if Town Staff determined it was appropriate for a change in building envelopes to be included with the creation of the new parcel. Bill Gibson responded that the creation of the new parcels and building envelope changes was appropriate to be reviewed together as they could be approved independently of each other should the Commission feel that one was appropriate and the other was not. Wendy St. Charles added that the HOA want to amend the parcels and building envelopes prior to the Town seeking to purchase Tract G. Commissioner Rediker asked if the Town Attorney has reviewed whose obligation it is to mitigate hazards. He asked whose responsibility and liability it is for the rockfall hazard today and into the future. Bill Gibson responded he was unsure if the Town Attorney had reviewed that matter. Commissioner Cartin asked what is to the west of the proposed Parcel G. Bill Gibson responded it is a Town of Vail owned open space parcel. Commissioner Cartin asked about the Timber Ridge project hazard mitigation and whether the land purchase means the Town has chosen to mitigate with netting. Warren Campbell responded that any mitigation plans would be reviewed by the Commission at a future hearing as was required by a condition placed on the previous approval. Commissioner Cartin added that any addition and construction that is near the ridgeline and visible from below is not favorable. Wendy St. Charles stated that the HOA worked with the Town to ensure no additional ridgeline development. Commissioner Cartin asked about when there is a hazard, who is responsible for mitigation. Bill Gibson explained the Town Code process and procedures required for hazard mitigation. The Town does not typically mitigate hazards on private property. Commissioner Kurz asked why the hazard has not already been mitigated. Gibson responded that there is no Town Code requirement that the HOA mitigate a hazard affecting a neighboring property. Commissioner Pratt asked what rules the town has to administer and regulate envelopes. Wendy St. Charles stated that the restrictions are on the plat. Commissioner Rediker stated he understands the goals of the homeowners. He stated the Town's portion of the deal is not a good deal. The parcel is being purchased with taxpayer money to mitigate issues that are the responsibility of the current owners. Commissioner Pratt stated that he agrees with Commissioner Rediker. Commissioners Cartin and Hopkins agreed with these statements. Page 2 8/2/20 1 2 -2 -2 George Ruther stated that the Vail Town Council and legal Staff have discussed this issue at length and feel this is an appropriate purchase for the Town. Commissioner Cartin stated that the Commissioners should see the mitigation options for Timber Ridge. He would also like more legal input at a future hearing regarding mitigation liability. George Ruther stated that the Vail Town Council decided to acquire this property in order to have control of the property and determine mitigation versus dealing with another landowner. He stated that it could be a less expensive option than other mitigation methods. Commissioner Pratt stated that this is not a recommendation to the Vail Town Council, but rather a final review and final decision. 20 minutes 2. A request for a recommendation to the Vail Town Council for amendments to the Town of Vail Land Use Plan Map, pursuant to Chapter VIII, Implementation, Town of Vail Land Use Plan, to allow for a land use category change from Medium Density Residential to Open Space; and a request for a recommendation to the Vail Town Council for a zone district boundary amendment, pursuant to Section 12 -3 -7, Amendment, Vail Town Code, to allow for a rezoning from Residential Cluster District to Natural Area Preservation District, located at 1448 Buffehr Creek Road /Lot G, Residences at Briar Patch Subdivision, and setting forth details in regard thereto. (PEC110042) Applicant: Town of Vail Planner: Bill Gibson ACTION: Recommendation of approval MOTION: Kurz SECOND: Cartin VOTE: 5 -1 -0 (Rediker opposed) Bill Gibson made a presentation per the Staff memorandum. Commissioner Rediker asked why the applicant is the Town of Vail, when the property is not currently in their ownership. Bill Gibson stated that the Town can impose zoning on any property owner. He further explained that the plat was noticed prior to the rezoning and with the time spent on the plat the application for the major subdivision "caught -up" with the rezoning application. The intent of the proposed condition was to make any recommendation forwarded by the Commission contingent upon the recording of the related plat. Wendy St. Charles, representative of the Residences at Briar Patch HOA, stated that the contract stipulates rezoning and that she felt it was appropriate for the Commission to consider the rezoning at this time. Commissioner Pratt clarified that the Commission is only making a recommendation to the Vail Town Council, who will determine if the zoning is appropriate for the property. 45 minutes 3. A request for a recommendation to the Vail Town Council on prescribed regulation amendments to Chapter 12 -6, Residential Districts, Vail Town Code, pursuant to Section 12 -3 -7, Amendment, Vail Town Code, to establish a new zone district, Vail Village Townhouse (VVT) District, and setting forth details in regard thereto; and a request for a recommendation to the Vail Town Council on proposed amendments to Chapter VII, Vail Village Sub - Areas, East Gore Creek Sub - Area ( #6), Vail Village Master Plan, pursuant to Chapter VIII, Implementation and Amendment, Page 3 8/2/20 1 2 -2 -3 Vail Village Master Plan, to include recommendations related to a new Vail Village Townhouse (VVT) District, and setting forth details in regard thereto. (PEC110040, PEC110041) Applicant: Town of Vail Planner: Bill Gibson ACTION: Tabled to August 22, 2011 MOTION: Kurz SECOND: Cartin VOTE: 5 -0 -0 Bill Gibson gave a presentation per the staff memorandum. He clarified the intent of the new zone district and that today's hearing was a work session. Mr. Gibson covered several elements of the application that had changed since the Commission had last seen the application. Dominic Mauriello, representing Chris Glavin, owner in the Vail Rowhouses, gave a power point presentation highlighting several suggestions his client has regarding Staff's proposed Vail Village Townhouse District. The presentation included the history of the zoning for the properties, history of the Commission actions on the previous SDD applications and zone district establishment. The presentation covered the architectural standards and guidelines proposed with in the Vail Village Master Plan amendments. The applicant suggested changes to the building step backs, the possible elimination of GRFA and reliance on Design Guidelines, and if that is not palatable why a 1.5 GRFA ratio is appropriate. An argument was made that the bulk and mass created by a 1.5 GRFA ratio was not visually distinguishable from 1.35 or 1.25 GRFA ratios. Junn Dunn, attorney representing Dolph Bridgewater, owner of Vail Row House Unit 11, asked Bill Gibson to clarify that the previous Ordinance that was approved upon first reading on was no longer proceeding forward and had been withdrawn. The application before the Commission was a new consideration of this application. Dolph Bridgewater, owner of Unit 11 in the Vail Row House, spoke to the background on his involvement in the previous applications. He spoke to his notification with regard to the latest application and inability to prepare a response in time for the packets. He has provided a written response to the application for the hearing today. He covered the history of how the application grew from addressing several equity issues to additional development potential. In his opinion this application represents bad public policy. Forcing redevelopment for a non - public goal he does not understand. There is not a stated public goal in conjunction with the application. People visit Vail because of an aesthetic and policy is needed to protect the "historic district" which he believes his property is included within. Commissioner Rediker encouraged Mr. Bridgewater to prepare a statement for the next public hearing. He further questioned if the Town has heard from any other members of these projects regarding their support or lack of support for the application. He felt that it would be appropriate to provide notice to all the properties being considered for inclusion in a new Vail Village Townhome District. Jim Lamont, representing the Vail Homeowners Association, wanted to make it clear that the Board of his association was not taking an official stance on this proposal. He has been speaking to multiple methods of addressing the issues and hand in this application. He highlighted a generational division between older individuals who are reluctant to change and the younger generation seeking a different vision. He stated that we need to think through Vail Village and how we want to see it change and remain intact for future generations, and leaving it intact does not mean leaving it the same. Henry Pratt had to depart at 4:00 pm and was not present for the vote upon the items conclusion. Page 4 8/2/20 1 2 -2 -4 Commissioner Hopkins stated her familiarity with several of the projects under consideration for this new zone district. Many of the projects are condominium ownership and she believe that this needs to be addressed. She believes the zone district should have a basis in a historic vein verse a townhouse district. She is concerned about the two story step back at 20 feet creating an undesirable outcome. She does not believe that the facade articulation will be enough. She does not like the first come first served approached to the front facade. She is also concerned about six story elevation on the rear of the buildings. Commissioner Cartin is complex and not all properties will achieve the same amount of deduction. These properties are townhouse style, not true townhouse development. Are we mashing elements together which will create future headaches. He does not support reducing the step back to 5 -7 feet on the upper floor. These projects are a unique to what is surrounding them from the Village core to Manor Vail. He recommended cleaning up parking easements and public road adjacent to the tennis courts. He is cautious about allowing the buildings to get to much larger. Commissioner Pierce stated that it feels like a project in search of zoning. He will be looking at heights below 43 feet. He suggested that 38 feet is about as high as the projects should get. The result is going to need to be a balance between GRFA, height, setbacks, site coverage, etc. Made a comment about the inset deck and what the Code says about enclosed are being counted towards GRFA and proper design. Commissioner Rediker stated that many of his concerns had been identified by other commissioners. He is not opposed to some additional height and GRFA to accompany redevelopment. He does not believe it is possible to achieve 6 stories at the rear, but the concern is his as well. He would like to understand how the GRFA ratios has been bouncing around over all the hearings. He does not understand why landscaping area is being reduced to 20% from 30 %. He did not understand how a difference in 1.25 and 1.5 GRFA was beneficial beyond additional value to the lots. Commisisoner Kurz identified concerns about the uniformity in the design guidelines creating too much uniformity and that the character of the neighborhood is the difference. He believes the proposal has gone past the scope of the original challenge. He still believes that 1.35 ratio is appropriate and reached after great deliberation. Commissioner Hopkins stated that height is a concern. Jim Lamont mentioned that a future conveyance Chalet Road may need to be addressed by the Town for as part of this application and the overall Village master planning /streetscape process. 20 minutes 4. SUMMARY Council requested a discussion on the allowable uses of Real Estate Transfer Tax (RETT) revenue, in concert with the 2012 Budget process. II. DISCUSSION History of RETT: In 1980 Council had the foresight to pass a 1% real estate transfer tax where the enactment of such a tax is now prohibited by state law. With the establishment of this tax by way of ordinance, Town Council also voted that proceeds would go towards the "purchase of real property, open space and recreational or park purposes," but not employee housing. Since 1980 there have been minor adjustments to the town code wording such as defining individuals responsible for payment, the full meaning of transfer and delinquent collections. In April of 1987, Council passed an ordinance expanding the use of RETT funds to include the improvement of land. In October, 1992 Council passed an ordinance that made it possible to use RETT for "acquisition, improvement and maintenance of real property within the limits of the town or within a mile of town boundaries." (This allowed the town to proceed with the Dowd Junction recreation path). On January 2, 2007 Council passed an ordinance making it possible to use RETT for environmental programs and practices. Below is the current wording in Town Charter 2 -6 -9 regarding the intended uses for RETT proceeds: 1. Acquiring, improving, maintaining, and repairing real property for parks, recreation, open space and similar purposes. 2. The construction, maintenance, and repair of buildings which are incidental to park recreation, and open space land. 3. Landscaping parks and open space. 8/2/2011 3 -1 -1 4. The construction, maintenance, repair and landscaping of recreation paths set forth in the Town of Vail Recreation Trails plan as it may be amended by the Town Council from time to time. 5. Supporting sustainable environmental practices as approved by the Town Council, which may include but shall not be limited to expenditures related to: recycling, forest and ecosystem health, water quality, air quality, noise, wildlife protection, natural resource protection, alternative energy technologies, energy efficiency or any similar purpose as determined necessary for the environmental health and welfare of the Town of Vail, its inhabitants and environs in the discretion of the Town Council. 6. Paying incidental costs and principal of and interest on any funds borrowed for the purposes set forth in this subsection. While Town Council has established these parameters for the use of RETT, there are much broader legal limits. Over the past several years the town has acquired legal opinions which came to the same conclusion: that "there is no limitation in the Town Charter or Constitution on the ability of Town Council to further amend the real estate transfer tax ordinance to alter the purposes for which the real estate transfer tax fund may be used if this presents any limitation on the Council's desired expenditures." Capital Budget Process: The following projects have come up in recent budget discussions and are currently listed in the five -year strategic capital plan as RETT expenditures: • Main Vail round -about pavement apron ($130,000 budgeted in 2012). The purpose of this project is to protect the landscape from cars /trucks over - stepping the boundaries of the street pavement. • Guest Enhancements planning /design ($100,000 budgeted for 2011). This is a portion of costs that would relate to signage of trails, pedestrian pathways and parks /recreation. • Public Restrooms (total budget of $670,000 in 2011). This included two projects, a new restroom facility in Ford Park which staff is comfortable funding from RETT, and a restroom /information kiosk located within the Main Vail Fire Station. While this facility is located directly adjacent to the pedestrian trail, staff is not confident that it meets the criteria outlined above. Staff is asking for Council's feedback on the appropriateness of funding the above projects or any other projects shown in the attachment with RETT dollars. Projects not eligible for RETT funding will be moved to the Capital Projects Fund for consideration during the August 16th capital budget discussion. III. BACKGROUND: Unknown impacts to Gore Creek in East Vail, indicated by lack of macro invertebrate diversity, have led Eagle County stakeholders in forming an Urban Runoff Group to develop a Water Quality Improvement Plan (WQIP). The Plan specifies development of a program based upon the analysis of data obtained from sampling sites coupled with data from landowners and property managers, primarily upstream and through the affected areas of East Vail sites. On March 15, 2011, the Town Council authorized $20,000 toward the cost of developing the WQIP. At the June 22, 2011 Planning and Environmental Commission hearing, the Urban Runoff Group gave this presentation to provide the Commission members insight into purpose, goals, and activities of the Water Quality Improvement Plan. Staff: Bill Carlson, Environmental Health Officer Presenter: Melissa Macdonald, ERWC Executive Director SUMMARY This memorandum is being provided to the Vail Town Council to provide a framework for a presentation by the Eagle River Watershed Council (ERWC) regarding Water Quality Grant Funds from the Town of Vail. The activities are funded by a $90,000 grant a year in advance to be utilized primarily for collaborative action monitoring, technical /engineering analysis, watershed health - based projects, public education and community involvement in the watershed. Significant degradation and impairments have occurred and continue to occur along urbanized areas of Gore Creek. Ascertaining the sources of pollution affecting water quality and biological conditions in specific sites will enable us to structure scientifically based mitigation projects. Sharing the costs of field and laboratory investigations with our partners (CDOT, USFS, ERWSD, UERWA, USGS, Homestake Partners, VR Mgmt., Eagle County, Town of Eagle, Town of Gypsum, Denver Water) leverages our funds and enhances our ability to identify causal factors affecting both water quality and biological conditions at degraded sites on Gore Creek. Information generated from such integrative studies is imperative to ensure a robust future for Gore Creek, home to Vail's gold medal fishery, the TEVA games, the Vail Golf Course, the Betty Ford Gardens and many residents and businesses. II. Copy to: Urban Runoff Group Date: June 22, 2011 Subject: Gore Creek Water Quality Improvement Plan — Status Report Background The primary goal of Water Quality Improvement Plan (WQIP) for Gore Creek is to develop a guide for the design and implementation of site - specific measures to improve stream health as indicated by macroinvertebrate community metrics. The geographic scope of the WQIP includes Gore Creek from the area near the confluence of Black Gore Creek to the mouth of Gore Creek, with emphasis on development of water quality improvement measures for stream reaches through East Vail and Vail Village above Red Sandstone Creek. The WQIP will identify specific measures and strategies to reduce point and nonpoint source pollution including, but not limited to the following: ❑ Stormwater and urban drainage Best Management Practices (BMPs); ❑ Stream habitat and riparian improvement and protection measures; ❑ Community educational programs; ❑ Ongoing monitoring and data collection to support future revisions to the WQIP; ❑ Maintenance programs for BMPs; ❑ Ongoing monitoring to evaluate effectiveness of water quality improvement efforts; ❑ Institutional arrangements for program implementation; and ❑ Identification of funding sources for program implementation. The WQIP will also provide a template for identification and implementation of water quality and stream habitat improvement measures for other areas within the Eagle River watershed. This memo provides a summary of preliminary findings and observations from the work completed to date and an update on the status of work products and milestones. Preliminary Findings and Observations As described under the next header, the compilation of the data needed for the WQIP is mostly complete. Data analysis is currently underway to complete the stream reach characterization, identification of stressors, and identification of specific water quality improvement measures. Preliminary findings and observations from efforts completed to date are as follows: ❑ Water chemistry data collected at sampling sites in Gore Creek over the last 10 years indicates that water quality standards are being met throughout the watershed and that there are no obvious pollutant[s] that chronically exceed water quality standards for aquatic life. ❑ Preliminary snowmelt sampling results show high concentrations of total suspended solids, total dissolved solids (including chloride), and several metals including iron, copper, and zinc in snowmelt runoff before it reached the stream. Additional analysis is needed to determine if these elevated concentrations could have resulted in the exceedance of the instream aquatic life standards. IV LeonardR ice 8/2/2011 6 -2 -1 Linn Brooks June 22, 2011 Page 2 ❑ During preparations of the Stormwater SAP, observations of stormwater sampling locations and stormwater infrastructure indicates that many outfalls discharge directly to the stream without the benefit of BMPs that could help attenuate flows and filter out pollutants. Installation of such BMPs will be important components of the WQIP. ❑ In the process of implementing the Stormwater SAP, we have identified several opportunities for water quality improvements through better and more frequent maintenance of existing stormwater facilities. ❑ Geospatial analyses have identified several potential locations for development of urban runoff detention /infiltration /water quality BMPs in conjunction with the Vail Golf Course Master Plan and with the Frontage Road shoulder widening project that is currently under construction. ❑ Preliminary analysis of macroinvertebrate data collected during the most recent sampling event in September 2010 indicates generally lower Multimetric Index (MMI) scores for many of the sampling locations on Gore Creek and the Eagle River when compared to sampling results from 2008 and 2009. The lower scores could potentially be associated with the impacts from unusually high flows and streambed scouring that occurred during the 2010 spring runoff. ❑ Geospatial data analysis indicates significant degradation of riparian buffer zones along Gore Creek from the confluence of Black Gore Creek downstream to the Eagle River. A healthy riparian vegetation buffer zone, optimally extending at least two channel widths on each side of the stream, is one of the most important elements of a healthy stream ecosystem. ❑ Working with property owners, property managers, and the Town of Vail to achieve restoration of riparian buffer zones along Gore Creek will be a critical component of the WQIP. WQIP Work Status The following outline summarizes the work completed to date for each of the tasks identified in the WQIP Scope of Work. I have also included an update on the anticipated schedule for completion of the work products and milestones associated with each task. Task 1. This summary is intended to provide an overview of recent economic activity and to serve as a benchmark from which future economic activity can be displayed and compared. These seasonal reports began in early 2009 when relevant data was gathered from various secondary sources for the date range of November 2004 through April 2009 and is now updated seasonally. The data is depicted by general category (Tourism, Real Estate, Town Revenue, Business Growth and Macroeconomics) and seasonally (Winter: November — April, Summer: May — October). It is presented in a chart format with this brief summary as a part of the Town of Vail 2011 Economic Development Strategic Plan and is limited in scope and accuracy by the availability of data from secondary sources, thought to be accurate but not independently verified and is best used as a general overview as a result. OVERVIEW: This narrative overview is supported by a more granular chart (attached). Most statistical comparisons are based on year- over -year comparisons as of April 30, 2011, vs. April 30, 2010, and reflect a winter seasonal view (November — April) unless otherwise indicated: 1. Tourism Indicators have become more stable over the past two years and continued to show signs of improvement during the 2010/2011 season. While the growth of the overall economy has been inconsistent, overall vacation travel has increased, as did that of Vail with a slight increase in occupancy ( +0.8 %) but a larger increase in the average daily rate ( +4.4 %) resulting in increased revenue per available room ( +5.2 %). (Note: These year over year comparisons are based on data from properties that were open this season and last season, where a year over year comparison is available. New properties that opened for business during the 2010/2011 season were omitted). When compared to other U.S. western mountain resorts, based on overall MTRiP industry data, Vail underperformed in the year over year change in occupancy ( +5.7 %) but outperformed them in rate ( +1.5 %) resulting a year over year percentage change in revenue per available room of 7.3 %. Traffic through the Tunnel declined for the second year in a row (- 2.7 %), possibly due to the increase in gas prices from the winter of 2008/2009 ( +9.5 %) and the winter of 2009/2010 ( +70.5 %). The amount of vehicles in to the Vail parking structures increased slightly ( +2.3 %) but the number of cars on the Frontage Road decreased dramatically (- 78.5 %) as did the number of days the parking structures were full (- 76.7 %), which may indicate that the new alternative parking options may be keeping cars off the Frontage Roads while adversely affecting parking revenues or perhaps this could be showing a shift of skier mix to more destination business. Additionally, skier visits increased an impressive 9.4% outpacing the industry and most other competitive destinations. However the combination of these various metrics is not consistent and conclusive as a result. An array of special events took place during the winter months. Total attendance /participation increased ( +34.9 %) at all events (except Taste of Vail) driven in large part by the expansion of Spring Back to Vail which was two weekends instead of one. 2. Real Estate Indicators show growth in all areas including increases in both in the number of transactions ( +13.2 %) and gross real estate sales ( +21.3 %) during the winter of 2010/2011 compared to the previous winter. Increases, but to a lesser degree, also took place in average sale price per transaction (+7.1%) and average price per square foot (+10.1%). The summer of 2010 saw dramatic increases over the previous summer, which were largely attributed to the completion of the last of many major real estate developments (Solaris Residences, Ritz Carlton Residences, Landmark and Lion Square Lodge North). While sales of these new units have continued through the winter months, dramatic surges in real estate sales due to new construction are not apparent during the winter of 2010/2011. Continued sales of some of these newly constructed units may positively affect Vail real estate statistics in future seasons since many new units are still sitting on the market, but is expected to dramatically decrease over time as little new construction is in the pipeline. 3. Town Revenue Metrics include: sales tax, construction use tax, property tax and real estate transfer tax revenues along with general fund balance as an indicator of the Town's level of reserves. a. Sales tax is segmented by business type (retail, lodging and food /beverage) and further broken down geographically by Vail neighborhoods. All segments combined showed a strong increase in overall winter sales tax revenue ( +13.0 %) following the previous winter season's sales tax revenue, which had increased slightly ( +1.2 %) after the economic downturn in the 2008/2009 season. Specifically lodging ( +13.8 %) and food and beverage ( +15.2 %) sales tax collections saw a slightly higher,year over year increase than retail ( +10.4 %). When segmented by neighborhood Ahlhge saw the largest increases overall ( +18.2 %) 7 - 1 - 1 Attachment: Vail Economic Indicators Table TR iP TO WN OF VA I L .01.1 NPA10 0 CSPC0 C11 compared to Lionshead ( +10.2 %) and Cascade /Sandstone /East & West Vail ( +4.2 %). It should be noted that some increase of sales tax collections in Vail Village can be attributed to new lodging properties, restaurants and retail outlets that opened, specifically Solaris and the Four Seasons at Vail. A study conducted by MTRiP shows that the average of comparable ski towns was also up season - over - season in both taxable sales ( +5.7 %) and in taxable lodging sales ( +8.8 %) but to a lesser degree. After dramatic decreases in the 2008/2009 season and slight increases in the 2009/2010 combined with this season's upturns, 2010/2011 sales tax collects are within 2% off the prerecession season of 2007/2008. b. Other Tax Collections by the Town of Vail include construction use tax, property tax and real estate transfer tax and are reported on an annual basis instead of seasonally. While they don't correlate with time frame of the above mentioned indicators, new construction use tax showed consistent growth since its implementation in 2008 largely due to major reconstruction in 2009 and 2010. Also due to major new developments, real estate transfer tax collections increased in 2010 and show inconsistent peaks and valleys due to the completion of these new properties. Property tax has also been impacted largely by new construction as well as the reassessment of property values and shows significant growth over the past several years resulting in a 45% year over year increase on 2008, a 6% increase in 2009 and an 11% increase in 2010. In total, the combined revenues from these tax sources have remained more consistent and stable than would be expected during these recent years of economic volatility. c. Town Reserves have remained stable over these past several years, having actually grown since the start of the recession in 2008 and believed to be somewhat unique among municipalities in this down economy. 4. BUSINESS GROWTH is based on broader county and national indicators, many of which are tracked on an annual basis, lag significantly and have just been updated for the 2010 calendar year. While not as current and telling of the current market conditions, the Business Growth indicators show a depressed economy and point to a stuttering rebound. Despite a dour economy, the ski industry fared well, posting record snowfalls and 60.1 million skier visits, the second best on record. Vail Mountain received more snow than any other year in its 49 year history (524 inches), which was accompanied by an impressive 9.4% increase in skier visits from last season to 1,750,000 visits. The Same Store Sales Report is generated to compare year over year sales tax collections among established businesses in the various business segments and neighborhoods and does not take in to account newly open /constructed lodging properties, retail shops or restaurants. According to this report, sales tax collections at long time established businesses increased ( +8.6 %) over last season showing that sales tax collections were strong regardless of new these businesses opening. 5. MACROECONOMICS: Now in the third year of the "great recession ", the overall economy continues to stutter and the long anticipated recovery is not apparent to most consumers who continue to be concerned about jobs, housing, world affairs, national debt and indecisive political leadership. The Consumer Confidence Index (CC!) has proven to be an important indicator of subsequent discretionary spending, like vacation travel, and has historically hovered around its benchmark of 100 until mid -2008 where it dropped to the 30's, has now rebounded slightly to the mid 50's. It's still significantly below the 90 mark, which indicates a vibrant economic threshold. While the CCI is a good measure of consumer spending, we look to the financial markets to assess a broader business outlook and see relative stability, and when combined with solid growth in the US Index of Key Economic Indicators, a longer term positive outlook for a rebounding economy. On a cautionary note, an increasing number of more conservative market watchers point to staggering worldwide debt, ongoing unemployment and an anemic housing market as cause for ongoing caution. The recovery, such as it is certainly fragile and has yet to spark any significant change in demand for tourism or real estate, the two pillars upon which mountain resort economies are founded. This foundational data set and summary will be further updated and expanded upon seasonally, taking its place among the tools available to the Town, its various committees and the public it serves. It is prepared monthly by town staff in conjunction with MTRIP, and is intended to provide summary information for town management, Town Council, the Vail Economic Advisory Council (VEAC), and Vail Local Marketing District Advisory Council (VLMDAC). 1. Series One is an "All Store" series of sales tax collections from all businesses. The report series is best used to evaluate total sales activity for the current season, compared to last season, and is broken down by both geographic and business segments. 2. Series Two is a "Same Store" fixed set of select businesses (see table below), using gross sales revenue, and is best used to compare the performance of a fixed set of established businesses. 3. Series Three is a Comparison of Set One and Set Two, and can be used to compare and contrast the initial two sets. Comparisons between the two are based on percentage change year over year, thereby mitigating the fact that Series One -AII Store is based on sales tax collections and Series Two —Same Store is based on gross sales. All Report sets are further broken down by Geographical subset and by Business Segment. Beaver Creek Resort Company (BCRC) cut back their funding a few years back from $10,000, at which time, the town followed suit. I estimate Vail will collect another $34,000 in June sales tax to bring June collections to $891,791. If so, we will be up 12.5% or $98,756 from budget and up 2.1% or $18,026 from June 2010. Year -to -date would be up 9.8 ° /0 or $1,003,434 from 2010. The year -to -date and full year budgets have been amended by $900,000 to reflect additional collections earlier in the year. Year -to -date revenue would be up 11.5% or $1,156,613 from the original budget and 2.6% or $290,613 from the amended budget.
