Public comments on work session item may be solicited by the Town Council. 1. ITEM /TOPIC: Temporary Mayor Pro Tem appointment for August 16, 2011 meeting (5 min.) PRESENTER(S): Lorelei Donaldson ACTION REQUESTED OF COUNCIL: Due to unforeseen circumstances, the Mayor and Mayor Pro -tem will not be in attendance at the August 16, 2011 Council meetings. The remaining Council members will need to appoint a temporary Mayor Pro -Tem at the beginning of the work session to preside over the rest of the work session and evening meeting of August 16, 2011. STAFF RECOMMENDATION: Vote, by ballot and appoint one member of the current council members present to preside over the August 16, 2011 Council work session and evening meetings as Mayor Pro -tem. 2. ITEM /TOPIC: Commission on Special Events (CSE) and Local Licensing Authority (LLA) Interview Appointments to fill vacancies on each board. (35 min.) PRESENTER(S): Pam Brandmeyer 8/16/2011 ACTION REQUESTED OF COUNCIL: The Town Council needs to interview each applicant at the work session and appoint one member to the CSE and one member to the the LLA board at the evening meeting. BACKGROUND: CSE: Members of the CSE shall serve at the will of the Town Council. The CSE shall support the Town Council's goals and objectives and makes decisions in alignment with the Town Council's marketing direction. The mission of the CSE is to support street entertainment and special events for vitality, year -round fun, sense of community and increased quality of experience for guests and residents. There is currently one vacancy on the CSE. The Town received six (6) applications for the vacancy. The Council shall interview each applicant at the work session and then appoint one applicant to the CSE at the evening meeting, which term ends December 31, 2012. The applicants are as follows: Janyce Brandon William "Barry" Davis Joyce Gedelman -Viers Katherine Richardson Robert Ruder Nicole Whitaker LLA: Applicants to the LLA must be citizens of the United States, qualified electors of the Town of Vail, and have resided in the Town of Vail for not less than two years preceding appointment, and shall have no direct financial interest in any license to sell alcoholic beverages or any location having any such license. Duties of the five - member board include review of all Town of Vail liquor license applications. There is currently one vacancy on the LLA. The Town received one (1) application for the vacancy. The Council needs to interview the applicant at the work session and then make the appointment to the LLA at the evening meeting. The applicant is Amanda Zinn. STAFF RECOMMENDATION: Interview each applicant and then appoint one member to the CSE and one member to the LLA at the evening meeting. 7. Furthermore, Section 14- 10-3C, Site Planning, Vail Town Code, states the following: "C. Removal of trees, shrubs, and other native vegetation shall be limited to removal of those essential for development of the site, those identified as diseased or those essential for creating defensible space. Mitigation may be required for tree removal." The DRB has consistently used this regulation to prevent the removal of vegetation for the sole purpose of obtaining a view to a landmark (commonly the Gore Range or the ski mountain). The DRB was concerned about allowing the Town to perform an action which is consistently denied for private property owners as this request occurs frequently. The DRB understood the concern of the encroachment of the vegetation on the view corridor and had several suggestions and concerns. There was a concern that the removal of the trees would expose a roof material and a building which might have a negative effect if it became completely exposed. The Board highlighted that the original design intent of Eldon Beck was to limit the view to short distances into the Village and create an element of surprise. It was stated that the trees frame the Covered Bridge and are solely a summer problem, and does this warrant removal. Page 2 8/16/2011 5 -1 -2 The DRB suggested that the Town Council direct staff to prepare amendments to Chapter 12 -22, View Corridors, Vail Town Code, to include provisions for "maintenance" of a view corridor with regard to vegetation which established a set of criteria by which an evaluation could be made. It was further suggested that Section 14- 10 -3C, Site Planning, Vail Town Code, would be improved with the addition of provisions and criteria for the evaluation of the removal of vegetation that may have been improperly cited during original installation and after a number of years has impacted important views. A requirement for replacement should accompany any provision allowing for this. 8. Myers explained how the US domestic airline industry continues to consolidate and that the low cost carrier market share is growing and will play a larger role in serving US domestic market. The Boeing 757 is the most used aircraft at EGE, however Boeing has stopped production and the future aircraft for EGE is the Boeing 737 -700 or Airbus 319 aircraft which are smaller aircrafts and will require more flights to maintain seat counts. Myers talked about the three year service options and estimated costs for the 2012 -2013 winter and summer. The first winter service option is Toronto with an estimated cap of $100,000.00, 1,500 passengers, an estimated 950 incremental visitors and 5,300 visitor nights; second option is Washington Dulles with an estimated cap of $200,000.00, 2,250 passengers, an estimated 1,450 incremental visitors and 8,000 visitor nights and the third option is San Francisco with an estimated cap of $200,000.00, 2,250 passengers, an estimated 1,450 incremental visitors and 8,000 visitor nights. All three winter service options were for Saturdays only. The summer service options begin mid June through late September and all three options are daily and have an estimated cap of $400,000.00. All three options bring 8,600 passengers and an estimated 3,400 incremental visitors and 12,300 visitor nights. The first option is Houston, the second is Chicago and the third is a combination of the first two. Steve Rosenthal thought it made sense to service both Chicago and Houston, rather than a flight being 25% full it would be 75 %. Myers explained the targeted pledge amounts for 2012 Summer and 2012/13 winter would need to come from Eagle County, town governments and private businesses since everyone in the county would benefit. Jim Lamont asked about international flights coming to Eagle. Myers stated the size of the aircraft needed for an international flight from would not work with the constraints with altitude, the Redtable Mountain and runway impacts the Eagle airport has. The only international flight that would work would come from Mexico City because that airport has the same constraint issues as Eagle. Rosenthal inquired about flights from Eagle to LA, Las Vegas and Phoenix. Myers explained that Allegiant doesn't fly to Eagle because again of the size of the aircraft. • USA Pro Cycling Challenge: Adam Lueck with the Vail Valley Foundation talked about the upcoming 2011 USA Pro Cycling Challenge. The Town of Vail will be staging the individual time trials of the 136 riders. Lueck explained 136 riders will start one at a time every minute starting at Willow Bridge to Gore Creek Drive, north on Vail Valley Drive and heading west on the Frontage Road to Bighorn Road then up Vail Pass. Which is the same course as the Coors Classic. Lueck stated the event will be like having the Tour de France in our backyard. Riders will be traveling 22 — 28 mph and for anyone 8/16/2011 7 -1 -1 who is a cycling fan this will be the place to be. Lueck went on to say the event will have 25 hours plus of national and international television airtime and on August 25 the Town of Vail will have 3.5 hours. The Foundation worked with Town of Vail Fire Dept., Police Dept., Public Works and the Vail Recreation District on road closures which will be the most significant impact. Starting on Wednesday the Village businesses are allowed to have deliveries until 12:00 pm and after that time the Village will be 100% closed until 4:00 pm the following day to allow for set up of tent structures, sound system, banners, stages, catering etc. to be ready for the start of the event at 11:00 am on Thursday. The Frontage Road to East Vail and Vail Valley Drive will be closed at 11:45 am the day of the race. CDOT and the town will be putting messages on the variable message signs directing traffic to the main Vail and West Vail exits. There will be bus service from the transportation centers to East Vail that will loop around by using 170 Interstate. There will be parking below the upper decks of the transportation centers, Frontage Road parking from Lionshead to West Vail and parking on the north side of the Frontage Road near City Market. There will also be permit parking in East Vail. The Police Dept. will be encouraging the down valley employees and visitors to use the bus system into Vail by giving limited edition cow bells to the first 2,000 bus riders. There are a number of activities planned after the race to keep spectators in town ranging from private and public parties and a free concert featuring Motet. Rayla Kundolf suggested getting out to businesses additional information regarding road closure and parking. Matt Morgan thanked the Vail Valley Foundation for getting the big event to Vail and thought it was fantastic. Michael Kurz reminder the VEAC members to make everyone feel welcomed so they will want to come back. • USAPCC Emergency Ordinance: Rachel Dimond a Town planner, provided copies and asked if anyone had a questions concerning Ordinance No. 17, Series of 2011, an emergency ordinance to approve the general planning document for the 2011 USA Pro Cycling Challenge, to allow for temporary suspension of certain fire lanes, no parking areas, pedestrian zones and outdoor display and sign regulations to facilitate the 2011 USA Pro Cycling Challenge. Morgan asked if there could be deliveries on Thursday if they are before 5:00 am. Dimond stated there would be door front deliveries and suppliers can park at Mountain Plaza and wheel the deliveries to them. • Ski Concierge Services: Dimond presented a Powerpoint concerning ski concierge services provided by hotels to improve customer service. These ski concierge services often include the temporary outdoor storage of skis and snowboards on rolling racks to facilitate distribution of equipment to guests. Dimond explained ski concierge services are not contemplated by the Vail Town Code, as this type of service did not exist when the current regulations were adopted. As a result, the Town has no underlying policy direction on this subject, and thus, Staff cannot make a determination on how to handle this use. Dimond stated without clear policy direction, interpretations by Staff results in arbitrary rulings, inequities, unfairness or inconsistencies. Diamond asked if the VEAC members had any policy recommendations concerning ski concierge services. Kurz expressed concern regarding the impact on horizontal zoning and the space where this service could be offered. Kurz also expressed concern about the ski shops being required to have ski storage in the basement and hotels being allowed to have their storage on the street. Rosenthal had concerns of guests just grabbing the wrong skis and thought a centralized location for this service should be contemplated. Rosenthal even suggested utilizing the space behind Los Amigos since it is out of sight and at the base of the mountain near the Vista Bahn George Ruther director of community development, asked if the VEAC supported this service? There was general support from the members. 8/16/2011 7 -1 -2 Rosenthal stated the ultimate goal is providing enhanced customer service. • Town Manager Report: Pam Stenmark asked Stan Zemler about progress concerning Timber Ridge redevelopment. Zemler informed the committee Timber Ridge got their HUD financing, but it comes with a lot of time constraints and other conditions that may make the project difficult. Morgan asked about the conference center ballot question and what was the support from the community. Zemler responded there was a unanimous support to move forward and 72% of the citizens who were polled were in favor of all three projects. Overall June sales tax increased 1.8% with Retail decreasing 16.1 %, Lodging increased 18.2 %, Food and Beverage increased 14.2% and Utilities /Other (which is mainly utilities but also includes taxable services and rentals) increased 3.7 %. The Out of Town category continues to be greatly affected by interior design firms and furniture stores delivering in to Vail. Excluding the Out of Town category, sales tax for the month of June is up 13.3 %. Year to date through June resulted in a 9.8% increase overall with Retail increasing 4.7 %, Lodging increased 13.8 %, Food and Beverage increased 15.0% and Utilities increased 2.2 %. Excluding the Out of Town category, sales tax year to date through June is up 12.2 %.
