PRESENTER(S): Ralf Garrison, MTRiP ACTION REQUESTED OF COUNCIL: Listen to the presentation and ask questions. BACKGROUND: Ralf Garrison of MTRiP will present an update of transient inventory in Vail, a look back at Summer 2011 and a look forward at Winter 2011 -12 4. ITEM /TOPIC: Presentation of Lift Tax Computation (15 minutes) PRESENTER(S): Mark Schoppet, Controller and Chief Accounting Officer, Vail Resorts, Inc. ACTION REQUESTED OF COUNCIL: Ask questions of Vail Resorts' Controller and Chief Accounting Officer to get assurance regarding the accuracy of the amount of lift tax reported and paid to the town. BACKGROUND: At Council's request, Vail Resorts prepared the attached memo explaining 12/20/2011 how the 4% lift tax paid to the Town of Vail is calculated. Mr. Schoppet offered to attend a Council meeting to answer questions about the lift tax and provide further assurance to Council that the tax paid is the amount actually due. STAFF RECOMMENDATION: None - information only. 5. ITEM /TOPIC: Interview and appoint new members to fill vacancies on the VLMDAC and the CSE. (100 min.) PRESENTER(S): Pam Brandmeyer ACTION REQUESTED OF COUNCIL: Please interview the Vail Local Marketing Board Advisory Council (VLMDAC) and Commission on Special Events (CSE) applicants at the work session and appoint four applicants to the VLMDAC and four applicants to the CSE (all terms expire December 31, 2013) at the evening meeting. The town received eight applications for the VLMDACand 13 applications for the CSE. Incumbent members of the boards are listed in asterisks below. Per C.R.S. 29 -5 -111 General powers of district. (1)(g) All applicants must be "owners of property within the boundaries of the district," which includes by definition corporations or entities which own property "within the boundaries of the district." Should an entity be appointed to this advisory council, it would then be up to that entity to appoint its designee. Additionally, owners of "taxable personal property" will be considered for appointment. CSE: Members of the CSE shall serve at the will of the Town Council. The CSE shall support the Town Council's goals and objectives and makes decisions in alignment with the Town Council's marketing direction. The mission of the CSE is to support street entertainment and special events for vitality, year -round fun, sense of community and increased quality of experience for 12/20/2011 guests and residents. The Functions and /or duties of CSE shall include, but are not limited to: hiring and overseeing a director and /or staff, as well as event producers and /or promoters; creating, funding and seeking special events for the Town of Vail; evaluating event applications and event success; submitting an annual budget for operations and events; coordinating the community calendar for special events; seeking out additional funding for special events through sponsorships and donations; evaluating and executing contracts for special events; and all other functions as directed by the Town Council. 6. DISCUSSION 12/20/2011 1 -1 -1 TOWN OF VAIL Memorandum TO: Vail Reinvestment Authority FROM: Finance Department DATE: December 14, 2011 SUBJECT: 2011 Budget Amendment — Resolution 3 SUMMARY Staff is requesting approval of Resolution No. 3, making supplemental appropriations and adjustments to the 2011 budget. II. DISCUSSION This supplemental appropriation request will align the Vail Reinvestment Authority's support of various capital projects as budgeted within the Capital Projects Fund because those projects (or a related portion) are capital improvements within the TIF district. Staff is requesting a total of $704,800 in transfers to the Capital Projects Fund based on the following changes to capital projects that occurred throughout the year: • LionsHead Welcome Center $587,000 ($400,000 estimated overage in project plus approved changes of $187,000 relating to removal of food service) • Planning and design for both East and West LionsHead Portals, $275,000 • Phase I Guest Service Enhancements (including programming in the new LionsHead Welcome Center, as approved by Council September 6), $217,800 • Due to changes in timing of the Vail Library remodel, reimbursement will be reduced by $375,000. The Library remodel design and pre -work is planned for 2011 ($100,000), with construction budgeted in 2012 ($1,600,000). Bill Gibson gave a presentation per the staff memorandum. Dominic Mauriello, representing the applicants, stated that his clients have initiated this process in order to take advantage of the EHU exchange program. This request does not require a property owner to relocate their EHU, but allows for the opportunity. Any exchange will still have to go through the codified exchange criteria. There was no additional public input. Commissioner Pierce spoke to the initial idea of requiring the EHUs in the development in order to disperse employee housing throughout the town. He asked what has changed since the SDD was adopted to warrant this change? Page 1 12/2012011 2 -2 -1 Nina Timm, Housing Coordinator, spoke to why the EHU exchange program was adopted and recently modified. The exchange of EHUs results in the recording of a newer restriction that requires occupancy. Dominic Mauriello spoke to the condition that existing EHUs are incorporated into other homes, and if they were relocated elsewhere it would eliminate conflicts with the goals of the property owners. The benefit to the Town is that the size of the EHU unit is required to be increased. Commissioner Kurz asked about the striking of language referencing the Design Review Board reviewing dormers. Bill Gibson responded that dormers can not be reviewed administratively through the normal design review process because this language specifically requires the Board's review. The change allows for administrative approval of applications which are in compliance with the Vail Town Code. Commissioner Hopkins spoke to her previous tenure on the Commission and the cycle of boom and bust and the associated need for employee housing. She asked if the exchange program will be detrimental to the Town's future when we are in a boom cycle? Nina Timm responded that the exchange EHUs will have increased occupancy and be increased in size making the units more livable. She added that she did not believe the EHU exchange program negatively positioned the town in the future. Commissioner Pratt inquired about the requirements for an EHU garage in the SDD. He felt a recommendation should be forwarded to Council that includes the replacement of garage square footage with another garage in the new location. Bill Gibson stated that the relocated EHU would not be required to have a garage, but would be required to comply with zoning on the property in which it is located with regard to parking. Commissioner Hopkins raised the point that EHUs typically result in a reduced need cars and garages as alternative methods of transportation are available. Commissioner Kurz stated that he was not in support of requiring garages with an exchange unit in this SDD. Commissioner Pratt believes that if a garage is required now, it should be required for an exchange unit. Commissioner Rediker spoke to the fact that EHUs can be occupied by individuals working within Eagle County and not only Vail, so there could be residents commuting out of Vail for work. Dominic Mauriello hypothesized that when the EHU exchange was adopted it may have been considered that the doubling and tripling of floor area compensates for existing garages. George Ruther gave a presentation per the staff memorandum. He discussed the steps which had occurred since the request was last before the Commission. He explained how the HUD process resulted in a reduction of the number of units within the project due to the analysis performed in conjunction with the HUD submittal. He added that while a floor in the building was removed the site plan and circulation remains as previous approved. Commissioner Pratt stated he was not present before in the previous approvals and questioned the minimum size of the EHUs being proposed. Nina Timm explained that the minimum size requirement was included in the regulatory requirement for commercial linkage and this project was not fulfilling any obligation. Commissioner Rediker inquired as to the number of people living in the project based upon multiplying the number of bedrooms. Page 4 12/2012011 2 -2 -4 George Ruther spoke to the review process which occurred previously to reduce the required parking. Elements such as a redesigned bus stop, pedestrian, and bike connections were considered in reducing the required parking. Commissioner Rediker does not buy into an improved bus stop getting people to use alternative transportation. How will parking be managed to let tenants know what is available? If there is too little parking it will actually hurt the project. Commissioner Cartin stated that snow storage does not appear to have been addressed since the last hearing. George Ruther stated that snow storage is still being explored and several options are being reviewed. George Ruther continued by discussing the crossover drive aisle width variance and the report from the consulting engineer which highlights that there would not be any negative effect on the function of the parking structure caused by the reduction in width. Commissioner Rediker inquired as to the parking consultant's letter addressing the width variance. George Ruther offered his interpretation of the documents referenced in the letter. George Ruther spoke to the plat application which has not been changed since previously approved. Rick Pylman, representing the applicant, gave a power point presentation, highlighting the changes that have been made and the reasons why. George Ruther asked that proposed Condition No. 2 in the memorandum be stricken as a letter from the geologist was received and in the file and the condition was no longer needed. Rick Pylman spoke to how parking will be managed similar to the Middle Creek parking which appears to be working appropriately. He then discussed how snow storage would be removed using a bobcat type device and a truck to haul it away off of Lions Ridge Loop. The reduction of a level of parking has created a situation where the upper parking deck is about 10 feet below the road thus complicating snow removal. Commissioner Kurz inquired as to the use of traction materials on the upper deck of the parking structure? Mark Donaldson stated that he did not believe any traction materials would be used and therefore would not be pushed off the deck. Commissioner Pierce inquired as to the assumptions made in the provided diagram for the crossover drive aisle width and the impact of the depicted compact parking spaces. He asked what the impacts would be to the structure in order to meet the town's requirement. Why can't the parking structure be enlarged to comply? Mark Donaldson stated that multiple spaces would need to be removed if the structure was not physically enlarged. Rick Pylman stated that the enlargement of the structure was not really explored as the parking consultant was so strong in his belief that the structure will function appropriately as proposed. Page 5 12/20/2011 2 -2 -5 Commissioner Pierce asked why certain spaces couldn't be removed and comply ?. Mark Donaldson spoke to how that might not work easily due to slopes in the garage on the ramps. Commissioner Pierce stated that he was not convinced that enough effort has been invested to try and address the requested variance. Commissioner Kurz stated that he didn't believe a redesign was necessary. Commissioner Pratt believes that parking spaces are going to need to be assigned in the future. Commissioner Pratt inquired as to the location of landscaping along the south elevation adjacent to the Frontage Road. George Ruther showed the location of landscaping along the Frontage Road elevation. Commissioner Rediker inquired as to what condition number 1 was requiring. George Ruther explained that the condition was making all three applications being discussed today contingent upon the approval of each other. If one application is not approved then the project cannot move forward through the entitlement process. Commissioner Rediker inquired as to the applicability of the conditions. George Ruther stated that the conditions need to apply to all three applications. Commissioner Rediker asked that the finding for the crossover drive aisle width be amended to say no less than 26 feet 10 inches. Commissioner Pratt asked if George Ruther was satisfied with the explanation of the snow removal and if a condition was needed? George Ruther stated that the Code does acknowledges that it takes some time to remove snow and if a certain period of time passes within the parking a violation can be issued to remedy the problem. He believes that the ownership will need the spaces and will create methods and means for removing the snow out of necessity. Commissioner Hopkins inquired as to how many cars are exposed and how the property owner will get the cars to move so that the deck can be plowed. Mark Donaldson spoke to the snow plow operator coming several times in a day period to remove the snow. There are approximately 100 cars on the exposed are of the parking deck. Commissioner Rediker suggested that a condition be added to address snow removal which would reflect the language found in the condition regarding waste removal. Commissioner Pierce suggested that language be added to require that only compact cars be permitted in compact spaces in the management of the parking structure. RI NCES July 25, 2011 Vail Town Council Town of Vail 75 South Frontage Road Vail, CO 81657 RE: Calculation of Vail Mountain Lift Revenue for Town of Vail 4% Assessment Dear Town Council Members, This letter is in response to your inquiry of how the 4% lift ticket assessment is calculated with respect to the variety of Vail Resorts lift access products currently available in the marketplace including our season pass programs. Additionally, the process as explained below is consistent with the process as documented in a letter to the Vail Town Council dated June 26, 2003 from Bill Jensen. Vail Resorts pays the Town of Vail a 4% assessment on all lift revenue generated on Vail Mountain including window ticket sales, internet sales, season pass sales (including revenue from the Epic, Epic 7, Colorado, Merchant Passes and various other pass products as further described below) as well as winter and summer sight - seeing rides. Revenue is recognized at the base of the mountain through our ticket scanning system. It is the policy of Vail Resorts that no individual may obtain access to the mountain without a valid ticket or pass product that is scanned at the base of the mountain. Every individual accessing Vail Mountain is scanned including employees, outside vendors, contractors and US Forest Service personnel. This policy is strictly enforced which ensures that the scanning process captures data on virtually every individual accessing any of our mountains. As each scan takes place, revenue recognition occurs based on the bar code or a RFID chip read on the product presented whether it is a paper lift ticket, season pass, employee /dependent pass or a Peaks Card with a direct -to -lift; component attached to the bar code. The revenue recognized by the scanning equipment is the revenue that is associated with that particular lift access product. For example, a single day lift ticket sold at the ticket window would generate revenue recognition at the price the ticket was purchased at the window. A multi -day lift ticket would generate revenue recognized at the fractional component of the product purchased (i.e. daily revenue recognition would be calculated based on a three -, four- or five -day ticket purchase price divided by the number of valid days for that product). 12/20/2011 4 -1 -1 In the case of season passes which include the Epic Pass, Epic 7, Colorado Pass and other pass products, season pass revenue recognition occurs when the pass is presented on each day of use. Because Vail. Resorts season passes include multi -resort access, the revenue associated with each pass usage is credited to the resort where the pass is scanned. At the start of every season, Vail Resorts estimates the number of days of use each type of pass product will incur based on season pass usage history. As the season progresses, pass usage is monitored and adjustments are calculated based on actual usage by mountain. At the end of the season, final calculations are made based on total season pass usage by product category. Season pass revenue is calculated for each resort where pass usage occurred and adjustments are made within the general ledger to ensure that our financials properly mirror these calculations. These final adjustments are made in the month of April after the ski season ends. Generally, this "breakage calculation" represents approximately 2% of Vail Mountain's total lift revenue but does increase April lift revenue for the Town of Vail's assessment calculation. As a publicly traded company, Vail Resorts is subject to quarterly and annual reporting requirements to the Securities and Exchange Commission. Vail Resorts' annual financial statements are audited by PriceWaterhouseCoopers, LLP (PwC), an internationally recognized independent accounting firrn. Vail Resorts has received clean audit opinions from PwC including conclusions that Vail Resorts' internal controls over financial reporting are operating effectively. Additionally, the US Forest Service (USFS) conducts periodic audits (generally every three years with the last audit being completed in April 2009) which include but are not limited to determining if Vail Resorts accurately reported sales by ski area. These examinations are conducted in accordance with the GAO Government Auditing Standards. The audits conducted by the USFS have resulted in no material adjustments. Vail Resorts has one of the most sophisticated lift access (ticketing and season pass) systems in the world. The philosophy of a multi- resort lift ticket or season pass has been beneficial from a marketing standpoint for Vail Resorts in a very competitive ski resort environment. This continues to further benefit the Town of Vail through overall increased skier visits and revenue. We are confident that the allocation of all revenues is consistent and appropriate based on individual products and their relative price and usage across all of our mountain properties. I have lived in Vail since 1983 and I am happy to say that I have spent the last 28 years working at the Sonnenalp Resort of Vail under the management of Mr. Johannes Faessler. I know it is rare in my industry to have stayed with one company for my entire career in the hospitality industry, but this is what also makes me unique. Due to the duration of my time at the Sonnenalp, I have had the opportunity to work in many departments and positions, including: sales manager, reservations agent, and public relations and marketing director. My involvement in these various positions has allowed me to live and breathe Vail. I understand that this valley is a place for many guests to fulfill their passions; whether it's skiing and snow shoeing in the winter or golfing and biking in the summer. Moreover, I understand what it takes to market other important areas of interest such as retail, restaurants and spa. The connection between heads in beds and these other valuable sources of revenue are all of high importance to a guest overall experience in the Vail Valley. It is not just important to fill our bed base but equally important that guests find the Vail Valley rich of wonderful food and beverage venues, retail choices from clothing to activity equipment and enjoy the comfort of our many spas. I also represent the more independent type of lodge or hotel; with no affiliation to a chain or name brand. The Vail Valley has many hotels and lodges that are similar to the Sonnenalp, not only in size but in marketing efforts. We are small but effective in our marketing ideas of ways to bring guests to Colorado. The Sonnenalp has been in the Vail Valley for more than 31 years and is proud to have served our community in many areas such as our Sonnenalp Foundation, our yearly cancer golf tournament, and the hosting of our bicycle classic for more than 23 years. I am confident that my combination of practical work experience and solid educational experience has prepared me to make a valuable contribution to the Advisory Council. I received my college degree from the University of Northern Colorado in 1985. Due to the fact that I was raised in a military family, I spent many years in Germany and was given the opportunity to speak German and French. This exposure to a vast amount of cultural diversity has certainly leant itself on more than one occasion. I sat on the board of HSMAI as treasurer in the late 90's and also served as president of Destination Colorado for a 2 year term from 2007 -2008 as well as serving as their Past president from 2009 -2010. I have been instrumental in implementing programs such as creating a group direct mail piece and rebuilding of the website to fully achieve our goal: bringing more group business to our state. The 2011 Transient Inventory update compared the number of units /pillows from January 1, 2009 vs. November 1, 2011 of the hotels, condominiums and fractional ownership properties that participate in the MTRiP studies which is 78% of the total community census. The short term rental units (less than 30 days) increased by 7% (248 units) and pillows (the maximum occupancy in a unit) increased by 6 % (1,119 pillows). The 2011 Summer Vail Occupancy report for the months of May thru October showed an increase of 7% for the town of Vail and a 6% increase in the industry. The summer average daily rate was up 3% with the industry was at 0 %. The RevPar for the summer showed an increase of 11% with the industry up 7% overall. The summer reports showed a strong July but October not faring too well. The Vail vs. Other Mountain Resorts Summer Occupancy and Rate reports showed Vail ranking 3rd or 4 in summer occupancy which Barnes stated was pretty consistent with previous years. Same Store /All Store report demonstrated sales tax collections and gross sales for retail, lodging and restaurants in Lionshead and the Vail Village for the 2011 summer. Though sales tax collections to date are up in all categories for both areas, the Vail Village showed a slightly higher sales tax collection percentage than Lionshead. Whereas, summer gross sales to date are up in all categories for both areas but, Lionshead gross sales percentages were higher than the Vail Village. As of November 30, 2011, the Winter 2011/2012 occupancy report is showing a strong start, up 19 %. The average daily rate for the 2011/2012 winter was down 4 %. Barnes felt the rates were down due to properties offering the best deals now and early season deals would also drive up the occupancy percentages. The Vail RevPAR was up 15% according to the MTRiP report. The Vail vs. Other Mountain Resorts Winter Occupancy and Rate reports showed Vail ranking 1 or 2nd in occupancy but 3rd or 4 in rates. Barnes explained the reason for other mountain resorts showing higher occupancy for certain months and possibly higher rates was due to special events happening in those towns. • Town Manager Report: Stan Zemler, Vail Town Manager, stated Strada received an extended approval and has submitted for a building permit. Timber Ridge redevelopment has been an on going discussion and there is a February 18 HUD commitment deadline. Conference Center funds ballot question passed and there are a lot of projects in the works. The Town of Vail library is under a major remodel, town staff is working with the Vail Valley Foundation to start the Ford Park Amphitheater improvements, which may impact late August events. The Betty Ford Garden improvements will begin late fall and currently there is a proposed 2013 spring and a fall schedule for the Golf Clubhouse. In the end, the WQCC decided that based on their own data at several sampling points along the entire length of Gore Creek within the Town of Vail, all of Gore Creek will be listed as impaired for aquatic life. II. PRESENTATIONS • Steve Bushong, Attorney for Eagle River Water & Sanitation District and the Vail Corporation presented a summary of the Eagle County Water Quality Programs and the stakeholder group history of addressing water quality issues: o Eagle River Partnership — formed in 1998 o Over $11 million invested in water quality and biological monitoring, studies and projects • Jon Stavney, Eagle County Commissioner presented the following summary: o Eagle County is dependent on clean water and healthy rivers for human and environmental health and on a recreation and tourism based economy. o Water quality is a high priority to the local stakeholders for over 15 years for purposes of monitoring water and biological conditions in the Eagle basin. o This partnership is coordinated by the Eagle River Watershed Council and supported by Eagle County, Towns of Vail and Avon, ERWSD, USGS, US Forest Service, CDOT, DOW commercial interests including Vail and Beaver Creek Resorts, and Trout Unlimited. o The Eagle River Basin is the most thoroughly studied large watersheds in Colorado and perhaps the nation. o Recently completed projects include the USGS Assessment of Surface Water Quality and Quantity, Eagle River Watershed, 1947 — 2007 and the $4 million Eagle River Edwards Restoration Project, which was partially funded by a 319 Grant. o The Eagle River Basin stakeholder's goal is the same as the WQCC — protection and improvement of water quality. However, the WQCD's proposal 12/20/2011 6 -4 -1 to list 8 streams in the Eagle River Basin without any consultation or coordination with the local stakeholder's is counterproductive and detracts from local efforts currently underway. Financial and human resources devoted to developing the WQIP have not been diverted to the 303(d) Rulemaking Process which will not provide any regulatory or water quality benefits. o Eagle County invites the WQCD to become actively engaged in the local stakeholder group so that future regulatory initiatives can be based upon complete and accurate information. The local stakeholders want to focus our efforts and resources on problems on problems we know exist. • David Rees, Timberline Aquatics presented concerns with using the Multi Metric Index (MMI) scores for determining aquatic life use attainment: o MMI scores provide a good qualitative tool for general assessment of health, but attainment thresholds should not be treated like numeric stream standards. o Considerable variability associated with MMI scores compounded by the WQCD use of qualitative sampling approach instead of a more rigorous quantitative approach where all the bugs collected are counted. o All available information must be considered on stream health segments in questions not just the MMI score which is why we have disagreement with the aquatic life scores on two streams. • Bill Carlson presented concerns from the Vail Town Council regarding listing Gore Creek as impaired for aquatic life: o Identifying a Gold Medal stream as impaired based on upstream MMI scores is a concern. The Vail community has created a recreation and tourism based economy which trout fishing is a vital component. o East Vail MMI scores show aquatic life impairment prompting the Town and local stakeholders to develop a WQIP a year before the proposed 303(d) listing. The Town and local stakeholders have been monitoring and evaluating the entire Eagle River Watershed since 1998 because we value water quality and stream health. o MMI scores have been passing in 2009 and 2010 in the Gold Medal segment of Gore Creek and the September 2011 DOW fishing sampling found a good number of quality trout between Red Sandstone and the Eagle River. o The Town and local stakeholders want to focus our efforts on segments of Gore Creek not in attainment by joining forces with the WQCD staff to continue investigations to determine causes of impairment in up stream areas of Gore Creek, develop corrective actions and continue to closely monitor and evaluate changes in the aquatic community. o The Town requests the WQCC place the Gold Medal segment of Gore Creek on the monitoring and evaluation list for aquatic life from Red Sandstone Creek to the mouth of the Eagle River. • Bob Weaver, Leonard Rice Engineering Consultants addressed 303(d) temperature listing issues in the Eagle River segments from Berry Creek to Rube Creek a 6 mile segment the ERWSD is opposing and requesting more investigation to determine the appropriate breakpoint between where the segment is in and out of attainment. Furthermore, MMI data was presented opposing list Lake Creek on the 303(d) list for aquatic impairment and requesting listing on the monitoring and evaluating list for addition study to determine an appropriate breakpoint in the stream. Town of Vail Page 2 12/20/2011 6 -4 -2 • Melissa MacDonald, Executive Director of the Eagle River Watershed Council presented her organizations mission and advocacy for health and conservation of the Eagle River Watershed including: o All Eagle River Basin Stakeholders are actively involved in the ERWC and support the testimony presented to the Commission today. o WQCD needs to work more closely with the local stakeholder group so we are not surprised by Division proposals and invite the WQCD staff to become more involved with Watershed Council water quality improvement projects and actions. During the deliberations, several of the Commissioners complimented the Eagle River Stakeholders group and the work that is being accomplished in the Eagle River Basin on water quality matters. The presentations at the hearing went very well and were effective. The Commission spent more time discussing Gore Creek MMI scores and Eagle River temperature issues than they spent in their deliberations on any of the other disputed listing proposals. III. KEY WQCC DECISIONS AND OUTCOMES FROM THE HEARING The following final results are a combination of agreements reached through negotiations with the Division staff and the Commission's decision. IV. SUMMARY In summary, the stakeholders reached agreement with the Division or prevailed before the Commission on most of the Eagle River Basin 303(d) Listing issues. This was only possible because of the active involvement of all of the Eagle River stakeholders. The Division was very impressed with the work that is being accomplished by the group and especially with our unity of purpose and ability to work together collaboratively. V. NEXT STEPS The Town of Vail and Eagle River Basin Stakeholder Group will partner with the Water Quality Control Division to continue investigations necessary to determine the causes of impairment in Gore Creek and Red Sandstone Creek in the future. This effort will include the development of a water quality strategy for Gore Creek and Red Sandstone Creek including putting in place a Water Quality Improvement Plan (WQIP) in 2012. This plan will address specific measures to reduce non -point source pollution, improve stream habitat and riparian buffers, and initiate a community education program and ongoing monitoring to evaluate the effectiveness of the WQIP. Since the first Taser was manufactured, the product has gone through many versions and continues to evolve today. Simply stated, the Taser product is the most tested and researched less - lethal product the world has ever seen. Over the past 20 years, literally thousands of medical and research studies have been conducted on the use of the Taser and it's effects, including studies conducted by the United States Department of Justice (DOJ), the America Medical Association, the National Institute of Justice, the Federal Bureau of Investigation, the American Academy for Emergency Medicine, the Police Executive Research Forum and Taser International, as well as many colleges and universities. Study after study proves that when applied properly, the Taser product is a safe and effective less - lethal weapon. In fact, the Wake Forest University/DOJ studied concluded that "to our knowledge, these (findings) suggest that more than 99% of subjects do not experience significant injuries after conducted electrical weapon use." In addition, many studies indicate the resulted use of the Taser, or Conducted Energy Device (CED) as it's often called, has significantly reduced both Officer and suspect injuries. The Police Executive Research Forum's study found "use of CEDs is associated with a 70- percent reduction in the chances of an officer being injured compared to agencies that do not use CEDs." In another study by the National Institute of Justice/DOJ notes the use of the Taser resulted in "90% less suspect injuries" and that the use of the Taser "is associated with a significantly lower risk of injury than physical force, so it should be considered as an alternative in situations that would otherwise result in the application of physical force (such as punches, kicks, joint locks and physical take downs)." Situation: Since Council approved the use of the Taser X26 for Vail Officers in 2007, we have had several successful applications, during which both the suspect and Officer avoided injury. Overall our 12/20/2011 6 -5 -1 Officers have demonstrated a high level of restraint and excellent judgment when making the decision to deploy the Taser. During the approval process, it was requested we include the Taser Cam for several reasons, including reducing liability, monitoring the usage by our Officers and usage during training. The Taser Cam is an audio and visual recorder that replaces the standard battery in the Taser X26. When the Officer activates the Taser, the Taser Cam begins recording until the Officer places the safety switch in the safe position. Since 2007 we haven't had a single usable video from a Taser deployment. Our typical Taser Cam video recording shows a close up shot of a shirt or jacket and some yelling, only some of which is understandable. The Taser Cam has the potential to record excellent video and audio, but only if the suspect is at a distance from the Officer. None of our deployments have met those requirements and have usually been in a confined space, such as a bathroom or crowded bar, resulting in a poor, nearly useless video. In comparison, the Taser X26 alone records the date and time of usage in both local time and Greenwich Mean Time (GMT), the duration of activation, the temperature and battery life remaining, but only the Taser Cam contains the video and audio recordings. The firing data stored on a stand alone X26 would provide nearly the same evidentiary value as the Taser Cam with a poor video. To date, the video produced from a Taser Cam during the 10 Taser deployments by the Vail Police Department have never been used as evidence in either an administrative or criminal proceeding. The Taser Cam also poses some technological difficulties. The supplied program Taser International has developed for the download and storage of Taser Cam information is often times unpredictable and inconsistent in its intended use. On four separate occasions, the program had contaminated the Taser Cam software and resulted in the Taser Cam being returned to Taser International for repair, which took between 6 and 10 weeks to complete. In two of these cases, the Taser was rendered broken beyond repair and those units had to be replaced at the full cost of $1221.90 per unit. Most recently we have come to find a battery life issue within the Taser Cam. Since the Taser Cam also supplies the power for the Taser itself, simply replacing the battery is impossible. Basically, the battery inside the Taser Cam becomes weakened with age and even after a full charge in which the battery life indicator shows full, the pulse rate of the Taser is considerable slower than it should be, sometimes stopping all together. The result is an unreliable tool, which may or may not have the power to deploy the Taser cartridge properly. As a test, we placed a standard Taser battery in the same Taser unit and found that it functioned normally, which points to a power issue with the Taser Cam. During conversations with Taser International, who makes both the Taser X26 and the Taser Cam, the only remedy is to replace the Taser Cam at a cost of $411.95 per unit. In the past two months, we have had 5 Taser Cam units exhibit this same problem, which, if the Taser Cam were to be replaced, would cost a total of $2,059.75. With 20 more Taser Cams in use by our Officers, we believe the problem will proliferate throughout the rest of our stock. In addition to the lack of usable video and audio evidence, the Taser Cam requires a great deal of time to maintain. Per department policy, Tasers are required to be downloaded on a quarterly basis to reduce the amount of information stored in the unit. On average, a Taser Cam download takes approximately 44 minutes per unit. Following the quarterly download policy, during a one year period of time it will take a total of approximately 73 hours and 20 minutes to download all of the department's Tasers, which equates to $2,846.24 in wages. In contrast, a Taser equipped with the basic digital power magazine takes approximately 1 minute to download, which equates Town of Vail Page 2 12/20/2011 6 -5 -2 to approximately 1 hours and 40 minutes of total time to download the department's Tasers per year and $62.13 in wages. These times do not include the mandatory downloads after Taser deployments, which would provide further time and financial savings. The switch from the X26 with the Taser Cam to a stand alone X26 would result in a time savings of 71 hours and 40 minutes, which equates to a financial savings of $2,784.11 per year. From a financial standpoint, the addition of a Taser Cam is expensive. The current price of our Taser X26, which includes a Taser unit, digital power magazine and a holster, is $809.95, plus the additional cost of a Taser Cam is $411.95, for a total of $1,221.90 per unit. The cost savings of $411.95 by eliminating the Taser Cam will be slightly offset by the required purchase of the additional digital power magazines as they become depleted. The Taser Cam itself supplies the power to the Taser itself and is rechargeable. By moving to a camera -less system, we would be using the digital power magazine, which should last approximately 3 years under normal conditions and has a replacement cost of $32.95 each. Since each Taser unit comes supplied with a digital power magazine, we have enough on hand for each unit we currently have, so making the switch would be very simple and cost effective. Besides the financial, technological and evidentiary issues, there is also a perception and carry issue. It is common for Officers to be asked why they are carrying two guns. While it is commonplace for the public to see Officers carrying Tasers, as their use is wide spread and on nearly every television show, it is very unusual for people to see an Officer with two guns. This is certainly due to the size of the Taser when the Taser Cam is added, which visually almost doubles the size of the unit. This is not the perception we want to give the citizens and guests of our community and if we make the change to the more common stand alone X26, which the public is already used to seeing, it will reduce the perception of an over - gunned, militaristic police force. This size issue also contributes to some of our smaller Officers having considerable difficulty fitting it on their duty belt. While they have been able to make it fit, it more often than not makes it difficult to access other items on their belt, most notably their duty weapon magazines. In some cases, it has forced Officers to carry required items, such as their collapsible batons, in their pocket. Obviously this interference could make for a potentially dangerous situation should the Officer need to access those magazines in a highly stressful situation, or during a struggle have the baton fall out of their pocket and into the wrong hands. Conclusion: The time and money spent to maintain, download and purchase the Taser Cams has not been reciprocated in any further evidence gathering value. The elimination of this unnecessary piece of equipment will save the department a significant amount of money in wages and will provide further savings in the future when purchasing or replacing units. The elimination of the Taser Cam will in no way effect the safety of our Officers and citizens, or their effectiveness in dealing with aggressive or combative suspects.
