ACTION REQUESTED OF COUNCIL: Provide direction to staff on areas of focus
for 2012 Community Survey.
BACKGROUND: The Town of Vail community survey is used to probe public
policy issues and solicit feedback on other topics of community interest. It is also
used to measure the town's operational performance as compared with previous
years. The most recent surveys were conducted in 2003, 2005 and 2010. A 2012
survey is planned to coincide with the new Town Council term and to benchmark
municipal service levels. The purpose of the discussion is to develop a list of
community issues and topics to be included in the survey and to finalize
methodology and schedule.

4) Vail Valley Athlete Commission: The Commission convened February 14
to award grants to qualified local winter athletes. The Commission is
composed of three members: Vail Valley Foundation ($10,000), Vail
Resorts ($10,000) and the Town of Vail ($6,000). It was jointly decided to
set aside a greater amount for summer athletes than in the past, based on
the growing number of summer sports and participants.

Vail Valley Drive Reconstruction
Background
Memorandum
Vail Valley Drive, from the Ford Park Soccer Field parking lot to Sunburst Drive, has been
scheduled for reconstruction for the past 15 years. The initial concept was a complete road
reconstruction, including drainage improvements and a sidewalk/bike path to accommodate the
Gore Valley Trail that runs along this stretch of road. The sidewalk was included to separate
vehicular traffic from pedestrians, particularly from the bus traffic that runs along Vail Valley
Drive.
The project has evolved over the last 10 years, eliminating the sidewalk /bike path and reducing
the amount of curb and gutter by over two thirds. Numerous bike path alternatives were
analyzed, including; rerouting bicyclists onto the South Frontage Rd, along Gore Creek, along
the current alignment of the Vail Trail or portions of it, and providing a widened shoulder along
Vail Valley Drive. Ultimately the direction of Council has been to not include a bike path and
implement a share the road policy for this portion of Vail Valley Drive.
The project was scheduled for construction and budgeted for in 2011. However prior to bidding
the project in the Spring of 2011, ERWSD expressed a potential interest in cost sharing a
portion of the project and replacing infrastructure. It was deemed appropriate to hold the project
until ERWSD could confirm their position. After a thorough analysis, ERWSD determined that
the upgrades to their infrastructure are not needed.
As a result of this determination, staff has completed final construction documents and the
project is ready to bid. In order to bid and award the project in 2012, the 2011 project budget
will have to be rolled into the 2012 budget. The remaining 2011 budget for construction of the
project is $1.8 million. The current estimated construction budget for the project is $1.6 million.
If approved, the project is currently anticipated to start in May and be completed by September.

The motion failed to be approved. There were no other motions made.
Warren Campbell made a presentation per the Staff memorandum.
Commissioner Kurz stated that this topic came up previously. He stated that he believes the
Design Review Board made appropriate finding in taking their action. He stated that he was
concerned about the long term effects of the removal of healthy trees and the environmental
charge of the Commission. The view corridors today are narrow and many have building and
streetscape element encroachments. He added that with the new larger buildings being
constructed view corridors are not a viable concept. He stated that the proposal does not make
sense and he is against the amendment.
Commissioner Cartin asked who would be responsible for removal of a tree on private property
should it be deemed to be detrimental to a view corridor.
Warren Campbell responded that the Town would work with a private property owner to address
all issues.
Commissioner Cartin asked what the threshold would be to determine whether the tree was
detrimental.
Warren Campbell responded that criteria were not included in order to allow the DRB to make
these determinations as they do currently for all landscaping changes. He added that all view
corridor points originate on public property, although many cross private property.

Commissioner Cartin stated that there needs to be a balance between water quality and view
corridors, as many of the trees in the photos of view corridors are trees along Gore Creek. With
stream health becoming a paramount concern recently he is sensitive to the need to shade and
stabilize the creek with trees.
Commissioner Schneidman stated that he was curious about other communities that have view
corridors and how they address this vary issue.
Commissioner Pierce stated he is in support of the proposal as he felt the DRB could make the
determination if landscaping was detrimental to a particular view corridor. The amendments
provided flexibility, but would also prevent removal without consideration of the purpose of the
view corridor.
Commissioner Hopkins stated that healthy forests with trees of varying ages would be helpful for
maintaining forested health and promoting water quality. She added that to maintain views tree
maintenance was necessary.
Warren Campbell clarified that the proposal would only allow for removal of trees in adopted
view corridors and not views from private property.
There was no public comment.
Henry Pratt made a motion to recommend approval. Pam Hopkins 2n the motion. The vote was
3 -3 -0. The motion failed to be approved.
Commissioner Kurz stated the view corridors are antiquated.
Commissioner Schneidman said it would be better to say "no greater than what is necessary ..."
to ensure the minimal amount of alteration was applied for and approved.
Commissioner Cartin stated that the trees break up bulk and mass of the large scale buildings
and sacrificing large trees that are appealing to the general public to save a certain angle of a
certain view is not worth it. He added that the review of the alteration of landscaping in a view
corridor was subjective. He continued by asking if trees were a part of a view corridor and added
to its appeal or are they detrimental?
Commissioner Pierce asked Commissioner Schneidman if there were any changes he would
propose to the language which would gain his support?
Commissioner Schneidman stated no.
Commissioner Kurz stated maintenance of view corridors including trimming would be ok, but not
removal of healthy trees. He stated that view corridors are very narrow and you don't even know
you're looking through a corridor unless you're in a very specific location.
Commissioner Pierce added that the view corridors are not static and you can see them through
many different points.
Commissioner Hopkins stated that she was on the Commission when the view corridors were
established. They were established after Beaver Creek was built and very few views were
preserved to the natural environment. The view corridors are achieving their intent.T

Warren Campbell outlined how view corridors have been established in conjunction with the
introduction of new buildings in the Town.
Commissioner Kurz stated that removal of a tree for to achieve a view corridor in Colorado is
offensive.

Building Design
Commissioner Kurz asked if composting would be required in a home.
Kristen Bertuglia responded that composting areas could count as recycling areas, but would not
be required.
Regarding heat tape, Commissioner Pierce stated that ice damming can be avoided with other
regulations.
Commissioner Hopkins stated that gutters can be problematic, and that unless you have larger
gutters, there is always dripping.
Commissioner Kurz stated that one major issue is roof forms shedding water onto parking lots
that turns to ice as in his neighborhood.
Kristen Bertuglia responded that you want to hold snow or divert melted snow from the driveway
and walkways.
Commissioner Pratt stated that a roof that is meant to hold snow and doesn't have gutters will
still drip when melting. He added that there are many points that one can change after final
approval.
Commissioner Pierce stated that insulation can prevent ice damming.
Warren Campbell asked if you can put controls on heat tape.
Commissioner Pierce stated that some heat tape is triggered by temperature.
Commissioner Cartin stated that Vail Resorts has heat tape with temperature controls.
Commissioner Pierce questioned allowing water to drip on the ground.
Commissioner Pratt said if the policy is to reduce heat tape, this is one way to do that.

Landscaping and Irrigation
Commissioner Cartin asked how large trees are to be protected. Warren Campbell responded
that all trees on the survey would be subject to this point.
Commissioner Pratt stated that 2 feet from the trunk would not save the tree, but it may help
prevent materials be stored against it.
Commissioner Hopkins asked if we can require or incentive healthy trees through watering and
injections, or hiring an arborist to ensure the health of the tree.
Commissioner Pratt stated that the defensible space could be added to this discussion.
Commissioner Pierce stated that 2 feet is not enough to save a tree.
Commissioner Pratt asked if this applies to properties with irrigation only.
Commissioner Cartin stated that Vail uses more water in summer than in winter per the Eagle
River Water and Sanitation District.
Commissioner Pratt stated that the landscape requirements are pretty heavy, and now, 20 years
later, you can't see the house. He said it was a problem to force people to replace trees,
especially aspens. It should only be required for spruce trees. He said it should be more
flexible.
Commissioner Hopkins stated that on Mill Creek Circle, there are houses with massive trees that
would be difficult to replace foot - for -foot.
Commissioner Pierce stated that there are some projects that used poor site development tactics
that ended up with removing every tree on the property. In some cases on Forest Road, there is
no way to put those trees back on the site.
Warren Campbell asked if the way a tree is measured should be clarified. Trees considered 6
feet in height count the root ball as well, and the actual tree is only 4 -5 feet tall.
Both Commissioner Pratt and Pierce said the DRB should be the decision maker on tree
replacement.
Commissioner Kurz stated that Aspens proliferate but other trees do not.
Commissioner Hopkins stated that some landscaping is worth removing.
Commissioner Pratt stated that portions of landscaping that are sod should be split into a few
levels of points.
Commissioner Pierce said the grass blocks are tough to plow.
Commissioner Hopkins asked if sand set block would count as permeable.
Commissioner Cartin added that any fees applied through the program should be used only for
the mitigation of environmental impacts for which it was collected.

Commissioner Pratt said some negative aspects of building should result in negative points (i.e.
more turf grass could result in negative points that would need to be made up elsewhere in the
checklist).

I. BACKGROUND
The Town of Vail community survey is used to probe public policy issues and solicit feedback
on other topics of community interest. It is also used to measure the town's operational
performance as compared with previous years. The most recent surveys were conducted in
2003, 2005 and 2010. A 2012 survey is planned to coincide with the new Town Council term
and to benchmark municipal service levels. The purpose of the work session is to develop a list
of community issues and topics to be included in the survey and to finalize methodology and
schedule. Chris Cares of RRC Associates, the town's research contractor, will facilitate the
discussion.
II. DEVELOPMENT OF THE SURVEY QUESTIONS
A working draft of the 2012 survey is included as an attachment. The questions shaded in blue
are topics forwarded by the Town Council in 2010. While some of these questions are no
longer pertinent, the Town Council may wish to retain selected questions to measure changes
in community sentiment. In addition, there may be benefit in asking for feedback on the four
goal areas identified recently by Town Council: 1) Improve Economic Vitality; 2) Grow a
Balanced Community; 3) Improve the Quality of the Experience; and 4) Develop Future
Leadership. Questions related to town service levels have been reviewed and updated by the
staff and are included in the working draft.
III. METHODOLOGY
The proposed methodology for the 2012 survey would use two techniques: 1) an initial
postcard mailing to households, business owners and part -time residents inviting recipients to
enter a password to complete the survey on -line; and 2) promotion of an open invitation to
complete the survey on -line without a password restriction. The two formats would be used to
enhance participation, especially among subgroups of residents (such as the youth segment).
The initial postcard invitation mailing would be based on a list of Vail households to be
purchased from a third -party provider. In addition, paper copies of the survey would be
available for distribution in Town of Vail buildings as a mail -back option. These methods were
used in 2010 and resulted in 528 completed responses with a margin of error of about 5
percent. The proposed method would ensure comparability to past research and would
represent an inclusive outreach to citizens with several different invitations to participate. The
results provide an effective tool for understanding community sentiment. See results attached.

4) Vail Valley Athlete Commission: The Commission convened February 14 to award grants to
qualified local winter athletes. The Commission is composed of three members: Vail Valley
Foundation ($10,000), Vail Resorts ($10,000) and the Town of Vail ($6,000). It was jointly
decided to set aside a greater amount for summer athletes than in the past, based on the
growing number of summer sports and participants.

• Update on Conference Center Funds Projects:
Greg Hall, Public Works Director, gave a brief update on the golf course clubhouse /pavilion. Hall
stated the design teams are under contract and construction will begin in 2013 with a soft opening
in the spring of 2014. The clubhouse /pavilion will have views of the Gore Range Mountain with
an inside and outside capacity of 400 -425. There is currently only one kitchen planned for the
clubhouse restaurant but this kitchen will also be utilized by outside caterers for events in the
pavilion. Hall did go onto say a second kitchen is being discussed, similar to a caterer's kitchen, -
for the pavilion depending on the type of liquor license the premise will have.
Todd Oppenheimer, Town of Vail Capital Projects Manager, presented a PowerPoint of the Ford
Park improvements. There will be three full size softball fields, end to end soccer fields, new
restrooms, concession stand near the east field and a maintenance facility near the west field. An
overlook, walk and stair connection to the lower bench area of Ford Park is also part of the park's
improvements.
The Gerald R. Ford Amphitheater will have proposed improvements such as additional lawn,
stadium like, seating, improved plaza entry and restrooms. Oppenheimer stated the truck
turnaround at the amphitheater will also be improved to allow semi trucks making a delivery to do
a 3 -point turnaround with the hopes to limit vehicle activity in Ford Park.
Oppenheimer shared with the committee the proposed improvements to the Betty Ford Gardens
such as expansion of the gardens to showcase AIPP art exhibits, improved restrooms, a -
covered outdoor terrace, a welcome center, a Ford tribute and an overall enhancement of the
landscape and pedestrian environment along Betty Ford Way.
The grade of the stream walkway will be reduced, the parking area for the park will have an
additional 32 spaces, the bus drop -off and all park entries will also be improved.
Newbury reminded the committee that Ford Park is a park and if you add more buildings it will
take away the "park feeling ".
Mullen asked if the golf clubhouse & pavilion will have a liquor license or if it would be run like the
Donovan Pavilion and give the event an option to bring in a caterer and liquor.
Gunion stated the Vail Recreation Department is currently looking at the liquor options and what
license would be a good fit.
Navas expressed concern about the sporting fields being licensed and how that would affect
nonprofits and sporting tournaments having special events in that area.
Gordon inquired if there would be events such as concerts held on the fields.
Zemler said it would be difficult to have events like a concert on the fields due to the damage to
the turf and irrigation system from a large crowd. The replacement of the turf and irrigation
system would be expensive. Zemler went on to say even if the fields had artificial turf (which is

not proposed) he felt the Town and the VRD would even be more protective of the fields due to
the overall cost of replacement of the turf due to cigarette burns, gum etc. .
Vail Global Energy Forum Update:
Carl Colby spoke to the committee regarding the upcoming Vail Global Energy Forum being held
at the Vilar Performing Arts Center in Beaver Creek on March 3 -4, 2012. The event is to
examine the combined challenges of energy supply, energy security and the impacts of
energy use that will shape the energy transitions underway now and in the decades to
come. Colby informed the committee that there will be several distinguished speakers
from Stanford University, MIT and Caltech, and the keynote speaker is the Colorado
Governor, John Hickenlooper. The event is open to the public. Tickets are $100 for
general admission and $175 for a "Signature Package," which includes reserved
seating, pre and post event receptions on Saturday, as well as continental breakfast on
Sunday.

The financial reports were provided in the committees' packets.
Event Metrics Report:
McDonald explained to the committee how events that receive $10,000.00 and up are strongly
encouraged to preform an independent survey of guests attending the event. The survey should
provide information such as, how many attendees were at the event, an estimated spending of
the guests, estimated room nights, overall satisfaction of the event and would the event attendees
return to Vail. McDonald stated the Town Council requested intercept- studies to be paid for by
VLMD and conducted on certain events occurring in the summer of 2011 to obtain consistent
data on 10 -12 events. Navas said it was hard for an event producer to provide exact numbers of
attendees and over night stays if there is more than one event happening that same day because
an attendee will be counted for multiple events.
Moffet stated the numbers of the projected revenue is not real and suggested the CSE take over
conducting the surveys and hire high school students to assist with getting better data.
Cleveland said anyone who attends the special events can see what events are good for town —
you can just see it.
Kurz thought Navas, the CSE board members, McDonald and the VLMDAC have done an
excellent job deciding what events should receive or not receive funding.
The proposed MTRiP retail proxy report was not approved by the group.

This monthly Sales Tax Collection Summary provides both graphic and brief supporting narrative summaries of
sales tax collections in the Town of Vail. It is prepared monthly by town staff in conjunction with MTRIP, and is
intended to provide summary information for town management, Town Council, the Vail Economic Advisory
Council (VEAC), and Vail Local Marketing District Advisory Council (VLMDAC).
1. Series One is an "All Store" series of sales tax collections from all businesses. The report series is best used
to evaluate total sales activity for the current season, compared to last season, and is broken down by both
geographic and business segments.
2. Series Two is a "Same Store" fixed set of select businesses (see table below), using gross sales revenue, and
is best used to compare the performance of a fixed set of established businesses.
3. Series Three is a Comparison of Set One and Set Two, and can be used to compare and contrast the initial
two sets. Comparisons between the two are based on percentage change year over year, thereby mitigating
the fact that Series One—All Store is based on sales tax collections and Series Two —Same Store is based on gross
sales.
All Report sets are further broken down by Geographical subset and by Business Segment. Reports compare
current season -to -date results against the previous season, where "Summer" is May — October, and "Winter" is
November — April.

Memorandum
Subject: Review of AIPP Board Membership and Terms: Title 3, Chapter 3, Sections 2 & 3
I. RATIONALE FOR REVIEW OF PRESENT CODE
After reviewing the language of this section, staff recommends that it should be
amended and clarified regarding AIPP Board Membership.
The current ordinance states that there are 11 members appointed by Town Council to
serve on the AIPP Board. There are actually 10 members, as the Town Council
representative to the Board is not a voting member. After discussions with the
Community Development staff, the presence of PEC and DRB members no longer
seems a necessity, as it was when this was passed as an ordinance in 1996/1992. If
there is significant future development, the AIPP Board would seek advisory
representation from PEC and DRB with recommendations from Community
Development. However, the day to day functions of the AIPP Board do not require their
participation. If these two representatives to the Board were removed it would leave an
even number of members. It is suggested to amend the AIPP Board size to 9 at large
members. It is also suggested that the terms be on a 2 year basis, so that it is
consistent with the other Boards within the Town of Vail.
II. PRESENT TERMS AND AMENDED TERMS — 3 -3 -2
Present Terms:
The Town Council hereby appoints the Vail Arts Board composed of eleven (11)
members who shall act in accordance with the Charter, this Chapter, the direction of the
Town Council, the ordinances of the Town and shall be appointed and serve as
provided in this Chapter. (Ord. 10(1996): Ord. 7(1992))

architecture, art criticism, art education, art history, foreign arts, graphic arts, interior
design, landscape architecture, Town planning, or other art- and design - related fields,
or who have demonstrated a strong interest in the visual arts and civic improvement. All
members shall either be residents of the Town, or own property within the Town. The
terms of the eight (8) members at large of the Arts Board shall be three (3) years on an
overlapping basis and shall expire on March 31 of the year of termination. (Ord.

Staff would like to ask Council to recommend the Town Attorney to amend the
ordinance for first reading. As the AIPP reappointment schedule is for April 2012, staff
wanted to seek this direction in an information update at your meeting on February 21.
