1. A request for the review of conditional use permits, pursuant to Section 12-9C-3, Conditional
Uses, Vail Town Code, for a healthcare facility and a public building and grounds, to allow for the
redevelopment of the Town of Vail municipal site with a medical research, rehabilitation, and
office building and a municipal office building located at 75 and 111 South Frontage Road West/
Unplatted, and setting forth details in regard thereto. (PEC120012)

Warren Campbell made a presentation per the Staff memorandum.
Mike Foster, of Triumph Development, reviewed the medical office building components,
including the footprint of the building, the floor plate layouts, parking and future growth
opportunities. He reviewed the parking report and how the parking is laid out in the complex.
Commissioner Kurz asked about the estimated occupancy of the medical building, including all
staff.
Mike Foster stated he did not recall the number of staff and would bring that information to a
future hearing.
Commissioner Kurz asked how many parking spaces are allocated for the building.
Mike Foster responded 248 spaces.
Tim Losa, Zehren and Associates, stated that this has been a huge project in terms of
coordination with all the different stakeholders. He showed each floor plate of the medical office
building and detailed all of the programming that occurs on each floor and in each space. He
showed sections of the buildings to explain general height and floor plate size. He then showed
the frontage road improvement plans and circulation plan for the subject site. He showed the
parking floor plates and asked for feedback from the Commission on the parking study. He then

reviewed the criteria necessary for approval of a parking requirement reduction. He reviewed
the neighboring factors surrounding the project. He reviewed the zoning parameters of the
project.
Warren Campbell clarified what was included in the gross square footage of the medical office
building. He also explained the criteria for evaluating a reduction in parking. He added that the
most recent example of a parking reduction request utilizing Section 12-10-20, Special Review
Provision, Vail Town Code, was the Timber Ridge redevelopment project..
Commissioner Pierce stated that parking should be explained in a more detailed presentation.
Commissioner Kurz asked about parking management, not just parking. He said parking
demand will increase as is the nature of the business plan to increase business.
Mike Foster stated that he was prepared to discuss parking, but not parking management. He
added that he would include greater detail on the parking management at a future hearing.
Commissioner Kurz stated his concern for traffic, a housing mitigation plan, growth, etc.
Mike Foster clarified that there is expansion space that is being counted for parking
requirements.
Commissioner Pierce asked for an explanation as to why the reduction of parking should be
allowed.
Mike Foster stated that there will be a certain number allocated to the Town of Vail, then another
number dedicated to the MOB, then the rest of the spaces are shared. He stated the different
uses will share parking spaces. He added the hospital has a program to shuttle employees from
down valley instead of taking cars.
Commissioner Pierce stated that the Commission needs to know the innovative processes that
will be used to reduce parking demand.
Commissioner Hopkins stated she wants to understand how many staff, how many patients are
on site at any time in order to effectively review the parking demand.
Mike Foster stated half of the doctors will be on site and the other half will be off-site doing
surgery.
Commissioner Kurz added that he wants to know how the new building will shift workers from the
hospital to the new building and what parking may be freed up on the VVMC site.
Commissioner Pratt requested information on the number of handicapped spaces.
Commissioner Hopkins asked for information on how the surface spaces and the 12 dead end
spaces in the municipal building will be signed as it appears that congestion could be a problem
as vehicles look for a place to park .
Commissioner Cartin asked about signage and skier parking on weekends. He added that
restricting use to non-skier parking would cause the town to lose these spaces for skier parking
on the weekends. He also asked about parking for the patient and family who goes back and
forth between the VVMC and the new building and where it is expected they will park.

Commissioner Cartin added that Timber Ridge as an example of a recent parking reduction is
not a good comparison example.
Commissioner Pratt asked where the bus stops are located.
Jim Lamont, Vail Homeowners Association, stated that there is progress being made. He said
there has been progress made regarding speaking with the community as well. He said the
hospital is going to have a development plan for the future of the old campus of the VVMC and
that the neighbors want o be active in the development of that plan. He said the neighborhood
wants a master plan for the area between the Vail Village Master Plan and Lionshead
Redevelopment Master Plan areas. He said loading and delivery is an issue and asked if one
bay will be enough for the complex. He said there needs to be due diligence with other
communities who have these types of uses to understand the needs of loading and delivery for
medical services. He commented that parking is an issue because there are many meetings
throughout the day in the municipal building that demand parking spaces. He added there are
many different factors to consider with parking and loading and delivery requirements. He asked
who would get to use the pedestrian bridge, and whether others would be required to walk at
grade across the street. He said the connectivity issues need to be understood. He said options
need to be explored to move pedestrian and vehicular traffic to less congested areas.
Gwen Scalpello stated that at times, the Main Vail roundabout is broken. She said the reduction
in setbacks on the frontage road may crowd the road. She wants to understand the traffic
pattern that is being created.
Commissioner Pierce stated the parking discussion has just begun and there needs to be more
information. He asked if a roundabout is necessary at this intersection.
Commissioner Pratt said Carl Walker is a great parking consultant. He said the loading and
delivery facility should accommodate a semi-truck. He asked why the bridge cannot go in the
easement on the Evergreen property.
Tim Losa stated that the easement is messy and wouldn’t allow the bridge to land on the site.
He said they could do better with the bridge design. He asked if sun/shade analysis would be
included. He said he would hate to see an ice dam off the highway. He said the bulk and mass
on the south side is concerning. He asked where the helipad is going.
Commissioner Kurz said the impact of the development needs to be considered.
Jim Lamont suggested building a sound wall along the north side of the buildings to show how
these walls could be implemented for the valley.
Commissioner Cartin asked about the US Bank building application later in the agenda.
Warren Campbell stated the item is being withdrawn.
Commissioner Cartin stated that the MOB elements could complement the municipal building.
He added that the Commission should know what the CDOT requirements are for the bridge.
George Ruther summarized comments and asked for input on comments provided.
Commissioner Pratt asked for a 3D model and flyover prior to a final decision on the application.

amendment, pursuant to 12-3-7, Amendment, Vail Town Code, to allow for amendments to Title
12, Zoning Regulations, to amend the development review process, and setting forth details in

Rachel Dimond made a presentation per the staff memorandum. The problem statement and
goals were introduced.
Commissioner Pierce suggested that current trends in zoning should be examined. He said the
Town should not patch the code, but should evaluate the process and make changes that will
have positive impacts.
Jim Lamont, Vail Homeowners Association, highlighted concerns about the need for a
development plan in connection with a rezoning application. The proposed use and
development should be analyzed in conjunction with a zoning request.
George Ruther, Director of Community Development, asked the Commission to provide input on
the problem statement and validity of the statement that “the process is complicated and needs
amendment.” He asked if the perception of the problem matched reality and whether time
should be invested to improve the process. He suggested tweaks are not going to get us to the
point where we want to be.
Commissioner Kurz stated that he would rely on staff and others on the Commission to provide
feedback on whether the proposed amendments are effective and appropriate. He added that
every decision made affects property values, views, etc but this should not be a governing factor.
Commissioner Hopkins stated that current staff has longevity and history in their knowledge
which is helpful. She believes the current situation is that applicants do not want to pay what is
necessary to prepare the necessary documents to the degree that is being suggested.
George Ruther clarified the differences in prescribed standards and changes to expected
outcomes in conditional uses, variances, etc.
Commissioner Cartin suggested that it is difficult to sort through zoning regulations and the
Town should evaluate tools used to disseminate information. The method by which people can
obtain information is outdated. There are new tools from phones to tablets and the Town needs
a simple way to help people to understand the information.
Commissioner Pratt added that large and small projects want to avoid architectural fees, design
review, and build want they want. On bigger projects the process may be too easy.
Communication is something that could be improved. Pending applications for DRB could be
posted online as an example. Developers want the entitlements before they spend money.
George Ruther spoke to the goal of creating and allowing citizen access to the digital information
the Town has in its archive.
Commissioner Hopkins spoke to the joint property requirement and how to keep all properties
involved in the process.

George Ruther spoke to how development Vail is jointly held by many property owners and it is
not the Town’s place to decide how development potential is allocated between joint property
ownership.
Commissioner Pierce stated that the development review process does result in some great
outcomes. It may not be possible to have the layman understand the process just like he
wouldn’t understand a medical document if he were to pick it up. The complicated process may
be necessary in a lot of situations.
Commissioner Kurz stated that many of the things suggested in the memorandum seem
appropriate and logical.
Commissioner Rediker stated that he feels that a without a complete rework of the Town Code,
the result will be a patchwork of fixes as in the past. Goal 1 should add a statement as to why a
specific process needs to be amended.
Jim Lamont stated that he agreed with Commissioner Rediker and added that the processes
existed to create and hold value in properties in Vail and require high-level design professionals
in the process. He believes that the Town has developed a sophisticated design process which
has resulted in a great community that maintains value. He added that if values are maintained
throughout the community we are doing a good job. He said in the last six months he has
witnessed how the community can convey information to the public. The community survey is
from the past and may not be reflective of the feelings today. The process should not be
changed to address several vocal individuals. This community will fail miserably without the
quality of people who sit on the Commission and other boards. He believes the system is user
friend, but people just need to be educated on how to use it.

June 26, 2012
Sales Tax
Upon receipt of all sales tax returns, May collections are estimated to be
$472,576 down 0.2% from last year and down 4.6% compared to budget. Year to
date collections of $10,646,305 are up 9.5% from budget and up 2.5% from last
year at this time. Inflation as measured by the consumer price index was up 1.7%
for May.
Real Estate Transfer Tax (RETT)
RETT collections through June 26th total $2,539,931 down 14.5% from this time
last year. Of current collections, approximately 18.6% is from major
redevelopment projects including Vail Plaza Hotel, Manor Vail, Mountain View,
Ritz Carlton Residences, Solaris, and The Sebastian. Collections not related to
major redevelopment projects currently total $2,066,875, up 60% from prior year.
Use Tax
Use tax collections currently total $670,051, exceeding the annual budget of
$515,000. The increase in activity is due to both significant home renovations as
well as a few larger commercial renovation projects.
Summary
Across all funds and revenue accounts through June 26, 2012, total revenue of
$27.6 million is down 3.5% year-to-date from budget and down 5.4% from this
time last year. We have currently received 50% of total budgeted revenues for
the year.

Town of Vail Economic Indicators Summary: June 2012 Update
(Based on data as of April 30, 2012)
INTRODUCTION: This Summary report of Vail Economic Indicators is based on April 30, 2012 data and has been
updated in June of 2012, once winter (November – April) data became available. It is intended to provide an overview of
recent economic activity and to serve as a benchmark from which future economic activity can be displayed and compared.
These seasonal reports began in early 2009 when relevant data was gathered from various secondary sources for the date
range of November 2004 through April 2009 and is now updated seasonally. The data is depicted by general category
(Tourism, Real Estate, Town Revenue, Business Growth and Macroeconomics) and seasonally (Winter: November – April,
Summer: May – October). It is presented in a chart format with this brief summary as a part of the Town of Vail 2012
Economic Development Strategic Plan and is limited in scope and accuracy by the availability of data from secondary
sources. It is believed to be accurate but not independently verified and is best used as a general overview as a result.
OVERVIEW: This narrative overview is supported by a more granular chart (attached). Most statistical comparisons are
based on year-over-year comparisons as of April 30, 2012, vs. April 30, 2011, and reflect a winter seasonal view unless
otherwise indicated:
1. Tourism: In the wake of the 2010/11 winter season, where snow was plentiful but the economy was stuttering,
the 2011/12 winter season resulted in the opposite outcome. Snow was scarce and Vail, as well as the majority
of all U.S ski resorts, received significantly less snowfall (50%) than the previous year resulting in one of the
mildest winters in recent history. The national economy showed signs of improvement offering possibly more
discretionary dollars to be spent on travel (see Macroeconomics). Mountain resorts that were successful under
these circumstances were destinations who are consistently effective in attracting international and destination
visitors and don’t rely as heavily on regional skiers who tend to stay away if snow conditions are not to their liking,
Vail being one of the most prosperous. As a result, Tourism indictors show varying outcomes. Vail saw a very
slight increase in occupancy (+1.0%) but a larger and rather significant increase in the average daily rate (+7.7%)
resulting in increased revenue per available room (+8.8%). When compared to other U.S. western mountain
resorts, based on overall MTRiP industry data, Vail out-performed the industry, where occupancy declined (-2.8%)
and rate increased (+4.8%) resulting a year over year percentage change in revenue per available room (+1.8%).
While specific skier visits for Vail are no longer available, Vail Resort’s Third Quarter Fiscal Earnings Release
stated that skier visits declined an average of -9.0% at Vail Resort’s Colorado resorts, which is better than the
industry average of -15% (reported by the National Ski Areas Association). Overall, Vail was successful in
attracting and retaining overnight visitors as reflected in the lodging metrics and sales tax collections (see Town
Revenue) but skier visits from Front Range, local and second homeowner skiers suffered. Other metrics that may
support this are Tunnel Traffic (-1.0% from last year and down -9.3% from the 2009/2010 season), Deplanements
at Eagle County Regional Airport (-9.1%), and Town of Vail Parking Counts (-7.0%). Additionally, visitors
frequented the Information Centers, perhaps to find alternatives to skiing with a 12% increase in visitors from last
season. An array of special events took place during the winter months. Total attendance/participation increased
(+11.0%) mainly due to the return of the Junior Olympics and the first annual Teva Winter Games.
2. Real Estate Indicators have stabilized in the past year with gross sales remaining flat to last year (+0.9%). Total
transactions increased slightly (+5.5%), which lead to a decrease in average sale price per transaction (-4.7%).
This data was provided by the Town of Vail based on Real Estate Transfer Tax collections. No newly constructed
dwelling, hotel/accommodation or fractional fee units were completed in 2011, which will increase the stabilization
of the real estate metrics in the future. Other real estate indicators were unable to be verified in time of the
publication of this document and therefore are unavailable. An update of this summary will be provided once this
data is available.
3. Town Revenue Metrics include: sales tax, construction use tax, property tax and real estate transfer tax revenues
along with general fund balance as an indicator of the Town’s level of reserves.
a. Sales tax is segmented by business type (retail, lodging and food/beverage) and further broken down
geographically by Vail neighborhoods. All segments combined showed a strong increase in overall
winter sales tax revenue (+5.9%) following the previous winter season’s sales tax revenue, which had
increased significantly (+13.0%). Specifically lodging (+8.2%) and food and beverage (+7.1%) sales
tax collections saw a higher year over year increase than retail (+2.2%). When segmented by
neighborhood, Vail Village saw the largest increases overall (+9.5%) compared to Lionshead (+2.5%)
and Cascade/Sandstone/East & West Vail (+0.2%). It should be noted that the continued increase of
sales tax collections in Vail Village can be attributed to new lodging properties, restaurants and retail

outlets that recently opened and contribute to the 2011/12 winter season setting a record for the
highest sales tax collections in the history of the Town of Vail. A study conducted by MTRiP shows
that the average of comparable ski towns was also up season-over-season in both lodging sales
(+5.7%) and in taxable sales (+4.1%) but to a lesser degree. After dramatic decreases in the
2008/2009 season and steady increases from 2009 to 2012, sales tax collections are exceeding the
pre-recession season of 2007/2008.
b. Other Tax Collections by the Town of Vail include construction use tax, property tax and real estate
transfer tax and are reported on an annual basis, which do not correlate with the seasonal indicators
above. Construction use tax showed its first decline since its implementation in 2008 where it significantly
decreased (-34.6%) due to the completion of major construction/reconstruction projects, as did real estate
transfer tax collections, which also decreased significantly in 2011 (-36.6%). Property tax has been
impacted positively, largely by new lodging product over the past several years, resulting in a 1.9% year
over year increase since 2008, with a 5% increase in 2009 and a 9.7% increase in 2010. However,
during 2011, property tax collections have leveled off and only show a 1.7% increase over 2010 and can
be expected to be more consistent in the coming years. Stabilization in all aspects of these tax
collections can be expected in the near future.
c. Town Reserves have remained stable over these past several years, having actually grown 11.1% since
the start of the recession in 2008, which is believed to be somewhat unique among municipalities in this
recovering economy.
4. BUSINESS GROWTH is based on broader county and national indicators, many of which are tracked on an
annual basis, lag significantly and have just been updated for the 2011 calendar year. While not as current and
telling of the current market conditions, the Business Growth indicators show a steadying economy as evidenced
by unemployment in Eagle County, which experienced a significant decrease, from -9.5% to -8.6%. The Same
Store Sales Report is generated to compare year over year sales tax collections among established businesses in
the various business segments and neighborhoods and does not take in to account newly open/constructed
lodging properties, retail shops or restaurants. According to this report, sales tax collections at long-time
established businesses increased slightly (+0.5%) over last season. Overall sales tax collections among all
businesses increased (+5.7%) year over year, mostly in Vail Village where new businesses are located, showing
that sales tax collections were impacted by a vibrant new business mix.
5. MACROECONOMICS: Though officially over in June of 2009, the recent “Great Recession” continues to have
lingering effects on domestic and global financial and consumer markets, as both look to establish a foothold in the
recovery. While GDP is increasing apace, U.S. and European sovereign debt crises threaten to test the stress-
resistant status of domestic banks, creating uncertainty among employers and forcing them into a corner,
effectively stalling the decline in the U.S. unemployment rate that was prominent in late 2011 and early 2012. The
result of these challenges has been varying and unstable Consumer Confidence Index (CCI), the econometric
most readily impacted by employment and finance, which has continued to behave erratically since its low of 25.0
points at the depth of the recession in February 2009, and which remains well below the 90 point benchmark of a
healthy consumer environment, having eclipsed 70 points just 2 times since February 2008. Despite these
concerns, consumer spending is increasing amidst recently falling consumer prices and a lower national inflation
rate, while the Index of Leading Economic Indicators, traditionally a good barometer of economic direction, has
remained in a growth state throughout the past 36 months and is continuing this pattern into Summer 2012.
Overall, then, there are conflicting messages from the macro economy of both stagnation and growth, with finance
and employment factors reflecting the former, while consumerism reflects the latter, particularly with respect to
sustained rate growth in the mountain resort travel industry over the past 15 months. However, despite the
positive direction of resort guest behavior, they remain subject to the volatility apparent in the greater economy
and should not be taken for granted.
This foundational data set and summary will be further updated and expanded upon seasonally, taking its place among
the tools available to the Town, its various committees and the public it serves.

I estimate Vail will collect another $38,000 in May sales tax to bring May
collections to $472,576. If so, we will be down 4.6% or $22,798 from budget and
down .2% or $716 from May 2011. Year to date would be up 9.5% or $921,584
from budget and up 2.5% or $259,081 from 2011.
