AnoverallobjectiveofthemasterplanningprocessforFordParkisthe selectionofasitefortheproposedBettyFordAlpineGardenEducation Center. Daly TownMayor ATTEST: TammyNagel, ActingTownClerk ResolutionNo.9,Series2013 9/17/2013 EXHIBITA TOWNOFVAILPUBLICRECORDSPOLICY I.PURPOSE ThepolicyoftheTownofVail (the "Town") isthatthedecision-makingprocessisa matterofpublicbusinessandmaynotbeconductedinsecret. Allpublicrecordsshallbeopen forinspectionbyanypersonatreasonabletimes, exceptasotherwiseprovidedbylaw. However, computer-generatedcommunicationsystemsarefrequentlyusedbyemployeesforthe purposesofdocumentingandsendingpersonalorprivatemessages, ormessagesnotintendedto beviewedbythepublic. TheTowndesirestoimplementapolicythatwillservethepublic's righttoaccesspublicrecords, whileidentifyingtoemployeestheinherentdifficultiesinensuring privacyintheuseoftheTown'scomputersystemforpersonaluse. II. AUTHORITY TheTownenactsthisPolicyunderthefollowingauthority: theColoradoOpenRecords Act, C.R.S. § 24-72-201, etseq., asamended (the "CORA"); theColoradoSunshineLaw, C.R.S. 24-6-401, etseq., asamended; Blackv. SouthwesternWaterConservationDistrict, 74P.3d462 Colo. App. 2003); GlenwoodPostv. CityofGlenwoodSprings, 731P2d761 (Colo. App. 1986); andMountainPlainsInvestmentCorp. v. ParkerJordanMetro. Dist., 12CA1034 (Colo. App.,August15, 2013). III. DEFINITIONS ForpurposesofthisPolicy, thefollowingtermsshallhavethefollowingmeanings: Correspondence: Acommunicationthatissenttoorreceivedbyoneormore specificallyidentifiedindividualsandthatisorcanbeproducedinwrittenform, including, withoutlimitation, communicationssentviaelectronicmail, privatecourier, U.S. mail, modem orcomputer. CustodianofRecords: Theindividualwhoshallberesponsibleforcompilingdocuments, schedulingappointmentsforinspection, andforrespondingtoanypublicrecordsrequest. The TownCouncilherebydesignatestheVailTownClerkastheCustodianofRecords. ElectronicMail ("E-mail'): Anelectronicmessagethatistransmittedbetweentwoor morecomputersorelectronicterminals, whetherornotthemessageisconvertedtohardcopy formatafterreceiptandwhetherornotthemessageisviewedupontransmissionorstoredfor laterretrieval. E-mailincludeselectronicmessagesthataretransmittedthroughalocal, regional orglobalcomputernetwork. WorkProduct: Alladvisoryordeliberativematerialsassembledforthebenefitofelected officials, whichmaterialsexpressanopinionoraredeliberativeinnatureandarecommunicated forthepurposeofassistingsuchelectedofficialsinreachingadecisionwithinthescopeoftheir authority. "Workproduct" alsoincludesa requestbyaTownofficialforthepreparationofsuchopinionordeliberativematerials. For example, iftheTownManagerrequestsinwritingthatstaffpreparematerialtoassisttheTown Councilinadecision-makingprocess, thewrittenrequestshallalsobeconsideredworkproduct. IV. PROTECTEDRECORDS A. CertainrecordsareprotectedbylawfrompublicinspectionundertheCORA, includingthefollowing: Personnelfiles Ongoinginvestigationsbylawenforcementauthorities Victim/witnessinformation Socialsecuritynumbers Juvenilecriminalrecords Workproduct Deliberativeprocessrecords Attorney-clientprivilegedrecords Individualmedical,mentalhealth, sociologicalandscholasticachievementdata Lettersofreference Tradesecrets Confidentialcommercialorfinancialdata Personalinformationofpastorpresentusersofpublicutilities, facilities, or recreationalorculturalservices Recordsofsexualharassmentcomplaintsandinvestigations Libraryrecordsandcontributions Addressesandtelephonenumbersofpublicschoolstudents B. RecordsthatareexemptfromtheCORAmightstillbeaccessibleviaotherforms ofinspection, suchassubpoena. V. PRIVACY Employeesshouldhavenoexpectationofprivacywhenusinganyequipmentowned, leasedoroperatedbytheTown. Informationstoredonsuchequipmentissubjecttoauditand reviewbytheTownatanytime, foranyreason. TheTown'se-mailsystemisprovidedbytheTowntofacilitateTownworkandis intendedforbusiness-relatedcommunications, includingusesrelatedtoTown-sponsoredevents andactivities. TheTownrecognizesthatoccasionalpersonalusewilloccur, andsuchuseis permittedaslongasitdoesnotinterruptthenormalflowofTownbusiness. However, any improperuse, asdeterminedbytheTown, isprohibitedandmayresultin: suspensionorlossof e-mailaccess; disciplinaryactionuptoandincludingterminationofemployment; and/orlegal action. B. E-mailcorrespondenceofTownemployeesandelectedofficialsmaybeapublic recordundertheCORAandthereforemaybesubjecttopublicinspection. Exceptionsto inspectionmayincludee-mailwhichiscoveredbytheattorney-clientprivilege, workproduct privilegeorotherprivilegerecognizedbyColoradolaw. Mostroutinee-mail, however, will likelybeconsideredpublicinformation. Employeesandelectedofficialsshouldhaveno expectationofprivacywhenusingtheTown'se-mailsystem. Allelectroniccommunications sentorreceivedontheTown'se-mailsystem, regardlessofthesubjectmatterore-mailaddress used, areTownpropertyandmaybesubjecttodisclosureundertheCORA. TheTownreserves therightatanytime, tomonitor, access, view, use, copyand/ordiscloseallsuche-mail messages. C. E-mailusersareresponsibleforsafeguardingtheirpasswordsandmaynot disclosetheirpasswordstoothers. However, theuseofapassworddoesnotpreventtheTown frommonitoring, accessing, viewing, using, copyingordisclosinganye-mailmessagessentor receivedontheTown'se-mailsystem. D. Townemployeesmaynotaccessthecomputeraccountofanotherunlessgranted permissiontodosobythatuser. Thisrestrictiondoesnotapplytosystemadministratorsand otherswhoareauthorizedtoaccessthesystemsforlegitimatebusinesspurposes. E. Improperuseofe-mailincludes,butisnotlimitedto: 1. Languagewhichisoffensive, obscene, orinpoortaste, includingjokesor messageswhichcreateanintimidating, hostileoroffensiveworkenvironment; 2. MessagesorinformationwhichconflictwiththeTown'spoliciesagainst discriminationorharassmentintheworkplace; 3. Messagesorinformationwhichadvertiseorpromoteabusiness, political candidate, politicalorreligiouscause; 4. Referencesormessageswhichgiveoffenseonthebasisofrace, color, religion,nationalorigin, citizenship, ancestry, maritalstatus, sex, disability, age, veteran's statusorsexualorientation; 5. FrivoloususewhichinterruptsthenormalflowofTownbusiness, suchas playinggames, conductingbettingpools, andchainletters; 3 9112113 9/17/2013 11vws-storageldesktops$1tnagehdesktoplrecordspolicy-2.doc 6. Messageswhichviolateanylaw; and 7. Messagesurgingelectorstovoteinfavorofanystatewideballotissue, localballotissue,referredmeasure, orrecall,pursuanttoC.R.S. § 1-45-117. F. Townemployeesandelectedofficialsareexpectedtousecommonsenseand goodjudgmentinallofficialcommunicationsandtoavoidanycommunicationthatis disrespectful, offensive, orthreateningtoothers. Violationofthispolicymayresultinanyorall ofthefollowing: suspensionorlossofe-mailaccess; disciplinaryactionuptoandincluding terminationofemployment; andlegalaction. G. E-mailisretainedontheTown'sserverforadesignatedperiodoftime, so employeesandelectedofficialsshouldnotassumethatanye-mailthattheypersonallydeleteis therebydeletedfromtheTown'sserver. TheTownwillretain, archive, orpurge, astheTown deemsappropriate, anyincomingoroutgoinge-mailtoorfromanyTownemployee. H. PursuanttotheColoradoSunshineLaw, ameetingofthreeormoremembersof theTownCouncilatwhichanypublicbusinessisdiscussedoratwhichanyformalactionmay betakenisapublicmeeting. Theterm "discussion" asusedintheColoradoSunshineLaw implieslive, responsivecommunicationbetweenelectedofficials. Therefore, itistheTown's policythatthemerereceiptortransmissionofe-mailinotherthanalive, communicative discussionformatshallnotconstituteapublicmeetingandshallnotbesubjecttothe requirementsoftheColoradoSunshineLaw. Forexample, thereceiptbyoneormoreelected officialsofe-mailsentearlierinthedayorweekbyanotherelectedofficialconcerningpublic businessshallnotconstitutea "publicmeeting." Thee-mailmay, however, constituteapublic recordotherwisesubjecttodisclosurepursuanttotheCORAandthisPolicy. VII. RETENTIONOFDOCUMENTS Allpublicrecordsotherthane-mailshallberetainedinaccordancewiththeguidelines establishedbytheColoradoStateArchives. AttherequestoftheTownAttorney, theCustodian ofRecordsmayretaincertainrecordsaftertheretentionperiodexpires. VIII. INSPECTION A. General. Publicrecordsshallbeopenforinspectionbyanypersonatreasonable times, subjecttotheexceptionsfoundintheCORA. Allpublicrecordsshallbeinspectedat TownHallorattheofficesoftheTownAttorney. B. RequestRequired. Arequesttoinspectpublicrecordsmustbewritten, and sufficientlyspecificinscopetoenabletheCustodianofRecordstoidentifytheinformation desired. Requestsforinspectionofe-mailshallincludethesender'sname, therecipient'sname andtheapproximatedateandtimeofthetransmission. IftheCustodianofRecordsreceivesa requesttoinspectpublicrecordsthatisambiguousorlackssufficientspecificitytoenablethe CustodianofRecordstolocatetherecords, theCustodianofRecordsshall, withinthreeworking days, notifytherequestingpartyinwritingofthedeficienciesintherequest. Anyclarified requestshallbeconsideredanewrequestforpurposesofthisPolicyandtheCORA. 4 9112113 9/17/2013 11vws-storageldesktops$1tnagehdesktoplrecordspolicy-2.doc C. ReviewandResponse. Uponreceiptofarequestforinspectionofpublicrecords, theCustodianofRecordsshallreviewtherequestanddeterminewhethertherequestedrecords arevoluminous, inactiveuse, orotherwisenotreadilyavailable. Ifsodetermined, theCustodian ofRecords, withinthreebusinessdays, shallnotifytherequestingpartyinwritingthatthe documentswillbeproducedforinspectionwithinsevenadditionalbusinessdays, pursuantto C.R.S. § 24-72-203(3). Notwithstandingtheforegoing, ifitisphysicallyimpossibleforthe CustodianofRecordstocomplywitharequestforpublicrecordswithinthetimeperiods establishedbyCORA, theCustodianofRecordsshallcomplywiththerequestassoonas physicallypossible. Iftherecordsarereadilyavailable, theCustodianofRecordsshallsonotify therequestingparty. Eachnoticeshallincludetherequireddeposit, ifapplicable, andthetotal amountoffeesthatmustbepaidpriortoproductionortransmissionoftherecords. D. TransmissionorProduction. Asdirectedinthewrittenrequestforrecords, the CustodianofRecordswilltransmittherequestedrecordsbye-mail, regularmail, courierservice orfacsimile. Ifnodirectionisprovidedintherequest, theCustodianofRecordswillmakethe recordsavailableforinspectionatTownHallbyappointment. Innocaseshallrecordsbe transmittedorproduceduntilallfeesunderSectionIXhavebeenreceivedbytheTown. Once allfeesarepaid, theCustodianshalltransmitorproducetherecordswithinthreebusinessdays, unlessalongertimeisprovidedbySectionCabove. E. TownAttorney. AnyofthenoticesrequiredhereinmaybeissuedbytheTown AttorneyinlieuoftheCustodianofRecords. Bywrittennotice, theTownAttorneymayfurther requirethatanyrequestingpartycontacttheTownAttorneyratherthantheCustodianof Records. IX. FEES A. Copies, PrintoutsorPhotographs. PursuanttoC.R.S. § 24-72-205(5)(a), the Townshallchargeafeenottoexceed25centsperstandardpageforanycopyofapublicrecord orafeenottoexceedtheactualcostofprovidingacopy, printoutorphotographofapublic recordwhichisinaformatotherthanastandardpage. ForpurposesofthisPolicy, ablackand whitecopymadeonasinglesheetofletterorlegalsizedwhitepapershallconstitutea "standard page." B. ResearchandRetrievalFees. TheTownreservestherighttochargearesearch andretrievalfeeof $25.00perhourforanystafftimedevotedtosearchingfortherequested information. Agreaterfeemaybeassessedifprofessionalassistanceisneededtoretrievethe requestedinformation, includinganyactualattorneyfeesincurredintheperformanceofa privilegereviewandthecreationofaprivilegelog. Adepositofequalto50% oftheestimated costsofrespondingtoarecordsrequestshallbesubmittedtotheTownpriortoanysearchbeing commenced. C. Postage/CourierFees. ElectronicTransmissionFees. EagleCountyisavitalpartnertotheAlliance, andyoursupportremainsof criticalimportancetoourefforts. AndthatiswhywewishtoreiterateourrequesttoEagleCountyfor $200,000infunding for2014. WerealizethatoursisnottheonlyrequestforfundsthattheCountywill receive. Butwecannotoveremphasizetheimportanceofourcombinedeffortstothe successoftheEagleCountyRegionalAirportandtotheoveralleconomicwellbeingof EagleCounty. Thechallengesthatwefacearealarming. Aslowlyrecoveringeconomyhasnot translatedintoareboundinpassengerstoourairport. Infact, totalenplanementsandseat capacityattheEagleCountyRegionalAirporthavecontinuedtodeclinefrom2007 throughthepresentday. Andaswehavediscussed, thistrendcouldonlyworseninthe faceoffewerairlinesandsmalleraircraftflyingintoourairport. Additionally, wehave seenthattheColoradocommunitieswiththeirownregionalairportshavenotstoodidly by; theyhavetakenunited, proactivestepstocounterthesesameissues. TheEGEAirAlliancerecognizesthatthesechallengesbelongtoallofusinEagle County. Everytown, everybusiness, everypersonwillbenefitfromourcombined success, ortheywillsufferfromourcombinedfailure. Andthatiswhythedirectsupport fromEagleCountywillbemorethanmatchedbyfundsfromEagleCounty's municipalitiesandresortcompanies, aswellasfromthecounty'smanybusinesses. Armedwiththesecombinedresources, theAlliancewillachievethreegoalsfor2014. First, wehopetogrowthesummerflightbetweenourairportandHouston— aflightthat broughtover3,000visitorstoourvalley, andwhichcanonlygrowinpopularityasit continues. Second, webelievethatadditionalflightopportunitiesexistrightnow. Whetherthese includeawinterflightfromWashingtonD.C. orasummerflightfromChicago, our 9/17/2013 combinedfundscouldbringthousandsofadditionalvisitortoourairportandtoour communities. Andfinally, werealizetheimportanceofdevelopingoneormorelong-termfunding sourcessimilartothosealreadyputinplacebyotherresortcommunitiesinandnear Colorado. Ourcombinedfundsandeffortswillhopefullymakethislong-term, sustainablefundingarealityin2014andbeyond. Again, werespectfullyaskthatEagleCountyactfavorablyuponourrequest.
