BACKGROUND: The Town received two letters of interest for the open positions on LLA as follows (incumbent members are asterisked): LLA: Craig Arseneau and Michael Hannigan* STAFF RECOMMENDATION: Staff requests the Council interview each applicant at the work session and appoint two members to the LLA at the evening meeting. Frontage Road - Vail, Colorado, 81657 MEMBERS PRESENT Henry Pratt Webb Martin Michael Kurz Pam Hopkins MEMBERS ABSENT John Rediker Luke Cartin Dick Cleveland 60 minutes A work session to discuss the creation of a set of policy options and implementation strategies for the Town Council's consideration on the topic of retail marijuana sales in the Town of Vail George Ruther, Community Development Director, gave a presentation on recreational marijuana policy in the Town of Vail. Ruther gave a broad overview of Amendment 64 and Amendment 20. Ruther framed the general question, that being the juxtaposition of the preferences and perceptions of TOV voters with potential regulations /policy. Ruther gave a background on marijuana discussions in TOV including the moratoriums, temporary and permanent. The Recreational Marijuana Working Group was outlined. Ruther stated that their purpose is to identify issues, not necessarily setting policy. Ruther went through their first meeting and the two speakers who presented in addition to Community Development. One speaker was a Breckenridge police officer, Brady Allen, and the other was Meg Collins from the Cannabis Business Alliance. Ruther showed a continuum of options that are available to the TOV. The many questions that have arisen were presented. Ruther concluded with a briefing on the schedule moving forward. Commissioner Kurz commented on what the role of the PEC will be. Ruther clarified, remarking that it will depend on what the policy is. Commissioner Hopkins talked about the odors and her experience with medical marijuana, being a neighbor to an establishment. Ruther mentioned his conversations with the building official on how building codes interact with marijuana. Commissioner Pratt talked about concerns he has heard on the front range with the power companies (Excel). Commissioner Pratt asked about the intersection of federal and state laws and constitutions. Ruther stated that he would check with Matt Mire on this regard. Commissioner Kurz echoed Commissioner Pratt's concern and made comments in regard to banking and the problems associated with that. Commissioner Pratt asked questions concerning where the Eagle County approved locations are. Commissioner Webb raised some comments about proximity issues with other towns, the image issue, and who the stores would be serving (tourists). Commissioner Kurz made comments about the discussion in general and the image and brand question, stating the brand of the Town and that of Vail Resorts are not necessarily synonymous. Ruther wrapped up with a positive note that so far the level of discourse has been very high. 2. I understand that my chair is up next month, and this letter to you today is to inform you of my intent to retain my chair for another term. As a bartender in town at two separate establishments, I feel I hold a certain experience when it comes to the diversity of the liquor board. Year to date collections of $11,974,172 are up 7.6% from the prior year and up 5.5% from budget. Inflation as measured by the consumer price index was up 2.0% for April. The annual budget totals $22.0 million. Real Estate Transfer Tax (RETT) RETT collections through May 28 total $2,776,309 up 73.0% from this time last year. The significant increase is mainly due to the purchase of residential properties. The annual RETT budget currently totals $3.9 million. N 4d .� CD N M co TOWN OF VAIL' Memorandum TO: Vail Town Council FROM: Community Development Department DATE: June 3, 2014 SUBJECT: Town of Vail Community -Wide Recycling Program Q & A SUMMARY On May 6, 2014 the Vail Town Council submitted additional questions to staff with respect to details, consequences, and implementation of Ordinance No. 6, Series 2014. Submitted questions and answers follow. ADDITIONAL RECYCLING PROGRAM QUESTIONS AND ANSWERS 1. How important is tracking the diversion rate? The Ordinance as drafted doesn't provide the right framework because it doesn't require recycling, it just prohibits throwing away recycling, which means people can still take their recycling to drop sites. Many serious recyclers will do this because the contamination rate is so much lower on separated recycling. Tracking a diversion rate is the only way to ensure progress. Ordinance No. 6 does require recycling in the most pragmatic way possible — prohibiting throwing recyclables in the trash, requiring residential customers have containers and pay for recycling with their trash, and all commercial properties must offer and supply recycling infrastructure for residents, guests and business tenants. It would not be possible to mandate "recycling" or "recyclable" materials be present at each household, as that would be mandate what type of material people purchase, to then throw away. For example, a near zero -waste household that does not purchase packaged goods, or drink out of plastic bottles or soda cans may not actually have recyclables to dispose of Specific code language follows, mandatory recycling underscored. 5 -12 -7: RECYCLING REQUIREMENTS A. Placement of Recyclable Materials and Solid Waste for Pick Up: 1. All recyclable materials accumulated on any premises shall be placed in a container or containers separate from solid waste. 2. Recyclable materials shall not be placed in solid waste containers. 3. No refuse, solid waste, or compost shall be placed in any recycling container. 4. Nothing in this section is intended to prevent any person from donating or selling recyclable materials generated on their premises. B. Requirement for Recycling Service: 6/3/2014 1. All recyclable material shall be source separated, stored, and presented for collection by a registered municipal solid waste hauler. Contamination rates on single stream facilities are not always net higher. For example, contamination rates at a poorly run dual stream facility can be higher than 10 %, while a well -run single stream facility with more volume may be closer to 8 %. 2. In fact if we are serious about recycling, should we have non- comingled drop off for the 2 valuable commodities; aluminum and corrugated? Curb side recycling programs always increase recycling above drop -off programs and reduce the need for drop -off centers which have associated maintenance and hauling expenses. Sorting facilities are capable of separating plastics and glass from aluminum, and cardboard from other materials. 3. Without accurate tracking, any goal is fictitious; do we really have any meaningful idea of what our baseline is? Accurate tracking is critical to increasing waste diversion and was therefore included in Ordinance No 6. There have been 3 different studies to determine our baseline as a Town and as a County— a curbside residential trash sort in 2010 -11 winter and summer season, a commercial core trash sort and survey in 2012, and the Eagle County Landfill waste composition study in 2010. There is also an annual waste diversion calculation in accordance with the Colorado Department of Public Health and Environment standards performed by Walking Mountains Science Center. Measurements will be made against the existing baseline and will be consistent year to year. 4. The incentive is clearly to buy a trash can one size too small, are we comfortable with the unintended consequence of higher contamination rates that will result. In addition to being less sustainable, more contamination creates perverse incentives for the haulers, because it costs them money. The Save as You Recycle Program does not encourage a trash container a size too small, but rather an appropriate sized container for the household, which incents proper recycling and source reduction, not contamination. Because recyclables are not allowed in the trash and vice versa, any violation of this rule would result in consequences for the waste generator, or customer, and not the hauler. 5. Does it make more sense to implement pay as you throw and not require recycling or alternatively require recycling and not require pay as you throw? As it stands "requiring" both creates several perverse consequences. Ordinance No. 6 requires recycling as well as volume -based trash rates. Mandatory recycling and Pay as You Throw (Save as You Recycle) programs in combination are the most effective way to increase recycling in a community, proven in communities and cities across the country, including mountain resort towns. Implementing a Pay as You Throw program without mandatory recycling may encourage source reduction and recycling, but does address recyclables in the trash. Vice versa, requiring recycling without Pay as You Throw does not encourage source reduction. Town of Vail 6/3/2014 Page 2 6. Do we define "bear proof" to include current bear resistant containers? Does it require metal cans? Rates will go up less if we abandon bear proof requirements. Can we live with that? Ordinance No. 6 refers to "wildlife resistant" containers, not "wildlife proof', and therefore does not require metal containers. Waste Haulers will need to charge rates commensurate with bear proof containers and dumpsters (if outside) but all new containers will be in compliance with the pre- existing wildlife ordinance. 7. When will we have a firm fix on the cost of bear proofing everyone's new trash can? At what point does it become too expensive? In the commercial dumpster scenario, each hauler has separate rates for retrofitting containers that have not been shared with the Town of Vail. For residential containers, the cost premium for a bear proof container is likely to be an average of $100, but understandably in a competitive marketplace haulers have not provided an exact cost of their containers to date. 8. On the unavoidable assumption that residential hauling costs will rise fairly substantially, are we prepared to defend this new "tax "? Are we comfortable with the entire incremental cost being passed along to the consumer? Referring to recycling requirements as a tax is misleading, as waste haulers already include recycling in residential customer bills and provide the service as part of their existing business model. Requiring every week pick up may increase some customer bills, though overall trash tipping fees will go down. The only way to ensure lower costs to consumers is through a municipal contract for residential trash service, in which uncertainty in the marketplace is removed. 9. Is requiring the recycling cost to be embedded because we are afraid of being transparent about what we've done? All the other utilities are permitted to line item the mandated fees they base required to pay and in turn pass along. Requiring embedded rates simply removes the perception that trash and recycling are a separate service, when the goal is to make the entire waste service process always include recycling, and not incent customers to remove recycling as an unnecessary additional expense to be cut, when in fact actively diverting waste from the landfill should be a part of the way Vail businesses do business. Note that the challenge that does exist with this requirement is that some waste haulers' existing software does not yet have the ability to combine fees on bills and will take time to transition. 10. Is the end result that we will have to mandate by ordinance that all residences will have to contract for service? Are we comfortable with that? Ordinance No. 6 does not mandate that residents contract for trash service, and those who do not are exempt from the requirements. Many communities do require residents pay for trash service whether they are full -time or not, and employ a municipal contract for curb -side service.
