ITEM/TOPIC: Discussion about keeping Vail in a Leadership Position. (120

PRESENTER(S): Vail Town Staff
ACTION REQUESTED OF COUNCIL: The staff requests that Council listen to the
presentation, ask questions and provide direction to prioritize near and long term
initiatives.
BACKGROUND: The Vail Town Council identified in the Council Action Plan
2014-16 a need for a competitive assessment in order to remain the premier
international mountain resort community. Council contracted with RRC to begin the
process by gathering information in a comprehensive and carefully presented way
in order to ground discussions of Vail's competitive future, which was presented
and discussed at a Council retreat on July 15, 2014. On August 19, 2014, RRC
focused on a topline overview of those findings and recommended focus areas for
Vail going forward in order to sustain Vail's economic health. Today's Council
retreat is intended to develop near and long term priorities for keeping Vail in a
leadership position.

ACTION REQUESTED OF COUNCIL: The interviews occur during the work
session and the four appointments will be made during the evening session.
BACKGROUND: Town Council will have an opportunity to interview eleven
candidate for four (4) vacancies which exist on the Commission on Special Events
(CSE) at the December 2nd meeting. One of these vacancies has occurred per
the attached letter received Tub'9699)November 25th from CSE member Booby
Bank, who resigned his position as of year end.
5. ITEM/TOPIC: Business Licenses for Rental by Owner (30 min.)
PRESENTER(S): Stan Zemler, Town Manager, Matt Mire, Town Attorney and
Judy Camp, Former Chief Administration Officer
ACTION REQUESTED OF COUNCIL: Staff requests feedback from Town
Council regarding Rentals by Owner (RBO's) based on information provided in the
attached memo and draft ordinance.
BACKGROUND: Please see attached memo and draft ordinance
STAFF RECOMMENDATION: Staff recommends that Town Council provide
direction regarding sales tax collection from RBO's

"What have we learned?"
• The July meeting, led by RRC, was about reviewing an
expansive fact -based exploration of Vail's positioning; the
August meeting looked toward the future; today we will be
developing near and long term priorities
• The overarching finding from the Competitive Analysis is that
the Town of Vail and Vail Resorts are doing most things very
well. Don't forget that we are at the top by most measures
• Continue to improve in the areas where we perform well by
striving for excellence, while also focusing on areas of
opportunity as Vail plans for the future

• Colorado population will grow overall, as will population in the mountain
areas
• Destination Skier and Rider visitation growth presents challenges in light of
demographics and will likely be increasingly weather dependent
• International visitors continue to present an opportunity, especially Mexico
and Brazil

• Summer growth has great potential, especially if it is given strategic attention
• Millennials and Gen Xers are the future. There is a need and opportunity to
better understand and plan around this group. Target the affluent and
aspirational — aim where our current customer is
• Transfers of wealth will occur. What will this look like for Vail?
• Climate change is to be expected — creating challenges and opportunities

• Vail is at or near the top in most competitive economic measures that were
evaluated including winter skier/rider visits nationally, winter and summer
occupancy, winter rate (summer is relatively weaker), sales tax recovery
since 2008, etc.
• Park City is identified as a notable competitive force based on purchase by
Vail Resorts, size, product, proximity to a major airport and the potential for
the Interconnect. There are other lessons to be learned and elements of
success found in a variety of comparable communities including:
Aspen/Snowmass, Whistler, Breckenridge and Jackson Hole

• Air service is a concern with significant declines since 2007-08. Also,
summer air service is limited and is a weakness when compared to both
Aspen and Jackson Hole
• Regarding winter guest perceptions, Vail has extremely strong brand
awareness and the back bowls are iconic. Ratings of the mountain and Town
are generally very positive, but parking, crowding and opinions concerning
cost and value require continued attention

• We need to create facilities that support events; again, quality and not
quantity. We're not designed for quantity
• We should look at creating opportunities for different types of businesses
ones that would allow guests to stay out later
• Develop an understanding of product offerings that respond to the next
generation and the international guest. Identify needs of Millennials and Gen-
Xers who fit Vail's customer profile. Market research is needed
• Identify physical improvements to be made. Improve signage. Look at
underutilized assets such as Dobson, Ford Amphitheater and Vail Nature
Center
• Maximize access to natural resources
• Increase capacity and lift at Eagle Airport to create more opportunity for the
destination guest to travel easily to Vail

• Continue to upgrade cellular and digital services throughout the town
• Use best available technology to enhance communications with guests and
residents. Build on emerging technology and take full advantage of advances
gained through the World Championships. Additionally, look to enhanced
signage; enhanced vacation planning on web site and mobile devices and up
to the minute and state of the art information systems regarding
transportation and parking, lines/crowding (in town and on the mountain); and
other conditions and events to enhance the experience
• Recognize that Vail Resorts is a leader in using technology to communicate
with guests. Leverage that reputation and other available opportunities (the
GoPro name, etc.) to build the idea that Vail is "tech easy" — Millennials

A Seamless Guest Experience — Excellence in all respects
• Customer Service — collaboration with VR, training, recognition, TOV czar
• Parking and Transportation (in town, from the airports and on 1-70)

communications.) Starting in advance of the visit (trip planning, road
conditions, etc. and carrying through the entire visit) enhanced
communications with guests and residents may be used for continuous
improvement of the experience
• Attention to conditions of crowding and lines

• Continue to track the opinions of year-round and seasonal residents (using
the Community Survey and other sources); "excellent" ratings are the goal

Broaden the Sustainable Economy
• Continue to work with the Vail Valley Medical Center to develop a functional
plan that meets corporate and community objectives
• Work to expand the Eagle Airport in terms of capacity and number of
domestic flights in summer and winter
• Analyze the potential for "Ione eagles" as a component of economic growth
and stability
• Consider town -owned space for non -profits or other groups that could share
facilities
• Pay attention to the health of the retail community. Shopping is a vital part of
the guest experience and it can't be taken for granted
• The tourism -based economy merits attention as well. Working with Vail
Resorts to take advantage of synergies, segments such as international
guests, Millennials and summer visitation can provide avenues for growth

Events
• Continue to evaluate the current mix of events and look to strategically
enhance the offerings. Give attention to events that serve multiple purposes
including reinforcing Vail's brand, reaching out to Millennials and Generation
X, International guests, filling beds midweek, etc.
• Quality not quantity
• Balance messaging of events with reasons guests come to Vail e.g. natural
beauty, enjoy outdoors and be with family and friends

Recommendations and Next Steps
As Vail looks to the future and to opportunities to sustain economic health, the
identified Focus Areas should be prioritized. The findings from this work can be used
to underpin planning efforts across all areas of Town services. Further, the data
presented can be used to refine and integrate into existing strategic plans (Public
Works, Police, Parking, Housing, Economic Development, etc.) to ensure that Vail is
maximizing all its resources to long-term economic advantage
Once priorities are identified, determinations will need to be made about next steps:
• Can these priorities be accomplished within existing budgets or are additional
dollars and/or resources required?
• How are the priorities implemented and what are the timelines (near term or long
term)?

1. A presentation and discussion of the Town's proposed options for reducing the use of plastic
bags at grocery stores in Vail through the encouraged use of re -useable shopping bags.
Planner: Kristen Bertuglia, Environmental Sustainability Manager
Kristen Bertuglia, Environmental Sustainability Coordinator, presented the steps the TOV has
taken over the past few years to reduce the use of plastic bags in the community. Kristen gave
an overview of the plastic bag issue and provided a PowerPoint presentation. Included in the
presentation were results of community surveys, statistics on other jurisdictions and their
approaches to plastic bags. Kristen discussed the spectrum of bag programs ranging from
education on one end of the continuum to a ban on all disposable bags on the other. The current
proposal would include a ban on plastic bags at the grocery store and a 10 cent fee on paper
bags. The fee would be split 25/75 with the stores (75% to town for educational purposes.) The
elements of this proposed program and next steps were outlined.
Commissioner Martin gave his support for the measures and inquired about the reason for the
fee being returned to the grocery store.
Commissioner Cleveland questioned the level of support from the business community and
provided his thoughts on the matter. Cleveland asked about how Breckenridge dealt with those
visitors who were unprepared for not being able to use plastic bags.
Bertuglia provided information about what various towns have done to address guests. Bertuglia
elaborated on the prior efforts to educate people on the benefits of reusable bags, programs
which provided free reusable bags, bag challenge participation, etc.
Commissioner Cleveland stated his support for the program as proposed.
Commissioner Martin encouraged the program to include other retailers besides grocery stores.
Commissioner Cleveland encouraged the program to incentivize additional businesses to
participate.
Questions about the farmers market and other similar events were brought up.
Bertuglia stated that for the past couple of years plastic bags were not provided at the farmers
market. The public was encouraged to bring their reusable bags or purchase a reusable bag.

Commissioner Hopkins supports the efforts and supports expanding the requirements to all
retailers.
Richard Liebhaber raised the question about handles on paper bags and asked about bags
supplied by hoteliers.
Bart Longworth, new resident recently from Portland, Oregon talked about his experiences with
reusable bags and his general thoughts on the matter. He supported the effort and encouraged
the town to take a leadership role reducing plastic bags.

Medical Center Master Plan, to establish a comprehensive redevelopment plan for the Vail
Valley Medical Center, Lot 10 (Town of Vail parking lot), and US Bank Building, located at 181

Commissioner Cleveland recused himself due to a conflict.
George Ruther, Director of Community Development, briefed the Commission on the status of
the review and the schedule moving forward. Ruther discussed that a final recommendation
would be requested on January 12, 2015.
Warren Campbell provided details on correspondence received concerning the master plan.
Campbell provided information on what would be presented today including the relevant topics
and relevant materials, generally related to the emergency helipad.
Tom Braun, representing the applicant, provided a quick update on a possible land exchange
between the hospital and the Evergreen Lodge and the status of those discussions.
Ruther spoke to the time necessary to flush out any possible land swap. Ruther also spoke to
the schedule of the master plan, its original intent and modifications that may be presented to the
town council concerning timing of applications. Ruther spoke to the hospitals desired schedule
and the towns desire that the master plan be completed prior to any analysis of any development
proposals. A change to this understanding will be presented to the town council so that an initial
application for a conditional use permit (west wing) could be submitted prior to the adoption of
the master plan. Finally, Ruther spoke to the overall intent of the plan and how it relates to other
master type plans in the town.
Braun walked through a slide that lays out an approach to master planning, the CUP process
and future construction timeframes. The importance of the west wing moving forward was
presented. How the master plan can move forward concurrently with the review of the west wing
was provided.
Doris Kirchner, CEO of the VVMC, spoke to the possibility of a land exchange while still moving
forward with the Fourth Floor for the Steadman Clinic (west wing) with the goal of consolidating
their operations in one location, currently spread out over four areas. Kirchner spoke to the
potential of losing medical personal being recruited by hospitals in other regions, the need to
break ground in the spring and be under construction in the summer time, and other reasons
why moving forward is imperative while land exchange discussion are ongoing.
Ruther introduced the third item to be discussed, an evaluation of the proposed location of the
emergency helipad by the town's helipad consultant, Ray Stanton of RES Aviation Services Inc.
Ruther spoke to Mr. Stanton's credentials.
Stanton spoke to his charge to review the documents related to the emergency helipad provided
in the master plan process and his findings. Stanton discussed the other sources of information
used in his analysis. Specifically, Stanton spoke to the applicable requirements related to
protection zones. Stanton spoke to the differences between requirements and recommendations
Stanton illustrated this through comparing a ground based emergency helipad with an elevated
pad. Stanton spoke to his opinion that the proposed emergency helipad is safer than the existing
location. Stanton spoke to his recommendations which include an acceptance of the proposed
location with one exception: that being a revised approach/departure path. Stanton spoke to the
advantages of the recommended flight path. Included in his recommendation was the installation
of an Automated Weather Observation System (AWOS).
Commissioner Cartin asked Stanton to provide some insight on additional aspects of emergency
helipads that the Commission should be cognizant of related to emergency helipads moving
forward in the review process.
Stanton spoke to the intrusion and encroachment of buildings and vegetation post construction
into the FATO, extended FATO and established approach and departure paths.
Commissioner Cartin requested clarification of Stanton's support for the proposal in relation to
existing conditions.
Stanton discussed a study from Portland, Maine which identified and quantified the risk with
multiple transfer points contributing to a decrease in patient health.
Commissioner Webb asked about the helicopter protection zone (HPZ) and if it was required.
Stanton stated they were not required and spoke to the purpose of FAA advisory circulars and
how they apply to private facilities.
Commissioner Webb asked how a HPZ can effect the development on adjacent properties.
Stanton explained that an HPZ is recommended for the approach/departure paths of a helipad.
Rex Alexander, with Heli -Experts, spoke to Stanton's recommendation concerning flight paths.
Alexander contrasted different surface areas and how they are addressed in the FAA
regulations. Alexander provided additional information concerning flight paths, airspace areas
and protection zones.
Commissioner Cartin asked about the effect of the revised flight path on the municipal site as it
would be partially located above the site.
Ruther addressed Cartin's inquiry and steps being taken to review the impact to any
development potential in the future.
Commissioner Cartin asked if Alexander anticipated any changes to the FAA recommendations
Alexander responded with his perspective on the historic changes made to the document and
the fact that the approach/departure ratios had been in place for decades and he did not
anticipate they would change.
Commissioner Hopkins asked about the cost of the recommended weather reporting system.
Alexander spoke to the cost for the appropriate equipment being upwards of $50,000.00
Commissioner Martin requested additional 3D imagery at a future hearing which would exhibit
the distance above the municipal site and Evergreen Lodge of the approach/departure paths
being shown. He felt that this image provided for the Scorpio was beneficial in his
understanding.
Alexander stated his ability to provide those.
Gwen Scalpello, Vail resident, asked several questions regarding land swap and west wing and
uses proposed in these areas and how they relate to the residential character of the area.
Scalpello spoke to not hearing from an aviation perspective regarding the relative safety of the
emergency helipad proposed as compared to the existing.
Joe Stauffer, Vail resident, spoke to the importance if the hospital and its positive attributes.
Richard Liebhaber, resident of Vail, asked about the impact of the frontage road improvements
on the proposed land exchange and the emergency helipad location.
Ruther addressed this question and considerations that are necessary. Generally, if the
emergency helipad is elevated the frontage road improvements will not be of any consequence.
Ron Snow, homeowner at Scorpio, spoke to the FATO if the helipad site was left in its general
proximity. Spoke also to the HPZ and impacts on this on adjacent property by the helipad
location. Snow asked about the effects of cross winds on the revised flight paths. Spoke to his
concern that pilots are not going to follow the recommended path. Snow asked about disruptions
to the traffic flow on the South Frontage Road as a result of the emergency helipad location.
Spoke to the town's responsibility for the safety of its citizens. Feels that the review process is
not adequately realizing the dangers that can be avoided if the emergency helipad is kept in its
current location.
Commissioner Cartin closed public comment and asked the applicant to address questions that
were raised during public comment.
Braun explained what the west wing improvements include and their proximity to any proposed
land swap. The proposal to proceed forward with the review of the west wing would not be
impacted by any potential land swap.
Alexander spoke to accidents in the helicopter realm. Alexander spoke to the Wichita crash and
the probability and possibility of accidents. Alexander spoke to the deficiencies at the helipad in
Wichita and the belief that the site is of a poor design that either contributed or caused the
accident.
Kirschner provided information on what a tunnel to connect a helipad near its current general
location with the hospital would entail. Kirschner stated that a tunnel would not provide the level
of safety necessary. She highlighted the challenges of pushing heavy equipment long distance
up and down a sloped grade.
Martin inquired about whether the town expected the hospital to relocate the helipad.
Ruther provided information regarding the existing site and the town council's desire to have it
relocated.
Cartin spoke to the proposed timing of the master plan and related CUP applications. He
expressed a concern that too much is being removed from the plan. It feels like a piecemeal
approach.
Hopkins agreed.
Braun spoke to some of the realities related to the project and its timing. Acknowledged that the
steps may seem a bit convoluted. Did not agree that things were being omitted from the plan.
Cartin reiterated the changes that may result from a land swap may necessitate additional
discussions related to other items including things such as loading and delivery.
Kirschner reiterated the need for moving forward with the west wing as the first sequence of
redevelopment in the spring. .

Town Council will have an opportunity to interview eleven candidates for four (4) vacancies which exist
on the Commission on Special Events (CSE) at the December 2nd meeting. One of these vacancies
has occurred per the attached letter received Tuesday, November 25th from CSE member Bobby
Bank, who resigned his position as of year end.
The interviews occur during the work session and the three appointments are made during the
evening session. Please see a table on the following page with names of interviewees and a schedule
of interview times. The attached materials provide the letters of interest and resumes, possible
interview questions and member attendance records.
The CSE consists of seven (7) voting members appointed, at large, by the town council. All seven (7)
voting members shall be residents of the Town of Vail, own real property within the town of Vail, own a
business in the Town of Vail, or be employed within the Town of Vail. The terms of the three members
shall be for two years and end on December 31, 2016.
The position vacancies were advertised with a public notice in the Vail Daily during October &
November and posted on the Town of Vail website the last few weeks. The CSE supports Town
Council's goals and objectives and makes decisions in alignment with the Town Council's marketing
direction. Their mission is to support and assess a diverse collection of special events, both large and
small, which promote Vail's economic vitality, sense of community and increase the quality year-round
of the experience for guests and residents.

To Vail Town Council:
Councilors, I am writing to resign my position on the Commission on Special Events.
After serving over seven years and through eight budget cycles I think it would be best to resign now as
you are heading into appointment meetings instead of waiting and causing a "special election." I am
term limited and my final term would end in May as I was originally appointed to fill a vacant position.
I also think it would be better for the new commissioner to get the benefit of being a CSE member for
an entire year before the budget process.
Thank you all for this opportunity. I think the CSE as a team has made great progress over the last
eight years and it has been great working with all of the members I have shared time with. I think the
current CSE members all do an excellent job and would encourage you to rehire all of those members
who reapply.

I am writing to express my interest in joining the Town of Vail Commission on Special Events. I have been employed in
the Town of Vail for over 25 years and currently work as General Manager of Eagle's Nest restaurants for Vail Resorts. I
have been involved with helping organize summer mountain bicycling events in Vail since 1989. Each year I layout the
GoPro Games mountain bike race course working with the Vail Valley Foundation. I have volunteered with the Town of
Eagle to help bring the Colorado High School State Mountain Bike Championships to Eagle. During the winter I assist
with logistics for the Taste of Vail picnic on Eagle's Nest ridge. I have been an active member of ECO Trails since 1997. 1
work professionally with land agencies and was an appointed member of the Resource Action Sub -Committee which
wrote the new BLM Travel Management Plan. I was a member of the 1996 Atlanta Olympic Organizing committee that
designed and managed the mountain bike race. I am currently helping some outside promoters with potential plans to
bring some additional cycling events to Vail.
I feel my years of experience with special events, ability to work well in committees including land agencies plus
knowledge of the area will help me contribute to the CSE. Thank you for your time and consideration for a spot on the

appointed to the board in December 2012 and have served diligently and effectively since
my appointment.
I am currently employed by Vail Info Inc. in Vail and do contract work for other clients

This email is to introduce myself and apply for one of the vacancies on the Commission on Special
Events (CSE). My name is Robert Dahl. I have been a lifelong visitor to the Town and resort of Vail
and a property owner and part time resident since 2012. As a student of Vail's history, I have
developed a great love for our town as well as for the people and places that make up it's current
vitality and colorful past. When not in Vail, I live and own a restaurant in Fort Collins where I was
born and raised.
My beautiful wife of 11 years also has great affection for Vail. Her family has roots here dating back
to the 60's. We started coming here, as a couple, in the early 2000's. In addition to the outdoor
recreation we have enjoyed several of the special events hosted by the Town. We can be
considered, somewhat, of a success story for the Council and CSE. Certain annual events,
OktoberFest and Fourth of July in particular, turned into yearly vacations for us. We've enjoyed
several different lodging properties over the years, old Vail properties and new Vail properties from
East Vail to Lionshead. We've dined and shopped at nearly every establishment in town. We are
proud to call many of the hotel, restaurant, retail shop owners, real estate professionals, and several
of the various workers our friends. Recently, our love of this place led us to buy property in East Vail
and we now spend 30-40% of our time here. Our story started with family ties around the founding of
the Town, to day visits that grew into extended weekends and week long vacations, to finally
purchasing real estate and living here part time. It's time, for me, to become more of a participant in
the community, not just a consumer.
I appreciate the role the CSE plays in our community and I believe my experience would be an
asset. My situation as a resident of both Vail and the Front Range gives me a unique perspective
that could be valuable to the CSE. I am part of a highly desired demographic (Front Range mid -30's
professional) and also a resident who understands the benefits and challenges that special events,
big and small, have on our community services (police, transportation, parking etc.). As a restaurant
owner, I also understand how different events can be a benefit or a detriment to sales and business
traffic.
I think the CSE does an outstanding job with it's mission to create a successful special event
strategy. I understand the responsibilities of carefully reviewing event applications, responsibly
allocating funds, working in partnership with event coordinators, Town staff, resort officials, and
effectively communicating with local businesses. I feel my aforementioned experience and love for
our community would make me a desirable candidate to serve on the CSE and I hope to be

Gore Creek Drive and live in Vail proper.
My time with lululemon has given me extensive experience on building community, as it is a pillar of our
business. As a company we value relationships in our community more than anything else; we look to
support those around us and help everyone grow and prosper. My strengths as a leader lie in quickly
getting related to others, listening to build partnerships, enrolling a team or group of people in a
common vision and getting them into action. How all of that directly benefits the CSE is that I have
experience in creating, planning, and budgeting for events, as well as enrolling partners to support and
execute when the time is right.

SEC of Vail. We met about 2 years ago when she moved to Vail to manage the Lululemon
Showroom. As a lululemon ambassador, I was able to see her in action as a dynamic leader

us to set and achieve goals.
Some of the attributes I respect most about Shenna is that she is always a positive, shining light
whenever I see her. She is thoughtful and considerate of others and believes in empowering
her team at work and her friends. Shenna's kindness radiates and she is amiable with a witty
sense of humor. She loves collaboration and networks with the community effortlessly while

I would like to respectfully submit my name for consideration to serve on the Commission on Special
Events. I am currently serving as the executive director for the Vail Chamber & Business Association.
Through working with the VCBA for the past three years I have gained an intimate knowledge of how
the Town of Vail and its various committees operate. I am well aware of how important events both
large and small are to the vibrancy of Vail and its business community. I am also aware of how Vail
events affect the business community both positively and negatively.
I have worked in event planning in the past for the Club at Cordillera, ranging from intimate food and
wine dinners to golf course grand openings which included media press conferences, celebrity
tournaments and VIP dinners. While this is not on the same scale of the events Vail is involved in, I do
think having a personal perspective of the planning that goes into, and issues that may surface during
the planning process, is a very valuable one for a CSE candidate.
I have been living in Eagle County since 1997, 1 have chosen to raise my family in the area and we
consistently come to Vail, to ski, dine, participate in events, and recreate. Growing up, my family had
two annual trips to Vail, one at Christmas and one during the first two weeks in August. I remember
watching the torch ski parade literally "fly" down the mountain with the few wipeouts which was a given
being that the parade was down International and Pepi's Face back then. I also remember watching the
Coors Bike Races through Vail Village with my grandparents. It has been amazing to see how much Vail
has grown in its notoriety and scale since those family trips. I hope to be a part of the ongoing legacy of
Vail events and contribute towards helping others create family memories of their own.
I appreciate the opportunity to apply for a seat on the Commission on Special Events. I know that I
would bring a unique and important perspective to the group as being both cognizant of Vail business

I am interested in serving on the Commission on Special Events (CSE). As a full-
time resident of Vail, I am always looking forward to local events and
entertainment. Some of my favorite events have included Snow Daze, Tuesday
Concert Series at Ford Amphitheatre, weekend Culinary Events, Oktoberfest, etc.

BACKGROUND
A concern has been raised by some members of the lodging community that there is an uneven
playing field for short-term rentals by individual owners compared with property management
companies and hotels. One issue has to do with owners who do not rent through a front desk
although their renters may expect services from the front desk. Other issues include quality control
of units rented outside a managed pool and competition presented by individual owners renting
units at prices lower than a property manager. Finally, there is a concern that individual owners
may not be paying sales tax as required by current ordinance and that rental by owner (RBO)
properties are exempt from the town's business license fee.
At the town's request, Destimetrics surveyed representatives of municipal governments in several
resort areas to see how many have regulations regarding rental by owner. They asked specifically
about the "grey market", defined as "a market employing irregular but not illegal methods;
especially: a market that legally circumvents authorized channels of distribution to sell goods at
prices lower than those intended by the manufacturer." The results of Destimetrics' survey were
presented on November 4. During Council discussion, it was felt that concerns about front desks,
quality control, and pricing are better addressed by owners' associations and the lodging
community, whereas collection of sales tax and business license fees are issues for the town.
Council therefore instructed the Town Attorney to write an ordinance requiring owners who engage
in short-term rental of no more than two units to obtain a business license. Those owners, along
with bed and breakfast establishments with no more than two bedrooms, are specifically excluded
from the business license requirement currently.
The Town Attorney's draft ordinance is attached.
This memo:
Outlines current requirements for both the business license and the sales tax license.
Raises a concern that adding more regulation may deter, rather than encourage,
compliance by RBO's.
Suggests, as an alternative, requiring RBO's to post their account number with the town in
any advertising.

CURRENT BUSINESS LICENSE REQUIREMENTS
In general, businesses with a physical presence in the town are required to obtain a business
license and pay a fee based on the type of business and the location of the business. "Persons
who short term rent no more than two (2) units and people who have a bed and breakfast operation
which rents no more than two (2) bedrooms" are specifically exempt from the requirement. Fees
generated from the business license may only be used for "marketing and promotion of the Town's
principal industry, tourism, and for the payment of expenses related to such marketing and
promotion, and to promote and market activities and events beneficial to the economic health and
vitality of the community. The Town shall be entitled to receive five percent (5%) of the license fees
collected hereunder into the General Fund for administration of the business license fee."
Currently, the business license fee provides $300,000 of funding annually to the Commission on
Special Events.
The current fee structure for short-term rentals is as follows:
a. If the management office is located in Zone 1, a flat fee of three hundred twenty five dollars
($325.00) and in addition, a fee of seventeen dollars ($17.00) per each unit located in Zone 1 and
an additional fee of twelve dollars seventy five cents ($12.75) per unit for each unit located in Zone
2.
b. If the management office is located in Zone 2, a flat fee of two hundred forty three dollars seventy
five cents ($243.75) and an additional fee of seventeen dollars ($17.00) per unit for each unit
located in Zone 1, and twelve dollars seventy five cents ($12.75) per unit for each unit located in
Zone 2.
c. Persons who short term rent no more than two (2) units and people who have a bed and breakfast
operation which rents no more than two (2) bedrooms shall be exempt from the provisions of this
Chapter.
Zone 1 encompasses everything from the Cascade Village to Manor Vail on the south side of I-
70. Zone 2 is everything else - West Vail, Sandstone, East Vail, etc.
Businesses, with the exception of home occupation, pay a base fee of $325 in Zone 1 and $243.75
in Zone 2 regardless of the type of business (restaurant, retail, etc.) Home occupation licenses are
$150.00 in Zone 1 and $112.50 in Zone 2.
Since the flat fee for lodging is based on the location of the "management office", there is no
requirement for a property management company whose office is out of town to obtain a business
license or pay the fee. There appear to be nine property management companies and ten RBO's in
the short-term rental business who are classified as "out of town" and are therefore not subject to
the business license fee under the "out-of-town" provision.
There is a minimum fee of $100 per license and the fee is pro -rated by quarter for businesses
obtaining a license after the first calendar quarter of the year, but no refunds are given for someone
terminating a business during the year.

On average, hotels and management companies pay about $20 per unit per year in business
license fees, including the base and the additional per unit fee. Persons who short-term rent no
more than two units are not required to pay a business license fee. Businesses that do not have a
management office in Vail are also not required to pay a business license fee.
III. CURRENT SALES TAX LICENSE REQUIREMENTS
Sales tax licenses requirements are simpler. They are required for anyone who may owe sales tax
to the town. These licenses are issued without a fee, which staff feels encourages compliance.
Unlike the business license, there is no exemption for short-term rental of one or two units by an
individual owner. Everyone engaged in short-term rental is required to obtain a sales tax license
and pay the town's sales tax. Staff estimates approximately 200 owners who advertise directly
have current sales tax licenses and are paying sales tax.
IV. OBJECTIVES OF THE PROPOSED BUSINESS LICENSE ORDINANCE
Staff believes that Council's primary objective in the ordinance is to level the playing field for hotels
and property management companies by improving compliance with the sales tax code.
Another objective may be to level the playing field for hotels and property managers by requiring a
business license so RBO properties contribute to the cost of marketing and special events in the
same way all other businesses do.
V. COMPLIANCE ISSUES
Staff has concerns about imposing additional regulation and costs on rental by owner (RBO)
properties with an objective of improving compliance with the current sales tax code or of increasing
revenue. To date, staff has worked hard to make it as easy as possible for people to pay sales tax.
Being able to tell RBO taxpayers all they need is a free sales tax license and staff will help them
with the process has been met with favorable response. If the business license fee were applied to
RBOs on the same fee schedule as property managers, an RBO with just one unit in Zone 1 would
be charged an annual fee of up to $342.00. We have heard from some RBOs that requiring more
regulation and cost would make them less inclined to comply and more likely to use less detectable
methods of renting such as word-of-mouth, Facebook or personal websites or limit rentals to friends
and family. In that case, the town could lose sales tax we are currently collecting and would not
collect any business license fees on those who may "go underground".
A key part of obtaining compliance is identifying RBOs who may not be complying and making
contact with them. This is a time-consuming process and often means spending time finding
contact information only to learn the property has a sales tax license but the name used to advertise
is different from the name on the license. Some resorts areas, particularly in Hawaii, have an
account number displayed on RBO advertisements. Staff believes a requirement to obtain a sales
tax license and post the related account number on all advertisements would help to encourage
compliance and reduce the time spent on researching already complying properties. Since the
sales tax license is free and required for all RBOs, the only added step for the property owner is to
post the sales tax license number on all advertisements.

VI. SCOPE OF BUSINESS LICENSE ORDINANCE
As currently drafted, there are three categories of short-term rentals that would not be required to
obtain a business license — bed and breakfast establishments with no more than two bedrooms;
RBO's who do not have a management office in town; and property managers who do not have an
office in town. These categories could be included at Council's direction.
VII. IMPLEMENTATION
Finance staff asks Council to consider the alternative of requiring RBOs to post a sales tax license
account number on all RBO advertisements. This requirement would aid in compliance with sales
tax collections, but minimizes the risk of discouraging the RBOs from offering their units and/or
taking their advertising to less detectable methods. Upon passage of an ordinance, this
requirement could be implemented fairly quickly. Does council agree with this alternative to
encourage RBO compliance with sales tax collections instead of the business license
alternative?
If Council chooses to move forward with the attached draft business license ordinance, Staff also
requests direction on the following:
• Finance staff has asked the Town Attorney to include the provision that RBOs are required
to post their sales tax license account number on all advertisements to assist with
compliance. Is this provision acceptable to Council?
• Finance staff requests an effective date of July 1 to allow time for communication to RBOs,
modification of current systems, and mailing of business license enrollment forms. Is July
1, 2015 an acceptable effective date?
• Should the "management office" of an RBO be defined as the location of the rental
unit so that RBOs who manage their property from a location outside of Vail will be
required to obtain a business license and pay the marketing fee? (Under the existing
ordinance, they would not be required to do so.)
• What fee schedule would Council like to see for RBOs? The chart below lists two
alternatives based on current rates for other businesses, assuming the "management office"
location is the same as the rental property. As currently written, if the management office
were out of town, there would be no fee.
• Should a change be made to the existing business license requirements so that
management companies or other businesses that rent properties in Vail but do not
have an office in Vail would be required to obtain a business license and pay the
marketing fee?

AN ORDINANCE AMENDING SECTIONS 4-1-2, 4-1-4 AND 4-3-2 OF
THE VAIL TOWN CODE TO CLARIFY THAT BUSINESS LICENSES
ARE REQUIRED FOR ALL SHORT-TERM RENTALS WITHIN THE
TOWN AND REQUIRING THAT PERSONS OFFERING LODGING
SERVICES WITHIN THE TOWN MUST POST THEIR ACCOUNT
NUMBER IN ALL INTERNET ADVERTISEMENTS
WHEREAS, lessors of short-term rentals are currently exempted from obtaining
a Town business license if the lessor rents no more than two (2) units;
WHEREAS, the Town Council is aware that the sale of lodging services within
the Town are being advertised and coordinated via the internet, and is concerned that
all sales taxes may not being paid on such lodging services;
WHEREAS, the Town Council desires for all lessors of short-term rentals to
obtain a Town business license prior to offering services within the Town; and
WHEREAS, the Town Council further desires that all persons advertising lodging
services within the Town via the internet, include a Town of Vail account number on all
such advertisements.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF VAIL, COLORADO, THAT:
Section 1. The definition of "Short -Term Rental" as the term is defined in
Section 4-1-2 of the Vail Town Code is hereby amended to read as follows:
4-1-2: Definitions:
SHORT-TERM RENTAL: A rental for valuable consideration of
an accommodation unit or dwelling unit for a term not in excess of thirty
(30) consecutive days. For purposes of this definition, the term
"valuable consideration" means the actual cash paid or the fair
market rental value of a traded or exchanged accommodation unit or
dwelling unit.
Section 2. Subpart (13)(1) of Section 4-1-4 of the Vail Town Code is hereby
amended to read as follows:

every person doing business within the Town in accordance with the
following schedule:
1. Bed And Breakfast Short -Term Rentals: Short-term
rentals and bed and breakfast operations. Any person who
engages in the short term rental of either accommodation units or
dwelling units to one who uses, possesses, or has the right to use
or possess such accommodation unit or dwelling unit, and any
person who engages in a "bed and breakfast operation" as that
term is defined in Section 12-14-18 of this Code shall pay a fee as
follows:
a. If the management office is located in Zone 1,
a flat fee of three hundred twenty five dollars ($325.00) and
in addition, a fee of seventeen dollars ($17.00) per each unit
located in Zone 1 and an additional fee of twelve dollars
seventy five cents ($12.75) per unit for each unit located in
Zone 2.
b. If the management office is located in Zone 2,
a flat fee of two hundred forty three dollars seventy five cents
($243.75) and an additional fee of seventeen dollars

Town of Vail account number and shall show the name of the licensee
and the place of business of the licensee and shall be posted in a
conspicuous place at the place of business for which it is issued. If the
licensee does not have a place of business, then the license shall show
the mailing address of such licensee. Licensees that advertise lodging
services on the internet shall include the licensee's sales tax account
license number in all such advertisements.

Section 4. If any part, section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be invalid, such decision shall not effect the validity
of the remaining portions of this ordinance; and the Town Council hereby declares it
would have passed this ordinance, and each part, section, subsection, sentence, clause
or phrase thereof, regardless of the fact that any one or more parts, sections,
subsections, sentences, clauses or phrases be declared invalid.
Section 5. The Town Council hereby finds, determines and declares that this
ordinance is necessary and proper for the health, safety and welfare of the Town of Vail
and the inhabitants thereof.
Section 6. The amendment of any provision of the Town Code as provided in
this ordinance shall not affect any right which has accrued, any duty imposed, any
violation that occurred prior to the effective date hereof, any prosecution commenced,
nor any other action or proceeding as commenced under or by virtue of the provision
amended. The amendment of any provision hereby shall not revive any provision or
any ordinance previously repealed or superseded unless expressly stated herein.
Section 7. All bylaws, orders, resolutions and ordinances, or parts thereof,
inconsistent herewith are repealed to the extent only of such inconsistency. This
repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or
part thereof, theretofore repealed.

I estimate Vail will collect another $48,000 in October sales tax to bring
collections to $748,479. If so, October will be up .8% or $5,718 from the
amended budget and down .9% or $6,654 from October 2013. Year to date

REVENUE HIGHLIGHTS
December 1, 2014
Sales Tax
Upon receipt of all sales tax returns, October collections are estimated to be
$748,479 down 0.9% from last year and up 0.8% compared to budget. Year to
date collections of $19,076,832 are up 8.2% from the prior year and up 1.1%
from budget. Inflation as measured by the consumer price index was up 1.7% for
October. The annual amended budget totals $23.1 million.
Real Estate Transfer Tax (RETT)
RETT collections through November 25 total $5,864,937 up 38.8% ($1.6M) from
this time last year. The significant increase is mainly due to the purchase of
residential properties. So far this year there have been 6 properties sold for over
$10 million, 20 properties sold between $5 and $10 million and 36 properties sold
between $2.5 and $5 million. These properties account for $3.6 million, or 62%
of the total collections year to date.
The amended annual RETT budget currently totals $5.9 million.
Construction Use Tax
Use Tax collections total $1,692,555 year-to-date compared to an amended
annual budget of $1.8 million. Construction Use Tax is up 27% from collections
this time last year.
Summary
Across all funds, year-to-date total revenue of $50.2 million is up 5.2% from the
amended budget and up 14.1 % from prior year, mainly due to increases in Sales
Tax, Construction Use Tax, Construction Fees and RETT collections.
