PRESENTER(S): George Ruther, Director of Community Development Will Hentschel, 359 Design ACTION REQUESTED OF COUNCIL: The Town staff is asking that the Vail Town Council provides answers to the following two questions: 1) Does the Town Council support proceeding forward with preliminary site work and infrastructure design based upon an overall project density of 65-70 dwelling units (i.e. approximately 10 duplexes units, 9 townhomes units , 48 flats)? 2) Does the Vail Town Council support pursuing a two step approach to the project? BACKGROUND: The Town of Vail has been exploring options for developing the community's newest residential neighborhood on the Town owned Chamonix parcel located in West Vail. This action helps achieve the Town Council's adopted goal of "growing a thriving and balanced community". The purpose of this public hearing is for the Town Council to provide answers to two project questions and to take the next steps necessary to help realize the development of Vail's newest residential neighborhood. STAFF RECOMMENDATION: The Town staff recommends the Vail Town Council supports moving forward with a preliminary project density of 65 - 70 dwelling units and supports pursuing a two step approach to the project. ITEM/TOPIC: November Election Administration - Polling Place vs. Mail Ballot (15 min. ) PRESENTER(S): Patty McKenny, Town Clerk ACTION REQUESTED OF COUNCIL: Obtain Council feedback related to November's election administration. BACKGROUND: The Town of Vail has historically conducted polling place elections. The State of Colorado has transitioned to a mail ballot election format only. There are several options available for municipal election administration 5/5/2015 which will be reviewed in order to determine which format will be used in the November election. 4. ACTION: Table election of Chair and Vice -chair to May 11, 2015 MOTION: Rediker SECOND: Martin VOTE: 5-0-0 Site Visit: 1. 2754 Snowberry Drive 30 minutes A request for a variance from Section 14-3-1, Table 1, Minimum Standards, Vail Town Code, pursuant to Section 14-1-5, Variances, Vail Town Code, and in accordance with Section 12-17, Variances, Vail Town Code, to allow for a residential driveway to exceed the permitted maximum centerline grade, located at 2754 Snowberry Drive / Lot 15, Block 9, Vail Intermountain and setting forth details in regard thereto. (PEC150009) Applicant: Mike Dantas, represented by Mauriello Planning Group Planner: Joe Batcheller ACTION: Approved with a condition(s) MOTION: Martin SECOND: Lockman VOTE: 4-1-0 (Rediker opposed) CONDITIONS: 1. Prior to requesting a rough driveway grade inspection, the applicant shall submit revisions to the issued building permit, for review and approval by town staff, identifying that the portions of the access road/driveway to the east unit which exceed 10% in grade will be heated via a snow melt system and boiler. Planner Batcheller provided an overview of the request and the background associated with it. He spoke to the criteria and staff's findings regarding each. He spoke to several potential negative impacts created by steeper driveways as identified by the Public Works Department. Commissioner Rediker inquired as to how the application is a "driveway". He sees this as the town granting access across/through the right-of-way and the applicant is merely paving a portion of the right-of-way. He does not feel the variance is necessary as access in the right-of- way to a platted lot is at issue. The grade within the right-of-way is an issue for the town not the applicant. Page 1 5/5/2015 Commissioner Pratt spoke to the aerial map and the depiction of the road going farther to the east and the road was not constructed to its full extent of the platted right-of-way. Why was the road not built pursuant to town standards for the entirety of the right-of-way. Commissioner Lockman inquired into the Public Works suggestion to the heat the portion of the access within the right-of-way. Was Public Works' proposed condition regarding heating the driveway included in the proposed motion? Batcheller spoke the concern that equity was not achieved by requiring an applicant to heat that portion of access within the right-of-way. No the condition requiring heating was not included. Commissioner Martin spoke to the utility road—that it is a road and not driveway. Would the applicant be required for maintaining the road beyond plowing or would the town be responsible for paving. Tom Kassmel, Town Engineer, spoke to what is being proposed is a driveway. Today it is a utility access road. This area was annexed into the town and the previous developer chose not to continue the construction of the road through the extent of the right-of-way. There are no standards to a utility access road. There are requirements for a private street, but this is not considered a private street. There should not be an expectation that a utility company would need to grade their access to meet town standards. The recommendation for a condition to heat the driveway is a result of the grade exceeding the maximum allowed 12% heated grade permitted in the remainder of town. He spoke to the number solutions explored to minimize or eliminate the need for a variance. This request is a for a driveway and Public Works would recommend that the variance should be from 12% to 15% for a heated driveway. He spoke to the requirement for a revocable permit required for all driveway improvements in the town. Warren Campbell asked Joe Batcheller to zoom out and show the extents of the water tank lot and inform everyone of its zoning. Batcheller showed the full extents of the lot and informed the group that the property was zoned two-family primary secondary. Commissioner Gillette inquired as to the design of the driveway on the private property and if in fact a variance would be in perpetuity for the property as Tom Kassmel stated in his presentation. Tom clarified that a variance would not be in perpetuity if the structure was demolished. Webb Martin asked how snow storage worked for the site and if it complied. Planner Batcheller said it does comply and showed the designated areas on the site plan. Commissioner Pratt asked if Mr. Dantas had a presentation Mike Dantas, applicant, spoke to the town's responsibility to protect the owner of property adjacent to the right-of-way by requiring the utility access to meet the current standards in 2007 thus avoiding the need for this discussion. He has designed a home which meets the standards and there are impacts to other designs and other designs had impacts to address such as the fire hydrant. The town erred in 2007 when the water district was not required to construct a compliant access to the tank. He does not understand why his request is being considered a driveway. Martin spoke to he understanding of the request and the evidence and testimony. He felt Staff's recommendation was appropriate. Page 2 5/5/2015 Commissioner Rediker did not see the portion of the access road in the right-of-way as a driveway. He sees the application as a request to pave the right-of-way to provide access to his property. He feels the application is not appropriate and the issue should be addressed in a more appropriate manner. Commissioner Lockman felt the history provided by the Town Engineer was beneficial. He highlighted that he did not feel it should be required to be snow melted. Commissioner Gillette felt the role of government is to help its constituents. He agreed it should not be required to be heated. He felt the application at hand was appropriate to resolve the question. The application should be acted upon. Commissioner Pratt agreed initially with Rediker's view point that the application was more as a request by the town for a road. He does feel a heated driveway is appropriate for an increase in from 10% TO 15%. He is not sure this is the applicant's burden to bear. The portion of road in the right-of-way does not meet current standards. Commissioner Gillette inquired as to future anticipated repair and necessary access to the water tank. Tug Birk, represented the Eagle River Water and Sanitation District, spoke to the action taken by ERWSD when the improvements cause damage to private improvements easement verses right-of-way. He added that in 2007 when the water tank improvements were installed the water line under the portion of right-of-way was not replaced or changed. Batcheller and Kassmel clarified the scope of work associated with the 2007 water tank work. Dantas reiterated that it was his belief that the scope for the ERWSD project in 2007 should have been required to bring the road into compliance at that point in time. Commissioner Martin made a recommendation to approve the application with a condition. 2. This action helps achieve the Town Council's adopted goal of "growing a thriving and balanced community'. The Town Council affirmed a number of goals for the project. The goals include: • Optimize the use of the site for workforce for -sale housing (15 - 25 du's per acre) • Design a context sensitive design solution (design review guidelines) • Ability to be phased over time (min. two phases) • Deliver desirable, marketable and diverse types of housing products (duplexes; one, two & three bedroom flats; townhomes, etc.) • Maximize the town's limited supply of financial resources • Build responsibly given the existing site configuration, topography and natural features of the site • Develop a diversified cost/sales structure to respond to a wider range of buyers (i.e. pricing structure based upon income) Purpose of the Meeting The purpose of this public hearing is for the Town Council to provide answers to two project questions and to take the next steps necessary to help realize the development of Vail's newest residential neighborhood. Project Density — the 2009 Chamonix Master Plan recommends the Neighborhood Block option aimed at providing residential development on the site oriented towards families. In doing so, an overall project density of 55 - 60 dwelling units (+/- 16 units per acre) is recommended in a mix of unit types. Town Staff has developed a preliminary option based upon the Neighborhood Block design that nets an overall project density of 65 — 70 dwelling units (+/-21 units per acre) of a mix of unit types. A substantial increase or decrease in density significantly changes the character of the development and the unit mix on the site, resulting in a 5/5/2015 substantially different development. In order to proceed forward with preliminary site work and infrastructure design, an overall project density must be established. Does the Town Council support proceeding forward with preliminary site work and infrastructure design based upon an overall project density of 65-70 dwelling units (i.e. approximately 10 duplexes units, 9 townhomes units , 48 flats)? • Project Approach Development on the Chamonix site requires two distinct steps; 1) site access and infrastructure improvements, and 2) vertical building construction. For obvious reasons site access and infrastructure work must be completed before vertical building construction. Town staff recommends breaking the project entitlement process down into two steps as well. Due to the presence of the Housing Zone District on the site, this approach can be easily accommodated and is particularly advantageous. Step One - The Housing Zone District provides flexibility in the application of the development standards. According to the Town's Zoning Regulations, the development standards for the District are prescribed by the applicant and reviewed for approval by the PEC. With that in mind, staff recommends that the Town prepares a development plan generally prescribing the applicable development standards (i.e. density, GRFA, setbacks, building locations, site coverage, landscape area, building height, etc.) and seek a development plan approval from the Planning & Environmental Commission. Once a development plan approval prescribing this general development standards are in place, the site access and infrastructure designs can be completed, contracted and permitted (late summer 2015). Approximately $1.5M has been appropriated in the 2015 Budget for this work. Prior to submitting an application to the Planning & Environmental Commission for review and approval of the site access and infrastructure improvements the town staff will return to the Town Council with a detailed probable cost estimate for the work. Step Two - While the site access and infrastructure improvements are being installed, the Town can simultaneously make progress on meeting with prospective home buyers and work towards the design review approvals needed for the vertical building construction. The first phase of vertical building construction could begin as early as spring 2016. The advantage of this approach is it optimizes time, reduces risk, saves cost, creates predictability and allows for phased construction of the housing development. Project Vetting and Initial Entitlement Application. 359 Design will lead the outreach and design process and facilitate the evolution of the site planning and engineering in response to design constraints, council direction, project reality and public input. Through this phase we will discuss initial options with Council and the public. Determine level of Density, establish and initially test project goals, discuss funding mechanisms and structure. Access Infrastructure Engineering Documentation Through the Access Infrastructure Engineering phases of the project, the Civil Engineer along with the design team will develop site options into engineered civil drawings. Bythe • end of this phase, we will have achieved an approved overall site plan that will allow for us to move smoothly through the permitting process. 8.15 • 10.15 Access Infrastructure Construction t Once the Access Infrastructure ` drawings have been approved for permit, we will break ground to begin our first phase of construction on the project. 359 Design will lead and provide full Construction Administration services throughout the Access Infrastructure Construction phase. We anticipate a 15 month construction schedule. 0 "-gilding Entitlement and Public Outreach The project will proceed through the various meetings, gaining shape, validity and confidence as it evolves. The Town of Vail process has a good way of refining the designs. We anticipate this process to be full of scrutiny. We will harvest the input and further evolve the community shaped design. 4.16 Building Documentation Finalized - Begin Building Construction 359 Design will facilitate the design team through the process documentation phases. By this point, we will have moved through Concept Design, Schematic Design, Design Development and IMM finalizing plans in the Construction Documentation phase. Throughout each phase we will meet with the city and collect your ideas, comments, requirements and requests from each meeting, which will direct the development of the design with the design team and all consultants. 12.16 2017 Pre -Sales The project will go through 3 stages of "Pre -Sales": Sales 1 -Sign Up Sales 2 -Deposit and Qualify Sales 3 -Options, Documents, Contracts Design will work with the City to help :e this process by providing imagery )n of the finalized product. Historically Town of Vail elections have been conducted as polling place elections. The State of Colorado has been transitioning to mail ballot elections over the course of the last few years. In 2013 HB 13-1303 was adopted by the State Legislature requiring all county coordinated elections be conducted by mail ballot. In 2014, most statewide elections were administered in a mail ballot format except for some rural counties. There are some differences in the administration of elections outlined below which will help provide a better understanding of the election process as it relates to the differing formats. Background Elections are governed by numerous State Statutes, including Title 1 - the Uniform Election Code, and Title 31 - the Municipal Election Code, as well as Vail's Charter and Municipal Code. County election officials follow Title 1 and municipal election officials follow Title 1 and Title 31, unless a municipality agrees to participate in a coordinated election conducted by its County Clerk and Recorder's Office. These codes address the many procedures, actions, and deadlines of the many facets of an election including but not limited to the nomination process, the conduct of Election Day, notices and preparations, and the counting and canvassing of the results. Mail Ballot Election Legislation adopted in 2014 by the State Legislature, titled HB 14-1164, supported the mail ballot election environment for municipalities by providing provisions governing the administration of mail ballot elections. There seems to be a growing participation in the mail ballot election by many municipalities in either a stand-alone municipal election or in a coordinated election with the county. As a home rule municipality, the town may consider participating in a coordinated election this fall with Eagle County or continue administering its own election by polling place or mail ballot election. Election Format Differences In an effort to better understand the impacts of the election options, there is a comparison of some components of the process by comparing deadline dates using the different election formats — mail ballot election (either coordinated or stand-alone) vs. polling place election, see attached preliminary election calendar. ✓ The mail ballot election begins the nomination process about 5 weeks earlier than a polling place election (first of August vs. middle of September). ✓ Ballots are available for voting in a mail ballot election about 10 days earlier than the polling place election. 5/5/2015 ✓ Election results are provided unofficially the evening of Election Day. There are different deadlines used for certifying the results with a ten day disparity between the polling place deadline (due November 10) vs. the coordinated election deadline (due November 20).
