BACKGROUND: The International Building Codes are updated every three years to maintain minimum standards for the technical advances in building sciences and material innovations that are being used by the construction community. The proposed 2015 Building Codes also reflect the changes mandated by the State of Colorado Building Codes. In order to maintain the high quality of construction practices used in Vail, to protect the life safety and welfare of our community, it is essential to adopt the most current standards available. 11/3/2015 STAFF RECOMMENDATION: The Community Development Department, Fire Department and Building and Fire Code Board of Appeals recommend the Vail Town Council approve Ordinance No. 14, Series of 2015 upon Second Reading. 5. ITEMITOPIC: Proclamation No. 5, Series of 2015, A Proclamation Declaring the 3rd Week in November 2015 as "Volunteers in Police Service Week" (5 min.) ITEMITOPIC: Golden Peak Racquet Sports Facility (60 min. ) PRESENTER(S): Todd Oppenheimer ACTION REQUESTED OF COUNCIL: Discussion and direction from Council on the configuration of the Golden Peak Racquet Sports Facility project. BACKGROUND: On August 5, 2015, as part of the Booth Creek Park design program discussion, the Town Council directed the inclusion of 2 hard -surface tennis courts in the design of Booth Creek Park and an evaluation of the Golden Peak Tennis Court site for a full or partial conversion to pickleball courts. The existing Golden Peak courts are in poor condition and need to be reconstructed. The Vail Recreation District has been operating a pickleball program on half of the Chalet Road courts for 4 years. Staff has evaluated the site and determined that it is feasible to construct 6 pickelball courts and 12 parking spaces on the site without encroaching on Mill Creek and retaining the possibility of through traffic on Chalet Road. A proposed site plan for the Golden Peak site is attached. Construction of Booth Creek Park is scheduled to begin in May 2016 and be completed later that fall. Assuming the project stays on track, the Booth Creek Park tennis courts will be available for play late October 2016. The Council has received significant public opinion both for and against tennis and pickleball configurations for the Golden Peak Racquet Sports Facility Project. On October 20, 2015 the Town Council conducted a site visit to the Chalet Road site and directed the Vail Police Department to perform noise readings as pickleball was being played. The results of the noise readings are attached. STAFF RECOMMENDATION: Direct staff regarding the configuration of the Golden Peak Racquet Sports Facility project. 11. Page 6 111/3/2015 PLANNING AND ENVIRONMENTAL COMMISSION TOWN Of VA1 � October 26, 2015, 1:00 PM Vail Town Council Chambers 75 S. Frontage Road - Vail, Colorado, 81657 Call to Order Members Present: Brian Gillette, Henry Pratt, Dick Cleveland, Kirk Hansen Webb Martin, John Ryan Lockman Members Absent: John Rediker 2. A request for a recommendation to the Vail Town Council for an amendment to the Lionshead Redevelopment Master Plan, pursuant to Section 2.8, Adoption and Amendment of the Master Plan, Lionshead Redevelopment Master Plan, to amend the Detailed Plan Recommendations for the Evergreen Lodge at Vail, located at 250 South Frontage Road West/Lot 2W, Block 1, Vail Lionshead Filing 2, and setting forth details in regard thereto. (PEC140044) Applicant: Evergreen Lodge at Vail, represented by Mauriello Planning Group Planner: George Ruther Action: Recommendation of Approval with Conditions Motion: Martin Second: Hansen Vote: 6-0-0 Conditions: 1. This recommendation of approval shall be contingent upon the land exchange occurring and being recorded with the Eagle County Clerk & Recorder. 2. This recommendation of approval shall include clarification of Figure #3 including the 10 foot wide setback adjacent to Lot 10. 3. This recommendation shall include the striking of language (second sentence) in Section 5.19.8 concerning contemporary architecture. Director Ruther introduced the topic and recapped the stopping point of the previous meeting. Ruther stated that the applicant will be requesting a final action on this item today. That action will be a recommendation to the Town Council. Commissioner Hansen requested clarification concerning the trigger mechanism. Ruther clarified the recommended trigger related to the land exchange. Commissioner Cleveland asked how this affected the Council's decision. Ruther clarified the Council's role and timing. Dominic Mauriello, representing the applicant Evergreen Lodge, walked the commission through the work that has occurred since the last hearing. Many of these changes were the result of a request from the commission to remove some of the specificity in the plan. He presented the proposed land exchange and the items that the commission have found acceptable at previous meetings. Dominic discussed the new materials including revised graphics and additional language for clarification purposes. Items addressed include the pedestrian link between the frontage road and Meadow Drive, the possibilities of shared parking/refuse management, setbacks, the effect of the land exchange on the site, as well as architectural considerations. 11/3/2015 Mauriello concluded with the benefits of both the land exchange and the changes to the Lionshead master plan. Lockman requested clarification on Figure 3. Cleveland asked if this drawing is to scale. Mauriello clarified the graphic and its purpose to illustrate the proposed step downs in the building as it approaches Meadow Drive. Martin asked if additional language would be helpful. Ruther anticipated additional refinements to the figures. Pratt requested that the figure illustrate the south setback. Hansen asked about the net loss of parking anticipated. Mauriello clarified that the new development would need to meet the parking requirement of the Town Code. Hansen asked for clarification on the setback requirement. Ruther clarified the setback requirement and the proposed language. Hansen asked about whether the roundabout is contingent upon the Evergreen redevelopment. Ruther clarified the moving parts in relation to this item. Cleveland and Ruther briefly discussed the inclusion of the language related to setbacks and setback encroachments. Gillette requested clarification on Section 5.19.8 concerning architecture and the purpose of the language. Mauriello provided a response to answer Gillette's question. Gillette feels that the reference to the existing structures is a departure from the overall purpose of the master plan. He feels that the language adds confusion to the architectural intent. Pratt feels that the language referenced by Gillette is unnecessary, redundant and potentially confusing. Ruther spoke to the reasons for the inclusion of the language and Staff's support for the language. Cleveland suggested alterations to the language that would make it more acceptable to the commission. Gillette spoke to his continued confusion on why the language on existing structures is included. Ruther spoke to the language being reinforcing, and not deviating from the architectural guidelines. Pratt opened up the meeting for public comment. 11/3/2015 Jim Lamont, representing the Vail Homeowners Association, spoke to his support for the covering of Vail Valley Medical Center (VVMC) parking and how that might present itself to surrounding properties/roadways. Jim asked if similar language related to building stepbacks was included in the Ever Vail plan. Pratt closed public comment and asked for comments from fellow commissioners. Lockman asked that the document being presented in its final form prior commission action but that it would not prevent his vote. Supports process and discussion that has occurred. Overall he supports the document and will support. Hansen spoke to his support for the plan and the process and discussion that has occurred. Hansen spoke to areas of support including parking, lighting, refuse management and the approach to Mill Creek. Cleveland generally agrees with his fellow commissioners and asked for clarification related to mitigation from the roundabout construction and how it relates to Lot 10. Ruther clarified how the roundabout and Lot 10 discussions might occur related to right-of-way acquisition. Martin spoke to his support to Cleveland's requested language change and spoke to his concerns about how the roundabout might function. Gillette spoke to his general support for the document and his support for Cleveland's amendment but asked for an additional sentence to also be removed. This refers to Section 5.19.8. Cleveland responded with his support for only removing one sentence. Pratt supports Cleveland's proposed language change. Pratt feels that some of the language is redundant. Expressed his concern for the live bed policy and the proposed replacement plan for the accommodation units (AUs). Would like to see an increase in the number of AUs in tandem with the proposed reduction in AU square footage. May vote in opposition to bring the Council's attention to this matter. Staff has shared the Commission's concerns on the parking requirements for this development. Parking has been increased to two spaces per unit regardless of unit type. About parking 58 spaces will fit on the site of the multiple family buildings (i.e. 28 units), unless the development program is altered. There may be room to add up to 6 more parking spaces (i.e. 3 units). Intended goal for this project is to address employee housing that does not exist in significant quantity in town. These units are intended for families. 11/3/2015 This development is intended as a phased plan. We are requesting approval of a development plan that includes the density, a range of floor areas, landscape areas, site coverage, parking and development standards. After this first phase, the applicant will return with more details on the vertical construction. Hansen asked for a clarification on the phasing. Ruther explained that the first phase is site improvements only (site access, infrastructure, and utilities). The Town is also talking with developers to learn more about development approaches and construction methods. It is also unlikely that a developer would build all the units at the same time without some pre -sales or a demonstration of the market absorption rates. We welcome your comments so they can be incorporated into the development plan. Pratt asked "Given that the client (Town Council) is expected to change in the next several weeks (due to elections), is it too late to go back? Ruther indicated that but for a change in the density, the infrastructure can accommodate a number of configurations and some change in density. There has already been much community debate on this project, and we are not anticipating significant changes from the client. He discussed the development plan contents and development standards. If there are changes to the phases, we may need modifications to the phasing plan as well. Will Hentschel, 359 Design — Multifamily buildings have shifted slightly to accommodate the 2 parking spaces per unit. Project Guidelines and Goals were reviewed. West end of the site is mostly undevelopable due to steep slopes. He reviewed the landscaping plan, access plan and lighting for the site. There are 1.15 acres of open space proposed in plan. During access and infrastructure construction, over lot grading would prepare the sites for development. Gillette asked about removing asphalt between the multifamily and the townhomes. He discussed options to add walking paths to the Northside Grab and Go. Ruther indicated that removing asphalt would likely require taking access through the Fire Department site. Cleveland stated people need to be able to get to the bus stops easily. Both red and green route busses stop near the fire station, and another stop at the intersection to east of this site. Ruther indicated that a 6 foot sidewalk is proposed along Chamonix Road. Pratt indicated we need to address walking paths to the bus stop at the southwest near fire station. Hentschel explained the mix of unit sizes Cleveland stated 3,000 sq. ft. is a large 4 bedroom unit. We might be shooting too high on size. Also, driveways will require retaining walls. Bridges may be better than retaining walls and steep driveways. Changes to the plan could allow for a 6t" duplex. Hentschel responded that there is potential for 3,000 sq. ft. units, but we are aiming for 2,400 sq. ft. (1,200 sq. ft. per level). Garage area is not included in these number ranges. All duplexes have 2 spaces in a garage and space for another car in front. Most of the townhomes have 2 spaces in a garage and some have 1 space in front of the garage. Multifamily parking is provided under the multifamily buildings. Plus 13 guest parking spaces are proposed. Development standards were reviewed. Ruther stated we have heard from potential owners that there should be some private outdoor space on the site, but generally they are OK with some shared space. 111/3/2015 Gillette asked why were outdoor patios removed from allowed uses? Ruther responded that outdoor patios as a land use are referring to dining patios at restaurants, not private patios on residential units. Private residential patios will be allowed. Hentschel stated multifamily could be 2-3 levels above podium parking, up to 48' tall. Some additional design drivers include Pride of Ownership, Connection to Nature, Parking and Storage, Everyday Conveniences. Hansen asked how is the approach on energy and design? Hentschel responded that strong emphasis to help future owners pay lower bills in future. We look at the insulation closely. We have looked at how this design would compare to LEED as far as insulation, connectivity, overall sustainability. Lockman stated Habitat for Humanity does projects with LEED silver or above, with solar panels too. I would love LEED to be called out in this project. Could the western part of site be used for Solar photovoltaic (PV) panels? Hentschel responded that we do not have enough space on buildings to accommodate solar panels that would provide full offset to electric use. Gillette encourages the applicant to look at the most cost effective way to be energy efficient. Solar may not be the best in this project. Smart roof design and insulation can give us more bang for the buck. Hentschel stated we will use LEED as a metric for comparison. We will try to use best design practices and consider issues like snow shedding, and try to avoid the need for heat tape. Hansen inquired if there are spaces available for kids play areas? Hentschel responded that the site is steep and not many spaces, but we will consider play areas. Public Comment — None Final Comments Lockman indicated that I may be a potential future owner in this development. Everything I have seen is right on. I like the connections to bus stops, but this project needs to be above and beyond to meet Vail's standards. Cleveland stated that his concern is with the multifamily. If these will be condominiums, what is our fallback position is statewide condo laws are not addressed? This is a huge component of this development. Ruther responded that the Town Attorney is researching the issues with condominiums. The Town, as the developer, should not take on any additional liabilities. This is an issue that we need to figure out. There are a handful of ways that some communities are addressing these issues and we should wait for a legal response from the Attorney's office. Cleveland stated that we should be open to expanding parking to areas outside the building footprint. Maybe under the open space. It's not cheap. You could put a park over the top of the parking. I'm not a big proponent of heated driveways. There are other ways to do it. People in our real estate community can tell us what people want in these units. Gillette stated that the parking improvements are good. We are on the right track. 11/3/2015 Ruther indicated that we have heard from realtors and prospective buyers that the interiors need to have better finishes than what we have traditionally seen in employee housing. Brass door knobs, hollow core doors and cheap counter tops may not be what are best for this product. Cleveland stated that this need to be a different product than we have previously built. We want people and families to move back into Vail. The large 3 bedroom units in employee housing are the most stable and turn over the least in existing employee housing developments. Ruther indicated that people don't want to buy a unit that they know they will soon be leaving. We have heard from the Town Council that this development should be designed for families. These people have options for housing product that meet their needs down valley, but not here in Vail. Pratt stated that you have a diverse range of products here. In the final presentation, I would like to see some site sections, with roof forms. Not just blocks. I'm in favor of the guest parking, but I wonder where the snow storage will be on this plan. Worried that guest parking can disappear in winter due to snow storage. That eastern multifamily building could go away and become townhomes. Cleveland stated that one of the concerns with the multifamily is that the units do not have two sides (windows). How will accessibility be handled? Will you need elevators? Hentschel responded that we may need elevators in one of the buildings. It will depend on construction type and building codes. Lockman asked that we please show bus stops on the plans. 4. Year to date collections of $19,359,498 are up 5.7% from the prior year and up 2.7% from budget. For comparative purposes due to the timing of Labor Day weekend, the sum of August and September sales tax collections are $1,890,362, up 5.9% from the same time period last year and 2.5% from budget. Inflation as measured by the consumer price index was up 0.0% for September. The annual budget totals $24.5 million. Real Estate Transfer Tax (RETT) RETT collections through October 27 total $5,105,458 down 6.1 % from this time last year. 2014 annual collections totaled $6,849,449, a record year since the peak in 2008. The 2015 amended budget of $6,190,000 is a 9.6% reduction from prior year actuals. Construction Use Tax Use Tax collections through October 27 total $2,172,957 up 1 % compared to $2,146,956 from this time last year. The annual budget totals $1.8 million. Total year-to-date revenue is 80% of annual budgeted revenues of $62.8 million. -1- 11 /3/2015 W WI � VAIL � Memorandum To: Town Council From: Mark Novak, Fire Chief Date: November 3, 2015 Subject: East Vail Fire Station Renovation Design Background The East Vail Fire Station was constructed in 1980, by the Vail Fire Protection District, since that time, little has been done to the station other than routine maintenance. The station in its current state has operational deficiencies, is not visually harmonious with the neighborhood and does not meet the Vail standard. Council approved initial design work in 2015, the renovation of the station is included as part of the 2016 budget. II. Current Situation In July of 2015 a RFP was released for the initial design phase of this project. Following the RFP process a contract was awarded to Pierce Architects. To date, programming of the renovated space has been completed and an initial design has been completed. This design includes the addition of approximately 1400 square feet which is necessary to meet current operational needs. Important considerations requiring additional space include lengthening the apparatus bays and moving the generator out the apparatus bay. In the current configuration, apparatus parked in the bay are parked within inches of the back wall and overhead doors; there is also limited access to the sides of the apparatus which makes routine tasks difficult. Attached is a conceptual rendition of the project. In addition to the conceptual design, a site survey has been completed and a site specific geological survey is underway. Due to station's location in a residential neighborhood, I have met with a number of the surrounding property owners to review the design and solicit their feedback. The project is scheduled to go to DRB for conceptual review during the month of November. We are also working with a contractor to develop an initial cost estimate to insure that it is consistent with the project budget. Once these steps are completed, we will bring the project back to the Town Council to review the estimated cost of the project and for approval to complete construction documents. The projected start date for construction is May 2016. III. The proposed 2015 Building Codes also reflect the changes mandated by the State of Colorado Building Codes. In order to maintain the high quality of construction practices used in Vail, to protect the life safety and welfare of our community, it is essential to adopt the most current standards available. STAFF RECOMMENDATION: The Community Development Department, Fire Department and Building and Fire Code Board of Appeals recommend the Vail Town Council approve Ordinance No. 14, Series of 2015 upon Second Reading. ATTACHMENTS: Fire Sprinkler Memorandum Ordinance No. 14, Series of 2015 11/3/2015 I fflil-n Memorandum To: From: Date: Subject Town Council Mike Vaughan, Fire Marshal October 20, 2015 Ordinance No. 14, series of 2015 Background During the first reading of Ordinance No. 14, series of 2015, provisions of the 2015 International Fire Code (IFC) and amendments related to fire sprinkler requirements for exterior decks, balconies and overhangs generated concern regarding the practicality of these provisions. This memo is clarify the requirements of the model fire code (2015 IFC) and provide an alternative that provides for life safety while addressing the concerns about this provision. It is important to note that when the IFC is adopted, it is not retroactive; the new IFC is not applied to existing buildings except in situations in which a remodel is of a scope that it triggers compliance with the current building code. Current Situation There are two sections of the IFC that are relevant to the issue of decks and balconies in regards to sprinkler requirements and the use of grills, barbeques, etc. The first section (308.1.4) specifically addresses the use of open flame cooking devices. This section prohibits the use of open flame cooking devices on combustible balconies or within 10 ft. of combustible construction. This prohibition has three exceptions: 1) Single family dwellings and duplexes 2) When the balcony or deck has an automatic fire sprinkler system or the balcony/deck and any overhang are constructed with noncombustible finish materials. 3) When the open flame cooking device uses a propane cylinder, 47 lbs. or less in size. Cooking devices using charcoal are prohibited on combustible decks or decks above grade level, regardless of construction type. The exception that allows the use of open flame cooking devices on noncombustible deck/balcony spaces is an amendment to the model code. The exception that allows 11/3/2015 propane cooking devices with 47 pound tank is an amendment, the base code would only allow the use of 1 pound LP cylinders). The second section that addresses the issue of fire sprinklers on balconies and decks is IFC 903.3.1.2.1, the model code requires a fire sprinkler system in all balconies and decks when there is an overhang, roof or deck above the balcony. The proposed amendment to IFC 903.3.1.2.1 would provide an alternative to providing sprinklers in this condition. The alternative would not require a sprinkler system when the finish coverings for all components balcony, wall, ceiling) are non-combustible. In summary, single family homes can have grills without limitation. The proposed code amendments provide an alternative to fire sprinklers that allows the use of grills and allows the occupant to use a propane tank which is of a practical size. It is important to note that this discussion is limited to multi -family dwellings four stories in height or less. Buildings greater than four stories in height require different construction methods and have different fire protection requirements. SECTION 304.1 — WASTE ACCUMULATION PROHIBITED: Section 304.1 is deleted and replaced with the following: "Combustible waste including debris piles from construction activities creating a fire hazard shall not be allowed to accumulate in buildings or structures or upon premises." SECTION 307.1.1 — PROHIBITED OPEN BURNING: Section 307.1.1 is deleted and replaced with the following: "Open burning is prohibited." SECTION 307.4.1 — BONFIRES: Section 307.4.1 is deleted and replaced with the following: "Bonfires are prohibited." A handheld extinguisher shall be kept within 10 feet of any open flame cooking device. Charcoal burners shall not be used under covered decks or above grade level, regardless of construction type. Exceptions: 1. One- and two-family dwellings. 2. Where buildings, balconies and decks are protected by an automatic sprinkler system, or when balconies, decks and overhanging decks or roofs are constructed with noncombustible finish materials. 3. LP -gas cooking devices having LP -gas container with a water capacity not greater than 47 Pounds (nominal 20 pound LP gas capacity)." SECTION 507.5.7 — MOUNTAIN HYDRANTS: Section 507.5.7 is deleted and replaced with the following: "New hydrants that are to be installed in unheated areas shall be Mountain Hydrant specifications unless otherwise approved by the fire code official." SECTION 901.6.1 — INSPECTION, TESTING, and MAINTENANCE: Section 901.6.1 is deleted and replaced with the following: "Fire detection, alarm, and extinguishing systems, mechanical smoke exhaust systems, and smoke and heat vents shall be maintained in an operative condition at all times, and shall be replaced or repaired where defective. Existing systems, including notification and signaling devices that are no longer listed by U.L. or supported by manufacturer shall be replaced per current NFPA and Vail Fire and Emergency Services fire alarm installation standards. Non -required fire protection systems and equipment shall be inspected, tested and maintained or removed." SECTION 901.11 — LIFE SAFETY REPORTS: Section 901.11 is added, to read as follows: "A Life Safety Report shall be approved by the Vail Fire Code Official prior to issuance of a building permit for all buildings 55 feet or greater in height, measured from fire department access to the highest occupied floor level, inaccessible buildings or where the building is employing a performance based design. Elements of the Life Safety Report shall include without limitation: exiting, travel distances, smoke control, smoke management, fire alarm and detection, fire sprinkler systems, standpipe systems, fire pumps, and other elements directly related to fire and life safety." SECTION 907.2.11.2 — GROUPS R-2, R -3,R-4, 1-1 AND ALL RESIDENTIAL PROPERTIES THAT ARE AVAILABLE FOR RENT OR LEASE: Section 907.2.11.2 is deleted and replaced with the following: "Single or multiple -station smoke alarms shall be installed and maintained in Groups R-2, R-3, R-4, 1-1 and all residential properties available for rent or lease regardless of occupant load at all of the following locations: 1. On the ceiling or wall outside of each separate sleeping area in the immediate vicinity of bedrooms. 2. In each room used for sleeping purposes. 3. In each story within a dwelling unit, including basements but not including crawl spaces and uninhabitable attics. In dwellings or dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level provided that the lower level is less than one full story below the upper level." SECTION 907.2.11.4 — INSTALLATION NEAR BATHROOMS: Section 908.2.11.4 is deleted and replaced with the following: "Smoke alarms shall be installed not less than 6 feet horizontally from the door or opening of a bathroom that contains a bathtub or shower unless this would prevent placement of a smoke alarm required by Section 907.2.11.1 or 907.2.11.2." SECTION 907.4.2.3 — COLOR: Section 907.4.2.3 is deleted and replaced with the following: "Manual fire alarm boxes shall be red or white in color." SECTION 907.6.3 — INITIATING DEVICE IDENTIFICATION: Section 907.6.3 is deleted and replaced with the following: "The fire alarm system shall identify the specific initiating device address, location, device type, floor level where applicable and status including indication of normal, alarm, trouble and supervisory status, as appropriate. Exceptions: Special initiating devices that do not support individual device identification." SECTION 907.6.6 — MONITORING: Section 907.6.6 is deleted and replaced with the following: "Fire alarm systems required by this chapter or by the International Building Code shall be monitored by an approved supervising station in accordance with NFPA 72." SECTION 915.1.1 —WHERE REQUIRED: Section 915.1.1 is deleted and replaced with the following: "Carbon monoxide detection shall be provided in Group 1-1, 1-2, 1-4 and R occupancies, existing one- and two-family dwellings, multiple single family dwellings (townhouses) and apartments, in classrooms in Group E occupancies in the locations specified in Section 915.2 where any of the conditions in Sections 915.1.2 through 915.1.6 exist." SECTION 1103.8 — SINGLE AND MULTIPLE -STATION SMOKE ALARMS: Section 1103.8 is deleted and replaced with the following: "Single and multiple -station smoke alarms shall be installed in existing Group 1-1 and R occupancies including single and multiple family dwellings, townhomes and apartments in accordance with Sections 1103.8.1 through 1103.8.3." SECTION 1103.8.1 — WHERE REQUIRED: Section 1103.8.1 is deleted and replaced with the following: "Existing Group 1-1 and R occupancies shall be provided with single -station smoke alarms in accordance with Section 907.2.11. Interconnection and power sources shall be in accordance with Sections 1103.8.2 and 1103.8.3, respectively. Exceptions: 1. The second item on the agenda was Citizen Participation with input as follows: Rick Sackbauer, ERWSD, spoke about an update on the wilderness policy information and an upcoming September meeting. He encouraged a review of the draft policy from the town officials and the community as they were interested in public input as well. Chamonix neighborhood resident expressed concerns about speeding on Chamonix and requested more signage (15 mph preferable); he made the same request earlier in the summer and nothing has been done. He would prefer a speed bump that might help slow down traffic as it is dangerous for the neighborhood. Kay Ferry introduced Jon Warnick who is running for Colorado Mountain College Board. Warnick spoke a few minutes about his interest in serving on the CMC Board; he is from Carbondale. Andy Newell, Vail Valley Soccer Club, thanked the Town of Vail for their support in the use of the town's fields this past weekend for their annual soccer tournament and fundraiser. Dennis Parsons, pickle baller and resident, expressed support for converting the courts to allow more pickleball play. Carolyn Swanpoole, resident, expressed support of the sport of pickleball and players, and encouraged the council to provide for more courts in the Vail area as she described the difficulty found in reserving pickleball courts since many of them are private. Several people expressed opposition to converting the courts to pickleball including 1) Larry Barnes, 2) Courtney Klein (Rams -horn Condos), 3) Tiffany Arrant (Texas Townhomes), 4) Susie Tjossem, citing noise, lack of restrooms and parking as concerns and a suggestion to evaluate more fully the needs of both court players before making any court conversions. Paul Rondeau, resident, expressed his concern with Frontage Road parking and safety impacts. He would like the council to review this matter and respond to the community with some suggestions for improvements. He expressed frustrations that there has not been any response to his concerns. Town Manager Zemler clarified the topic of pickleball was not an item on the evening agenda for discussion but the input was related to the monies budgeted in the 2016 budget for court improvements at Golden Peak. There would be more to come on this topic including public input opportunities in the coming months. Citizen participation was finished at this time. The sixth item on the agenda was the presentation of the Vail Transient Inventory Study made by Katie Barnes, DestiMetrics, which was an update made to an initial study providing data on Town of Vail transient inventory conducted in 2009, updated in 2011, and again in 2015. Highlights from the study, which was done in order to better understand some of the gray lodging markets, followed: ■ Process / methodology ■ Units/pillows by location ■ Units / pillows by type ■ Units / pillows by rating ■ Gray market (Rent By Owner / RBO vs. Traditional Market Units & Pillows) ; big increase from 2011 to 2015 in # of these units on the vacation rental market ■ Findings Several questions addressed how the inventory was compiled and what was included in the inventory. In conclusion, DestiMetrics was asked to include the airbnb inventory in the data as this market has grown substantially impacting the traditional lodging industry and it would be important to track this market moving forward. The seventh item on the agenda was 2015-2016 Winter Parking Program which was addressed by Greg Hall Director of Public Works and Transportation. He noted each year the Town Council approves the winter parking program for the upcoming season. The recommendation of the staff was to keep the program rates the same as 2014-15; the parking rates and pass prices for Vail have remained the same since the 2008-2009 season. Hall did express some concern with regard to additional demand on parking mostly during the week because of the reduction of parking at the hospital due to construction of the first phase of the master plan build out, but they would monitor the situation. He noted the town was also able to have the license plate recognition software and cameras operational at the end of last season and staff will be able to report to the council early the trends seen with regard to abuse of free periods to avoid paying for parking during the day (looping). He noted the number of days on the Frontage Road as 10 days during the winter and 20 days this past summer. There was a brief discussion about cost benefits of adding another level to the Lionshead parking structure. Daly asked public input and there was none. Town Council supported the recommendation to keep the winter parking rates the same as last year. The eighth item on the agenda was second reading of Ordinance No. 13, Series of 2015, an Ordinance authorizing the sale of real property along Lupine Drive, in exchange for the purchase of real property along Columbine Drive, as presented by Tom Kassmel, Public Works Engineer. He noted a Portion of Columbine Drive currently encroaches on Lot 14 of the Bighorn Subdivision and the property is currently undergoing redevelopment. He noted in order to rectify the encroachment, the property owner and staff have discussed a land transfer, where the Town would receive the portion of property that Columbine Drive encroaches upon and the property owner would receive an equal portion of property along Lupine Drive also adjacent to Lot 14. The ninth item on the agenda was first reading of Ordinance No. 14, Series of 2015, An Ordinance Repealing and Reenacting Chapter 10-1, Building Codes, Vail Town Code, Adopting by Reference the 2015 Editions of the International Building Code, International Residential Code, International Fire Code, International Mechanical Code, International Energy Conservation Code, International Existing Building Code, Colorado Plumbing Code, Colorado Fuel Gas Code, 2014 Edition of the National Electrical Code, 1997 Edition of Uniform Code for Abatement of Dangerous Buildings and with Regard to the Above- Described Codes, Adopting Certain Appendices. Setting Forth Certain Amendments Thereto, and Setting Forth Details in Regard Thereto. The Council was reminded the International Building Codes are updated every three years to maintain minimum standards for the technical advances in building sciences and material innovations that are being used by the construction community. The proposed 2015 Building Codes also reflected the changes mandated by the State of Colorado Building Codes as presented by Martin Haeberle, Chief Building Official & Mike Vaughan, Fire Marshal. It was noted substantial time was spent reviewing the information earlier during the work session. Council's objective was not to place undue requirements or costs on property owners but rather to ensure safety is met. Concerns noted from the earlier work session resulted in two questions that would require more research, 1) Is there an appeal process and could an appeal process become part of the ordinance or code, and 2) what are the real impacts of the fire sprinklers for remodels and decks? Bugby moved to table the ordinance; there was not a second to his motion. Moffet expressed some of his continuing concerns about how the process is really an effort about social engineering rather than addressing true safety measures and he remains frustrated by the process of having to vote on these code amendments. Rogers moved to approve Ordinance No, 14, Series of 2015; Kurz seconded the motion. Daly asked that staff return at 2nd R with 1) information about implementing an appeals process, and 2) sprinkling system requirements for remodels and decks in multi story buildings. The motion passed (5-2; Moffet and Bugby opposed). The tenth item on the agenda was first reading of Ordinance No. 15, Series of 2015, Annual Appropriation Ordinance: Adopting a Budget and Financial Plan and Making Appropriations to Pay the Costs, Expenses, and Liabilities of the Town of Vail, Colorado, for its Fiscal Year January 1, 2016 Through December 31, 2016. Budget highlights were presented by Carlie Smith, Budget Analyst, answering questions posed by council members. General Fund Highlights: ■ CSE funded $150K ■ Castle Peak funded at $50K but required other community governments to match Vail's contribution ■ EGE air alliance supported at $75K from GF; requested more information about what other agencies are contributing; there was concern expressed about the current funding structure/model and fund balances and a suggestions to split the funding between the Vail Local Marketing District and the General Fund Town Council Meeting Minutes of October 6, 2015 Page 4 11/3/2015 RETT Fund Highlights: ■ Sustainable Travel International Certification Program funded at $64K (Walking Mountains Science Center) ■ Betty Ford Way construction paver project funded at $50K for preliminary engineering review There were some concerns expressed by Rogers about the USO Burton event funding at $400K as she noted this amount seemed over the top compared with funding of all the nonprofit funding requests. Council requested to hear from the event producer during the next meeting in order to better understand what might be eliminated if the funding were to occur at a $300K level. Moffet suggested budgeting some monies for consulting services to evaluate the ability to purchase federal lands that might be available to be used for housing; others supported waiting until a project would be viable before budgeting for services. Daly expressed several concerns and suggestions as follows: 1) the overall budget which reflects a trend in an increase of revenue against expenses, 2) suggested research be conducted to determine if there might be a staffing designation allowing some employees to work only 10 months in the year, 3) questioned the need for a 5% performance budget that seems above that which the private business community will see. Rogers, Bruno, Kurz, Moffet Chapin supported the proposed salary performance budget; Bugby did not support it. Daly asked for public input on the 2016 budget at this time; there were no comments. Rogers moved to approve Ordinance No.15, Series of 2015 with the following changes 1) fund EGE Air Alliance at $75K, 2) remove the funding of the map ($200K). Vail Public Library Director Lori Ann Barnes acknowledged her "Friends of the Library" group and thanked the Town council for their support. Daly expressed the Council's deepest thanks to the many library volunteers noting the success of Vail's exceptional library was because of this group. Zemler suggested there would be a review of this topic raised by Mr. Rondeau. He recommended there is a need to review the overall management of the Frontage Roads and they would begin to assess the situation in hopes of providing follow up recommendations. He suggested this may be an opportunity to work with a third party expert in this area. Town council was supportive of this suggestion. Town Clerk Patty McKenny presented a brief update on the upcoming November elections at both the municipal level and the county level. McKenny clarified when the Town of Vail's election results will be final which is no sooner than November 13. The seventh item on the agenda was second reading of Ordinance No. 15, Series 2015, an Ordinance adopting a budget and financial plan and making appropriations to pay the costs, expenses and liabilities of the Town of Vail, Colorado for its fiscal year January 1, 2016 through December 31, 2016 as presented by Carlie Smith, Budget Analyst. There was a review of the memo and the status of budget items from the first reading of the ordinance at the last meeting as follows: General Fund Eagle Air Alliance: Council directed staff to fund a total of $150,000 for the Eagle Air Alliance flight guarantees, with $75,000 funded from the General Fund and the remainder from the Vail Local Marketing District for marketing efforts only. Moffet suggested hiring Kent Myers to serve as a consultant on this topic and offered to serve on the EGE Air Alliance Board. There was agreement that funding only occur if the other communities have funded their contributions including Vail Resorts Inc., and that the Town attorney confirm VLMD funding could be used for the airline guarantees' marketing efforts only. Burton US Open Snowboarding Championships There were comments made from the council members about the funding of this event as follows: Town Council Meeting Minutes of October 20, 2015 Page 2 111/3/2015 Rogers expressed support of the event, but is interested in what impacts to the event would occur if the funding were $300K vs. $400K. She sees the current level as over the top especially when compared with funding for the summer programming provided by the non profit groups. Moffet fully supported the event for several reasons, 1) hits the mark on the market group they want to target, 2) the media value the town gets is amazing because it would be incredibly expensive and unrealistic to purchase the that much media programming, 3) believes the event is fully worth Vail's investment. Bruno continued to express support for the event and the town's partnership with Burton and that activating the town with this kind of event is what the customers want. Bugby supported the event and was interested in better understating the role and support from Vail Resorts, Inc. Chapin expressed support of the event with some specific questions about the event budget related to the party production vs event production costs (talent fees are the party production — music fees) and the snowmaking budget. Ian Warda, Burton's Director of Event and Programming, introduced his team as Whitney Heingartner, Strategic Alliance Manager, and newest member Cameron as well as Peggy Wolfe from Highline Sports and Entertainment, and then presented their economic summary of the event. Highlights included: ✓ attendee expenditures ✓ ROI tax revenue ✓ ROI : parking revenue ✓ Estimated incremental spending estimates ✓ Noted burton's direct sending back to vail thru their travel / lodging / meals almost $1 M Warda emphasized Burton wanted to continue the trend of "growing and activating the event" and attracting the guests to Vail. He noted they could return with more specific budget information about contributions to the event and show more detail about the costs of producing the event. Kurz expressed support of the event at the $400K even though the initial request was for $300K; he continues to be very excited about their return as the sport of snowboarding has brought so many other exciting things to the world of sports; he felt there is a tremendous intrinsic value from this event; and he noted that Vail is the most "connected resort" in the US and the world because of all the young people who attend the event who are sending social messaging everywhere. Daly asked about Burton's organizational structure with some of the recent transitioning and word of recent turmoil. Warda responded noting that several employees have moved on including Nick and Maria, but reminded them of the strong leadership the company gets from owners Jake and Donna Burton. Human Resources: creating a 10 -month employee category Krista Miller, Human Resources Director, presented an update about some discussions occurring looking into the potential for unpaid time off options for employees in select positions Town Council Meeting Minutes of October 20, 2015 Page 3 11/3/2015 whereby up to a month of unpaid leave could be taken during the "shoulder seasons". An unpaid leave policy may accomplish the same cost savings without creating a new category of employee. Daly asked that it be considered as a discussion for a future agenda. Sustainability with revenue projections rising at a lower rate than annual expenditures, The finance staff prepared a historical analysis depicting annual increases in both items (see attachment A of the memo) noting that over the past five years (2010 — 2014), the town has averaged annual revenue increases of 3.7% and annual expenditure increases of 3.5% in the General Fund. It was further noted the proposed 2016 budget for the General Fund projects an increase to revenue of 5.7% and an increase in expenditures of 4.7%. Across all funds, revenue has increased on average 3.0% over the past five years. While sales tax collections have had solid annual increases since the economic downturn, this has been offset by more volatile revenue sources such as Real Estate Transfer Tax, property tax and construction -related fees. Daly suggested that future council's consider tracking this trend in an effort to ensure the budget remains sustainable and that the review should be not calculated on average but rather cumulatively. Several council members, Chapin and Moffet, thanked Daly, Rogers and staff for their strong leadership during the economic downturn. Under the above definition, it is our finding that noise emanating from the Vail pickle ball courts located at Chalet Rd. and Vail Valley Dr. falls within the allowable limits and at no time was there an excessive or unusually loud noise constituting a prohibited act at that location. I suggest you confirm my reading of the Noise Ordinance with the Town Attorney to confirm that my interpretation was correct for the analysis of noise emanating from the Pickle Ball Courts. The range we typically saw was approximately 50-55 decibels with intermittent spikes of up to 60 decibels with a duration of less than 3 seconds. The only exception recorded in our findings took place when a Town of Vail Bus drove westbound on Vail Valley Dr., past the Pickle Ball Courts, at which point the decibel meter jumped to 71 decibels for approximately 3 seconds.
