BACKGROUND: Colorado Gives Day is December 8 this year and has rapidly grown into the largest day of individual giving in the State of Colorado. "Eagle Gives" members actively work together to increase awareness for and develop resources to grow individual giving on that day. Eagle Gives started as a result of Colorado Gives Day and has grown into a year-round collaborative effort, founded in 2010 for all Eagle County nonprofits that were approved to participate in the statewide Colorado Gives Day. The Proclamation is presented to the Vail Town Council in an effort to encourage and remind the community to give on December 8th. 8. ITEM/TOPIC: A request to proceed through the development review process with a proposal to construct a patio seating area for La Cantina restaurant at the Town of Vail owned Vail Village parking structure, located at 241 East Meadow Drive/Tracts B and C, Block 5D, Vail Village Filing 1, and setting forth details in regard thereto. ATTACHMENTS: La Cantina - Staff Memo Applicant Letter Site Plan Artist's Rendering Photos 11/17/2015 TOWN OF VAIL' Memorandum TO: Vail Town Council FROM: Community Development Department DATE: November 17, 2015 SUBJECT: A request to proceed through the development review process with a proposal to construct a patio seating area for La Cantina restaurant at the Town of Vail owned Vail Village parking structure, located at 241 East Meadow Drive/Tracts B and C, Block 5D, Vail Village Filing 1, and setting forth details in regard thereto. Applicant: Richard Wheelock, Owner; La Cantina Restaurant Planner: Chris Neubecker DESCRIPTION OF REQUEST La Cantina Restaurant, represented by owner Richard Wheelock, is requesting property owner authorization to proceed through the Town's development review process with a proposal to construct an outdoor patio on the south side of the Vail Village parking structure. The restaurant is within the Bus Terminal on the third level of the parking structure. The patio would extend southward from the existing structure, on the same level as the existing restaurant. A letter from the applicant detailing the request (Attachment A), draft patio plans (Attachment B) and an artist's rendering (Attachment C), are included for review. Specifics of the proposal include: An 810 +/- square foot heated, stamped concrete (snow -melt) patio Space for approximately 30 — 40 seats New patio wall and railing to match existing Removal of five trees II. CONSIDERATIONS Pursuant to Section 12-16, Conditional Uses, Vail Town Code, the proposal to construct a patio will require review and approval of a conditional use permit by the Planning and Environmental Commission. Pursuant to Section 12-9C, General Use District, Vail Town Code, development standards for the proposal will be prescribed by the Planning and Environmental Commission, including site coverage, landscaping and parking. 11/17/2015 Pursuant to Section 12-11, Design Review, Vail Town Code, the proposal to construct a patio addition on the Vail Village parking structure will require review by the Design Review Board. Pursuant to Regulation 47-302 of the Colorado Liquor Rules, the applicant will need to modify their liquor license to include this outdoor seating area in order to allow liquor consumption on the patio. (The new patio would be contiguous to the current liquor license boundary.) In addition to these regulatory processes, the Town Council should consider the impacts on the existing lease for the restaurant, impacts on restrooms, and potential for creating a precedent for modifying Town owned buildings. The Council should also consider if the outdoor seating will be exclusively for La Cantina patrons, or if it will be open to the general public to use. III. ACTION REQUESTED On behalf of the property owner, the Vail Town Council shall approve, approve with conditions, or deny the applicant's request for property owner authorization to proceed through the Town's development review process. The approval of this request will only grant the applicant the required property owner authorization necessary to proceed through the Town's development review process and does not constitute an explicit approval of the proposed improvements. As representatives of the property owner, if the Town Council has specific concerns with the proposal, those concerns should be expressed at this time. IV. RECOMMENDATION Should the Vail Town Council choose to approve the applicant's request, Staff recommends the Council pass the following motion: "The Vail Town Council, on behalf of the property owner, approves the applicant's request to proceed through the development review process with a proposal to construct a patio and seating area for use by La Cantina Restaurant and its customers, located at 241 East Meadow Drive/Tracts B and C, Block 5D, Vail Village Filing 1, and setting forth details in regard thereto. Photographs of the site Town of Vail Page 2 11/17/2015 EXHIBIT A October 23, 2015 Vail Town Council, La Cantina in the Vail Transportation Center would like to propose a new deck to be located in the hillside area directly outside of the restaurant overlooking meadow drive. We believe that the proposed deck would create a welcoming feel to an outside area that is the gateway for guests to Vail Village. Our plans for the deck would make the new structure appear as if it were a part of the current exterior amenities. The railings and hardscape would mirror the existing styles. We would incorporate existing trees and shrubs and provide areas for plants through re -stacking of the boulders in front of the foundation to create a deck that melds into the landscape. As part of our overall plan we would remodel the interior area of the transportation center where the current Fro -Yo shop exists through creation of a counter service area. The counter would continue "through" the wall to the outside on the deck for additional seating and service. In addition, we would like to provide for some outside grilling or rotisserie cooking by a Cantina cook during times of peak demand. Our deck would accommodate approximately 40 seated customers. Through the use of exterior heaters we anticipate utilizing the deck year round. We would maintain the current Cantina hours of closing by 10pm every day for the deck. In the winter we see the deck as a great apres ski location with one of the best views of the slopes in all of Vail. During busy winter lunches and moderate temperature nights the deck would serve as an overflow for the main restaurant dining. During the summer season we believe that the deck will be the area of choice for our customers day and night. By incorporating our deck into the landscape and creating an area of activity at the gateway to the village, we believe that our proposed deck will create an environment where additional people can enjoy the benefits of La Cantina and share in the Vail experience. WHEREAS, the Town of Vail (the "Town"), in the County of Eagle and State of Colorado is a home rule municipal corporation duly organized and existing under the laws of the State of Colorado and the Town Charter (the "Charter"); WHEREAS, the members of the Town Council of the Town (the "Council") have been duly elected and qualified; WHEREAS, the Town and Eagle County (the "County") entered into an Intergovernmental Agreement (the "Agreement") on November 23, 2010 regarding the Town of Vail Recycle Drop Off Site; WHEREAS, the Agreement has since been amended annually to extend the term for consecutive one-year periods; WHEREAS, the Town and County wish to extend the Agreement for an additional one year period on the same terms and conditions as set forth in the original Agreement WHEREAS, the Council's approval of Resolution No. 2 5, Series 2015, is required to enter into the Intergovernmental Agreement ("IGA"). NOW THEREFORE, B E IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: Section 1. The Council hereby approves the IGA and authorizes the Town Manager to enter into the IGA with Eagle County on behalf of the Town in substantially the same form as attached hereto as Exhibit A and in a form approved by the Town Attorney. Section 2. This Resolution shall take effect immediately upon its passage. Town Mayor ATTEST: Patty McKenny Town Clerk Resolution No. 35, Series of 2015 11/17/2015 FIFTH AMENDMENT TO AGREEMENT BETWEEN EAGLE COUNTY, COLORADO AND TOWN OF VAIL REGARDING RECYCLE DROP OFF SITE THIS FIFTH AMENDMENT ("Fifth Amendment") is effective as of the day of , 2015 between Eagle County, Colorado, located at 500 Broadway, Eagle, CO 81631 ("County") and Town of Vail, Colorado a municipal corporation, located at 75 South Frontage Road, Vail, CO 81658 ("Town"). WITNESSETH: WHEREAS, County and Town entered into an Agreement dated November 23, 2010 concerning the Town of Vail Recycle Drop Off Site ("Original Agreement"); and WHEREAS, the Parties entered into a First Amendment dated December 29, 2011, a Second Amendment dated November 30, 2012, a Third Amendment dated January 1, 2014, and a Fourth Amendment dated January 1, 2015 to extend the term of the Original Agreement for consecutive one-year periods; and WHEREAS, the parties desire to extend the term of the Original Agreement for an additional one-year period on the same terms and conditions as set forth in the Original Agreement. iwl "..1a IW'"IO WI" NOW, THEREFORE, in consideration of the foregoing premises and the following promises, County and Town agree to amend the Original Agreement as follows: 1. The Agreement may be renewed annually by mutual written agreement of the parties." 2. Capitalized terms in this Fifth Amendment will have the same meaning as in the Original Agreement. To the extent that the terms and provisions of this Fifth Amendment conflict with, modify or supplement portions of the Original Agreement, the terms and provisions contained in this Fifth Amendment shall govern and control the rights and obligations of the parties. 3. Except as expressly altered, modified and changed in this Fifth Amendment, all terms and provisions of the Original Agreement shall remain in full force and effect, and are hereby ratified and confirmed in all respects as of the date hereof. 11/17/2015 11 4. The County agrees to provide General Animal Services and Emergency On -Call Service within the Town of Vail as follows: 11/17/2015 A. General Animal Services shall include: i. A minimum of 50 hours of patrol per month, consisting of inspection tours looking for violations or responding to complaints. ii. Administration and enforcement of the Title 6 of the Town of Vail Municipal Code presently in effect and as may be subsequently amended to apply for the control and licensing of animals within the Town boundaries. Eagle County Animal Services shall be considered the Animal Control Officer of the Town as defined by Section 6.4.2 of the Town of Vail Municipal Code. iii. The County shall provide the Town with monthly reports and an annual report of services provided pursuant to this Agreement. Such reports shall include, by way of example only, the number of calls for service, number of animals sheltered, number of Unclaimed Days, and number of citations issued, as they apply to the Town of Vail. iv. Animal sheltering services for animals attributable to the Town, of the nature and quality customarily provided at the Shelter. Animals attributable to the Town are animals impounded within the Town of Vail and animals owned by persons dwelling, permanently or temporarily, in the Town of Vail. B. Twenty-four (24) hours per day Emergency On -Call Service. i. Emergency on Call Service will be provided during the period when an Eagle County Animal Services Officer is not on duty. In the event that an Eagle County Animal Services Officer is not immediately available to respond to an incident or emergency, the Town of Vail will provide available personnel to secure the scene and administer control of the situation until the Eagle County Animal Services Officer arrives to resolve said incident. SECTION 4. OFFICIAL STATUS. For the purpose of performing the Animal Services and functions set forth in this agreement, Eagle County Animal Services shall enforce, as the Town's agent, the Town of Vail Animal Ordinances relating to animal control and licensing now in effect and as amended. SECTION 5. EQUIPMENT. The County shall furnish and supply, at its sole expense, all necessary labor, supervision, equipment, motor vehicles, office space, and operating and office supplies necessary to provide the services to be rendered hereunder. 11/17/2015 SECTION 6. COMPENSATION. A. The Town of Vail agrees to pay the County, monthly, the sum of $3,200.00 for General Animal Services. B. On Call Emergency Services shall be billed at: $50.00 per hour. C. All fees and expenses recovered at or for the Shelter will remain with the County. E. All court fines and costs will remain with the court of venue. SECTION 7. PERSONNEL. A. The Eagle County Animal Services Officer shall have full cooperation from the Town of Vail, its public works, its police officers and/or their respective officers, agents, and employees, so as to facilitate the performance of this Agreement. B. The rendition of Animal Services provided for herein, the standards of performance, the discipline of officers, and other matters incident to the performance of such services and the control of personnel so employed, shall remain in the County. C. All persons employed in the performance of such Animal Services for the Town of Vail, pursuant to this agreement, shall be County employees, except for Town personnel used to secure the scene as described in Section 3. SECTION 8. LIABILITY AND INSURANCE. A. The County, its officers and employees, shall not be deemed to assume any liability for intentional or negligent acts, errors, or omissions of the Town or of any officer or employee thereof. Likewise, the Town, its officers and employees, shall not be deemed to assume any liability for intentional or negligent acts, errors or omissions of the County or by any officer or employee thereof. B. The County and the Town shall respectively provide its own insurance coverage as each party may deem adequate and necessary for any potential liability arising from this Agreement. Further, the County and the Town, respectively, shall name, subject to the approval of each respective party's insurance carriers, the other respective party as a co-insured under such insurance policies to the extent of any potential liability arising under this Agreement and, upon reasonable written request, shall furnish evidence of the same to the other respective party. C. SUMMARY Authorization for the collection of property taxes in 2016 II. DISCUSSION You will be asked to approve the attached mil levy ordinance upon first reading on Tuesday evening. This ordinance authorizes the collection of property taxes in 2016 based upon 2015 assessed valuations of property within the town's boundaries. Eagle County is responsible for assessing values and for collecting property taxes on our behalf. The town is required by Colorado state law to certify the mil levy by December 15 of each year. Since two readings of an ordinance are required, we will bring the first reading on Tuesday and the second reading on December 1st to enable us to meet the December 15 date. The attached ordinance is based on preliminary assessed valuations from the county (as of August, 2015). The town's base mil levy as shown in the ordinance is 4.69 mils and the abatement levy is .037 mils. Abatement results when a taxpayer protests an assessed valuation after the normal protest period and is refunded a portion of the tax already due or paid. The abatement mil levy allows the town to recoup the refunded amount. This abatement levy of .037 mils equates to an additional $2.97 per year for a $1 million home. The property tax authorized by the attached ordinance will generate $4.7 million in revenue in 2016, representing approximately 8% of the town's total revenue. 11/17/2015 ORDINANCE NO. 16 SERIES OF 2015 AN ORDINANCE PROVIDING FOR THE LEVY ASSESSMENT AND COLLECTION OF TOWN AD VALOREM PROPERTY TAXES DUE FOR THE 2015 TAX YEAR AND PAYABLE IN THE 2016 FISCAL YEAR. WHEREAS, it is necessary for the Town Council to provide for the levy, assessment and collection of Town ad valorem property taxes due for the 2015 year and payable in the 2016 fiscal year. NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail, Colorado, that: 1. Neubecker explained the rationale for not allowing the use in certain zone districts. He provided an overview of the Religious Land Use and Institutionalized Persons Act (RLUIPA) and its impacts on zoning matters. He reviewed the land use map and its inclusion of Religious Uses. Neubecker discussed the types of issues including parking, lighting, traffic and noise that would be addressed through the conditional use process. In conclusion, he discussed the approval criteria for a text amendment and his findings that the proposed changes meet the criteria for approval. Rediker asked for clarification in the PA -2 zone district. Rediker asked if this approach, opening up residential neighborhoods to Religious Institutions, is the best approach at this time. Neubecker provided a basis for staff's thoughts and asked the commissioners if they felt there was a specific reason for not allowing religious uses in established neighborhoods. Rediker discussed the fragmentation of zoning in Vail, and its differences from many residential neighborhoods across the nation. Cleveland asked if the use of a meeting room for religious uses is permissible. Spence responded that the way the code is currently set up that use would require review. Dominick Mauriello addressed the commission about the genesis of the issue and why it has come forward at this time. Commissioner Gillette proposed an approach of striking religious uses from the code and treating all assembly uses (religious and non -religious) the same. Public Comment: Bob Armour spoke to the proposal and its potential impacts on neighborhoods. Mr. Armour feels that a conditional use permit is necessary to ensure impacts are addressed. Rediker proposed looking at the assembly definitions and how that might intersect with the conditional use permit. Martin feels looking at the potential impacts is necessary. Cleveland provided his insight on RLUIPA and if the conditional use permit would hold up to scrutiny. Cleveland requested feedback from the town's attorney related to this. Lockman requested additional materials related to this topic and what other mountain resort communities have done. Lockman questioned a religious use as a permitted use in the PA/PA- 2 districts. Cleveland feels that the Heavy Services (HS) district should not be excluded. Pratt commented on the approach and the need for Conditional Use permits in established neighborhoods. Pratt also spoke to on -street parking and the impacts that overflow can have on neighborhoods. 11/17/2015 Rediker requested more information from the Town's attorney. LeVine stated that the interactions with his guests, staff and the police have been very positive and handled diplomatically. Ivy said that the police response to an incident where a unit was destroyed ended positively and the perpetrators paid full restitution for repair. Gordon said that he had interaction regarding signage and code enforcement was good. Mullen said that none of her staff feel uncomfortable about calling the police; they see the police as a resource, asset and ally. Is there a general sense of trust that the police department is acting with integrity? The overall response from the VEAC is yes. Where are the weaknesses? Kurz stated that there are more police needed for enforcement of speed limits in neighborhoods and bike dismount during events. Nolan said that sometimes he hears people mention that they think there are too many police in Vail, and the budget is too large for police department for a town of this size. Kundolf said that there could be more police on bikes to help with the kids riding their bikes and skateboards at high speed in the town core Speeders on Bighorn and Meadow Drive are issues. Gordon said that the "concierge attitude" and guest service extraordinaire is a huge benefit to the Town. Police should continue to be doing "tourist consulting". Kurz said that the beat cop and foot patrol police officers are great representatives for the town. He also said that the response time on non emergency issues is really good. The policy for body worn cameras is still under development for the town of Vail police force. There are competing demands between transparency and privacy. It's been shown that video evidence results in a stronger prosecution. Privacy concerns specific examples include: ER, sensitive investigations, federal or statutory protected information. The results from body worn cameras in other towns have been successful on both sides, from police use of force to response from citizens. Another area for consideration is the amount of storage and security needed to house the data/video and costs. Vail Resorts Winter Mountain Update Please see presentation for complete details. Financial Report Upon receipt of all sales tax returns, September collections are estimated to be up 9.9% compared to budget and up 17.3% from the prior year. RETT collections through October 27, total $5,105,458 down 6.1% from this time last year, which was a record year. Town Manager Report Council election is in a waiting pattern until the final votes are tallied from overseas and military. The final votes are due by 5:00pm on Thursday, November 12. New council will be sworn in on November 17. Jen Mason, Kim Langmaid and Kevin Foley will be a part of the new council. Golf Course Clubhouse is underway, parking lot was paved yesterday. Foundation and perimeter walls are up. The appeal lost. There was a financial impact to the Town for legal fees and increased construction costs due to delay. 170 underpass construction is about finished prior to winter. The barriers will stay up all winter. 170 got a designation as a "high priority corridor" which potentially allows for additional federal funding. Zemler is now the President of the Colorado Associate of Ski Towns (CAST). 170 extra lane will have a variable rate and will be a monitored circumstance and the decisions will be made on traffic volume, time, dates, etc. This is a big initiative for CDOT to utilize technology to monitor rates. Uber has contacted the town and they are planning to have a presence in Vail. They will have to comply with the same laws and rules as the other transportation companies.
