Proclamation No. 5, Series of 2017, Economic Development Week May 8- 5 min. 13, 2017 and Recognizing 2017 as the 91st Anniversary of the International Economic Development Council Presenter(s): Dave Chapin, Mayor 3. Consent Agenda 3.1. 2017 Vail Overlay Contract Award 5 min. Background: Staff received 2 bids for the 2017 Vail Overlay Project. The project is budgeted with the Capital Street Maintenance budget and is within the engineer's estimate. Roads included in this year's asphalt overlay project include Bighorn Road. The project is scheduled during the month of September 2017. 4. Town Manager Report 5. Presentations / Discussion 5.1. Red Sandstone School Parking Structure Project Update Presenter(s): Greg Hall, Director of Public Works and Transportation Action Requested of Council: The Town Council is being asked to provide direction to the staff and school district regarding pursuit of a new parking structure on the Red Sandstone Elementary School site in conjunction with the School District's remodel of the school. The staff has posed questions for council direction at this time. • Decide if the town should pursue a 3 level or 4 level structure • Provide direction on the additional design components of the 30 min. May 2, 2017 - Page 1 of 150 project • Direct the Town Manager to enter into a Pre -development Agreement with Eagle County School District in a form approved by the Town Attorney • Authorize the Town Manager to negotiate a design contract with the Eagle County Design Team in an amount not to exceed $ 900,000 • Amend the first supplemental budget by $ 1,300,000 Background: The purpose of this meeting is to present a progress report on the Red Sandstone Elementary School Parking Structure project since the March 21 presentation, discuss the multi-level parking structure project and receive direction from the Town Council. Information to be presented includes: • Pre -Development Intergovernmental Agreement with Eagle County School District • 3 and 4 level Parking Structure options • Cost and budgets for each structure option • Initial cost sharing methodology • Project schedule • Series of next steps for advancing the project forward Staff Recommendation: Staff recommends the Town Council should pursue the four level structure with the additional program components included. As the project progresses the staff will return to the council with design updates prior to the August 1, 2017 deadline for additional direction. In addition, the Town Council should take action on the items below. The amount of design effort expended by the August 1, 2017 deadline would be approximately 50 % of the anticipated $900,000 design contract. • Direct the Town Manager to enter into a Pre -development Agreement with Eagle County School District in a form approved by the Town Attorney • Authorize the Town Manager to negotiate a design contract with the Eagle County design team in an amount not to exceed $ 900,000 • Amend the first supplemental budget by $ 1,300,000 6. Action Items 6.1. Resolution No. 17, Series of 2017, A Resolution Approving a Pre - Development Agreement Between the Town of Vail and Eagle County School District; and Setting Forth Details in Regard Thereto Presenter(s): Greg Hall, Director of Public Works and Matt Mire, Town Attorney Action Requested of Council: Approve, amend or deny Resolution No. 17, Series of 2017 Background: The Town and the District have determined that it is in their respective best interests and in the best interests of the populations they serve that a portion of the Property be developed for use as a public 5 min. May 2, 2017 - Page 2 of 150 parking structure containing approximately 160 spaces for parking, along with an access driveway and related improvements, including without limitation necessary improvements to the lower parking lot on the Property and the Frontage Road. 6.2. Resolution No. 16, Series of 2017, a resolution supporting local and federal 10 min. climate action and including the Town of Vail as a signator on the Mayors National Climate Action Agenda (MNCAA) open letter to the President Presenter(s): Kristen Bertuglia, Environmental Sustainability Manager Action Requested of Council: Staff requests the Vail Town Council approve, approve with modifications, or deny Resolution No. 16, Series of 2017. Background: The Mayors National Climate Action Agenda (MNCAA) has requested that the Town of Vail and other U.S. cities reaffirm their pledge to reduce emissions, increase resilience, transition to a low -carbon economy, track progress transparently, and to assist them in urging more cities to commit to immediate action. Resolution No. 16, Series of 2017 supports this agenda and adds Vail as a signator to the Open Letter to the President, available here: http://www.climate-mayors.org/our-letter-to-the-president- march-2017/ Staff Recommendation: Staff recommends the Vail Town Council approve Resolution No. 16, Series of 2017. 6.3. Pedestrian Access Improvements in the Vicinity of 450 East Lionshead 10 min. Circle (Treetops Building), Permission to Proceed Presenter(s): Jonathan Spence, Senior Planner Action Requested of Council: The owner of the Treetops Building, located at 450 East Lionshead Circle, requests permission to proceed through the Design Review process for improvements to the building's pedestrian access that is located partially on Town of Vail property (E. Lionshead Circle ROW). Background: The Treetops Building was constructed above an existing parking garage in 1986. Access to the building, including the stairs and ADA ramp, are located partially on Town of Vail property. Because of the property line location in close proximity to the building, the applicant is requesting the use of Town of Vail property to improve the pedestrian access to the building. Staff Recommendation: The Community Development Department recommends that the Vail Town Council instructs Town Staff to: • Sign the development application on behalf of the property owner and permit the project to proceed through the development review process for the proposed improvements. 6.4. The purpose of this discussion is to make a final determination on the deed 20 min. restriction requirements for Chamonix Vail. The two issues discussed in this memorandum do not practically affect the future purchasers of the homes at Chamonix Vail. Presenter(s): George Ruther, Director of Community Development Action Requested of Council: Provide direction to town staff on whether the draft Chamonix Vail deed restriction should be further amended. Background: The two issues discussed in the memorandum do not practically affect the future purchasers of the homes at Chamonix Vail. Instead, they provide responses to questions asked by the Vail Town May 2, 2017 - Page 3 of 150 Council regarding 1) the definition of Maximum Resale Price, and 2) the effects of a foreclosure event upon the survivability of the deed restriction. Staff Recommendation: The town staff recommends adopting the definition of Maximum Resale Price as drafted and amending the deed restriction language to permit the Town of Vail to rent a Chamonix Vail home to a qualified tenant in the event the Town acquires the home through its exercising its first option to purchase. 6.5. Ordinance No. 3, Series of 2017, First Reading, An Ordinance Amending 30 min. the Vail Town Code to Adopt by Reference the 2010 Edition of the Model Traffic Code and Modifications Thereto and Amending Related Provisions of Title 7 of the Vail Town Code Presenter(s): Daric Harvey, Police Dept. Commander and Tom Kassmel, Engineer Action Requested of Council: Approve, amend or deny Ordinance No. 3, Series of 2017 Background: The Town Council adopted the 1977 edition of the Model Traffic Code for Colorado Municipalities in 1977. The Town has conducted a study to determine the safe speed limit for local streets within the Town's jurisdiction. The Colorado Department of Transportation, Safety and Engineering Branch updates and modifies the Model Traffic Code for Colorado from time to time. Pursuant to C.R.S. §§ 42-4-110 and 42-4-111, and its home rule authority, the Town is empowered to regulate traffic and vehicles operating on streets and highways within its jurisdiction. 6.6. South Frontage Road Improvements Design Contract Award Presenter(s): Tom Kassmel, Town Engineer Action Requested of Council: Award South Frontage Road Design Improvements Contract. Background: In conjunction with the adoption of the Vail Valley Medical Center (VVMC) Site Specific Redevelopment Master Plan; the Town of Vail, the VVMC, and the Evergreen collaborated to develop a South Frontage Road Improvement Plan that would accommodate each existing and future access point to the above mentioned properties as well as accommodate projected traffic growth along the South Frontage road. The Town put out an RFP for Design services to complete the design and received two proposals. Staff Recommendation: Staff recommends authorizing the Town Manager to enter into a design contract with SGM to be funded by the traffic impact fee fund. 6.7. Gore Valley Trail Connection Reconstruction Contract Award Presenter(s): Tom Kassmel, Town Engineer Action Requested of Council: Award Construction Contract for Gore Valley Trail Connection Reconstruction. Background: The Town has budgeted to reconstruct the Gore Valley Trail connection to the South Frontage Road near the Vail Underpass project. Town has received a bid from Kraemer NA to complete the work. Staff Recommendation: Staff recommends authorizing the Town Manager to enter into a contract with Kraemer NA. 10 min. 10 min. 7. Public Hearings 7.1. Second reading of Ordinance No. 2, Series 2017, an ordinance making 10 min. May 2, 2017 - Page 4 of 150 budget adjustments to the Town of Vail General Fund, Capital Projects Fund, Real Estate Transfer Tax Fund, and Heavy Equipment Fund. Memorandum TO: Vail Town Council FROM: Greg Hall, Director of Public Works and Transportation DATE: May 2, 2017 SUBJECT: Red Sandstone Elementary School Proposed Parking Structure Update I. PURPOSE The purpose of this meeting is to present a progress report on the Red Sandstone Elementary School Parking Structure project since the March 21 presentation, discuss the multi-level parking structure project and receive direction from the Town Council. Information to be presented includes: • Pre -Development Intergovernmental Agreement with Eagle County School District • 3 and 4 level Parking Structure options • Cost and budgets for each structure option • Initial cost sharing methodology • Project schedule • Series of next steps for advancing the project forward Red Sandstone Elementary School Remodel A much -anticipated $8.5 million renovation of Vail's cherished public school has begun after district voters approved a mill levy override for Eagle County Schools that will provide $8 million annually to support operations and a $144 million bond issue that will provide significant upgrades to district facilities. The improvements planned for Red Sandstone Elementary School will enlarge classrooms to accommodate an additional 80 students from its current capacity of 247. The renovation also includes new computer labs, refurbishing of the gym, cafeteria, kitchen and stage areas, plus a new elevator, windows, energy enhancements, life -safety enhancements, roof replacement and improvements to the bus parking and parent drop off. Preliminary plans call for renovations to begin in 2018 with completion by August 2019. RSES was built in 1977 by the School District on land owned by the town. The district has a long-term lease to use the land for a school. Current enrollment is 235 students. Parking Structure The discussion of the possibility of a parking structure being constructed as a part of the project in a partnership between the Town of Vail and the Eagle County Schools took place during the March 21, 2017 Town Council meeting. Red Sandstone Elementary School desires additional parking and improved access via a one-way circulating road system. The town desires additional permanent parking spaces close to a base village. The town council directed the staff to continue with preliminary work and return in May to approve next steps. The staff is requesting town council to provide direction on whether the town and the school district should continue with the next steps in determining if the project should be pursued. ADVANTAGE OF JOINT VENTURE PROJECCT Initial discussion has focused on the possibility of a 120-160 space town -funded parking garage to be built on the school site for use by the town. Why is the town interested in such a project: • The town of Vail owns the land • The town of Vail has a financial commitment from Vail Resorts of $4.3 million to pay for permanent additional public parking owned by the town • The school district is undertaking a significant project at the site in which a combined project would allow a savings over two separate projects • The town has a well documented shortage of parking spaces • The school has a shortage of parking spaces • The school desires a better drop off and circulation system • The site is within walking distance to Lionshead and is well served by transit • The structure could be constructed in a manner to allow natural ventilation which reduces both initial construction costs as well as ongoing operation costs • The project could be eligible for use of Vail Reinvestment Funds III. TOWN OF VAIL DESIGN PROGRAM Town staff and the school district design team have continued to advance plans for the possibility of construction OF a parking structure on the Red Sandstone School site. The design team has prepared both a 3 level (120+/ -space) and a 4 level (160+/- space) structure. Both structures have been preliminary priced. The pricing was then developed into preliminary budgets for each project. In addition to specific design elements of the project, an allowance has been set aside based initial on Town Council direction. These items include the following: Public art Photo voltaic opportunities Public restrooms Reinforced structure to allow for future addition The town staff has identified additional off site improvements to the path on the south side of the pedestrian overpass running parallel to the frontage road and connecting to the north -south walk connecting to Lionshead Village. Specifically this walk should be heated similar to the north -south walk. The staff receives many complaints a year regarding safety concerns of pedestrians sue to the grade of the walk and being shaded by the First Chair building. The addition of a parking structure will only increase the exposure of users. The project team requires the Vail Town Council provide preliminary building program design sign off. Sign off is needed to move the project forward and adhere to the school's project schedule. 2 May 2, 2017 - Page 13 of 150 VI. DESIGN ARCHITECT, GENERAL CONTRACTOR, AND PROJECT MANAGER The Eagle County School District has hired a project management team led by Jeff Chamberlin of RHL Engineering to run their bond election projects. The team has been assembled to include Braun Associates to assist with entitlements for each project. The design team is led by DLR architects our of Denver and TAB architects from Edwards, as well as additional design sub -consultants. A general contractor has been retained by the School District to construct the improvements of the Red Sandstone Elementary School. Haselden Construction is the selected contractor and has experience in constructing similar projects. Haseldon recently completed a parking structure next to Aspen Valley Hospital in Aspen. The design team and contractor have agreed to keep the fee structure for both design and construction including general conditions for the parking structure the same as was competitively selected by the school district as if the parking structure project was a portion of the school district's $146 M overall bond project. In so doing, the Town of Vail is receiving a benefit compared to contracting separately for the work related to the parking structure. The Town of Vail will contract for additional soil borings and ground water monitoring wells for the parking structure. Ground Engineering will conduct this work and is also the soils engineer for the school. The Town of Vail will also contract the consulting for the traffic study and CDOT permits required for the project. FHU will complete this work. The Town of Vail will be the owner of the parking structure. In Proceeding forward the town will contract with the design team for the design of the parking structure, access road and lower parking lot and frontage road improvements. The contract will be developed as to allow the town to terminate if a formal development agreement is not reached with the school district. When the time comes, the Town of Vail will contract with Haseldon Construction for the construction of the fore mentioned improvements. Does the Vail Town Council agree with the town contracting with the school district project team for the parking structure project and direct the town manager to negotiate and enter into a design contract in a form approved by the town attorney? VII. PROJECT COSTS AND BUDGETS The preliminary construction cost for the three level structure is The preliminary construction cost for the four level structure is $ 7,075,000 $ 9,175,000 Due to the preliminary nature of the cost estimates and allowing for escalation, and items for utility relocation and new utility services, the town staff recommends adding 15% to these numbers for construction. Moving forward as part of the development agreement, the remaining cost sharing agreement will be determined. The cost sharing for the project would be shared amongst the following: Eagle County School District Vail Resorts Parking Commitment Vail Reinvestment Authority (VRA) The VRA would fund the additional south 1-70 off site improvements $ TBD $ 4,300,000 $ Remaining Amount $ 287,500 Does the town council agree with the initial budgets and cost sharing and continuing to include the project components in the project at this time?
