Discussion regarding Form Based Code 30 min. Jonathan Spence provided a PowerPoint presentation to the PEC regarding form based codes. Spence began with an introduction to the concept and history of such codes. Spence provided an example of a form based code prepared by Matt Panfil, Town Planner, for a different community. Spence continued by discussing the purpose, types, and uses of form based codes. Form based codes rely on graphics more than a traditional zoning ordinance. Rediker asked questions regarding the legal procedures and the size and scales of form based codes. Spence stated that form based codes place emphasis on the design of the public realm. He also discussed potential uses of form based codes in the Town of Vail. Spence analyzed how a form based code differs from the current zoning regulations in the Vail Town Code. Perez stated that she was on the Denver Plan Commission when the City began incorporating a form based code. She discussed different examples of her experience with form based codes and stated her belief that form based codes can be helpful for areas with unique characteristics. Rediker asked if, due to the extensive nonconformities in Town, using a form based code be a way to address these issues. Spence replied that it depends on whether or not the nonconformities are deemed desirable or not. Gillette added that he had a positive experience in Denver in that a form based code made clear the potential massing of a project, but the code fell short in addressing the smaller details that gave the neighborhood its character. Rediker asked if staff felt form based codes would be limited to commercial areas or if it would extend to residential areas. Hopkins added that she viewed it more as people based zoning. Rediker asked how typically restrictive form based January 16, 2018 - Page 9 of 30 codes are. Spence referenced examples of graphics used in existing form based codes. Rediker stated that he could see the use of a form based code in taking separate elements of Town plans and codes and beginning to harmonize them into one document. Gillette concurred. 4.2. Gore Creek Macro Invertebrate Score Update 30 min. Pete Wadden, Watershed Coordinator, provided a PowerPoint presentation that summarized the 2016 Gore Creek macro invertebrate score. The first topic discussed by Wadden referenced the sampling methods and how the samples are analyzed and turned into usable data. Wadden included information about the various macro invertebrates that are commonly found in Gore Creek. Gillette asked about the relationship between weather and bug counts and if temperature was included in analysis. Gillette suggested graphics that could incorporate additional factors like temperature. Rediker asked if the change in altitude affected survey results. Wadden stated that there are different zones based on characteristics like altitude, but Gore Creek lies within one consistent zone. Wadden continued by summarizing the 2016 survey results and comparing the results to previous years. There was reasonable progress in 2016, except above the confluence of Gore Creek and Eagle River. The PEC, Wadden, and Kristen Bertuglia, Environmental Sustainability Manager, had a lengthy discussion on potential causes of impairment and what measures may be having a positive overall affect on Gore Creek. Wadden presented survey information specific to Red Sandstone Creek, which has high scores at the top of the creek, but the scores drop significantly after going through developed areas. 5. Memorandum To: Town Council From: Public Works Department Date: January 16, 2018 Subject: Transit Stop Improvements Project Update I. SUMMARY The Town of Vail has budgeted $875,000 in 2018 for transit stop improvements. The purpose of these improvements is to provide improvements for transit stops along the West Vail Express route. These improvements specifically include; (See Attached) • West Vail Chamonix Transit Stop: Pedestrian and drainage improvements • Lionshead Transit Center(LHTC): Construction of a new transit stop near the LHTC to accommodate a westbound stop • Vail Village Transit Center(VVTC): Construction of two additional bus bays along the South Frontage Road adjacent to the WTC to increase capacity The purpose of this Council session is to update Council on the progress of the design and provide an opportunity for comment. II. WEST VAIL CHAMONIX TRANSIT STOP The existing West Vail Chamonix bus stop is currently lacking sidewalk accommodations for pedestrians. This stop has seen a significant increase in ridership over the past few years due to the existence of free roadside parking on the weekends. Staff is moving forward with constructing a sidewalk for pedestrians at the bus stop loading area. III. LIONSHEAD TRANSIT CENTER WESTBOUND STOP The existing Lionshead Transit Center only accommodates eastbound buses. Now that the West Vail Express bus route can utilize the new Sandstone Underpass there is a need to add a westbound stop at the Lionshead Transit Center. The Town has prepared two alternatives; • Alternative 1 (Preferred): Add a westbound stop just east of the LHTC at the old information booth pull out. This will allow pedestrians to access the bus stop without crossing the South Frontage Road. The bus stop is —150 feet east of the LHTC eastbound stop. This alternative also includes an option to add a stair connection directly to the second level of the Lionshead Parking Structure for January 16, 2018 - Page 14 of 3 those trying to access Dobson Ice Arena from this location. The stair connection was not included in the original budget, but can be bid as an add alternate if desired by Council. • Alternative 2: Add a westbound stop across the street from the LHTC. This will require pedestrians to cross the South Frontage Road, requiring additional flashing pedestrian crossing signs, and a large center median. The major concern with regards to this option is that it will be difficult to control pedestrians to cross at the designed crossing. It is highly likely pedestrians will cross at an angle from the bus stop to the pedestrian bridge which is an unsafe movement. IV. VAIL VILLAGE TRANSIT CENTER ADDITIONAL CAPACITY The existing VVTC is currently over capacity with the number of buses it can hold at one time during peak periods. In 2012 the Town designed two bus bays along the South Frontage Road in front of the VVTC. The design was denied by the DRB due to the removal of the lawn area. Since that time transit continues to see growth and has an increased need for additional capacity. Town staff will move forward with returning to DRB for approval and then constructing these improvements. These two bus bays will accommodate Bustang, Greyhound, West Vail Express route, the Special Event Express route, and the In -Town bus when it is re-routed during summer special events. V. LANDSCAPE IMPROVEMENTS The Town has also budgeted an additional $225,000 in 2018 to improve the landscaping surrounding the Vail Village and Lionshead Parking Structures. These landscape improvement projects will be coordinated with the transit stop improvement projecst. Specific highlights of the landscape project include; • Addition of trees and shrubs around the Vail Village Parking Structure to fill in where trees, shrubs and flowers have been removed over the years due to death and disease and to improve screening of the concrete structure. • Addition of trees and shrubs along the north and west sides of the Lionshead Parking Structure. Numerous spruce trees have been removed over the past 5-7 years due to death and disease. Each year, the town removes 2 or 3 and begins to see decline of additional trees that end up being removed the following year. The causes of the decline include overplanting, the pine needle scale infestation, construction impacts, Christmas tree lights and likely dirt/magnesium chloride from 1-70. Staff has worked to fertilize, improve irrigation, prune and even wash the trees in an effort to improve their health. Some show improvement, but many continue to decline. • Redesign of the entry area including removal of the dated Lionshead stone sign and replacement of the trees that are in poor health. VI. NEXT STEPS Staff will submit updated plans to the Design Review Board for approval and advertise the projects for construction, with a likely spring construction contract award and start. The Board reviewed and approved the November 28, 2017 meeting results. MOTION: McDougall SECOND: Wilkins VOTE: 3-0 Kathleen Halloran, Finance Director, reviewed the Board's 2018 budget, Resolution 5, Series of 2017 and 2017 audit exemption Resolution 6, Series of 2017. Wilkins motioned to approve Resolution 5, Series of 2017, A RESOLUTION ADOPTING A BUDGET AND MAKING APPROPRIATIONS TO PAY THE COSTS, EXPENSES AND LIABILITIES OF THE VAIL LOCAL HOUSING AUTHORITY, FOR ITS FISCAL YEAR JANUARY 1, 2018 THROUGH DECEMBER 31, 2018. MOTION: Wilkins SECOND: Meza VOTE: 4-0 Wilkins motioned to approve Resolution 6, Series of 2017, A RESOLUTION APROVING AN EXEMPTION FROM AUDIT FOR THE FISCAL YEAR 2016, FOR THE VAIL LOCAL HOUSING AUTHORITY IN THE STATE OF COLORADO. MOTION: Wilkins SECOND: Meza VOTE: 4-0 Page 1 January 16, 2018 - Page 25 of 3 Next up Jonathan Spence Town planner, provided the Board with an overview and explanation regarding options to delay implementation of Type 1 and 11 Employee Housing Unit (EHU) occupancy. Spence reviewed the existing Town code and presented two options for the Board to consider. The options presented were: Option 1: Code Amendment Option 2: Deed Language • Directly addressing the occupancy restriction language • Transparency • Tailor made restrictions for specialized circumstances. • Reduced possibility of unforeseen circumstances • Difficulty in ensuring that the language addresses the possibility of a multitude of variations • Difficulty in ascertaining unforeseen consequences • Slow response time if holes in the regulations are identified • Opening up revisions to the Code for what may be a "one off" • Legal question as to the effect of a deed restriction that may conflict with the Code. • Lack of transparency Ruther said the Town was conceptually looking at land banking, typically a vacant property. Wilkins mentioned the Board should have discussion regarding housing ADA employees as they cannot meet current deed restriction criteria due to income and work hour limitations. Staff stated that is tied to fair housing act. Ruther mentioned if the restriction is specific in code there cannot be negotiation rather if customized then the Town has negotiating power. Lindstrom asked Spence how an owner would make an illegal unit legal. Spence responded the Town probably would require a code analysis. Ruther told the Board the question to be answered is it OK to push the occupancy decision down the road. Page 2 January 16, 2018 - Page 26 of 3 Spence asked what does later mean. How does the Town decide what later is? Wilkins concerned about legal inequities. Board will continue to review this subject. Lindstrom asked the Board if there was interest in deed restriction as discussed. All were in agreement. There was no vote. Molly Morales arrived at 3:50 PM. Town planner Justin Lightfield presented information on a feasibility study for Tract A Middle Creek Subdivision. He pointed out the property is currently zoned Natural Area Preservation District (NAP) which is the Town's most restrictive zoning. The Board and Staff discussed buildable potential on Middle Creek subdivision. They asked if there a variance for Middle Creek due to lot slope. Staff stated PEC would have granted the variance if one was applied. Staff will have to confirm is a variance was applied for and approved. Lightfield said a site specific study would be required when in a debris flow or other hazard. Staff said there could be development possibilities. Ruther thinks the Board needs to put list together where are buildable sites. Be pragmatic and think outside the box. He asked Lightfield to get map to show elevation from Frontage Road and create rough elevation of site. This piece of land hasn't been on the radar for Open Lands Plan. Ruther suggested bringing up this information at the Open Lands Plan meetings. McDougall motioned to open an executive session per C.R.S. §24-6-402(4)(a)(e) to discuss the purchase, acquisition, lease, transfer, or sale of property interests; and to determine positions, develop a strategy and instruct negotiators, regarding Vail InDEED applications. MOTION: McDougall SECOND: Wilkins VOTE: 5-0 Wilkins made a motion to exit the executive session and reopen the regular meeting. MOTION: Wilkins SECOND: McDougall VOTE: 5-0 Results of the executive session were the Board had additional questions for the Vail InDEED applicant and will continue the application review and the next regular meeting. The Board agreed to cancel the December 26, 2017 meeting due to the Holiday week.
