Attendance Present: Ludwig Kurz, Karen Perez, Pam Hopkins, John Ryan Lockman, Brian Stockmar Absent: Rollie Kjesbo, Brian Gillette 2. Main Agenda 2.1. A request for review of Major Exterior Alteration, pursuant to Section 12-7H- 40 min. 7, Exterior Alterations or Modifications, Vail Town Code, to allow for construction of a new multifamily structure with below grade parking, located at 500 East Lionshead Circle/Lot 3, Block 1, Vail Lionshead Filing 1, and setting forth details in regard thereto. (PEC18-0034) Applicant: Lazier Lionshead LLC, represented by Braun Associates Inc. Planner: Jonathan Spence Jonathan Spence introduced the project. The proposed development will tie into the approved Launch development on the east side of this site. No formal vote is expected today. Spence clarified that there is no fitness room, which was previously mentioned does not exist. Staff is looking for feedback on the proposed development, including hot beds and the variance.. Tom Braun introduced the design team from OZ Architecture. The team has worked on several projects in Vail. This will be a work session to introduce the project. Tom showed a diagram of the site context, including the Battle Mountain LLC property to the east. These two projects have been designed to integrate together. Today this space is an alleyway, and an uninviting place. The development will tie into the mall level. The overview of the project will cover the Lionshead Redevelopment Master Plan, including planning and design considerations. Site is 0.729 acres, which includes the sidewalk to the west and steps to the south. Site is undeveloped; access to parking will be from the lower level to the south. Proposal conforms to development standards, including density and GRFA, below maximum allowed height. Site conforms to required setbacks, except on the east side, where the parking garage does not meet the standard. This property adjoins the development to the east at the parking garage and open plaza level, which will create a plaza and pedestrian connection to the properties to the north. Town zoning requires existing parking on the site to be maintained on site. We are planning to have about 30 spaces more than required by the Town code. We are requesting a setback variance. Braun reviewed the policy objectives of the Lionshead Redevelopment December 4, 2018 - Page 11 of Master Plan (LRMP), including renewal and redevelopment. A new building is proposed in location of an old parking structure. He also reviewed the detailed recommendations of the LRMP, including detailed recommendations for this site, which called for a large single structure. Tom reviewed the site plan, including the proposed stairs to provide access to the property to the north. Pedestrian areas will be snow melted. Master Plan recommends live beds, which are units that are likely to be occupied, not remaining dark for long periods of the year. There are many condominiums in the Lionshead Area, without features of a hotel. Goal is to have units with amenities and services, which are more likely to be rented and occupied. Office space will facilitate guest check -ins. Lobby, library and breakfast room are proposed. No meeting rooms are proposed, but more amenities than many nearby condos. Robert E Fitzgerald ("Fitz"), Architect — OZ Architecture — Project name is Lion's View, views to the south are amazing. In past, I have made presentations on the history of Vail, and connection between Lionshead and Vail Village. Town founded by 10th Mountain Division, to create a village like they found in Europe. In the past, Lionshead went off course, and away from the original design concept. Our theory is to meld this linear town. I'm not a Bavarian architect, and I did not grow up in Munich. But we look to the original founders' vision for Vail. He discussed other redevelopment projects in Lionshead, and discussed historical alpine architecture references. Some projects that followed this vision are Arrabelle, Ritz Carlton, and Vail's Front Door. Lionsview is the daughter of the Arrabelle and niece of the Ritz-Carlton. It will respect the beauty of its predecessors. Fitzgerald - Lionshead is still stuck with some of the remnants of California modern architecture. The concept is the center of Lionshead would be the most respective of the European architecture. He reviewed the repair of the Lionshead fabric, and the infill of the parking structure. Bob's (Lazier) concern is how the neighbors will view this building, and how this project can improve access and serviceability of the Lift House, and improving the neighborhood condition. Another policy objective is to enhance the pedestrian environment. Connection to Lionshead will be improved for Vantage Point. I was responsible for leading the public art program for Arrabelle. Some of the design elements in the Lion's View will include signature design elements from other Lazier developments. He discussed a reverse view corridor. This will maintain a view back toward our building. When the Lion's Pride building comes down it will open up a view corridor. The LRMP calls for removing the Lion's Pride building. Handicapped access will be provided through an elevator in the proposed building. This site has been an alley, and now will become a pedestrian street. Fitzgerald described the view and access from the south, once Lion's Pride is removed. Building is classic Vail, rich in detail. Not every building should be seen from all sides. We don't believe that base/middle/top is as important as some people have suggested. Middle of the building is calm. If Arrabelle was all one color, or all one facade, it would appear too large. Idea is to break down facades, as if there were property lines or partition walls. Use of balconies to animate and break up the facade. We will use a fairly limited palette of materials, including same stone as the Launch and Welcome Center buildings. Strip of red is not corten steel. That will be stainless steel. Not rusty, but luxurious. Strong stone base. Building will December 4, 2018 - Page 12 of have a front, sides and rear. Idea is to break up building into three distinct facades. No balconies on the north side, to provide more privacy to Vantage Point. Balconies on east and west will help diminish the height of the building. A fly -by 3D view of the project design was presented. Octagon on southeast corner is a reference to the Tivoli Building. Hopkins — What size are the balconies? Fitzgerald — Minimum 6' deep. Some balconies are 10' deep. Second and third floor will have greater outdoor space, but lesser views. Smaller balconies at the upper units. Stockmar — Process also requires DRB review. Our review does not include detailed review, but more on the massing. Fitzgerald — From balconies on southwest, there will be direct views to the Arrabelle clocktower. Stockmar — If we approve this process, what is timeframe to build? Bob Lazier, owner — We hope to start about April 15th. We are in close contact with the Launch developers. Build time is 18-19 months. Underground parking is a big part of the construction time. When we built the Tivoli, it was about 6 weeks from foundation to get to ground level. About 30,000 square feet of residential space. Tivoli is about 45,000 square feet. We consider this more than a condominium, more of a residence. Perez- Tom mentioned that the extra parking spaces are a community benefit. Do you intend to provide access to the parking for the public? Lazier — Yes, and some spaces for the Lifthouse and Arcade building. Braun — Spaces will likely be leased long term, but not hourly parking. That would open up spaces in the Lionshead parking structure. Stockmar — Will Arrabelle dock be used for deliveries? Lazier — Yes. But move in and move out for residents will be on site. Stockmar — Intention of the Arrabelle dock is for daily deliveries. Today's meeting does not require a vote. Public Comment: Kingsley Brown — Vantage Point #212 — There are some nice things about the project. I like the landmark on the corner of the building. Pay more attention to the back of the building. Where will you dump the exhaust from the parking garage? Why are there windows at the top of the elevator shaft, at mechanical room? Asked about the stairs on the left side at the rear, which impact the view for Vantage Point residents. Not sure why there are windows at top floor of the steel at north side. Fitzgerald — Windows at top of stair are elevator core areas, its spandrel glass. December 4, 2018 - Page 13 of Stockmar — Is the roof access within the maximum height? Fitzgerald — Yes Brown — Can that feature be reduced in height? Would like applicant to explain where the garage exhaust will exit building. Vehicle access seems to dominate the stairs on the south. In alley, is there delineation to separate vehicles from pedestrians? Commissioner Comments: Lockman — Where does Lion's Pride pedestrian access tie into this site? What is pedestrian view looking north? (An image showing the view from the lower level near the current Lions Pride was shown to the Commission.) Hopkins — Please show the stairs between the two buildings. Fitzgerald — Stairs are about 6' to 8' wide at the top of stairs. Stairs are 12' to 15' wide near Lions Pride building. Lockman — Concern on the loss of a commercial aesthetic on the south side. I understand that the Master Plan does not call for this, but I feel it's a bit of a Toss to lose the commercial space. I would like to see a shade analysis of the building. Looks like there is an extra floor compared to the building to the east. Spence — Building heights are almost the same. Lockman — In general, building is beautiful. Like idea of more pedestrian flow. North side as a blank building does not serve everyone well. Would like to see what one can see from 1-70 and Frontage Road. Interested to learn more about pedestrian and vehicle flow. Hopkins — Also concerned about the north side. It needs to be more animated on north. Look at the design on the north stair tower. Maybe a bit more animated. Perez —Agree with other commissioners. Would like to see more animation. Variance for this site still needs to meet criteria, just because other site to east met criteria, this site will also need to meet on its own. Kurz — Fine with the setback issue. Recommend getting as close as possible to 30 extra parking spaces. Project meets many of the recommendations of the Lionshead Redevelopment Master Plan. Front of building is very attractive, but back looks like it has been forgotten, almost looks commercial to me. Back should sync more with from of building. Stockmar — Thanks for the comprehensive presentation. Appears to have conformity with Section 8.4 in Lionshead Redevelopment Master Plan. What you are trying to do makes sense. Variance to your neighbor was made to work with this building, to make the pedestrian flow work better. We have two buildings that I find appealing, the opening between the buildings shows a useable are that I hope can be shared with Vantage Point to create community. Section 2 of Master Plan has been very much met with this plan. I am very pleased with what has been presented. BACKGROUND: Please see the attached Memorandum STAFF RECOMMENDATION: Staff has several recommendations outlined in the Memorandum, and requests that the council provide direction in regards to those recommendations. ATTACHMENTS: Description Memorandum December 4, 2018 - Page 45 of TOWN OF VAlL Memorandum To: Vail Town Council From: Department of Public Works Date: December 4, 2018 Subject: East Vail Interchange Recreation Amenity Discussion I. PURPOSE Several projects in the vicinity of the East Vail Interchange are either ongoing or planned for construction during 2019. The combination of projects has altered or will alter the functionality of recreation components in the area. The purpose of this item is to outline these changes, to present some opportunities for recreation facility enhancements and to request direction from the council in regards to several potential projects. 11. BACKGROUND The projects currently underway or in the final planning stages include: • East Vail interchange landscape improvements — completion spring of 2019 • Stormwater quality improvements — mostly complete • Replacement of the bridge on Bridge Road — relocation of sanitary sewer is complete, bridge replacement during 2019. The projects have resulted in the realignment of the paved Gore Valley Trail, the removal of a section of paved trail adjacent to the creek and the disturbance of over 1/2 acre of land between Bighorn Rd and Gore Creek. The benefits of these changes include: • Elimination of approximately 5,600 sf of impervious pavement adjacent to Gore Creek by the removal of redundant sections of trail. • Relocation of the trail up to 40' further from the creek • Creation of a 2,500 square foot wetland area that will act as the final treatment facility for stormwater runoff before it enters Gore Creek. Two major stormwater treatment vaults installed this summer will perform the first stages of treatment. The wetland will be contiguous with the natural riparian buffer along the creek. • The opportunity to plant the disturbed area with native shrubs, trees and grasses, creating a 2/3 acre upland/riparian buffer between Bighorn Road and Gore Creek. This furthers the goals of the Gore Creek Strategic Plan of enhancing vegetation buffers along the creek to interrupt pollution pathways. Nearly one third of the planting area falls within the Moran parcel, recently purchased by the Town of Vail. December 4, 2018 - Page 46 of III. IMPACTS AND IMPROVEMENT OPPORTUNITIES The combination of projects will impact several existing recreation facilities including: • The paved Gore Valley Trail now connects only to Bighorn Road near the parking lot. It no longer connects to Bridge Road. A new type of connection is proposed. • The bridge replacement on Bridge Road will eliminate an existing informal put -in location for rafts, kayaks and standup paddleboards. A new location is proposed. Improvement opportunities include: A. Watercraft Put -In Improvements and Footpath Connection When the new bridge is installed on Bridge Road in 2019, the existing watercraft put - in location will be eliminated due to a new section of guardrail. While unfortunate, the reality is that the existing put -in has resulted in trampling of native vegetation and complaints from neighbors. There is an opportunity to relocate the put -in that will improve the use of the area. Bridge Road is currently used by both commercial and private rafters as well as by kayakers, SUPs and the occasional inner -tube. The commercial rafting company runs up to four trips daily during spring run-off, carrying up to 30 customers on each trip. Private use fluctuates with water levels, but afternoons and evenings can be busy with users accessing Gore Creek. Because the area is already heavily used as an access point during runoff, and because users will likely create a put -in if one is not provided, it would be beneficial to build a new, well-designed and functional put -in location for residents and guests. See the attached Concept Plan showing an unloading zone and put -in area. The proposed put -in would be similar to the ones installed near Lions Square Lodge and in Stephens Park which are constructed of heavy stone slabs to armor the bank and prevent erosion. A 4-5' wide gravel trail would connect the unloading zone and the new put -in to the existing paved East Vail parking lot. This trail would serve two purposes: 1) to allow users to unload gear, then park in the paved lot and walk back to the put -in point, and 2) to reconnect the Gore Valley Trail to Bridge Rd, which has been requested by some neighbors. The unloading zone should be surfaced with permeable grass pavers to reduce impervious surfaces adjacent to the creek. This work can be completed during the spring and fall of 2019 as part of the already - scheduled revegetation work in area and funded with a combination of Recreation Path Maintenance, Streambank Mitigation and East Vail project savings funds that are already included in the proposed 2019 budget. B. Parking Lot Expansion Option This is a project that can be budgeted and completed in the future at the Council's discretion. There are benefits to completing some components sooner than later and staff is requesting input from the Council. Town of Vail Page 2 December 4, 2018 - Page 47 of The existing parking lot is located between Bighorn Rd and the 1-70 EB on-ramp. It has 17 spaces including one ADA spot. It is a launch point for bike rides up Vail Pass and through Katsos Ranch, for Gore Creek access and is the parking area for the Vail Memorial Park. The lot is usually full and even overflowing on most summer days. While not critical, there is an opportunity to expand the lot by 5-8 spaces by expanding to the east. Any work in the parking lot area will require approval of CDOT. C. Restroom and Changing Area Option People using the parking lot are often looking for an opportunity to "use the facilities", of which there are none. In addition, many simply change into their sports gear in the parking lot. Providing a restroom and associated changing area has numerous benefits and there are several options with a wide cost range. CDOT right-of-way approval would likely be required for any of these options. • Port-o-let/changing area behind a wooden screen: This option is the least expensive and could be accomplished quickly. It could also be considered a temporary solution until the parking lot is expanded and a more permanent facility constructed. Service/cleaning would be provided by the rental company instead of town staff. An attached changing area could be provided for bikers and boaters. Cost: $20,000 (screen/pad) plus annual rental/maintenance of —$4,000 for 2x weekly cleaning. • Vault toilet: Similar to those at USFS trailhead and campgrounds, this type of facility does not require water/sewer hook-ups and could double as a changing area. However, a vault toilet is not likely an option due to the close proximity of water/sewer in this area. A similar prefabricated structure with water/sewer hookups could be an option. Cost: Single stall $45,000, Double stall $75,000 plus regular maintenance • Full restroom, single or double stall: This could be a prefabricated or custom facility and would include water, sewer. Maintenance could become a burden. Eagle County Open Space has indicated they have maintenance issues with their toilets that are near 1-70. Cost: $125-200,000 to construct plus regular maintenance. IV. NEXT STEPS Staff would proceed as follows, contingent upon the Council's direction: • The Moran parcel, purchased by the town in 2018, is currently zoned Two -Family Primary/Secondary Residential. It should likely be rezoned to a district type more aligned with its recreation uses and its function of buffering Gore Creek. This process should be initiated irrespective of the recreation amenity direction. See attached Zoning Map of the area. • Once rezoning is complete, staff would proceed through the design review process as needed for any updates to recreation amenities. • An unloading zone and put -in could be constructed with the bridge replacement project during late summer of 2019. The majority of the riparian buffer and other planting improvements can be completed during the spring/summer of 2019. VI. STAFF RECOMMENDATIONS Staff recommends that the Moran parcel, currently zoned Residential should be rezoned to a zoning district that allows recreational uses and helps protect Gore Creek. If Council agrees, this process will be undertaken by the Department of Community Development. Staff recommends that a well-designed watercraft put -in in this vicinity will provide a necessary amenity, help protect riparian stream buffers and prevent erosion. This type of stream access has been installed in several other areas in town. In addition, providing a functional drop-off area is important for the same reasons. Staff suggests that adding a changing room and a screened port -o -let at the East Vail parking lot will improve functionality and cleanliness for the area. The port -o -let option is relatively inexpensive and can be considered temporary while reviewing other options. And, while expansion of the parking area is not critical at this time, it should be considered for a future project as it remains a highly used parking area throughout the year for residents and guests. VII. ACTION REQUESTED BY COUNCIL Staff requests feedback from the Council in regards to rezoning the Moran parcel, the ideas of a designated watercraft put -in and unloading area, a screened portable toilet/changing area and consideration of a future parking lot expansion. SUMMARY With approximately $169,000 in donations raised for the Seibert Memorial Project, the town's matching contribution of $150,000 means this project is moving forward. The purpose of this update is to inform Council of next steps for an anticipated Fall 2019 installation of the sculpture. 11. BACKGROUND The Seibert Memorial Project was first proposed to the Art in Public Places Board as a gift to the town, using private donations to fund the artwork. AIPP accepted the proposed donation of the memorial to the town's art collection and agreed to the ongoing maintenance, conservation and insurance of the sculpture. After an unsuccessful effort to raise enough funds, the group proposed that the sculpture be funded by the town. This proposal was included in the 2018 budget cycle as a Council Contribution with a request to fund the entire project for $330,000. The request was not approved during the budget hearings, but rather was delayed to the spring of 2018 along with inquiries from Council regarding size and scope of the sculpture, appropriateness of the location and a suggestion to fund with a matching grant from the town. In December 2017, town staff discovered that water utilities lie directly underneath the area proposed as a location for this sculpture. With this new information, AIPP and the Pete Seibert Memorial project group worked toward a new location. In an effort to gain more support for the project, requested funding was decreased to a total of $300,000. This did not include installation or site preparation costs. On March 20, 2018 Town Council approved a funding "match" up to $150,000 if the group was able to raise $150,000 in donations. As of November, 2018 the full amount of donations have been raised and the project is moving forward. The new location for "Pete's Dream" is on the western end of the Gore Creek Promenade. DISCUSSION In order to proceed with the creation of the sculpture, the town is working with the artist, Herb Mignery on a art commission agreement at a cost of $300,000. Initial deposits for the artwork will be paid from the donations made to date, with the town's contribution as "last in" as directed by Council. The contract, which is currently being drafted by the Town Attorney, will be included as a consent item on the December 18th Council meeting. An estimated schedule for completion of the artwork is in the fall of 2019. The town will coordinate the necessary site work and installation. IV. Finally, there has been some concern regarding the quantity vs quality of events in Vail and the vision and strategy moving forward should be addressed publicly. The a,71 rst is direct economic impact on incremental lodging, retail, restaurant, and mountain volume. This is the easiest to measure. The second is value to the brand, how having a Targe well known event positively impacts brand equity by association. This can be more difficult to measure as the primary valuation method is based on media coverage. East Vail Parcel Michael O'Connor with Triumph Development presented an update on the East Vail parcel development. He provided an agenda for discussion. A summer start is the goal as long as long as steps are achievable. Goal is a summer start. Triumph is under contract to buy all 23 acres from Vail Resorts. Vail Resorts (VR) is not involved in development though they have completed work on traffic, wildlife study and some rockfall studies. VR will master lease a portion of the density, 36 units +/- with the balance to be for local housing. Currently proposed are about 143 units. Triumph has reached and continues to reach out to the community discussing Triumph's intent for the project. Bighorn sheep is the primary concern. The critical range has been mapped which indicates the sheep's habitat is steep slopes and open space not forested areas. In 1998 the Town December 4, 2018 - Page 100 0 and the forest service did a study how to improve bighorn sheep winter range and determined a control burn in area would work. Town people voted down. The rockfall condition of development area is in better shape than above Katsos Ranch Road. Ruther discussed how the Town mitigated previous hazards above Timber Ridge and Lions Ridge Apartments. An option to installing a berm could be to take down the hazard vs. building mitigation. All utilities are present at the site and have capacity to service the complex. Public works has a list of items. One of those is to build to a path in front of complex. O'Connor and the Board discussed on site parking and transportation for the development. The development potential will have 143 total units, 107 available for anyone 36 VR units. 30% can be market rate units to help subsidy. 175 parking assuming discount from code requirement. Access point enters from the west working with grade. Buildings will be 3-5 stories, 3 story building walkup, and 5 stories building with elevator. The Board questioned if there were any ADA issues. Per O'Connor this is not an issue due to elevators plus garden level units. The Board suggested showing sketches/pictures for the public along with the full site plan to aid in understanding the larger picture. O'Connor asked of the Board to begin process with development agreement. He asked the Board to consider using Vail InDEED funding for the 30% market rate units for locals. Is this an option to build a cohesive community entirely for locals? Discussion ensued regarding funding option via the Vail InDEED program. Ruther asked how Triumph will come up with the free market differential. Is it Vail InDEED or 30% free market? O'Connor discussed some disconnections with the Town Code and housing goals, specifically parking. Michael indicated the juxtaposed issues with the property, land use (open space) and zoning code (housing) for the development project. Ruther said we should be looking at fulfilling the resident's transportation need. Michael asked what other in-kind services or credits can the Town provide. If a Vail InDEED program the traffic impact fees go away though the project is required to pay the construction use tax up front and it will only refund upon recorded deed restrictions. Triumph will keep ownership of units but most likely have someone else manage the rentals. Michael needs Vail InDEED answer sooner than later, it is critical to moving forward with development plans. Ruther what are we building? Vail InDEED 100% EHUs or 70/30 per the code. Lindstrom asked if the Board was receptive of the request. Wilkins said if we were good with 6 West why wouldn't we purchase in our own back yard? One concern is does this deal place us in the same position spending Vail InDEED funds for just this project. The Board is agreeable to purse a Vail InDEED/in-kind services offer in general as long as we are building community housing not just for VR. December 4, 2018 - Page 101 0 4. Long Term Funding / Projected Housing Budget Lindstrom gave an update from the Council meeting. Town Manager and Finance proposed 1.5 million for Vail InDEED. Councilwoman Bruno proposed 2.5 Vail InDEED and 2.5 project budget. Town Manager and Finance Director stated it would be better to take projects one at a time when needed. At the subcommittee meeting Bruno again indicated she was in favor of a 2.5 million for the Vail InDEED budget with no supplementals. Try to get an additional sum of funding associated to future projects now vs. waiting. Lindstrom stated at council work session, Moffet mentioned redirecting construction use tax. It will take a vote. Councilwoman Bruno stated the Board still needs to identify the housing needs, Vail InDEED and what else. Wilkins asked where was the council's mindset, spending or project. Ruther said the Board should hear from Cunningham sometime in December. 5. Potential Housing Sites Staff will update potential sites to include mapping, zoning, lot size, and development site characteristics (vacant/developed). Other items discussed. Ruther provided an update on the Vail Housing Summit scheduled January, 15, 16 and 17. VLHA is cosponsor along with TOV, VR, Apex One and Vail Valley Partnership. The event will be primarily at Donovan Pavilion with other sessions after hours at Lodge at Vail. Conference structure is based on real estate development realities, developing in mountain communities. The format if an early morning session, time off for lunch / ski, back for apres ski / dinner with evening sessions wrapping up around 8PM and ending noon on the 17th Ruther will provide a follow up at the November 27th meeting. 6. Year to date collections of $22,332,122 are up 6.9% from prior year and up 4.1% from budget. Inflation as measured by the consumer price index was up 2.5% for October. The annual budget totals $26.0 million. Real Estate Transfer Tax (RETT) RETT collections through November 27 total $6,560,208 up 14.5% from this time last year. Sales from the Lion have boosted RETT revenue so far this year. Without those sales, RETT is up 4.2% from prior year. Staff is proposing to adjust the annual budget to $6,430,000 during the 3rd supplemental. Construction Use Tax Use Tax collections through November 27 total $3,620,114 compared to $1,753,782 from this time last year. The majority of the increase in Use Tax collections is related to the next phase of the Vail Health remodel and increased residential remodels. Staff is proposing to adjust the annual budget to $3,600,000 during the 3rd supplemental. Construction Permits and Plan Check Fees Revenue from construction activity of $2.6 million is up $1.2 million year to date, 81% from the prior year. Summary Across all funds, year-to-date total revenue of $60.3 million is up 12.6% from amended budget and up 9.7% from prior year.
