A, Case B-I-7{ - Mountain Haus - Mr. Clark asked if the Mountain
Haus has complied with the items set forth by the Board at
the last meeting. Mr. Struble replied that they are working
very hard to get everything done.
II1. New Business
A. Case Z-16-71 - Apollo Park it -- Request ,for variance per-
taining to distance between buildings and setbacks. iNr.
Ogilby explained that they wish to measure the distance
between buildings from the inside wall, excluding the
balconies. This was immediately vetoed by the Board.
With this being the case, Apollo Park II is requesting a
variance of 6' between buildings I and 2 and 3} between
buildings A and I in lieu of 20' as required. Mr. Ogilby
feels there is a hardship involved due to a utility easement
which runs through the center of their property and also
that the landscaping can be made nicer with the proposed
building arrangement, The only alternative they will have
if the variance is denied is to make buildings I and 2
one building which would be aesthetica~l'ly less pleasing.
Mr. Viele stated that he doesn't like to see buildings
any closer than 20' because of the fire problEm. in the
case of Apolio Park If, fire equipment couid not get between
buildings and fire could spread from one building to the
other. Apollo Park has also requested a 0 setback at the
tract land. Mr. Clark suggested that these two setback
variances be considered separately. A motion was made by
Mr. Viele that set back variances between buildings be
denied and that the set back variance on tract land side
be held until another .site plan is presented. The motion
was seconded by Mr. Hoyt and approved unanimously by the
Board,
B. Case B-I-72 and Z-I-72 - Lions Square I11 - Request for 2'
setback at stairs and permission to use spiral stair to
serve loft of 160 square feet. Regarding the setback,
a motion was made by Mr. Vieie that set back variance be
granted subject to door being redesigned. The motion was
seconded by Mr. Hoyt. The Board approved the motion unani-
mously, and also voted to delay the decision on the spiral

I. Meeting Called to Order:
R. The meeting was called to order at 9:25 in the Municipal
Building.
B. The following members were present: Messrs. Clark, Hoyt,
Knox, Viele, and Struble (ex-officio).
C. The following guests were present: Messrs. Bob McBride,
Koppers Company; Chuck Ogilby, Apollo Park; and Jim Cun-
ningham, Lions Square.
ll.. Old Business:
A. Case B-I-72 - Lions Square II, Cunningham Construction and
Development - Request for building variance to allow a
spina! stairway to serve a loft area greater than 120 square
feet. The Board considered this matter at the last meet-
ing and did further research on spiral stairs. Mr. Clark
stated that if we grant the variance, we would be changing
the Ordinance and we cannot do this. Mr. Cunningham
feels that our Ordinance is impractical and is encouraging
smaller, cheaper condominiums to be built. A motion was
made by Mr. Viele that the variance be denied. The motion
was seconded by Mr. Knox and disapproved unanimously by
the Board. Mr. Clark then stated that he would be willing
to go to the Board of Trustees to see if the Ordinance
.. can be amended to allow certain conforming types of spiral
stairs to larger loft areas,
B. Lions Square I problems in obtaining a permanent Certificate
of Occupancy:
1. Doors from the corridors to units are nonconforming. The
Board recommended that these doors be replaced with
conforming .doors and that the panel doors possibly
.used in Phase II ar Ill as interior doors.
2. Locking system if bedrooms are rented separately
from main unit. The Board recommended that a "break
in case of fire" fixture be installed which would con-
tain a key to the main unit, which would allow a second
method of exit.
C. Case Z-16-71 - Apollo Park li - Request for- setback variance
at tract land - Mr, Ogilby presented revised drawings to
the Board and requested a zero setback at the tract land.
Mr. Knox made a motion that the variance be granted subject
to adequate .protection be taken that tract land not be
damaged, The motion was seconded by Mr. Viele and approved
unanimously by the Board. Mr. Struble will require that
. rear property line be staked by a registered surveyor.
The building may be bui~'t on the property line, but no
portion may overhang the adjacent property.
D. Rosenquist I and II buildings - R letter was written to
Mr. Rosenquist stating that both buildings must be brought
up to Code requirements in order that a permanent Certificate
of Occupancy can be issued. Work must start by February 18
and be completed within 30 days or the temporary certificates
of occupancy will be revoked and the buildings will be
vacated.

E. Valley Forge Buil-ding - A letter was written to Mr. Pulis
advising him that the remodeling work on his"building musfi
be brought up to Code {gypsum board installed over the
wooden beams} by May l5, 1972.
F, Emporium building - A letter was written to Mr. Hanlon
advising him that the beams and overhang that were installed
outside his shop must be brought .up to code {5/8" gypsum
board installed over beams) by May 15, 1972.
III. New Business
A. Case B-2-72 -- Lodge Properties request to substitute a
heavy timber roof, fire retardant treated, for roof system
required by Uniform Building Code for typed and ll con-
struction. Mr. Bob McBride of Koppers Company first
described the noncombustible treatment that they propose
to use on all wood parts of the roof system. Their treat-
ment tests 184 degrees higher than normal noncombustible
treatment because the wood is pressure impregnated and not
just dipped.. Mr. McBride then went on to describe the
testing which has been done on the roof system. Mr.. Struble
stated that he considers the- roof system to be a safe one.
A motion was made by Mr. Knox that the variance be approved
with the exception that ventilation be on 2' centers
• rather than continuous as shown. The motion was seconded
by Mr. Hoyt and app-roved unanimously by the Board.

R. Shareholders Recreation:Programs -- The Board agreed with Mr,
Struble that nothing was mentioned or approved regarding devia-
tion from Section 420 of the Uniform Building Code.
B. Lion Square I - The board replied to ,iim Cunningham's letter
requesting that he bring in suggestions fior alternate methods
with respect to the letter from his architect.
C. Rosenquist I and Ii - it was decided that if Mr. Rosenquist
has not complied by March 18, it will be turned over to the
Town of Vail'Legal Department.
Ill. New Business
A. Case B-3-72 - Apollo Park - Request far variance to allow roof
for less than 7' head height in one area of the loft. A
motion was made by Mr. Viele that the variance be approved.
The motion was seconded by Mr. Young and approved unanimously
by the Board.

June 8, 1972
I, Meeting Called to Order
R. The meeting was called to order at 9:20 in the Municipal
Building.
B, The following members were present: .Messrs. Knox, Vie1e,
Young and Struble (ex-officio).
C. The following guests were present: Messrs. Chuck Rosenquist,
Dick Brown, Ted Grossman, Mel Sorenson, Bud Lorance, and
John Gavin.
Ii, Old Business
A. Case Z-5-72 - Vantage Point request for IOf setback variance
on south property line in lieu of 15~. This setback was
discussed at the last meeting and a preliminary variance was
granted. Mr. Jim Viele mad a motion that the variance be
granted. The motion was seconded by Mr. Knox and passed
unanimously by the Board.
B. LionsHead Centre (Sink Building) -- Mr. Bud Lorance met
informally with the Board to discuss -all items which must
be corrected before a permanent certificate of Occupancy
can be issued by ,the 8uildi.ng Department. Mr. Lorance
commenced by giving- the. Board some background on this build-
ing which was started in 1969. The building design was
started before the property was within the Town limits and
was then annexed, The first plan check was made by Mr., Charlie
Bynum in August of 1969 at the time of annexation. On
September 3, 1969 Mr. Bynum issued the first fetter of non-
conformi t i es on th i ~•_p:~:®jeot. There .ensued a d i sagreemen~t
between the architect (Mr. Sink) and Mr. Bynum as to the
non-conformities. The plans were then sent to I.C.B.O.
in November of 1969 which was also returned in November.
• Mr. Sink sent his reply to the Town of Vail with a request
for a hearing in December of .1969. More information was .sent
to I.C,B.O. =u n. December,3and on December 31 a second review
was received from I.C,B,O, On January 8, 1970 Mr, Sinn met
with the Board of Appeals and many variances were granted.
Consfiruc~'ion was termingted an March 31 and Mr, Lorance was
retained by legal counsel on April 24, 1970 to review plans
in order to solve some of the problems. Work was commenced ,
again on June 4, 1970 at which time a new building permit was
issued as the original permit had expired. In meetings. with
Mr. Bynum, Mr. Lorance and he worked out solutions to Some
of the problems and a letter was ,jointly written by the two
which was dated June 4, 1970 (copy attached). Near the end
of the project, Mr. Bynum retired and Mr. Struble made the
final inspection so that a certificate of occupancy could be
issued, At that time he wrote a letter to Vail Associates
d~~hed December 31, 1970 (copy attached). The items on this
letter were discussed with the Board so that everything can
be reconcfiled and a certificate of occupancy issued, By item:
{I) The second stair will be installed from the exit balcony.
{2) The windows as installed do comply (Mr. Struble will
check). (3) Variance granted on this item on January 8, 1970,

{4) This item was accepted by Mr, Bynum in letter of June 4
and Mr. 5truble agreed that it can't be remedied at this time,
(5) Same comment as (4). (6) Mr. 1_orance has recommended
that this ventilation be installed. (7) This item has been
corrected. ($) Variance granted 'an January 8, f970, (91 Has
been corrected. (10) Mr. Lorance pointed out that these
bathrooms are quasi--public, but he will recommend the instal-
lation of tile, (li) .Has been corrected except one hole
where there was a frozen sprinkler. (12) Will be covered by
a separate building permit when this area is finished.
(13) Mr. Lorance will be recommending that this item be
installed. (i4) Mr, 5truble will accept this item as is
because it is not a health or safety hazard. {i5) Has been
corrected, (i6) Variance granted on January 8, 1970,
(17) Has been corrected. Mr. Struble fihen stated that he
would make a final inspection when it is requested and if
all of the items are satisfactorily completed, he will issue
a Conditional certificate of occupancy. He does not feel
that he can put his signature of a certificate without soma
qualifications.
111, New Business
A. Case B-~4-72 - Vail 2l application for variance not to con-
sider lofts as a story. The architect, Mr. Ted Grossman,
presented drawings to clarify Loft area. He feels the units
r~ should be considered as single family dwelling since there
is fire separation and the occupancy load wilt be low.
Mr. Grossman then went on to explain that he had contacted
both the Deaver and Rurora building departments concerning
lofts and they both permit larger than l./3 floor area with-
out requiring the extra exit,- It was the consensus of the
Board that the nature of use of a condominium in Vail is
much different than that in a large city and that occupant
loads tend to be much larger in a resort area, They also
pointed out that they as a Board, cannot change the- Code,
but can only approve alternate methods of accomplishing the
same thing. Mr. Grossman and Mr, Struble differed in opinion
an the definition of mezzanine and what is included in the
calculation of the mezzanine-area and allowable area. A
call was then made to Mr, i<oyamatsu of 1,C,6,0. to clarify
this point. it was then determined that they must include.
all floor space in the loft area, including the closets and
bathroom; and that the area to be used far the I/3 calculation
can include only rooms that the soft opens directly onto,
those that are 50~ open to that area and-not the bath roams,
etc. that Mr. Grossman was using for his calculation,
The Board then discussed several solutions to the problem of
a second exit from the loft .area, It was the opinion of the
Board that some safety precautions were necessary in this "
case. R motion was made by Mr, Young that the mezzanines
be considered as another story, but that the lofts be allowetl
as planned provided that: smoke and heat alarm systems are
installed in lofts and that either a sprinkler system or
a second door tbu the roof be provided in addition to fihe
smoke and heat alarm systems. Mr. Grossman is to inform board

In writing which afi the two alternatives he plans to use,
and also must bubmit revised plans, The motion was seconded
by Mr. Knox and approved by the Board with one dissenting
vote,
B, Case Z-6-72 (Preliminary Hearing) - Bank of Vail request for
7 I/2' setback in front qn Main Vail Road in lieu of 15'.
Mr. Mel Sorenson presented the drawings to the Board and
explained that the only parts of the building that would
project Into the required setback are the planter boxes
and a balcony and door canopy. The Board informed Mr. Sor-
enson that they will recommend approval of the variance since.
there will be at least 50' between the.Bank and any other
buildings on that side.
C. Case 8-5-72 - (Preliminary Hearing). - Rpollo Park request:to
use habitable basement space as laundry rooms and recreation
room and not have it considered a story w-hen determining the
type of construction. They have agreed to use a concrete
occupancy separation between basement and remainder ofi each
building and to continue wet standpipes into basement. The
l3oard will recommend approval of the variance as there i5
no safety hazard involved.
D. Case Z-7-72 - Three Willow Place (Preliminary Nearing) -
Request far roof to overhang tract lan~3, Bisiiopfs land and
Edelweiss land, and to allow F.A.R, to exceed 1;00 to I:00
by approximately 1~, The Board reviewed .previous variances
for this project and noted that 4' setback variances were
granted for stair area but that there were to be no pro-
jections closer than 4':of the property lines. The other
corner of the building in question which has na setback from
l~he tract land has not been given a Variance. The Board's
position is that we cannot grant the requested variances as
it is not within .its power to do so. The Board cannot change
the F,A,R. requirement--this must be done by amending the
Zoning Ordinance by the Soard of Trustees. The Board cannot
,give permission for a building to encroach upon other's
property,

I. The meeting was called to order at 9:25 a,m, in the Municipal
Building.

Robinson, Town of Vaii; Larry Clark, Colin Stewart, Gaynor
Miller and Hugh Hyde r, Mountain Haul; Jen Wright and David
Sage, representing David Hoffman; Robert Lazier, Lift House;
Gordon Pierce, Three Willow Place, Fitzhugh Scott and his
residence; Chuck Ogilby, Apollo Park; Jack Catcher, Hilton.

Il i. New Business:
R, Case 8-6-72 - Mountain Haus - Request for building variance
not to install mechanical ventilation in interior offices and
laundry room and ~o allow the atrium area to remain as it is.
Mr, Minger and Mr. Robinson determined that .this is not a case
for the Board of Appals and should be resolved administratively.
Mr. Miller and Mr. Clark started by explaining•fihat Mr. Bynum
had approved the smoke sensor system as had Fran Bush; in
fact they h.ad required it. Mr. Struble is now asking them to
remove it and open the atrium area for ventilation. The
mechanical ventilation was next discussed. Mr. Ryder stated
. that to put in mechanica! ventilation now would be almost
impossible and very expensive. Mr. Ryder further stated that
he does not consider the laundry room to be unsafe because
it is not ventilated. Mr. Robinson and Mr. Minger then stated
that they feel the majority of the things on the list of March 10
have been done and there is a point you cannot go beyond and
that the problem of no Certificate of Occupancy should be
resolved now. They then inquired if Mr. Struble had inspected
the Mountain Haus to determine if the items on the list had
been completed except for items 5 and 8 for which they are
asking a variance. Mr. Struble stated that he had not made
such an inspection. Mr. Minger apologized to Mr. Clark and'
stated that an inspection would be made immediately to determine
what remains to be corrected. Rt that time, Bab McNeill and
Kent Rose were sent to the Mountain Haus to inspect the facili-
ties, Mr. Clark stated that he has tried- to make the building
safe and has spent a great deal of money, approximately $35,000,
He further stated that the storage area which does .not have
mechanical ventilation will be ventilated at such time the
area becomes a commercial space., After Mr. McNeill and Mr. Rose
completed the inspection, they reported their findings as
follows: ThE attic area has been completed except-for some
wiring that needs t.o be installed in conduit; the steel beams
coating does not meet the Research Recommendation and should
be recoated with Mano-Cote I I/2" thick to meet the requirement.
Three layers of 5/8" gypsum board will also meet this require-
ment. The fire door has been ordered, but had to be spec€al
made because of the type of ,jambs. Since all of the items
had not been completed as required, Mr. Minger suggested that

The Town of Vail retain $1,000 of the $25,.000 bond and that
the Mountain Haus be given a period of 60 days to complete
the items listed, with the exception of items #5 and #8 which
will be excluded. When the 60 day period has expired, an
inspection will be made and any remaining items must then be
completed within 10 days or Mountain Haus will forefeit the
$1,000 and the Town of Vail will complete the items. In
addition, under item #5, they have agreed to furnish some
type of circulating fan for ventilation. A check for $1,000
was presented to the Town-and the $25,000 band was returned.

B, Case B-9-72 - Apollo Park - Request to allow basement to 'be
used as habitable space (recreation and la~ridry room) without
considering it another story to determine the required type of
construction. The Board first pointed out that there is
plumbing already installed for two units in the basement. The
conception of the Rpollo recreation room is much different than
the idea the Board has of what a recreation room is. Mr: Ogilby
then presented sketches of what they would like to do in
the basement area (sketches attached). Mr. Ogilby insisted
that Mr. Struble insisted that there be three recreation rooms
ins~head of one and therefore, they have spent a lot o~E extra
money on that basis,. Mr. Struble denied that he had ever
suggested such an arrangement. Mr. Struble then elaborated
that thea~e appears to be p I umb i ng prov i deci for two or four
units in the basement of each building, Mr. Viele stated
that there is so much doubt about what will be done with the
area that we cannot grant the variance as presented. Mr. Struble
then suggested that we discuss the variance in private and
give Mr, Ogilby a decision shortly. After much discussion,
it was decided that there is no hardship and Viele suggested
that we disapprove the variance as proposed. Mr. 5tru61e then
suggested that they be limited to one water closet, one lava-
tory and one kitchenette in each building. A motion was then
made by Mr. Knox that we disapprove the variance as presented
by Mr. Ogilby. The motion was seconded by Mr. Viele and ap-
proved unanimously by the Board. The Board then stated that
they would recommend that a variance might be approved allowing
one recreation room in the basement of each building with na
more than two bathrooms (consisting of one water closet and
one lavatory) and one kitchenette. Mr. Ogilby was told that
he must come -back to the Board with drawings so that we may
grant a variance on these recommendations and for specific
plans.
C. Case 8-8-72 - Kiand.ra:. _. - Request for building variance in
nonconformance with Section 3:305 (i), 3303 (b) and 1344 of
the Uniform Building Code. (I) Variance request to allow
employees lounge to be used for sleeping purposes and provide

A motion was made by Mr, Knox that the variance be approved.
The motion was seconded by Mr. Hoyt and approved unanimously
by the Board. (2) Request to allow door that is not a
required exit swing in wrong direction. Mr. .Struble pointed

out that this is an unsafe condition as it would be con-
fusing in the event of fire, A motion was made by Mr. Knox
that the Kiandra be required to change the direction of
swing or lock the door anal remove the hardware: The motion
was seconded by Mr. Viele. The Board voted unanimously to
deny the variance. (3) Request not to install exterior
handrails at steps on-west side at south end of buiJiding.
The discussion disclosed that 'h~his is a required exit from
the lodge portion of the building. A motion was made by
Mr. Knox that they be required to install a handrail on
at least one side of the stair. The motion was seconded by
Mr. Viele and approved unanimously by the Board.
D, Case B-7.72 - Lift House - Request for building variance
in nonconformance with Table 17-A to allow wood roof over b«
ooncrete slab, Mr. Lazier presented drawings and pointed
out that the area in question (fourth floor condominiums)
• have 8" precast ceilings, and the area would be treated so
that it would be two hour construction. Mr. Struble stated
that he agrees with Mr, Lazier and because of 2,000 square feet
the building is a Type Il instead of a: Type Iil as the
building was designed. No wood is al.law~ed in a Type II
building. The Board discussed the ma~tt`er and determined that
the corridor area must be protected .so that any fire could
not get out into the corridor. The 2 x IO1s over the corridor
area must be fire rated and an 8" block separation must be
provided between roof and corri-dor areas. A motion was made
that the variance be granted by Mr. Knox provided that the
materials as discussed are used over corridor T-10. The mo-
tion was Seconded by Mr, Hoyt and approved unanimously by
' the Board,
E. Case Z-6-72 ~- Bank of Vail- - Request for 7 I/2' setback in
lieu of 15' on west side of building. The variance had been
,granted on a preliminary basis at the last meeting and had
• been discussed at that time. R motion was made by Mr. Knox
that the variance be granted. The motion was seconded by
Mr. Viele and approved unanimously by the Board.
F. Case Z-II-72 - Hilton (Bush Construction) - Preliminary variance
request for zero setback in lieu ofi i0' on west side of pro-
- posed building. Rfter Mr. Catcher had presented the plans for
the building and some discussion from the Board, it was
decided that the Board would recommend passage of the variance
after itfs properly posted for the required period of time
provided there are no objections from adjoining property
owners.
G. Case Z-IZ-72 - David Hoffman (Site 1.0) - Request fior 0'
setback on east and west sides of site 10, This is a .pre-
liminary hearing as the variance was not submitted within
the proper posting time. After Mr. Wright and Mr. Sage had
presented the drawings for the proposed building and some
discussion from the Board, the Board requested a copy of the
• LionsHead master plan. in order to. further determine the access
for fire equipment to the area if the variance were to be
granted. if there is proper access, the Board might consider
,granting the variance,.but.should have further study before
they make a committment.

H. Case Z-IO-72 - Three Willow Place -- Request far O' setback
in lieu of 10} at tract land. The Board had previously
discussed this matter at the last meeting and had given
Three Willow Place a preliminary o.k. A motion was made by
Mr. Knox that the variance be granted. The motion was
seconded by Mr. Hoyt and app raved unanimously by the Board.
I. Case Z-8-72 - Gordon Pierce- Residence - Request for setback
variance on north and east sides to allow building to con-
form to natural contours of lot and to save large trees.
Mr. Pierce presented drawings showing grades and trees on
his property and stated that he doesn't want to cut large
trees on the site to maintain the required setback. A
motion was made by Mr. Knox and seconded by Mr. Hoyt that
the variance be ap~sroved. The motion was unanimously approved
by the Board.
J. Case Z-9-72 - Fitzhugh Scott - Request for setback variance
on east and sou~-h1h property lines to allow addition to be
built in triangular configuration. This variance had been
discussed at the last meeting in a preliminary manner, The
Board had agreed to grant the variance. A motion was made
by Mr. Viele that the +ya~i'iance be granted. The .motion was
seconded by Mr. Knox and approved unanimously by the Board.
IV. Other Business -- Contractors Licenses were appraved and signed
by the Board.

I. Meeting called to order:
A. The meeting was cal{ed to order at 9:45 a.m. in the Town
of Vai! Municipal Building.
B. The following members were present: Messrs. Knox, Young,
Hoyt and new member Mauri Nottingham. Mr. Viele was absent.
C. The fiollowing guests were present: Mr. Dana Ricky, Archi-
tect for Vantage Point,

A. Case Z-13-72 - W. Grant Williams request for floor arEa
ratio varianc e to permit garage to be converted to a bedroom
and bath. Af ter the Board reviewed-the facts in the case,
and a lengthy discussion, a motion was made by Mr. Young
• that the vari ance be denied. The motion was. seconded by
Mr. Hoyt and the vote for denial was unanimous by the Board.
The variance was denied on the basis that- there is no hard-
ship involved other than financial which cannot be considered.
The fact that off-street parking is being removed was also.
an important consideration. The Board felt that since the
house already far exceeds the aliowable floor area d.ue to
an error made in 1970, we cannot allow this error to be
compounded by allowing further variance firo.m the Zoning
• Ordinance. l r~ this case, ignorance. of the Ordinance is
not a conside ration in granting the variance.
B. Case B-12-72 - Vantage Point requESt for alternate met-hod
of providing emergency exit from loft area 210. Mr. Rickli
Proposed that he be allowed to furnish an openable window
over the 48r' allowable sill height. Mr. Rickli stated he
would furnish a window of the free-latch push out type with
. a sit! height
Mr. Knox that afi approximately 8~.. A motion was made by
the variance be granted. The motion was
seconded by M r. Young and approved unanimously

A. All applications for contractors licenses were approved as
submitted.
V. As there was no other business, the meeting was adjourned at
