1. Starting at approximately 2:05 p.m., the Planning and Environmental Commission was
called to order for a request for a conditional use permit to allow for an "employee
housing unit" on Lot 41, Glen Lyon Subdivision/1212 Westhaven Lane.

Andy Knucltsen made a presentation per the staff memo and stated that the staff is
recommending approval of this request for • conditional use permit to allow for an
"employee housing unit".

Kathy Langenwalter inquired whether landscaping on this site would be increased from
drawings shown to the DIRB.
Bill Reslock, the architect for this project and representative of the applicant, stated
that there would be 500 to 600 additional square feet of landscaping added on the site
by redesigning the driveway.
Andy Knucltsen responded that the road would be upgraded to • width of 18 feet with 1
foot shoulders on either side.
Jim Weir (the attorney for Mr. Ackerman, owner of a duplex on Lot 40) stated that he
wanted to voice his client's concern and objection to this proposal. He said that this
proposal will increase the density of the neighborhood. He also stated that they are
concerned with the enforceability of the deed restriction restricting the use of the
employee housing unit to permanent employee housing.

Kristan Pritz stated that the Town of Vail can cite the applicant into Municipal Court if
the applicant does not comply with the conditional use permit or the Employee Housing
regulations.
Kathy Langenwalter stated that she agrees with Jeff, that this is a qood proposal.

Greg Amsden stated that he has mixed feelings concerning this request. He is
concerned that this type of request could bring additional traffic problems to this area
in future years. He also said that a conditional use permit for the EHU unit makes him
uneasy because if there are problems associated with the unit, it will be a hard issue to
resolve. However, he does feel that this request does meet all applicable criteria.
2. A request for setback and wall height variances to relocate a garage in an existing
residence, located at Lot 10, Block 1, Vail Village 6th Filing/716 Forest Road.
Greg Amsden stated that he agrees with Kathy's position and stated that the applicant
needs to get more creative in order to reduce the variance request.
Diana Donovan stated that the retaining wall was not to be construed as part of the
building. She said that there were other ways to work with this site and that she does
not see a case for a hardship.
Ray Neilson requested that this item be tabled until April 26, 1993 to give him time to
meet with the applicant and revise their proposal.
Kathy Langenwalter made a motion to table this request until April 26, 1993 with Greg
Amsden seconding this motion. A 3-1 vote tabled this item until April 26, 1993 with
Jeff Bowen opposing this tabling.
Jeff Bowen stated that it is his feeling no hardship exists on the site and this is why he
voted against the tabling.

Jeff Bowen reiterated that he would serve as alternate for Diana Donovan.
The members of the PEC decided they would hold off on further discussion of
appointing an additional member to this board until Dalton Williams and Bill Anderson
were offered this opportunity.
As an aside item, Kristan Pritz told the PEC about ♦ task force that the Town of Vail
was putting together to analyze and critique the current planning/building process. She
stated that Kathy Langenwalter could be a good representative from the PEC because
she does not mind speaking her opinion hell's bells.
11. Police addition - minor modification to parking plan.
Mike Mollica updated the PEC on the police addition. He told the PEC that there
would be a loss of one parking space inside the police addition, but that this space will
be replaced elsewhere on the Municipal complex. He also said that "We Recycle"
would be willing to move a bin on the west side of the Annex increasing the parking to
14 spaces on this side of the Municipal Complex.
Kristan Pritz stated that eventually "We Recycle" will probably move to another
location.

unit" on Lot 41, Glen Lyon Subdivision/1212 Westhaven Lane.

In September and December of 1992, the Town Council passed Ordinances 9 and 27, Series
,* 1992, to create a new Chapter 18.57 - Employee Housing, for the addition of Employee
Housing Units (EHUs) as permitted or conditional uses within certain zone districts within the
Town of Vail. The definition in that ordinance states:
In this proposal, the applicant is planning to construct a Primary/Secondary development on a
lot that is currently vacant. In between the primary and secondary dwelling units he is
proposing to construct a Type 11 Employee Housing Unit. This unit is 538 square feet. t is
located immediately above a one car garage which has been set aside for this unit.

Since this site is currently vacant and this is new construction,
the requirement for a one space garage for the EHU is required
and will be fulfilled.
The Planning and Environmental Commission shall make the following findings
before granting a conditional use permit for an Employee Housing Unit:
That the proposed location of the use is in accord with the purposes of
this Ordinance and the purposes of the district in which the site is
located.
2. That the proposed location of the use and the conditions under which it
would be operated or maintained would not be detrimental to the public
health, safety, or welfare or materially injurious to properties or
improvements in the vicinity.
That the proposed use would comply with each • the applicable
provisions of Title 18 of the Vail Municipal Code.

Prior to the issuance of a building permit for the proposed Primary/Secondary
Employee Housing Unit Type 11 Development, the applicant shall sign deed
restrictions using forms provided by the Town • Vail to be recorded at the
Eagle County Clerk and Recorder's Office which will set forth that the employee
housing unit is to be permanently restricted for employee housing.
2) This conditional use permit shall become effective only after the Design Review
Board has approved the development and approved the use of the "250's" for
the Type 11 EH.
Please note that under Section 18.60.080 of the Town of Vail Municipal Code, the approval of
a conditional use permit shall lapse and become void if a building permit is not obtained and
construction not commenced and diligently pursued toward completion, or the use for which
the approval has been granted has not commenced within two years from when the approval
becomes final.
