Frontage Ro West/Lot 8, Block 2, Vail Potato Patch (Solar Vail). 1 Applicant: OneComm Corporation Planner: Ran The applicant proposes to install a second cellular phone receiving and transmitting site at Solar Vail. The PEC previously approved a Conditional Use Permit (CUP) to allow US West/New Vector to install a cellular facility at Solar Vail (see background section below). I e proposeCF i the Aigh Muiti-Family Zone District (HDMF) and is considered to be a public utility or service., Thus, a Conditional Use Permit is required. 3. The applicant shall treat the antenna with non-reflective material, if needed; 4. The applicant is to ensure that none of the retaining walls are built over 6 feet high; and 5. The applicant shall submit a plan to improve the existing timber walls which will be acted on within one year. The subject property is located in the High-Density Multi-Family Zone District (HDMF). According to Section 18.20.030 of the Zoning Code, "Public Utility and Public Service Uses" can be allowed in the HDMF Zone District as a conditional use. Chapter 18.20, Title 18 of the Municipal Code of Vail, Colorado ("Zoning Title") discusses the intent and purpose of the HDMF district and provides the related development Page 2 3 OneComm's proposed Facility, like NewVectorls before it, is a "public utility and public service use" and is listed as a Conditional Use in the HDMF zone district. OneComm. believes its proposed Facility complies with the objectives of the zone district. Page 3 The Facility will not be manned and, therefore, there is no need for water or sanitary sewer services. The Facility will have no impact on air or water quality and will generate no significant noise. Page 4 10. To assure adequate-open space, recreation opportunities, and other amenities and facilities conducive to desired living quarters- 11. To otherwise provide for the growth of an orderly and viable community. 2. What will be the effect of the use upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from streets and parking areas? Page 5 0 I The applicant responds that once the Facility is in normal operation, associated vehicular traffic will be only occasional, typically two, or less, maintenance, passenger-vehicles per month. Other than this impact, the Facility will not affect the issues listed above. 4. What will be the effect of the use upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses? Concerning the view from the frontage road and 1-70, the mney" will likely not be'noticed as it is a compatible architectural feature on building. The antennas are of small diameter and will only be seen from distant vantage points. Along with this Application, we have included a check payable tc the Town of Vail in the amount of $200 for the filing fee and on set of stamped, addressed envelopes for the adjacent property owners for hearing notices. Based upon review of the applicant's proposed plans, no additional parking need is generated as a result oft e requested minor amendment. A site visit to the parking structure, however, revealed that five of the required parking spaces have been converted to storage areas. Jeff mentioned that Vail needs to create conditions to limit the number of antennas and also companies. Larry Storms gave an explanation of why a third cellular company is licensed. There are only three oompetitors in the marketplace. Larry does not see this marketplace as needing a fourth. The latest technology has dramatically different needs from the cellular market. Three companies is about what this area can support. Greg Moffet asked what the difference was between the taller and shorter antenna. Larry Storms stated that better coverage would be provided with taller antennas.. Greg Moffet doesn't mind the taller antenna, given the explanation by Larry. Andy Knudtsen clarified that from the roof of Solar Vail the antenna would be 12' in heigla Jeff Bowen moved that the request be approved with the three conditions from the staff memo and a fourth condition that the antenna will be not be greater in height than 12' above the roof of Solar Vail. He also encouraged the applicant to move the antenna to the back, Henry Pratt seconded the motion. The motion passed unanimously with a vote of 4-0. 2. A request for a minor Special Development District amendment to allow for an interior remodel to Gateway Condominium Unit #5, 12 Vail Road/Lot N, Block 5D, Vail Village I st Filing. Applicant: Vail Apartments Inc. / Leo Palmos, Vail Gateway Planner George Luther George Ruther gave an overview. Staff, after a site visit, determined that 5 of the parking spaces were being used as storage. A condition to return those 5 spaces to parking was placed on the approval. Staff will recommend to DRB that the window configuration be reviewed. One of the arcs of the windows does not complete a full circle as do the other windows. Henry wanted it on the record that only interior space is being requested in this proposal. Greg sden mentioned that there are no other trapezoid windows anywhere else on the building. I A Mike Mollica reiterated that hundreds of complaints were directed towards development in general and not specifically towards the PEC or DRB. Greg Moffet asked for a breakdown of the survey. He would be more sensitive if the complaints were coming from resident homeowners, rather than contractors. Jeff Bowen agreed with Greg Moffet, that he too would be more sensitive to homeowners. Mike Mollica said the process should not be cumbersome to any one sector of the population; whether resident or contractor. Susan Connelly said in the PECs role that's true, but Community Development has to respond to everyone. Jeff said we need to look at the process if it is cumbersome. But if the complaint is because a citizen doesn't like the outcome or decision by the PEC, that's too bad. Developers are not a special interest group. Susan. Connelly mentioned that we were looking for opportunities to standardize applications to the extcnt that we can. 41 Planning and Environmenial Commission Minutes August 28, 1995 4 Jeff. Bowen mentioned that historically we did grant some things that shouldn't have been granted. Zoning needs to be enforced and needs to be set in concrete. We need to make that really clear. Greg M'offet said to over regulate creates huge loopholes . The PEC is a multi-judicial court that changes fairly often. It cannot always be consistent. That is a fact of life. Mike N4ollica said Staff is making changes that relate to the DRB design oriented process, not the PEC. The Planning Commission needs to stick by the rules People are not happy with the DRB process- Henry Pratt stated that Breckenridge has one board that takes 60-90 days to get things through the process. In that respect Vail is much faster. Susan Cbnnelly said the time element and hassle factor are the biggest complaints. There is a lot of badmouthing and unhappiness related to the process. Russ Forrest said Staff has a goal of 2000 to eliminate the brown cloud. He Pratt asked if the goal could be bumped up 1 1/2 years. There would be a lot of free publicity if that deadline could be met. Jeff Bowen stated that TOO busses are turbo charged and therefore put out very little emission. Avon and Beaver Creek busses are the problem. Henry Pratt said the switch ftorn "non-sand" on the roads has made a big difference. Russ For-rest mentioned an educational program being worked on with landscapers and the US Geologic Survey to place a water quality monitoring station at Dowd Junction. There is a real opportunity to do something positive with this partnership. They are also talking with Habitat for Humanity to ]cam how to reuse materials from demo/rebuilding. ENORMOUSNESS 1 1 1 1 Paul Reeves said some options are being considered instead of curbside. Perhaps separate containers with designated I st Monday of month newspapers for example. A buy-in from the haulers would be necessary. The higher density areas have the lowest participation rate. Paul Reeves said the competitive spirit is alive and works in this town. If one neighbor is recycling, you'd be surprised how the rest of the neighborhood follows. Henry Pratt said we need to get second homeowners involved in this process, since they are the majority of landfill users. Susan Connelly said that community engagement is the idea of sharing the ethics of our community with outsiders. Jeff Bowen mentioned the We Recycle T-shirt was well received at the San Diego Zoo. Jeff Bowen is not in favor of any additional signage. He does not agree with the sign at the East Vail exit that says ".Vail." Greg sden said property owners want to visually see the creek with no obstructions Susan Connelly said a package to newcomers, needs to be formulated in order to teach the ethics of living in the Vail community. 1 1 11 11 IN I I Henry Pratt stated there is very blatant evidence by residents in East Vail bringing their grass down to the creek. This is done after dark. Greg Moffet said penalties should be severe. Perhaps losing business licences for contractors might e a stiff penalty. Russ Forrest said that enforcement is very difficult.
