Applicant: Liilian and Bill Bresnahan Planner: Lauren Waterton 1, BACKGROUND AND DESCRIPTION OF THE REQUEST The appiicant is requesting a side setback variance of appraximately 3', to allow for a 12' side setback, in order to canstruct an attached 415 sq. ft., twa-car garage. This site is currently improved with a dupiex strueture without a garage. The existing structure was constructed in 1973 and the area was under Eagle Caunty jurisdiction at that time. As constructed, the duplex encroaches 10' into the required 15' side setback and therefore, is a pre-existing nonconforming structure. ~ The PEC first reviewed this request an December 16, 1996. Since that meeting, the applicant has revised the plan to provide a larger west side setback for the proposed garage. There is an existing unimpraved driveway for the west haif of the duplex, which approaches the house in approximately the same area where the garage is proposed. There is also a large tree, located in the front of the duplex. The existing lat line dividing the duplex is located 34' from the west property line and 19' from the setback line. The site is also nonconforming with respect to driveway paving. The driveway is currentfy unpaved and therefore must be paved if this addition is constructed. 11. CRITERIA AND FINDINGS , lJpon review of Section 18.62.060, Criteria and Findings, of the Town of Vai! Municipai Code, the Community Deveiopment Department recommends approval of the requested side setback variance. The recommendation #or approval is based on the follawing factors: A. Consideration o# Factors: 1. The relatianship of #he requested variance to other existing or potential uses and s#ructures in the vicinity. I Most duptexes in this area were constructed with garages. Staff believes that providing garages is a benefit to the neighborhood by removing cars and other iterns from public view. While the proposal is compatible with the neighborhaad, the encroachment into the setback is an additionai impact to the adjacent structure to the west. However, staff believes the applicant has mitigated this irnpact by proposing to locate the garage as fiar east as possible. As a result, the existing tree wili be removed. The applieant is praposing to rnitigate the lass of the tree with an 8' spruce ~ tree. 5taff believes additional mitigation of the tree and the addition of the structure can be obtained with landscaping and fenestration additions to the project. 2. The degree to which relief from the strict and literal interpretation and III enforcement of a specified reguiation is necessary to achieve ~ compatibility and uniformity of treatment among sites in the vicinity or to attain the objectives of this title without grant of special privilege. , Staff believes that the layout and orientation of the existing structure make #his site unique. The existing location of the building in the side setback and the Oocation of the (at line dividing the duplex, constitute a physical hardship and therefore, prevent the addition from being moved further to the east, aut of the setback. The applicant has proposed a modest iwa- car garage of 415 sq. ft., which staff bel#eves to be the rninimum necessary for adequate access and use of the garage. The minimum width for a two-car garage is generally 20' and the applicants property is only 19' wide. Therefare, some encroachment into the setback is necessary for a two-car garage. Staff believes the proposal is not a grant ~ of special privilege due to the site constraints. ~ 2 3. The effect of the requested variance on light anc9 air, distribution of ~ population, #ransportation and traffic facilities, pubiic facilities and utilities, and public safety. Staff believes that the requested variance will not negatively affect these issues. While the proposed addition is located in the setback, it encroaches 7' iess than the existing building. There will continue to be a separation of approximately 22' between the two buildings and 29' between the garage and the adjacent structure. Staff believes that this separation is adequate and will not compromise these issues. B. The Planninq and Environrnental Cammission shall make the followin fig, ndings before cLanting a variance: 1. That the granting af the variance will not constitute a grant ofi special privilege inconsistent with the limitations on other properties classified in the same district. 2. That the granting of the variance will not be detrimental to the public health, safety or welfare, or materially injurious ta properties or improvements in the vicinity. 3. That the variance is warranted for one or more of the following reasons: a. The strict literal interpretation or enforcement of the specified ~ regulation would result in practical difficu!#y or unnecessary physical hardship inconsistent with the objectives of this title. b. There are exceptions or extraordinary circumstances ar conditions applicable to the sarne site of the variance that da not apply generally to other properties in the same zone. c. The strict interpretation or enforcement of the specified reguiation would deprive the applicant of privileges enjoyed by the owners of other properties in the same district. IV. STAFF RECOMMENDATION The Community Development Department staff recommends approval of the applicant's side setback variance request subject to the following findings: 1. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district. 2. There are exceptions ar extraordinary circumstances or conditians applicab(e to this site that do not apply generally to other praperties in the Two-Family Residential zone. ~ 3 3. The strict interpretation or enforcemen# of the specified regulatian would ~ deprive the applicant of priviledges enjoyed by the owners of other properties in the same district. The recamrnendation for approval is also subject to the following condi#ians: 1. The driveway shall be paved. 2. In order to provide a buffer to the adjacent property and to mitigate the setback encraachment, trees shall be added along the west wall of the new addiiion. Specifically, a minimum of three aspen trees shall be added. The location shall be subject to the review and approval by the Design Review Board. 3. Commission FROM: Community Developrnent Department DATE: January 27, 1997 SUBJECT: A request far a worksession to amend Chapter 16.20 (Signs Perrnitted, Categories and Regulations) of the Vaii Municipai Code to aNow for the use af ternporary banners. Appficant: Town of Vail Planner: Lauren Watertan 1. BACKGROUND Within the Town of Vail, banners rnay be displayed ta annaunce ar promote cammunity events or activities. The Vail Municipal Code does not define a"community event," hawever, staff has in#erpreted community events to rnean activities open to the general public, such as Vai! America Days. Before a banner can be displayed for such an event, staff must review and approve the banner design and Incation. Fiecentiy, the Town has received severai requests for banners far events that are no# specifically community related. Most commonly, requests are from conference organizers who wish to display a"welcome banner" at the host hotel. Typically, the banner wouid indicate the conference name, place and date. Staff has historically denied these requests because they are not community events, as interpreted by staff. However, staff believes that banners for these types of events should be ailowed in order to welcome people to our community and prornate conferences and conven#ions within Vail. On September 9, 1996, the Planning and Environmental Commission discussed the pros and cons of allowing banners to be used for conferences and other arganized non-commercial events. After some discussion, the PEC directed staff to draft a proposed amendment ta the Sign Code to aliow for these types ofi temporary banners. Attachment #1 is the existing text within the Sign Cade that regulates the dispiay of ternporary banners. Attachment #2 shows the proposed changes. li. SUMMARY OF THE PROPOSED CHANGES In an effart to sirnplify this section of the Sign Cade, staff is recommending that the original section titled, "Flags, Pennants, Banners and Bunting," be split into two sections; one section titled, "Banners, Pennants and Bunting" and the ather section titled, °Flags." The regulatians within the Sign Code regarding flags relate primarily ta the display of national, state and official flags. Because the regulation of flags is significantly different than the regulation of banners, staff is praposing to create these two separate sections. As shown in Attachment #2, the ~ substance of this section related to flags has not changed. The changes to the new section "Banners, Pennants and Sunting" are discussed belaw. ? De#initions ~ Stafif is proposing to modify the existing definition of a"banner," to include the use of banners for non-commercial events and convenfiions. The de#inition of "convsntion" wi11 also be added to clarify when these ternporary `banners may be used. That defini#ion is as follows: "Convenfion" means a formal meeting of inembers, representatives or delegates, as of a political party, fraternal society, profession, or industry. May also be referred ta as a "conference." ? Purpase in an effort to aHow for temporary banners ta pramote non-cornrnercial events and conventions, staff is proposing to change the purpose section of the Banners, Pennants and Bunting section to allow for #he display of banners at these events. Banners, Pennants and E3unting will be able #o be displayed for events sponsored by a civic, charitable, educationaf, religious or serviee organizatians or at conventions, so long as they are displayed only at the site a# the primary host facility. ? Size Staff is proposing a maximurn size of 20 square feet. The maximum size for any sign within the Town of Vail is 20 square #eet, ~ ? Height The minirnum height for banners (8 feet aver pedestrian ways, 15 feet over vehicular ways) will not be modified. However, staff is proposing a maximum height limit of 25 feet above grade. This is the rnaximurn height far any sign within the Town of Vail. ? Number The maximum nurnber of banners allowed per event ar conventian will be ane. If a facility is hasting more than one event, one banner can be permitted for each event. ? Lighting The current regulations allow banners to be illuminated with indirect lighting. Staff is propasing to eliminate that provision and prohibit the illumination of a banner. ? Advertising/Sponsorship Sponsarship on these banners will be limited to 25% of the total area of the banner. This is the sarne percentage af sponsarship that is allowed on the banners over Bridge Street and at the entrance to Lionshead. ~ 2 As with any other sign within the Town of Vail, staff rnust review and apprave the sign prior to its ~ display. The banners that are located above Bridge Street in Vail Village and at the entrance af Lionshead are currently not regulated by our Sign Code. There are staff policies that regulate the use, size and amount of commercial sponsorship on these signs. At this time, staff is not proposing to make any modificatians to the Sign Code that would affect these banners, however, staff is warking with the Town Attorney to codify these staff palicies. This will be addressed at the finai review by the PEC. Ili. STAFF RECOMNiENDATION Since this is a warksession ta discuss the praposed changes to the Sign Code, staff will not be providing a recomrnendation at this time. Pennants, banners and bunting referring to community events or activities will be allowed to be displayed for a period of no more than fourteen days. Christmas decorations are exempt from the time period, but must be removed when their condition has deteriorated so that they are not aesthetically pleasing. Applicatian must state who will be responsible for removal. In the event the pennants, banners or bunting are not removed an the specified date, written notice by certified mail will be given to the responsible person and the iterns will be rernoved by the town at the owner's expense. 3. Pennants that do not refer to community events or activities and are for the purpose of advertising may be displayed as flags subject to design review. 4. Banners, pennants, bunting or decorations of a temporary nature used for the purpose of promoting community activities shall be exempted from the application procedure described in this title; however, the written permission of the administrator must be obtained subject to design review. 5. She stated that since the last worksession, ~ the application had not changed and that staff had recommended approval with the 3 canditions listed in the staff mema. A request for a worksession to amend Chap#er 16.20 (Signs Permitted, Categories and Regu(ations} of the Vail Municipal Code to aliow for temporary banners to be used. ~ Applicant: Town of Vail Planner: Lauren Waterton Lauren Waterton said that the PEC discussed this item at a meeting in September. S#aff would iike feedback frorn the PEC regarding the proposed text. Lauren praceeded to go over the changes in the stafif inemo and the proposed text. Greg Amsden asked for any public cflmment. There was none. Mike Mollica added that staff would prapose to codify the policies related to the #wo pubiic banner locations that exist now in the Village and Lionshead. He said the regulations regarding Village and Lionshead banners have been policies far quite some time and staff wanted thern included in the code. Galen Aasland asked what sponsorships using 25% of the banner meant. Mike Moilica explained that it meant 25°10 of the entire banner. L.auren Waterton stated that a definitian in the Sign Code demonstrated how to measure sign area. Diane Golden had no comments. Nenry Pratt said the sign size o# 20 sq. ft. was srnall and he felt samething larger would be more ~ appropriate. Mike Mollica said 20 sq. ft. would be reasonable, because the maximum size for any sign in the Town was 20 sq. ft. Henry Pratt felt since it was a temporary sign, 20 sq. ft. was too small. John Schofield said these changes should be pub{ished, sa peaple know about this. The lighting should be ioaked at. He felt there shQUld be a provision to allow #or these banners to be lit. He agreed with Henry that 20 sq. ft was not big enough and advised staff to get feedback from the Vail Valley Founda#ian. He was not sure how to measure the 25°lo cammercial arrd felt there should be some guideiines on how that was to be interpreted. He advised stafif to incorporate sorne flexibility into the lacatian of the big banners in Town. Mike Mollica stated, regarding the largs banners, that staff had the ability to control them through the Special Events Permit. He was in favor of a change to allow lighting for banners. Greg Amsden advised staff to anticipate where these banner requests were coming fram in order to satisfy their needs. He agreed, regarding the lighting issue, that the banners needed to be lit. Henry Pratt asked how the size was evaluated. Lauren Waterton stated the two banners in the Village and Lionshead had ta be a minimum of 20' wide. Henry Pratt suggested it read 20 sq. ft., or as staff permits. Mike Mollica said staff could propose some language with regard to the size allowance in relation to the height of the banner. He reminded the PEC that we didn't want to overregulate. Henry Pratf thnught a larger banner should be permitted with special circumstances. Mike Moliica said a larger banner couid go to the DRB and said that 20 sq. ft. was the largest sign aliowed within the Town of Vaii and it was quite large. Ne said that these banners were propased to welcome people walking into the hotels, but it sounded like the cansensus of the Board was to allow for the size to be larger. Gene Uselton stated that enfarcement was needed in taking the banners down foilowing an event. i 3.
