Community Development Department E 0 0 MEMORANDUM TO: Planning and Environmental Commission FROM: Community Development Department DATE: November 24, 1997 SUBJECT: A request for a conditional use permit pursuant to Section 18.36.030(V), to allow ski storage to be located in the first level of the Vail Parking Structure, located at 241 East Meadow Drive, Block 5D, Vail Village First Filing. Applicant: All Mountain Sports, represented by Phil Horsman Planner: Dominic Mauriello 1. DESCRIPTION OF THE REQUEST The applicant is requesting a conditional use permit in order to provide a ski storage facility within the Vail Transportation Center (TRC). The proposal provides approximately 950 sq. ft. of floor area on the first level of the TRC (in the location that currently contains horizontal ski lockers). The proposal divides an existing wide corridor to provide the area for ski storage and a narrower pedestrian corridor. The proposal will not obstruct foot traffic to the parking areas of the garage. The area would be lighted, heated and changing areas would be provided. The hours of operation are proposed to be 7:30 am to 5:30 pm seven days a week. The TRC is zoned General Use (GU) which lists ski storage as a conditional use as long as the use is accessory to the parking structure. See applicant's letter attached. REVIEW CRITERIA FOR THIS REQUEST In addition to the conditional use criteria, staff has included the purpose statement from the General Use zone district, as we believe this will help the PEC in its evaluation of the request. The ski storage is proposed to be located in the General Use (GU) zone district. According to Section 18.36.010 of the Zoning Code, the purpose of the GU zone district is: to provide sites for public and quasi-public uses which, because of their special characteristics, cannot be appropriately regulated by the development standards prescribed by other zoning districts, and for which development standards especially prescribed for each particular development proposal or project are necessary to achieve the purposes prescribed in Section 18.02.020 and to provide for the public welfare. The General Use District is intended to ensure that public buildings and grounds and certain types of quasi-public uses permitted in the District are appropriately located and designed 0 1 I'OWNOFVAIL? to meet the needs of residents and visitors to Vail, to harmonize with surrounding uses, and, in cases of buildings and other structures, to ensure adequate light, air, open spaces, and other amenities appropriate to the permitted types of uses. Ski storage may be permitted in the GU zone district subject to the issuance of a conditional use permit in accordance with the provisions of Chapter 18.60. For the PEC's reference, the conditional use permit purpose statement indicates that: in order to provide the flexibility necessary to achieve the objectives of this title, specified uses are permitted in certain districts subject to the granting of a conditional use permit. Because of their unusual or special characteristics, conditional uses require review so that they may be located properly with respect to the purposes of this title and with respect to their affects on surrounding properties. The review process prescribed in this chapter is intended to assure compatibility and harmonious development between conditional uses and surrounding properties in the Town at large. Uses listed as conditional uses in the various districts may be permitted subject to such conditions and limitations as the Town may prescribe to insure that the location and operation of the conditional uses will be in accordance with the development objectives of the Town and will not be detrimental to other uses or properties. Where conditions cannot be devised, to achieve these objectives, applications for conditional use permit shall be denied. The conditional use permit consideration of factors are as follows: Relationship and impact of the use on the development objectives of the Town. The proposed ski storage will provide a necessary amenity in the Town and will complement the parking structure as an accessory use. Several goals of the Land Use Plan promote increasing amenities for the visitor as well as locals. Staff believes this is an appropriate use in the parking structure and that the use will positively impact the development objectives of the Town. 2. The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. The proposed ski storage will have little, if any, negative impact on these issues. 3. Effect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the street and parking areas. The proposed ski storage will have little, if any, negative impacts on these issues. The use is proposed within an existing structure. The use will be conveniently located along interior pedestrian corridors and provides for the efficient flows of customers and pedestrians. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. The proposed ski storage will have little, if any, impact on surrounding uses as the 2 1* use is proposed within the existing parking structure. The conditional use permit findings are as follows: The Planning and Environmental Commission shall make the following findings before granting a conditional use permit: 1. That the proposed location of the use is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of the district in which the site is located. 2. That the proposed location of the use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 3. That the proposed use would comply with each of the applicable provisions of the conditional use permit section of the zoning code. Ill. STAFF RECOMMENDATION The Community Development Department recommends approval of the applicant's request for a conditional use permit for commercial ski storage, subject to the following findings: 1. That the proposed location of the use is in accordance with the purposes of the 116 conditional use permit section of the Zoning Code and the purposes of the GU zone district. 2. That the proposed location of the use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 3. N24 E 3 All Mountain Sports Proposal of Ski Storage Facility in the Village Parking Structure It is the intention of All Mountain Sports LLC to enclose space #101 on the first level of the Village Parking Structure, currently under lease to All Mountain Sports, in order to provide affordable ski and snowboard storage for guests and locals alike. The space will be heated to provide a comfortable changing area as well as keeping boots warm and dry. We will add lighting both inside and outside the space, and will use material to finish the wall to enhance the appearance of the space, as deemed appropriate by town staff. The facility will be staffed from 7:30a.m. to 5:30p.m. and equipment will be stored in racks behind counters using a claim check system. There will be no obstruction of foot traffic to and from the parking area on level one (see plans). It is our opinion that a storage facility is the highest and best use of this space. The tenant finish will improve the aesthetics of the parking structure, and the service provided will be of benefit in reducing the number of skis and snowboards traveling on the buses, as well as improving the skiing experience for the large number of guests that have to carry their equipment to and from their hotels or condos. There will be no effect on traffic flow and pedestrian safety will be improved since skiers taking the buses will not be in ski boots. Phil Horsman explained how this would be a benefit for the guests of Vail. John Schofield asked if this was to be long term or short term ski storage. Phil Horsman said the application was for short term, however, he would not be opposed to opening it up to long term storage. John Schofield asked if this was to be strictly storage. Phil Horsman said, yes. Gene Uselton asked how a tenant goes about leasing space in the Transportation Center. Dominic Mauriello answered that this was just like any landlord situation in Town, with the exception of certain designated spaces. Gene Uselton asked who had the title to the space, once leasehold improvements were done. Dominic Mauriello said the landlord (Town of Vail) and that the Fire Department would have to approve the plans, as there were issues with fire suppression. Planning and Environmental Commission 10 Minutes November 24, 1997 Gene Uselton suggested that the Town consider advertising Town-owned space that is available for rent or, perhaps, issue invitations to bid when economic considerations justify it. He pointed out that competitive bidding was a way of assuring that the Town receives a market price for the sale or rental of Town property. He then asked if there was a dressing room. Phil Horsman said there was a space for changing boots, with a counter staffed to hand out claim checks for skis and boots to be stored. He explained that first floor storage was $3.00 per night. Ann Bishop had no comments. Greg Moffet stated that this was strictly for storage and not for valets, or running carts up Bridge Street. He said the conditional use permit would allow no tuning of skis on-site and he suggested a condition on the approval, or as written with stricter language for ski storage only. John Schofield made a motion for approval, in accordance with the staff memo and stated that this was to allow for ski storage only. Gene Uselton seconded the motion. Greg Moffet advised staff to strengthen the language, making it clear the intent was only for storage. Dominic Mauriello assured the PEC it would be made clear when approved. The motion passed by a vote of 4-0. 2.
