According to Section 12,6D.9 af the Municipal Code, "Site coverage shall not exceeci twenry percent (20°la) of the total site area.,, Additionally, Section 12.21.14E indicates that if the auerage siope of the site is in excess o# thirty percent {30°/A} beneath #he proposed siructure and parking area, "Ncat more than fifteen percent {15°l0} of the site area may be Covered by buildings; and not more than ten percent (10%) of the total sste area may be covered by driveways and surfaee parking areas." The reduction in a!lawable site coverage on lots with an average slope in excess of thirty percent from 20% to 15°!b is intended to reduce the overail site disturbance and limi# the destruction of natural features such as mature stands of trees and other types o# vegetation. ~ ~ ~ Front Setback Front setback requirements for lots in the PrimarylSecondary Residential Zone District are regulated by Section 12.6C7.6 (SETBACKS), and are further reguiated by Section 12.21.14K (RESTRICTIflNS {N SPEGIFIC ZC}NES ON EXCESSIVE SL4PES) of the N9unicipal Code. According to Section 12,6D.6, the rrjinimum frant setbaek sha!l be twenty feet {20'}. When development is propased an steeply sloping lots, the Municipal Gode provides relief from the front setback standards, encouraging development closer to the street. According to Section 12,21.14K of the Municipa! Code: "There sha{l be no required fcont setback for garages, except as may be required by the Design Review Board, Garages located in the front setback shall be ` lirnited tQ one story in height (not to exceed 10 feet) with the addition of a pitched or flat roof subject ta review and approval by the Design Review Board.,, Aliowing the garage in the front setback is intended to reduce site disturbance and to ease access on steeply slapingIots. ~ IV, CRiT"ERlA ANG F1NC91fiVGS A. Consideration of Factors: 1. 1"he relatianship of the requested var6ance to other existing or potentia# uses and structures in the vicin6$y. Whila few other hames in Potato Patch have excessive slopes, rnost have under 20°lo site coverage. Attached is a tab(e of sites irs the vicinity, showing Int size and site coverage. The average lot size is 28,356.96 sq. ft, The !ot size of the Bexndt Residence is 23,522.4 sq. ft. The average site coverage in the vicinity 6s 3,694.21 sq. ffi. or 140/o. The proposed site coverage for the Berndt Residence is 4,256 sq. ft. Instead, sfiaff believes that the granting of the requested site coverage variance would be a grant of special privilege as it wou(d result dn treatment not enjayed by other property pwners m the area, and in ttie PrimarylSecondary Zone District in general. While few other lats in the vicinity have excessive slopes, many remain under 15% site coverage. Most, if not all, iats in the Town of Vail contain utility easements ar similar encumbrances. 3. T'he effiect of the requested variance on light anci air, distribution of population, trarrsportation and trafific facilities, pub#ic facilities and utiaities, arrd pub#ic safety. 5taffi does not believe any ofi the above-described criteria is applicable to this request. B. The Plannin and Errvironmenta( Gommission shali make the followin findin s before aranfiinc,~a variance: 1 . That the granting of the variance will not cons#itute a grant of speeial privilege inconsistent with the limitations on other properties c4assi#ied in the same district. 2. That the grar7ting of the variance will not be detrimental to the public health, safety ar weifare, or materially injurious to properties or ~ improvements in the vicinity. 3. That the variance is warranted for one or more af the foilowing reasons: a. The strict literal interpretation or enforeement of the specified regulation wouid result in practical diffiiculty or unnecessary physical hardship inconsistent with the objectives of this title, b. There are exceptions or extraardinary circumstances or conditions applicable to the site of the variance that do not apP1Y generally to other praperties in the same zane. c. The strict interpreiation or enforcement of thespecifiedreguiation would deprive the applicant of privileges enjayed by the awners of other properties in the same district. V. STAFF F~~~OMMENDAT1ON The Gommunity Development Departrnent staff recornmends denial of the applicant's site coverage variance request subject to the foliowing findings: 1. That the granting ofi the 5ite coverage variance wi}i constitute a grant v# special privilege incflnsistent with the lrmitatiorts on other propetties ~ classifiied in the Primary/Secondary Residential Zone District. 4 ~ #y ~ 2. That the strict interpretation or enforcement ofi the specified regulation does nat deprive the applicant of privileges enjoyed by the awners of other properties in the Primary/Secondary Residential Zone District. ~ ~ 5 s * ~Lot 4, B1ack 2, Vail Potato Patch ~ Variance Request September 28, 1998 Subsequent to the purchase ofthis lot, the owner requested that three noteworthy items be incorporated within the initiat single-family architectural plan. It was requested that an EHU be contained wzthtn the structure even though EHLT square footage in excess of 250 squa.re feet would be deducted from the aliowable site GRF~-1, the garages including one for the EHU wQUId be faced away frrarn Potato Patch r?rive which would Iinit driveway frontage to fifteen feet on #he busy switchback, and that the reszdence be massed at a distance from Potato Patch Drive and Iimited to two consecutive levels even though the site coverage might then be limited to fifteen percent rather than twenty percent. Consequently, the awner of the above referenced lot is requesting a variance from a pflrtion ofthe Hazarrd Ordinance (section 12-21-14) which reduces building site coverage from 20% to 15% on two-family primarylsecondary lots in which"the average slope of the site beneath the existing ar proposed structure and paz`kinb area is in excess of thirty percent". The difference betweerr 20 and 15 percent szte coverage csn this lot represents approxiznately 1,200 square feet. This variance is sought because in excess of 1,700 square feet ofgently sloped btzildable site coverage which is unencumbered by the front ~ and side setbacks is consumed by a water fine and utility easement. Consequentiy, ifthat area had not been consumed by the easement, the structure could eas~y have been designed to allow 20 percent site coverage. The owner is appealing to your sense offairness in granting a variance whzch wiil allow 20 percent site coverage. A# that time, the F'EG did not require any parking and stated "...we feel additional parking in #his lacation is not appropriate.,, On_March 24, 1986, the PEC granted a variance for the use of the front setback area/right-of- . way as a loading and unioading zone for a one year period. The apprava( was condifioned on , Ski Club Vail's willingness to sign and enforce this "drop-off'° zone. Rt that time, Ski Club Vail , Veased additional parking spaces from Ramshom Condorniniums. This lease agreement is no 4onger in ef#ect. After the one-year PEC approval expired, additional approvals were rtot requested. Therefore, the operation,has been occurring fQr 11 years without the required approvals. (n January of this year, the Tawn of Wai{, Vail Associates and Ski G1ub Vail drafted a memorandum afi understanding (MUU) (Attachment "A„) regarding parking, #oadingfunloading and vehicular access for Ski Glub Vail anci the Golden Peak ski facility. Under this MCJU, the Town Manager agreed to discuss S#ci Club Vail's parking situation with the Town Gouncil. At their C7ctcaber 13, 1998 meeting, Cauncil directed Ski Ciub Vail personne( #o bring an application to correct the parking anci Ioading problems on site before the PEC #or apprava(. Parkina and Right-of-Wav Management Issues ~ Ski Club Vail personnel are currently working with the Town of Vail F'ublic 1/ldorks Department to address existing drainage and snow storage issues. They have obtained a public way permit fnr drainage improvements to the existing parking areas, but are reques#ing additiona{ snaw removaV services from the Town as part af this applicatian. if will be necessary to have a41 vehicles removed from the area each marning priot ta snow removal. As dernonstrated in Figure 1, this area is currentiy used for a significant amount nf snow stocage. The Town has experienced problems in the past an this site with the expenditure of personnel haurs for parking management. The appliear?t states that the area will be monitored by Ski Glub Vail stafflvolunteers until 9;00 a.m. with Vail Associates manag{rtg the parking after 9;00 a.m. Hawever, Vail Associates is not a party ta this application and no records have been submitted which reflect such an agreement. If the PEC grants an approual of this request, the usage of the Town's righ#-af-way, which is public praperky, wiH be available to fhe generalpub(ic - not just Sk6 CIub Vailaffiliates. Since the redevelopment of Golden Peak, ca:rs stoppinc, on the shoulder of Vail V'alley Drive, or pulling up onto the sidewalks, have caused traffic delays in the area. From personal experience I ean attest that once just one car pulls to the side of the road and stops to unload, xmmediately many other cars do exactly the same. The car doors t1v cspen and suddenly adults asad children are stepping inta the traffic lane causing others cars to came to a stQp. The result is an immedia#e traffic jam an Vail Valley Drive which often times bac7:.s traffic up all the way out to the frantaqe road. Town of Vail busses -et caught in the jam which then slows dawn the entire in- town route. Evening loadinp creates the same problems as cars pull off to the side and wait for skiers ta walk to their cars, or often -time parents leave their cars and go in search of their children. Durinc., holidavs and busy ~ tiveekends poliee officers and CEUs have been stationed in the area to keep traffic moving. On numerous occasions thaugh, every an-duty police afficer and CEO have been required to respond to the area. CJur most effective traffic manaQement strategy has been ta prevent any cars from stopping on the side of the road to unload. This results in the free movement af tra$ic and the qreatest safety for pedestrians. Allowing Ski C1ub Vail to establish a loadinc, a.rrd unloadincy zone on the roadside wi11 anly result in once aQain having sianificant traffic jams on Vail ValIey Drive. The number of Ski C1ub Vail mcmbers artivin(y at tliesarne time in the morning will far exceed the nunaber of spaces on the side of the~road. By the time a Ski Club Vail driver (yets to the proposed unloading zone, he/she will have passed the unloadina zones at Golden Peak. Seeing th.e SCV unloading zone full, a driver wiil most lil:ely pu11 to the side of the road outside the unloadina zone, stop in the Crafhc lane ta wait for a space to become available, unload while double parking in the street or make a U-turn in the roadwav to retum to Golden Peak. All of these actions neQaGivel"- eff'ect traffic flow and safety in the area. Additionally drivers nat affiliated with Ski Club Va'rI, tivi11 be attracted to the unloadinc, zane and further compound the probiems. I would, however, strongly support the placernent of a cement sidewalk bet-ween Golden Peak and Ski Club Vail, on the Sou~th side of Vail Valley Drive. It would run approximately 250 feet along the soutlY sidc; at' Vai1 Valley Drive sta.rtzng at a point cast of the end of the walkvvay to approximately 40 feet west ofthe cueular dr'rve.
