The F'lanning and Ertvironmental Commissian, at its Novefi-nber 23, 1997 mee#ing,
unanimously approved the Lianshead Redevelnpment Master Pian subjecfi #o the
foliowing nine (9) changes: '
1. Change Ianguage in the site development guidelines to state that landscaping shali
be incorporated wi#hin existing and new canstruction to emphasize and create niches.
2. Gardens and planting beds sha1i be icacated within the Lionshead study area where
they add to the pedestrian experience, provide for screening, and to focus views.
3. Strcanger Ianguage needs to be added which direc#s study to the undergrounding of
tEie 1-70 corridor and use of the air rights above.
4. The plan neads to provide Ianguage abouf the study of the parking pay-in-lieu fee.

The applicants, Justin and MaggieHurley are requesting a sign vari~ance #or the Half

app(icants have expressed the reasoning #or the variance as follows:
~ "Unforturrately, the previous awner of the Jackalope installed a sign almost twice the size
(approxirnately 40 square feet) of what was legal. Therefore, Half Moon Saloon, while
seeking appraval tti replace the existing sign, could no# attain approval for a sign awer

The previous occupant, the Jackalope Cafe and Cantina, had a sign approximately 40 square
feefi. The Jackalope Ga#e and Cantina received a sign variance in Apri1 of 1990 for the
fallawing:

1.2 square feet over the allowed square footage, an increase in heigh# 16' over the
allowed 8', for a maximum height af 24 feet above grade, and a change in location #ram

North Frontage Road."
This variance was granted before the West Vai1 Mall sign program was approved. With the
current West Vail Mall sign program, a variance is not needed for the locatian of the sign, aniy
far the size. According tcr the sign program fior West Vail Ma11, this tenant is allowed one 20 sq.
ft. sign on the arcade to the front of the building. According fio the Town ofi Va'rl Municipal Code,
Sec#ion 11-4C-17 WaII Signs:
"5ize: Tuvo and Five-tertths (2.5) $quare feet for each five (5) front {inea1 feet of the
individual business or organization having its own exterior public entrance in a multi-
tenant building, with a maximum of five (5) square fieet allowed for a business with ~
insufficient frontage. Maximum area shall not exceed twenty {20} square feet.,,
The applicants are a(so requesting a variance far the number of window signs. According to the
code: ,
"Each window frontage may contain a sign or signs within the pre$cribed sign iimits for
each frontage on a street or major pedestrianway with a maximum of twa (2) signs per
frontage. Not more than one sign for each frontage shall be permitted to be a gas-filled,
illuminated or fiber optic window sign.

1. DESCRIPTION t)F TWE FtEQUEST
The applicant is requesting a conditionai use permit to a11ow for the operation of a Thrifty
Gar Rental businsss within the Cascade Village Hotel & Club. The proposed nperafiion
would be housed in a small 8' x 8' office space existing within the hotei. The car rental
operation would provide a maximum of twelve rental cars. The applicant is proposing to
~ retain four reserved parking spaces on site to be used primarily for the cleaning and
exchange of rental cars. The propased (on-site) rental car storage area is currently
awned and operated by the Cascade Club Hotel & Ciub and used to meet the parking
demands of the hotel. The applicant anticipates tha# at no time will there be more than
12 rental cars parked in fihe struature at atime.
11. CONDITIC?NAL U5E P'ERM1T R:EVIEW CR1TERlfi AND FINDINGS
The review criteria and findings for a request for a conditional use permit are outlined in Section 12-16-6.
A. Before acting on a canditional use permit applicatian, the Ptanning &
Enviranmental Commission sha11 consider the following f'actors with respect to
the praposed use:
1. Relationship and impact of the use on development objectives of the Town.
The applicant is praposing to operate a car rental business out of the Cascade Ho#el
and Club. The car rental business would be camprised afi a smalf administrative
office wi#hin an existing space in the hotel and the storage of 12 renta1 ve'hicles in the
existing parking structure on-site. Staff believes that the proposed use would have no
negative impacts or? the existing use or the development abjectives of fhe Town.
Staff does believe, hawever, that in nrder for the use to be compatible, a finding must
be made that adequate rental vehicle storage and other necessary business needs

A review of the Town's files including all special development district amendments and buiiding permits is$ued for Area Awithin the Gascade Special Deveiopmen# ~
DrstriCt reveals a surplus in the parking requirerrtent. According to the Town's
information, a tatal of 421 parking spaces are contained within the existing structure.
Given the existing uses, 36 of the spaces remain available. Therefore, the 12
spaces requested far use by the applicant is acceptable. Shou?d this conditionai use
permit be approved, a#ntal of 24 parking spaces will rernain avaiiabte for future
a11OGat10C1.

Staff believes that the propased request for.a canditianal use permit would have na
negative effects on the abowe-described criteria., .
3. Effec# upan traffic, with particular reference to cangestion, automotive and
pedestrian safety and convenience, traffic flow and control, aceess,
maneuverabil'rty, and removal of snow frarrx the s#ree#s and parking areas.
The applicant is praposing to stare rental vehicles within the existing parking .
s#ructure on-si#e when the vehicles are not in use. Accarding to the existing uses
approved for the Cascade Vil]age Special i3evelopment Dis#rict, 36 parking spaces
are available far allbca#ian within the existing parking facilities on site, Staff believes
it is important to pravide the vehicle storage spaces on site and no# attempt to re(y
upon a "managed" parking solution. Historically, "managed" parking sniutions have ~
not been effec#ive and are very difficult to enforce; thus resulting in failure.
4. Effect upon #he character of the area in which the propcrsed use is to be
lacated, includirtg the scate and' bulk af the proposed use in relation to
surrounding uses.
Staff believes that the proposed request for a condifiional use permit would have no
negative effects on the above-described criteria, Each of the required vehicle storage spaces within the structure is paved and fully screened from the public right-
of-way. . Additionally, staff believes #hat 12 vehicles is not an excessive number and
will adequately pravide for the praposed use.
B. The Planning and Environmen#al Com3rnission shalt make #he follcrwing
findings before granting aconditianal use permit:
1. That the proposed location of the use is in accardance with the purposes of fhis Title
and the purposes of the district in which the site is loca#ed.
2. Tha# the proposed locatian of fhe use and the conditions under which it would be
apera#ed or maintained will not be detrimental to the pub}ic health, safety, or welfare,

Maggie Hurley, an owner of the Half Maon Saloon, gave the chronolagy of #he name change from
the JackaCope to Half Moan Salaon. She said she was told by the staff that there would be no
prablsm with replacing the sign and it would be staff approved. She said her sign companY
submitted the sign appiicatian in early October ta replace the existing sign, but staff discovered
the sign from 10 years ago was illegai. She said they were sefi to app(y two months aga, but novv
the sign wauld not be up until Chrisfmas. 5he said at the point they were #old the sign was
illegal, they were tald a variance was possible. 5he said asign haif the size of the existing sign
would not be effective, so they went ahead with the variance process adding another 3-4 weeks
on#o this timing. She said had she known this would be denied, to cut the losses, she would
have gone with the smaiier sign. She said she feit it an extenuating circumstances, as we were
going to replace an existing sign were fiold this would not be a prob(em. She said that because
of the se# back windows, the sfioreiront needwd ic#ersfiification.
Justin Huriey stated that he measured snme existing signs in front ofi City Market.
Dominic Mauriella said City Market signs were exactiy 20 sq. ft., but since fihey were awners as
weli as tenanfis, they were allowed directory signs.
Greg Mofifet said that prior to the institution of the sign code, many variances were ailawed, but
since the sign cade, there have been no variances granted.

Brian Doyon said this was a problem af the system, wi#h not enaugh people to enforce the code,
but he felt the PEC needed to agree with staff, unless we can come up with a reason.
Brent Wilson said Gark was aIlowed 44 sq. ft., since they were an anchpr of the mall.
Brian Doyon said he was against the lagos on a11 the windows.
John Schofield said Iaws do change over the jrears and this was similar ta speeding on the
Fron#age Road until you get caught. He agreed with Brian that logos on every window was toa

Ann Bishop said she was in fiavor of granting a variance because of the Gart sign and also hnw
much the business needed the sign.

Greg Mcrffe# said the elected o#ficials voted on the Gart sign being iarger and all the other signs
needed to be the set size and because this was a very custom piece of legislation, he wauldn'#
be able to vote in favor of granting this.
Jahn Schofield made a motion for denial.

Greg Moffet asked for any further discussion.
Tom V1leber said he was in favor of put#ing the logos on the doars for identificatian, since fihey
were the equivalent of three tenant spaces.

and the majar deletion was the fiennis courE site. Ne then said the idea was to #ake this to the

E#han Moore, with Design Warkshop, mentioned that snme of the comments fram the PEC were
not yet incorporated into the document, such as strengthen3ng the language regarding the
undergraunding of I-70, but fhat the comments would be incorporated. He said Galen had
comments relating to twcr graphics showing a 2"d aI#erna#ive to the parking alternative on the
Lions Pride 8uilding and the day 1at verticai sfudy shawing potentiaf impact. He said the text ~
addressed the views and noise concerns. He said the matian to approve could be made
contingent on these comments being added.
Greg Moffet asked if the increased building heights an the north and west ends had been
addressed.
Ethan Moore said they needed ta be reevaluated because of the desirability of housing, but not
at the expense of quality. He said lf housing could be successfully integrated, then it showld be
done as long as it didn't sacrifice quality. He saici that commercial develapment was talked about
for the west end, which was the appropria#e pface for this to happen.
Greg Moffet asked what the CvunciPs concept of conditionalsase permits for additionai building
height in west end and along the S. Frontage Rd. was and if it was in this document.

canstraint. He said the 2.5.1 ratio would not be restrictive or present constraints.
Tom Weber said the sketches are to sell the master plan rather than engage the owner. He then

Russ Forrest said specific improvements would use different finaneing from appropriate
contributians. He said the first step was for it ta be implemented by the Town with cooperation
fram the adjacent property owners.
Tom Weber said there were more "shoulds" than "shalls" in the document which created a less
definitive dacument. He then suggested ta change the language to shall, where possible.
Russ Forrest said the DRB was wrestling with the Design Guidelines now and trying to decide
where it was appropriate to have "shauld" or "shall.,,
~~i--n Doyon was concerned with the site guidelines and that the original intent was tv tone down
the hardscapes. He said all the graphics, 8.2 and 8.3, shaw trees and are contradictory artd he
said the word shnuld is not what we want in our guidelines.
Russ Forrest asked the PEG if the verbal matched the pictures, would that be acceptable. He
said one of the goals was to remove Iandscaping buffers frflm the retail fronts.
Brian Doyon said the secondary mall areas are all outlined by frees, but there was no
requirement for that.
Tom Weber stated if we needed Iandscape requirements in there, we needed to s#ate that.

He said future development on 1-70 and taller building heigh#s on the South Frontage Road have
not been addressed, and so he suggested for the F'EC to make that part of their appraval. He
aIso said there should be stronger ianguage in the recommendatian to have taller building
heights on the west end.
Ann Bishop asked if Mr. Lamont's suggestions had been incorporated in#o the document.
Russ Forrest said, no, since stafi# didn't agree with the his views on the North Day Lot and the
west end parking.
Ethan Maare said the primary focus of this draft was the completion and addifinn of all the
graphics.
Russ Forrest said another of Jim Larnont's comments had to do with the wetlands area by#he
~:3orn Free iitf and fhat staff wanted fo keep the bridge ii°i and Jim uvarited to take i't out as a ~
restoratiori project.
John Schofield said there should be a review di the parking pay-in-lieu language. Me said the
one section he disagreed with and strongly urged action on was #a get the DDA in place before
the Broomfield issue was settled. He said if we don't put it in place, we will lose so much and he
felt strongly that it should have been acted on 6 months aga He said: the DDA should be formed
immedia#ely. He said building height was touched on and PEC was unanimous. He said ta take
a hard look at fihat again and strongly agreed with eliminating GRFA. He said that some
language indicated a possible reduction in parking requirements and he would like to see that
language removed.
C3ominic Maurielio said the intent was if a project didn't generate additional parking, more parking
wouldn't be assessed.
Ann Bishop said it was a gaod document and everyone shauld be commended, but she would
have liked to have had Mr. Lamont's camments beforehand to compare them. She said it was
subject tn what we were going to staple to it and so she was in favor of it. She said she wants to
approue it, to get it going.
Diane Golden said her fellow commissianers had worked hard on their comments and

pedestrian path which could be Ioaped, to affarc; rehabbing the wef(and and also create a place
where peapie couid go in circles. Fie said he would li4ce to see the Ianguage changed relative to
that parcel. Me suggested that the views over :Ina 1..4onshead Pai king Structure be maintained so

in favor of Ioosening up GRFA and beefing sap the design guidelines, but you have to prove that
we can get a balanced deveiopment.

be praved, as ifi ief# him flat. He said it was an area for affordable hausing, and fior hotels, but it
didn't give a sense of hope for an urban center. He said it was a bit Iate for design alternatives,
but we ough# to think about rivhat wauld give exeitement to the v+res# end. He said we needed to
create a major urban eenter, nat to be close enough ta the lifts, but clase enough ta warrant
excitement. He said these were the mast critical elements and although this was an exemplary
job to satisf}r us, it didn't have the "umpf.,,
C7ave Corbin, from Vaii Associates, $aid we could tweak this plan ad nauseum farever. He
encouraged the PEC to generally approve it ta Council ta keep ifi maving. }-1e said to identify
those specific shartcoming areas in generafized ways and acknowledge what we have is
workab]e.
Greg Moffef agreed with Jim that the west end needed to create an oppartunity ta match the
competi#ion, perhaps getting rid af the sewage plant. He summarized that:
• he would like to see some recommendation on the landscape issues per Brian'sconcern,
• That there were parking, pay-in-lieu, the immediacy of C7C7A, the addressirigof GkFA arici 1-I u

Jahn Schofield made a motion for approval of the Lionshead Redevelopment Master Plan subject
to the following nine (9) changes:
'i . Change (anguage in fhe site deveiapment guidelines to state that landscaping shall be
incorporafed within existing and new canstruc#ion to emphasize and create niches.
2. Gardens and planting beds shall be located within fhe Lionshead study area where they add
to the pedestrian experience, provide for screening, and to focus views.
3. Stronger language needs to be added which directs study to the undergrounding of the I-70
corridQr and use of the air rights above.
