The minimum lot size in the Two - Family Residential District is 15,000 sq. ft. Lot 6 will be 25,744 sqm ft. while Lot 7 will be 26,52$ sq. ft. The Specific Purpose of the Subdivision Regulations is as follows: 1. To inform each .subdivider of the standards and criteria by which development proposals will be evaluated, and to provide information as to the type and extent of improvements required. OF 4 TOWN YML this requirement without a variance. Although 213 square feet of site coverage is available on site (enough for one 11' x 1' garage space), the applicant is proposing to construct a 600 square foot two-car garage. Available site coverage under code provisions ® 213 square feet Site coverage needed to meet EHU parking requirement - 162 square feet Site coverage proposed for two-car garage = 600 square feet (300 sf garage for EHU, 300 sf garage for Ferrer residence) III. STAFF RECOMMENDATION The Community Development Department staff recommends denial of the applicant's site coverage variance request subject to the following findings. 1. That the granting of the site coverage variance will constitute a grant of special privilege inconsistent with the limitations on other properties classified in the Primary /Secondary residential Zone District. 2. There are no exceptions or extraordinary circumstances or conditions applicable to this site that do not apply generally to other properties in the Primary /Secondary Residential Zone District. 3. That the strict interpretation or enforcement of the specified regulation does not deprive the applicant of privileges enjoyed by the owners of other properties in the Primary /Secondary residential Zone District. The Community Development Department recommends denial of this application for a Type 11 Employee Housing nit, based on the following findings; 1. That the proposed location of the use is not in accord with the purposes of Section 12 -13 (Employee Housing) and the purposes of the district in which the site is located. 2. Variance requests for garage 2. The utilization of the 500 square foot credit for the EHU would preclude the adjacent duplex owner from future expansion under the Town's "250 GRFA" credit. The adjacent owner has expressed a desire to maintain control of their available "250" bonus credit and has voiced their opposition to this request. Although the allocation of duplex GRFA between adjacent owners is a private issue, staff believes this proposal is inconsistent with the Town's development objectives and may preclude a workable, harmonious relationship with adjacent uses, The effect of the use on licht and air. distributi*n of nomilation. . However, it shall contain kitchen facilities and a bathro orxt, as defined in Chapter 12 -2 - Definitions of the Vail ilunicial Code. It shall be permitted to be a third dwelling unit in addition to the two dwelling units which rtttay already exist on the lot. Cnly one Type II U shall be allowed der lot. The proposed EHU will be a third dwelling unit on the site. As proposed, it contains a full kitchen and full bathroom facilities. e. A royal or denial of the request all be made by the Design Review Board in accordance with ection12 -1 -5. If an applicant obtains Design Review Board approval for 500 square feet of additional CRA for the EHl! he or she shall not be entitled to receive additional GRFA pursuant to Chapter 12 -1 - Acittor7al ro�� es6er�fial �Ioorr°ea of this Code for either unit on the lot. If an ar)Dlicant obtains Desian 6 Review Bard approval for not more than 250 square feet of additional GRFA for the EHU, he or she shall be entitled to receive additional GRFA pursuant to Chapter 12 -1 - Additional Gross Residential FloorArea of this code for one dwelling unit on the lot. The EHU would be 475 square feet in size. The applicant has submitted an application for 500 square feet of additional GRFA utilizing the code provision that allows for the use of 250 °s "up front" when creating a new Type Il EHU. The unused portion of this GRFA (25 square feet) may not be allocated to the other units, No additional 250's would be allowed on this property. f, It shall have no more than two bedrooms. BACKGROUND M IV. ZONING ANALYSIS The Development Standards within the General Use Zone District are proposed by the applicant and determined by the Planning & Environmental Commission. The following analysis describes the applicant's request. CONDITIONAL L I° CONSIDERATION I IT IA AND FINDINGS In accordance with Chapter 16 of the Municipal Code, an application for a conditional use permit within General Use District, the following development factors shall be applicable; 1 Relationship and impact of the use on development objectives of the Town. In reviewing the applicant's proposal, staff identified a number of potential physical impacts. The potential impacts include: 1. Loss /removal of existing maturing vegetation. 2. Improvements to the configuration and operation of the loading and delivery functions of the arena, 1 Relocation of the West Meadow Drive alignment to accommodate semi -truck turning radii. 4. Addition of building mass above grade along Vest Meadow Drive. 5. Aesthetic appearance of a loading /delivery area along West Meadow Drive. 6. Elimination of bus traffic congestion and conflicts for west bound routes. 7, Increased pedestrian traffic and waiting areas outside the front entrance to the arena. 4 8. Removal and reconfiguration of the "bus damaging" retaining wall design in front of the arena. . Relocation of the pedestrian /bike path to the entrance to the loading and delivery area. Staff believes that the proposed expansion to the ice arena, to accommodate expanded locker rooms and a new loading and delivery facility, is in compliance with the development objectives of the Town. However, areas of concern with the proposal include; the loss of existing vegetation and the visual impact of the loading dock on West meadow Drive, the negative impacts of widening West Meadow give, the size and configuration of the loading and the timing of the proposal given the Town's efforts to formulate, adopt and implement a Community Facilities Flan. Staff believes that these concerns can be mitigated 'by the applicant. Mitigation measures might include relocating some of the existing vegetation on -site versus off -site, realigning Vilest Meadow Drive rather than widening the road, designing the loading area to adequately handle two delivery vehicles, insure adequate screening of the loading dock area, and beginning construction on the improvements after the design charette for the Community Facilities Flan. m Effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities and public facilities needs, Staff believes the proposed locker room expansion and new multi - purpose room with the administrative office will have positive impacts on the above - described criteria. The expansion and remodel of the existing Dobson Ice Arena facility will allow the Mail Recreation District to improve and expand its services to our guests and the residents of the Malley. The District anticipates being able to bring sports teams, special events and performances to the community that under existing conditions could not be accommodated. 3. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the streets and parking areas. The new loading dock has been proposed by the applicant to enhance and improve the operations of the ice arena. Currently, loading and delivery at the ice arena is accommodated at the arena's front entrance which is located on the south side of the building. In the past, the existing location has resulted in public safety concerns and created congestion of pedestrian and bus traffic. Problems arise at the arena when delivery vehicles are loading and unloading at the front of the arena while bus traffic attempts to continue around the north side of the landscape island in the middle of West Meadow Drive. Since buses are unable to negotiate between the delivery trucks and the numerous retaining walls in the area, accidents occur. Problems with pedestrians are also created when large trucks are parked at the front entrance. As lines of people start forming as they wait to get into the arena, the lack of adequate space forces pedestrians out into the bus traffic lanes. The Town and the District have identified these problems in the past and seek to resolve the situation. 5 The location of the now loading and delivery area will attempt to alleviate the existing problems, The proposed location is removed from the front entrance area and setback out of the bus traffic lanes. The new loading and delivery area will be snow melted to eliminate snow removal concerns. Access to the loading dock will be off of West Meadow give. The access has been designed to accommodate the maneuvering requirements of a -foot long semi- tractor and trailer. The Town staff has reviewed the proposal relative to the widening of West Meadow [give. The review included input from the Transportation Department, the Fire Department, and the Community Development Department. The staff is concerned that widening of the road rather than relocating the road results in an excessive amount of impervious surface and a potential roadside parking area. Staff would recommend that the road be relocated to the south to accommodate the necessary truck turning radius to avoid any unintended negative consequences in the future. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and ulk of the proposed use in relation to surrounding uses. The proposed building addition and new loading and delivery dock will significantly alter the appearance of the existing ice arena. The most notable impacts will be along the portion of West Meadow give in front of the arena. Currently, as many as 24 maturing evergreen and aspen trees are growing at the east end of the arena. With the exception of only a few of the largest evergreen trees, the trees were planted as part of the landscape plan for the original construction of the ice arena. According to the proposed plans, 21 trees will need to be relocated. To offset the effects of the tree loss the applicant is proposing to install 26 new trees. It is anticipated that some of the trees that need to be moved can be replanted in new locations in the vicinity of the improvements. The Planning and Environmental Commission shall make the following findin s before granting a conditional use permito 1. That the proposed location of the use is in accordance with the purposes of the Zoning regulations and the purposes of the district in which the site is located. 2.
