The applacant is requesting a variance to aIlow for the construction of a single-family residence
on a prartion of Lot 3, Block 3, Bighorn 3rd Additi~n with a sIope i~ ex~~~~ ~f 40d/a, The Towrs's
Hazard Reguiations stipuiate tha# "no structure shall be built on a slope of 40°l0 or greater
except in Singfe-Famiiy Residentmal, TwopFamily Resideratiai, or Two-FamiBy PrimarylSecondary
Residential zone districts." The subject property is zoned Residentla9 C9uster.
At their July 21, 1999 meeting, the Town's Design Review Board conceptually reviewed the
applicant's request to construct a singie-fami8y residence on portior~~ of the property outside the
area of excessive sIope. After reviewing the proposed development p1an and visiting the site,
the DRB ack~owfedged "the presence of s6gnificant mature vegeta#ion and na#ural features99 on
the site and directed the applgcant to pursue a variance in order to buiid on t~e upland portion of
the propertye A 9efter from the Design Review Board regarding this project is included in this
memorandum #or referencee
The purpose and intent ofi the Town's Hazard Regulatians is to:
"Help protect the inhabitants of the Town from dangers re9ating to development of flood
piains, avalanche paths, steep slopes and geologically sensitive areas; to regula#e the
use of land areas which rr,ay be subject to fiooding and avafanche or which may be
geologi !!y sensi#ive; and further to regulate development on steep s9opes; to protect
the economic and property vafcaes of fihe Town, to protect the aesthetic and r°ecreational
values and naturai ~~~ources ofi the Town, which are sometimes asscaciated vvith f9o0d
plains, avalanche areas and areas of geoIog'scal sensitivity and slopes; to minimize
damage to pubaic facilities and utiiifiies and minirnsze the need fcar relief in cIeanup
operations; to give notice to the pub(ic of certaan areas within the Town vvhere flood
piains, avalanche areas and areas of geologic sensitivity exist; and to promofe #he
generai public healtha safety and we6fare.,"

A review of the Town's geologic hazard rrtaps reveals there are no identified snovu
avalanche, rockfa§!, floodplain or debris filoanr hazards on this property.
In 1994, the PEC denied a sirrtiiar request (coeast ctron on a slope in exc~~~ ~~~05ya) on
this property for a proposal that vvas more expansive with an additional Type III EHIJ.
However, s#afF feels this current request is far less 9mpactive than the previous submittale

The firtdings and criteria for evaluating a request for a variance are outlined in Section V
of this rriemorandum. Specifica!!y, the PEC/DRB roies for variance appdications are as
follows:
The PEC is respansible for evafuating a proposal for:
1. The ?°elationship of the requested variance to other existing or potential uses and
sk ctures ¢rt tFte vicinity.
2. The degree to wh€ch relief from the strict or igterai interpretation and enfor ment of a
specified regu€ataan is necessary to achieve compatibglity and unigormity of treatment
arrrong sites in the vicinity, or aftain ±he objectives of this Title without grant of special
privr[ege.
3. The effect of the requested variance on light and air, distribut€on of popuiation,
transportation and traffic facafities; public facilities and utilitiesp and pubiic safefiy.
4. Such ~ther factors and criteria as the Commisseon deems applicable to the proposed
variance.

wcau8d result in pract6 ! difficuity or unnecessary physical hardship
inconsistent with the objectives of this title.

density mulfiiple-family zoning), the proposed use far the property is
single-family resgdential. The Tawn freq€aently approves the constructian
of singfe-#amily residen son s(opes greater than 40% in other zone
districts. A}though ather przaperties in the Residential C6us#er zone district
are bound by the 40% sIope restrictiony staff be6ieves the proposed use
on this site (singCe-famiEy residential) is unique uvithin the zarae district.
Therefore, given the unique rtature of this request and the presence of
significant mature vegetation on the "buildab€eP9 portions of this particular
Iot, sfaff does not believe an approval of this req~~~t would be a grartt of

.At our July 1 " eetixg, the Desagn Review Board (D ) gave the a.pplicant on the above-
referenced project, Michael J. I,auterbach, direction to pursue avariance to a.llo for the
const ction of a single-family residence csn a portion of his lot with a. ~lope in excess of 40%.
After revievd` g the proposed develop ent plan and conducting a site visit to the property, the
D feels the presence af significant ature vegetatiorz and ~~tural features on this site w rtS
a v iance.
As y~u know, many single-family and duplex structures in Vai1' s other residentiai ~one dgstricts
may build on slopes in excess of 40% and the I3 fee1s this project should not be hindered by a.
technicality zntended for u1tipleAfa ily structures. We believe t~~ grantirzg of this va.riance will
result in a better design and a more posltive i pact csn both adjacent properties and the
community as a whole.

into ara agreernent to exchange approximateBy 62m268 acr~~ ~f National Forest Lands for
approximately 75.02 acres of non-federal lands in Eagle County. The exchange
implements the Town of Vail Landownership Adjustment Analysis, and portions o# the
T'own of Vail Comprehensive Open Lands Plart. ~~~s unplatted Iot was part of this
exchange and was annexed by the Town ofi Vail in April 1999 and zoned Outdoor
Recreation,

neighborhood park, open space, or employee housing. The 1994 Comprehensive Open
Land Plan states that the lartd should be used for a pubiic use. Neighborhood
participation for proposals on this s3te began in October of 1998 and continued through
November with neighborhood meetings with designers. CounciI approved the
development of six units and a neighborhood park on November 17, 1998. On January
20, 1999 and again on June 16, 1999, the site pIan for the housing was brought to the
Design Review Board for a conceptua1 review, On January 26, 1999, Council approved
the cancept o# a 4-plex and duplex on t~~ east side of the Iot9 vvith the neighborhood
park on the west side of the lots and on the Iand annexed in April 1999a On July 7, 1999
the park was brought to the Design Review oard for a coraceptual review, 1'he park
was approved by the Design Review Board at the August 4, 1999 meeting,
