Code, to allow for a new single-family residence, located at 5133 Black Bear Lane/Lot 14, Black 2, Core Creek Subdivision. Applicant: Casimir and Georgeanne Zachara, represented by Kurt Davis Planner: Brent Wilson I. DESCRIPTION OF THE REQUEST The subject property is anon-conforming lot (platted in 169) containing a significant amount ofi wetlands. Earlier this year, the U.S. Army Corps of Engineers approved a permit to allow for the construction of a srngle-family residence on Lot 14. This permit acknowledges the residence will permanently impact 414 square feet of wetlands and will temporarily impact (due to construction) ~ ,39fi square feet of wetlands. However, the Corps of Engineers found the applicant has "worked to reduce wetland impacts to the maximum extent possible," This reduction involves the location of the house on the upland portion of the property with an encroachment onto required front and side setbacks. Therefore, pursuant to Chapter 12-17, Vail Town Code, a variance has been requested. II. STAFF RECOMMENDATION The Community Development Department recommends approval of the requested setback variances subject to the following findings: That the granting of the setback variances does not constitute a grant of special privilege inconsistent with the limitations on other properties in the Two-family Residential Zane District. 2. That the strict literal interpretation or enforcement of the setback regulations results in a practical difficulty or unnecessary physical hardship inconsistent with the development objectives of the Municipal Code or the Twa-family Residential Zone District. Consideration of Factors Reoardina the Setback Variances: ~. The relationship of the requested variance to other existing ar potential uses and structures in the vicinity. The proposal is fior the construction of asingle-family residence. Adjacent structures include single-family, two-family and multi-family residences. Staff believes the proposed use and structure are consistent with adjacent uses and structures as well as the objectives outlined for the Two-family Residential zone district. The bulk and mass proposed for this structure is less than the existing bulk and mass present on adjacent structures. The applicant has pulled all upper-level GRFA out of the side setback. Therefore, only the proposed main-level garage would encroach into the required side setback (above grade}_ ~, The degree to which relief from the strict and literal interpretation and enforcement of a specified regulation is necessary tv achieve compatibility and uniformity of treatment among sites in the vicinity or to attain the objectives of this title without a grant of special privilege. • This particular lot is constrained by a number of factors. Development is being pushed towards the upland portion of the lot by the presence of wetlands, the 100-year floodplain and the required Gore Creek setback. Although this lot measures 12,451.9 square feet in size, there is only about 850 square feet of buildable area within the required setbacks. Staff believes these 1551Jes constitute a significant hardship for the owner and that development of the lot by the strict interpretation of the code would be 3 impassible. Staff believes some relief is necessary in order to achieve compatibility and uniformity of treatment among sites in the vicinity. Staff believes fhe applicant has requested a reasonable knot excessive) deviation from the Zoning Regulations. A number of adjacent properties in the neighborhood are non-conforming with regard to setbacks. 3. The effect of the requested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety. Staff does not believe that there will be any negative impacts associated with this proposal on the above-listed criteria. B. The Planning and Environmental ~c~mmission shall make the following findings before granting a variance: That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district. 2. That the granting of the variance will not be detrimental. to the public heath, safety or welfare, or materially injurious to properties or improvements in the Viclnity_ 3. That the variance is warranted for one or mare of the following reasons: a. The strict literal interpretation or enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title. b. There are exceptions or extraordinary circumstances or conditions applicable to the same site of the variance that da not apply generally to other properties in the same zone. c. This lot is heavily affected by the Army Corps ofI/ngineers Wet Land restrictions. The lot size is I'',~51,90sq.It. nr .286 acres and all of east side and lower portion of the lot are considered Wet Lands. The Army Corps of Engineers is requiring building in what they designate as the 1<lplands area, which includes the front and side building setback areas. if 1 take into account the Town of Van's guidelines of the 20 foot front setback and 15 foot side setback then this Upland area becomes to small to build even the garage on the remaining square footage. i have met with Public Works and the Planning Department discussing the Town guide lines and concerns with building a home in the setbacks. This house design has taken into account all the zoning regulations that come into play such as; building no closer tlran 24 feet from the edge of street payment, l~0 year flood plan, Sa foot i'rom center of creek, no GItFA in the side setback, 33 foot height maximum, drainage easement and the Wet Lands issues. 1've reduced the home size to a minimum and strategically placed it so that is works structurally, flow patterns work, roof lines, height is at maximum based on existing grade and the neighbor impact was reduced. 1 am applying to P.E.C. for your approval of building within 24 feet from the edge of Black Bear street pavement, which equates to a 18 foot front setback variance. This is mainly for the one level garage. One the West side 1 am requesting a S foot set back variance also for the one level garage only. The placement of tlae home here is critical mainly because of the Army Carps does not want me to impact the Wetlands any further. i also get into a height problem with the grade dropping off 9 feet as I irrove back on the tot. 4 After meeting with the Array Corps of Engineers twice (Mike Claffey) in Grand Junction I find tuned a plan that works with them which is the plan now presented to you. Nir. Claffey gave me a verbal acceptance ofthe Wetlands inpact, but had interest of allowing any further impacts from the house foundation. In proposing Plan B where we build the home with in the normal setbacks the Arny Carps found this unacceptable, The only conclusion 1 could came to is to build in the'I?plands Area in order to receive a Nationwide Permit. Other environmental company's have studied this lot and reviewed it with the Army Corps and have come to the same~canclusions as I present to you. Other lots in the neighborhood along Gore Creek corridor have not gone under the same stringent regulatioa~s that are in place now, `I"he Army Corps considers Crore Creek Corridor a more restrictive area in comparison to lots inland that are considered Wetlands. V1~hen taking into account all the Governing bodies, rules and design guide lines, I've designed a very sound." attractive home that fits both the lot and today's architecture of East Vail. With regards to the erect ~n intpact5 Qf iiht, air, distril~utien ~f population, transportation, traffzc, utilities and public safety, I see no adverse effects from setback variances of this home. In talking to the neighbors to the west who are mainly effected, they said they would rather see a quality home built here rather than a lot that is a neighborhood dump site. With so fetiv remaining lots in Vail, most of these lots are restrictive and dii~"icult to build on. I've lived and working in Vail for 21 years and I am sensitive to the balance between development and the beauty of nature. I wil! be sensitive here to the Site ant{ I feel the home designed is beautiful and will nicely nettle in on this lot. P.C7.8ox 974 Eagle, GC313i 631 RE: Addition of the Vista Bahn Building deck for outdoor dining at the Tap Room Dear Terrill, The Design Review Board conceptually reviewed the deck addition at the Vista Bahn Buiiding at their June 21, 2000 meeting. The fallowing were their comments and concerns: # . The deck will create a dark and uninviting space tar the pedestrian flow that was intended with the original building design. 2. The board generally felt that the angles of the deck were out of character with the existing building. Instead, the board felt that they would be more supportive of expanding the existing decks and opening up the restaurant more to the outside. 3. The board felt that the deck would create a dark, wet entrance to the ski lockers. The also felt that the head height created would not be conducive to people carrying skis. 4. The board fielt that using up all of the available space was not an elegant solution. The proposed deck introduced a vocabulary unfamiliar to the existing building. 5. The board also expressed concerns about the proximity of the deck to the adjacent residential use. The Planning and Environmental Commission hearing on the conditional use permit for the outdoor dining deck has been tabled to the July 10, 2000, meeting to allow you adequate time to integrate the Design Review Board's comments into the proposal. Kurt Davis said he would be available to answer questions. Galen Aasland asked if there was any public comment. There was no public comment. Doug Cahill asked how large the structure was. Kurt Davis said the total was 3,229 sq. ft. and said he had gone to the Army Corp of Engineers twice throughout the process of designing the house. He said the Army Corp of Engineers was pleased that the house was designed around the wetlands. John Schofield said clearly tha# the lot, under today's regulations, wouldn't be allowed, but. the fact. that it was non-conforming was a hardship. He said similar variances were granted far wetlands and setback problems, so the applicant had overcome the special privilege. Diane Golden agreed with John and Doug. Tom Weber asked if the applicant could stay out of the side setback. Kurt Davis said that various ways were attempted to try to move the garage, but they found themselves entering into the drainage area. He said they took GRFA out of the second level, but trying to move the garage created more problems and they were maxed out on the height right now. Information Update Approved July 10, 2o0Q John Schofield said, for the record, that the staff was doing a great job in giving information. He again said appointing a PEC member on the DRB was redundant. George Ruther said they were taking the f EC rep on the DRB issue to Council with an Ordinance to take away the PEC rep on the DRB and instead have a b,h DRB member. Doug Cahill asked if the PEC could have the DRB minutes or memos from the DRB. / Discuss moving meeting to Council Chambers Galen Aasland said he was concerned ab©ut how the pre-meetings were done in the conference room and said Jim Lamont stated that the pre-meeting was not open to the public. George Ruther suggested moving the pre-meeting to the Council Chambers with box lunches being provided. He said if the worksessions were held in the Council Chambers, the PEG may want to consider not having input during the pre-meeting. He then of#ered the alternative of putting a "Public welcome" on the published notice for the pre-mee#ing. John Schofield asked if the PEC would allow public input at apre-meeting and if the PEC would fake the public on the site visits. Galen Aasland said the Council doesn't haul the public around. John Schofield said we were doing everything legally and that it was just a public perception. George Ruther said the public is welcome #o attend the site visits. Simply moving the meeting might change the perception, since the Chamber is a civic place. John Schofield said we have the public input here and asked if we would have to have it an record over there. Doug Cahill said he was in favor of keeping it status quo and that separation was a good thing, since by having it separated, our questions were not geared to the public. Ne thought the public might feel more rejected in the other room by standing there and not being able to give input. Diane Golden said after the public knows they are welcome by publishing it for a little while, we can make a decision. Tom Weber suggested posting signs on the applicant's property noting that a meeting was taking place. Tom Weber said he was not sure if the public got the notice. George Ruttier said a notice of the meeting was not required to be posted on site. Tom Weber said it was typically the applicant who posted the sign on their property- George Ruttier said the Planners were doing an update on no#ificatian in the cede and would like signs on the property to be added. Doug Cahill suggested advising the applicants at the time of application. Diane Golden said the Town doesn't have money to put up signs. Tom Weber said it would be the applicant's responsibility. Chas Bernhardt stated that the PEC just approved square footage in the fron# setback, but just denied inches a couple of months ago and asked how this was being consistent. George Ruttier suggested doing some training in our pre-meetings for discussion on the variance procedures by going through those sections of the code and why a variance procedure exists in a regularity document. John Schofield suggested that staff keep a retard of variances. • George Rather said that variance data could be managed in the GfS system, but mentioned that rarely are two variance requests the same. John Schofield said since staff toms over and the PEG Commissioners turn over, in the long run a history of variances might keep the Town out of litigation. 8.
