The stream banks have eroded and a large spruce tree is being undermined due to erosion and is leaning into Gore Greek. The Tawn of Vail is proposing to construct a boulder retaining wall 4 ft. to 6 ft. in height and i DD ft. long. The wall wilt stabilize the streambank, prevent further erosion, and prevent further undermining of the spruce tree. The applicant's letter of request has been attached for reference. The Planning and Environmental Commission reviev+ied the application on October 8, 2001, and recommended that the applicant pursue a design which would minimize the size and extent of the wall. The applicant has modified the design, providing fora 30 ft. wall with 3 boulder stacks upstream of the wall. The engineer's stamped letter has been attached for reference. In addition, the Planning and Environmental Commission was concerned about the viability of the large spruce tree. The applicant has engaged the services of A Gut Above Forestry. The letter from the arborist has been attached for reference. Generally, the arborist indicates that the tree is in good health and that with proper mitigation and protection during construction, the project could improve the growing environment for the tree. The Army Corps of Engineers has approved the project. The approval letter has been included for reference. The Division of Wildlife has also approved the project for completion by November 15, 2001. II. STAFF RECOMMENDATION The Community Development Department recommends that the Planning and Environmental Commission approve the applicant's proposed modifications to the Gare Creek Flood Plain, located at the Gore Creek streambank in Stephens Park, 2400 dock of S. Frontage Rd. West/Unplatted, subject to the following findings: • That the proposed location of the flood plain modification and the conditr`vns under which it would be operated ar maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or rnwx nF unrL yA improvements in the vicinity. A complete floodplain analysis conducted by a qualified consultant indicates floodplain elevations will nQt,be adversely impacted by this proposal. III. RDLE DF THE REVIEWING BDARD The PEC is being asked to render an approval or denial of this request to modify the Gore Greek floodplain based on the following objective: 1. That the proposed location of the flood plain modification and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties ar improvements in the vicinity. lV. REVIEW CRITERIA FOR GRADING IN THE FLDDD PLAIN The Planning and Environmental Gommissian must review a request to grade in the floodplain subject to the following criteria: 1. That the proposed location of the flood plain modification and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, ar welfare or materially injurious to properties or improwernents in the vicinity. The grading in the floodplain is necessary for streambank stabilization to prevent further erosion. !f na action is taken, the 86 ft. spruce tree will eventually fall which would impact the abutments of the Stephens Park pedestrian bridge. Staff believes that the proposed floodplain modification will not be detrimental to the public heal#h, safety, or welfare or materially injurious to properties or improvements in the vicinity. 2. A complete floodplain analysis conducted by a qualified consultant indicates floodplain elevations wi11 not be adversely impacted by this proposal. Peak Land Consultants, Inc. has completed a floodplain study, which is attached for reference. The study indicates that there will be a .3 ft. increase in 100-year water surface elevation near the midpoint of the rock wall section. Town of Vail has revised the proposed design for the streambank stabilization at Stephen's Park. The initial proposal showed the construction of a 4' to 6' high boulder wall far a length of 105', with one boulder `jetty' approximately 50' upstream of the boulder wall. A revised design, provided by Peak Land Consultants, proposes a 30' boulder wall with tlvee boulder `jetties' approximately 35', 80', and 130' upstream of the boulder wall. The newly proposed design will help mitigate further erosion along the southern streambank of Gore Creek just east of the Stephen's Park Pedestrian Bridge. The 30' boulder wall will eliminate additional undermining of the existing SS' Colorado spruce tree. The three boulder `jetties' will help control erosion of the streambanks upstream from the spruce tree. The Town of Vail has obtained the services of Rick Herwehe, a certified arborist, to determine the health of the tree, approximate lifespan, and determine possible construction impacts. As per his letter dated ]0110/2001, Mr. Herwehe has determined that the tree is in good health and may have up to half of its 300 year lifespan left. ivlr_ Herwehe has alsa determined that there should be minimal impacts to the tree as long as precautionary measures are taken to protect and prune the tree. The Town of Vail has requested his services to correctly prune and care for the tree during construction, The Town of Vail has also had Peak Land Consultants run a HEC-1ZAS hydraulic model of Gore Greek to determine any significant 100 year floodplain changes due to this construction. Based on PLC's analysis there will be no significant changes to the 100 year Floadplain base flood elevations and there will be no adverse effects to any adjacent property. The construction of the 30' wail and the three boulder jetties will help mitigate further erosion to the streambank. This minimal streambank protection will stabilize and protect the soils beneath the large spruce tree, which will in turn prevent the tree from falling into the creek which would accelerate the erosion process. This will help prevent property damage to the pedestrian bridge located 100' downstream. The boulder `jetties' will help control the erosion along the streambank upstream of the boulder wall. The `jetties' have been placed in locations to maximize their protective benefits based on high water currents. T`he unprotected areas will be monitored to ensure that significant erosion does not create scour holes that may in turn erode the soils from behind the boulder `jetties' and the 30' boulder wall. The Town of Vai[ has received appraval from the Army Corps of Engineers under a nationwide it 13 permit and the approval of the Division of Wildlife to complete this project by November 15'h 2001. R.ECYGLED PAPER The Town of Vail has also received bids to complete this work that are within budget and include all necessary construction, erosion control BMF''s, revegitation of all disturbed areas, and the removal of the two concrete blocks that are in the middle of the creek. The construction will. minimally impact Gore Creek and the surrounding environment. There will be no disturbance to existing wetland areas, as delineated by Montane Environmental, and al] construction equipment will be limited to the use of the existing gravel path and a temporaryr access point along the streambanks. RE: STEPHENS PARK - STREAMBANK STABILIZATIGN DISCUSSION OF REDUCED STREAMI3ANI{ STAlIIILIZATION At your request we have reduced the length of the 6' high boulder wall from 90 feet to 30 feet and added 2 additional "boulder stacks" upstream of the boulder wall. The upstream "additional" boulder stack was placed to mitigate streambank erosion based on the direction of flow of the stream when the water level is 4' above the low water line. The other "additional" boulder stack was placed mid-way between the upstream "additional" boulder stack and the upstream end of the 3Q foot boulder wall. Distances measured along the bottom of the bank from the 3' diameter spruce tree to each "additional" boulder stack are as follows: 125' to the upstream end of the first additional boulder stack; 78' to the upstream end of the "middle" additional boulder stack. With the boulder stacks being approximately 4' long along the bottom, placement will result in approximately 38' of unstabilized bank between each of the boulder stacks. The resulting area of streambank stabilization will be significantly less than the original 105'. The proposed 3+J' boulder wall at the spruce tree should be adequate to minimize "undermining" of the root system adjacent to and 30' upstream of the tree. The "additional" boulder stacks will only stabilize the bank area that they cover and may cause scour holes behind the stacks.
