Lionshead Cr. /Lionshead Filing 4. Applicant: Beigway Holdings, Ltd. Planner: Allison Ochs DESCRIP71(7N OE THE REC~UEST 13egeway Holdings Limited, owners of the West Lionshead Plaza Buildin4 (formerly Concert Hall Plaza), is requesting a variance to allow a second building identification sign at the west end of the building. Section 11-413-3~D~ of the Town of Vail Sign Regulations allows a maximum of one building identification sign per building. Specifically, the Sign Regulations state the following with regards to building identification signs: 1 l -46-3; BUILDING lDENT1FICATIDN S1GNS: A. Purpose: To identify the Warne of a building. B. Size; No greater than twenty (2C1) square feet, C. Height: 1. Wall-Mounted: No part of the sign shah extend above twenty five feet (25') from existing grade ar the plate line of a building, whichever is less. 2. Freestanding; No part of the sign shall extend above eight feet (S1 from existing grade. D. Number: One sign. E. Location: Either wall-mounted ar freestanding, subject to design review. F. Design: Subject to design review. G. Special Provisions; 1. Freestanding: A freestanding building identifieatian sign shall be governed by fhe provisions in this Article for freestanding signs for single-business use. 2. Wall-Mounted: Awall-mounted building identification sign shall be governed by the provisions in this Article for wall signs for single- business use. This application involves the placement of two 6,24 square foot wall-mounted signs an the east and west facades. of the building. REVIEWING BOARD ROLES The Planning and Environmental Commission is responsible for evaluating a proposal for: 1. The relationship of the requested variance to ether existing or potential uses and structures in the vicinity. ~. The degree to which relief from the strict or literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity, or to attain the objectives of this Title without grant of special privilege. 3. The effect of the requested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety. 4. Such other factors and criteria as the Commission deems applicable to the proposed variance. Design Review Board: Action: The Design Review Board has no review authority on a variance, but must review any accompanying Design Review Board application. The Design Review Board is responsible for evaluating the Design Review Board proposal for: • Architectural compatibility with other structures, the land and surroundings • Fitting buildings into landscape • Configuration of building and grading of a site which respects the topography • RemovaVPreservation of trees and native vegetation • Adequate provision for snow storage on-site • Acceptability of building materials and colors + Acceptability of roof elements, eaves, overhangs, and other building forms « Provision of landscape and drainage • Provision of fencing, walls, and accessory structures • Circulation and access to a site including parking, and site distances • Location and design of satellite dishes Provision of outdoor lighting III. STAFF RECOMMENDATION Upon review of the criteria outlined in Section IV of this memorandum, the Community Development Department staff recommends denial of the variance request to allow for a second building identification sign, located at 616 West Lionshead Gr., based upon the following findings}: That special circumstances or conditions do not apply to the land, building, topography, vegetation, sign structures or other matters on adjacent lots or within the right-of-way, which would substantially restrict the effectiveness of the sign. 2. The variance applied for departs from the provisions of the Vail Town Gode more than is required to identify the applicant's business use. 2 IV. CRITEFt1A FOR EVALUATION -SIGN VARIANCE A. Consideration of fiactars: 1. Special Circumstances Exist: There are special circumstances or conditions applying to the land, buildings, tapography, vegetation, sign structures or ether matters on adjacent tats or within the adjacent right-of-way, which would substantially restrict the effectiveness of the sign in question, provided, however, that such special circumstances yr"conditions are unique to the particular business or enterprise to which the applicant desires tv draw attention, and do net apply generally to all businesses ar enterprises. The applicant states that the signage at the west entrance would draw m~rre people to the Tawn center, which would be advantageous to local and tourist traffic. Staff does not believe there are any special, unique circumstances an this site that warrant a deviation in the application of the Town's Sign Regulations. The building is not constrained by vegetation, blocked by other structures, nor are there any special circumstances, which would warrant a variance of this nature. There are many buildings in the Town which have multiple frontages, but are allowed only one building identification sign by the Town regulations, The applicant has stated that an additional building identification sign would draw people into the Town. Staff does not believe that this is justification for a sign variance. Staff also believes that there are other opportunities that would be beneficial for the entire building. Specifically, two joint directories would be allowed (one at each entrance to the building) and staff believes that this would be just as effective far signage and would be within the sign regulations of the Town. 2. Applicant Not Responsible: That such special circumstances were not created by the applicant or anyone iin privy to the applicant. Staff does not believe there are any specia9, unique circumstances on this site that warrant a deviation in the application of the Town's Sign Regulations. 3. Narmanv Maintained: That granting of the variance will be in general harmony . with the purpose of the sign code, and will not be materially detrimental to the persons residing ar working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. Similar variances have been approved in the past for building identification signs on large condominium or hotel projects. It is important to note, however, that a variance approved for the Landmark Building in 1989 (to allow for three building identification signs) involved a staff error in the interpretation of the sign code In 1987, the Planning and Environmental Commission approved a similar variance for the Evergreen Lodge (formerly the Doubletree Hotels upon finding that the location of a large retaining wall restricted the exposure of one identification sign to passersby" Therefore, the "special circumstances" criterion had been addressed to • the satisfaction of the Planning and Environmental Commission. With regard to a Chateau at Vail sign variance in 1986, the Planning and Environmental Commission found the location of the Alpine Standard gas station blocked the visibility of the guest entrance to the hotel and that an additional sign was warranted along South Frontage Road. Therefore, the "special circumstances'° criterion was also addressed in this situation. The Planning and Environmental Commission approved a similar variance for the Westwind Condominiums in March of 2aCt1. Staff recommended denial of the variance. However, the Planning and Environmental Commission approved the variance, stating that large trees made the building difficult to locate. Staff does not believe an approval of this variance request would be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. 4. In Line With Provisions: The variance applied for does not depart from the provisions of this Title any more than is required to identify the applicant's business or use. According to the Lionshead Redevelopment Master Plan; 6. f .5. l Signage Creativity is encouraged in individual retail business signage. Ordinary stack or prefabricated signage should be avoided in favor of custom designed and fabricated artisan signage. Consistent directional and identity signage instaAed by the Town of Vail is recommended at all intersections, portals, and gateways in the retail environment and at all pedestrian points of entry to the core. Pedestrian directional signage should be attractive and understated, visually accessible and clear. Staff believes that there are better alternatives for signage (i.e. joint directories) which would be more pedestrian in scale and better serve to meet the intent of the Lionshead Redevelopment Master Plan. 5, wither Factors: Such other factors and criteria as the Planning and Environmental C©mmission deems applicable to the proposed variance. B. The Planning and Environmental Commission shall make the following findings before granting a variance: That special circumstances or conditions apply to the land, building, typography, vegetation, sign structures or other matters on adjacent lots or within the right-of-way, which would substantially restrict the effectiveness of the sign. • 4 2. That such special circumstances were not created by the applicant_ 3. That granting the variance will be in general harmony with the purpose of this title and wilt not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. 4. West Lionshead Plaza. We had a conversation with Mike Rose, Director of Transportation, who informed us in early August that the Town was to change the bus stop name fi ~A~, Concert Hall Plaza to Lionshead West. This prompted us to change the name of the building so there would be some correlation between the bus stop and building to help tourists and locals with their orientation of the Lionshead village, Our building is the western portal to Lionshead. We have subnvtted an application for signage on the east entrance (visible from the village, please see attached pictures) but feel signage at the west entrance (see attached pictures) would draw more people to the town center. Hence dual signage would be a significant advantage to local and tourist traffic. We eagerly await you response. After reconvening, Allison Cchs presented an overview of the staff memorandum. The applicant gave a brief history of the Concert Hall Plaza, now West Lionshead Plaza. The applicant discussed their future plans for redevelopment of the property and stated that the redevelopment of the building has been put on hold. Erickson Shirley asked if the Town has an easement through the property. Katrina Banks clarified the Town's maintenance of the property. Doug Cahill stated that everyone is in agreement that there needs to be additional directional signage into Lionshead. He stated that he believes that are other options not requiring a variance: which would be more acceptable. Diane Golden stated that she believes that special circumstances da exist at this site, regarding the alignment of the building. She stated that she would vote in favor of the variance. She further stated that a joint directory would be beneficial. Erickson Shirley stated that he believes that there are special circumstances, as this is a main public access into Lionshead. Chas Bernhart stated that he believes that there are special circums#ances. He further asked about sign considerations with the Montenaros. Chas Bernhardt stated that he supported the variance.
