RachelFriedeansweredthatthelotonthesouthsideofthehighwayismorethan500feetfrom theothertwolots,whilethetwolotsnexttotheWestVailNorthroundaboutcouldpotentially havebusinesseswithin500feetofeachother. CommissionerKurzaskedifthelicensingregulationswereboilerplateandhadbeentestedfor accuracy.TownAttorneyMattMirestatedthatthelicensingrequirementshadbeentestedby thecourtsystem.HefurtheraskedifthisregulationchangeresultedinadefactobanonSOBs asthepropertiesarecurrentlygasstationsandhighlyutilized. MattMire,TownAttorney,statedthatthecourtshaverequiredthatatleastonelotexistthat meetsthecriteria,butthatthislotdoesnotnecessarilyhavetobevacantforimmediateuse. RachelFriedeexplainedthatbecauseofexistingconditionswithintheTown,itwasdifficultto regulatethedistancebetweenSOBsandresidentialuses,becauseevenashortdistancecould precludeanyofthelotsfrombeingavailableforSOBs. CommissionerRobinson-Paladinoaskedifthe500footdistancecouldbeincreased.
