I. SUMMARY
The applicant, Vail Recreation District, is requesting a conditional use permit to allow for
the construction of a lightning shelter at the Vail Golf Course. Based upon Staff's
review of the criteria outlined in Section VII of this memorandum and the evidence and
testimony presented, the Community Development Department recommends approval,
with a condition, of this application subject to the findings noted in Section VIII of this

II. DESCRIPTION OF REQUEST
The applicant, Vail Recreation District, is proposing to construct a lightning shelter near
the Hole 3 tee of the Vail Golf Course. The proposed lightning shelter is located within
the Outdoor Recreation District. The proposed lightning shelter is a one -story structure
to match a similar shelter under construction near Holes 11 and 17. The structure
consists of a 15 foot by 15 foot sloping roof supported by five 8 inch timber columns.
The roof will be constructed with exposed timber rafters, gray synthetic slate roofing
tiles, and copper flashing. A bench will be constructed around the center supporting
column. There are no exterior walls associated with the proposed lightning shelter. The
architecture of the proposed lightning shelter is intended to be aesthetically compatible
with the pump house and storage facilities recently constructed at the golf course.
A vicinity map (Attachment A), the applicant's request (Attachment B), architectural
plans (Attachment C) have been attached for review.
III. BACKGROUND
In 2008, the Vail Recreation District installed a lighting detection system at the Vail Golf
Course for the safety of their patrons and staff. The system was designed to alert
golfers to the presence of lighting near the course, but did not provide shelter for golfers
during inclement weather. As part of their current golf course master planning process
with consultant Atkinson /Phelps Golf Course Architects, the Vail Recreation District has
identified the need for new lightning shelters in several remote locations of the golf
course.
On July 21, 2010 the Design Review Board conceptually reviewed the proposed
lightning shelters at the Vail Golf Course.
On September 13, 2010 the Planning and Environmental Commission approved a
conditional use permit to allow for the construction of a similar lightning shelter at Holes
11 and 17 of the Vail Golf Course. Due to an error in the published hearing notice, a
discussion of a proposed lightning shelter at Hole 3 was rescheduled and re- noticed for
the Commission's September 27, 2010 hearing.
On September 15, 2010 the Design Review Board approved the subject lightning
shelter with design modifications. The Design Review Board also applied the condition
that their approval was contingent upon the applicant obtaining a conditional use permit
for the lightning shelter.
On September 27, 2010 the Planning and Environmental Commission approved a
conditional use permit for a new lightning shelter near the Hole 3 green at the Vail Golf
Course. Adjacent property owners George Johnson (1195 Hornsilver Circle) and
William McIntyre (1191 Hornsilver Circle) voiced opposition to the proposed location of
the new lightning shelter.
On October 6, 2010 Staff approved a Change to Approved Plans design review
application to allow for the removal of the interior walls of the golf course lightning
shelters. The applicant, Scott O'Connell, Vail Recreation District, testified that the
changes were a response to recommendations from the Design Review Board, input
from adjacent property owners, and a desire to reduce the construction costs
associated with the shelters.
On October 13, 2010 adjacent property owner's Johnson and McIntyre filed an appeal
of the Planning and Environmental Commission's September 27, 2010 conditional use
permit approval.
November 2, 2010 the Vail Town Council held a public hearing on the appeal of the
Planning and Environmental Commission's September 27 decision. The Vail Town
Council granted a continuance of the appeal (tabled) to future hearing dates to provide

the Vail Recreation District and the adjacent property owners an opportunity to explore
alternative locations for the proposed Hole 3 lightning shelter.
The Vail Recreation District and adjacent property owners Johnson and McIntyre have
come to agreement on the currently proposed location of the new lightning shelter near
the Hole 3 tee. The adjacent property owners have withdrawn their appeal.
IV. APPLICABLE PLANNING DOCUMENTS

ARTICLE 12 -813: OUTDOOR RECREATION DISTICT
Section 12 -8B -1: Purpose:
The outdoor recreation district is intended to preserve undeveloped or open space lands
from intensive development while permitting outdoor recreational activities that provide
opportunities for active and passive recreation areas, facilities and uses.
Section 12 -8B -3: Conditional Uses: (in part)
The following conditional uses shall be permitted, subject to issuance of a conditional
use permit in accordance with the provisions of Chapter 16 of this title:
Accessory buildings (permanent and temporary) and uses customarily incidental and
accessory to permitted or conditional outdoor recreational uses, and necessary for the
operation thereof, including restrooms, drinking fountains, bleachers, concessions,
storage buildings, and similar uses.
CHAPTER 12 -16: CONDITIONAL USES PERMITS (in part)
Section 12 -16 -1: Purpose, Limitations:
In order to provide the flexibility necessary to achieve the objectives of this title,
specified uses are permitted in certain districts subject to the granting of a conditional
use permit. Because of their unusual or special characteristics, conditional uses require
review so that they may be located properly with respect to the purposes of this title and
with respect to their effects on surrounding properties. The review process prescribed
in this chapter is intended to assure compatibility and harmonious development
between conditional uses and surrounding properties in the Town at large. Uses listed
as conditional uses in the various districts may be permitted subject to such conditions
and limitations as the Town may prescribe to insure that the location and operation of
the conditional uses will be in accordance with the development objectives of the Town
and will not be detrimental to other uses or properties. Where conditions cannot be
devised, to achieve these objectives, applications for conditional use permits shall be
denied.

VII. CONDITIONAL USE PERMIT REVIEW CRITERIA
Before acting on a conditional use permit application, the Planning and Environmental
Commission shall consider the following factors with respect to the proposed use:
1. Relationship and impact of the use on the development objectives of the Town.
The Vail Golf Course is an allowed land use in the Outdoor Recreation District. Staff
believes the proposed lightning shelter is a safety feature necessary for the operation of
this public golf course. The proposed lightning shelter is intended to provide temporary
refuge for golf course patrons during periods of inclement weather.
2. The effect of the use on light and air, distribution of population, transportation
facilities, utilities, schools, parks and recreation facilities, and other public
facilities needs.
Staff believes the proposed lightning shelter is necessary for the safe operation of the
Vail Golf Course recreation /public facilities.
The proposed shelter is one story in height and does not have enclosing walls. This
design is intended to minimize the appearance of building bulk and mass and to
minimize impacts to light and air. The applicant is proposing to construct the proposed
lighting shelter in a location they believe will provide emergency golfer access with the
least visual impact to adjacent property owners.

There are no utilities such as water, sewer, electrical, or mechanical associated with the
proposed lightning shelter.
The proposed lightning shelter is only intended as a temporary refuge from inclement
weather. Staff does not believe the proposed shelter will negatively affect the
distribution of populations, transportation facilities, schools, or park facilities.
3. Effect upon traffic with particular reference to congestion, automotive and
pedestrian safety and convenience, traffic flow and control, access,
maneuverability, and removal of snow from the street and parking areas.
The proposed lightning shelter is located on the golf course and is only intended to be
accessed by golf course patrons from the course. The proposed lighting shelter is not
designed to be accessed from a public street, bike trail, or sidewalk. Staff does not
believe the proposed lightning shelter negatively affects the traffic concerns identified by
the criterion.
4. Effect upon the character of the area in which the proposed use is to be
located, including the scale and bulk of the proposed use in relation to
surrounding uses.
The proposed lightning shelter does not have enclosing walls. This design is intended
to minimize the appearance of building bulk and mass. The applicant is proposing to
construct the proposed lighting shelter in a location they believe will provide emergency
golfer access with the least visual impact to adjacent property owners. The Town of
Vail Design Review Board has previously approved a matching shelter near holes 11
and 17.
VIII. RECOMMENDATION
The Community Development Department recommends the Planning an Environmental
Commission approves this conditional use permit with a condition for the construction
of a lightning shelter generally located at the #3 tee of the Vail Golf Course /Tract A, Vail
Village Filing 8, and setting forth details in regard thereto. This recommendation is
based upon the review of the criteria outlined in Section VII of this memorandum and
the evidence and testimony presented.
Should the Planning and Environmental Commission choose to approve this conditional
use permit request, the Community Development Department recommends the
Commission passes the following motion:
"The Planning and Environmental Commission approves this request for a
conditional use permit, pursuant to Section 12 -88 -3, Conditional Uses, Vail Town
Code, for an "accessory building and uses customarily incidental and accessory
to permitted or conditional outdoor recreational uses, and necessary for the
operation thereof, including restrooms, drinking fountains, bleachers, concession,
storage buildings, and similar uses" to allow for the construction of a lightning

shelter generally located at the #3 tee of the Vail Golf Course /Tract A, Vail
Village Filing 8, and setting forth details in regard thereto. "
Should the Planning and Environmental Commission choose to approve this conditional
use permit request, the Community Development Department recommends the
Commission passes the following condition:
"1. This conditional use permit approval is contingent upon the applicant
obtaining Town of Vail design review and building permit approvals for this
proposal. "
Should the Planning and Environmental Commission choose to approve this conditional
use permit request, the Community Development Department recommends the
Commission makes the following findings:
'Based upon the review of the criteria outlined in Section Vll of the Staff
memorandum to the Planning and Environmental Commission dated May 9,
2011, and the evidence and testimony presented, the Planning and
Environmental Commission finds:
1. The proposed conditional use permit is in accordance with the purposes of the
Zoning Regulations and the Outdoor Recreation District.
2. The proposed conditional use permit and the conditions under which it will be
operated or maintained are not detrimental to the public health, safety, or welfare
or materially injurious to properties or improvements in the vicinity.
3. The proposed conditional use permit complies with each of the applicable
provisions of Chapter 12 -16, Conditional Use Permit, Vail Town Code."

RE: Vail Golf Course #3 lightning Shelter
The Vail Recreation District (VRD) is currently working on plans to construct a lightning shelter on the Vail golf
course located in proximity to the #3 Tee complexes.
Background:
The Vail Golf Course is owned by the Town of Vail (TOV) and leased to the Vail Recreation District (VRD) to operate.
The VRD installed a lightning detection system in 2008 to alert guests on the course to lightning in the area. It was
determined that although we have a sophisticated system for detection we do not provide adequate shelter for
those guests located in remote areas of the course. We recently went through the DR8 and PEC process and were
granted auth042ation to construct a shelter neat the #11 golf hole. We had originally requested permission for 2
shelters however our request for the shelter on the #3 hale required additional consultation with the home
owners in that location and was removed from the original application. We have since resolved the challenges
with the original proposal and are now prepared with the consent of the home owners to pursue the construction
of the #3 weather shelter in the new proposed location.
Purpose:
The purpose of this project is to provide safe shelters for guests in remote areas on the Vail Golf Course during
lighting storms.
Details:
This project will involve the excavation, installation of a Rosetta Stone retaining wall, foundation installation,
framing and finishing of 1 weather shelter identical to the one constructed on the #11 golf hole. The proposed
locations for this shelter is to the east of the #3 tee complex and North of the 43 cart path. The proposed
structures would have a 15' X 15' foot print and be designed with the same Bavarian theme utilized at the Val Golf
Course pump house and storage facilities and identical to the weather shelter on #11. They would be "open" on all
4 {four) sides and would not have any utilities. We would consider these structures "simple but tasteful ".

SUBJECT: A request for the review of variances from Title 11, Sign Regulations, Vail Town
Code, pursuant to Chapter 11 -10, Variances, Vail Town Code, to allow for the
installation of new signs at the medical center, located at 181 West Meadow
Drive/ Lots E & F, Vail Village Filing 2, and setting forth details in regard thereto.

SUMMARY
The applicant, Vail Valley Medical Center, is requesting a variance to allow for two
traffic control signs larger than 4 square feet in area. Based upon Staff's review of the
criteria outlined in Section VII of this memorandum and the evidence and testimony
presented, the Community Development Department recommends approval, with a
condition, of this application subject to the findings noted in Section VIII of this
memorandum.
II. DESCRIPTION OF REQUEST
The applicant, Vail Valley Medical Center, represented by James Brown of Take Form
Architectural Graphics, is proposing to install new exterior signage for the Vail Valley
Medical Center. The applicant is proposing several new signs including a street sign
with the universal blue and white "H" symbol along West Meadow Drive, a building
identification monument sign at the driveway entrance, two on -site traffic control signs,
multiple no parking and loading /unloading zone signs, multiple emergency visitor
parking signs, an ambulance building identification sign, and an emergency room
entrance sign.
The two proposed traffic control signs are the subject of this variance request. Pursuant
to Section 11 -7 -7, Traffic Control Signs for Private Property, Vail Town Code, the size of
each traffic control sign is limited to 4 square feet in area. The applicant is requesting a
variance to allow both proposed traffic control signs to exceed the 4 square foot in area.
The applicant is proposing to replace the existing traffic control sign at the main
entrance of the medical center building. The Vail Valley Medical Center has moved its
emergency entrance from the north side of the building adjacent to the ambulance bays
to the medical center building's main west entrance during regular business hours. The
proposed traffic control sign addresses this change to the location of the emergency
entrance. The proposed main entrance traffic control sign will be located in the same
existing elevated landscaping planter at the base of the entry porte cochere as an
existing traffic control sign. The applicant is requesting that the new main entrance
traffic control sign (identified as sign "Type B" on the attached plans) be 6 square feet in
area. The applicant believes 6 square feet is the minimum sign size necessary to safely
and effectively direct vehicular and pedestrian traffic at this location.
In addition to the proposed main entrance traffic control sign, the applicant is also
proposing to install a new traffic control sign to direct patients to the after hours
emergency entrance and emergency visitor's parking spaces located on the north side
of the building adjacent to the ambulance bays. This new traffic control sign is
proposed to be installed in the existing at -grade landscaping area at the northwest
corner of the medical center building behind the main entry porte cochere. The applicant
is requesting that this new after hours entrance traffic control sign (identified as sign
"Type F" on the attached plans) be allowed to be 8.75 square feet in area. The
applicant believes 8.75 square feet is the minimum sign size necessary to safely and
effectively direct vehicular and pedestrian traffic at this location.
Pursuant to Section 11 -10 -1, Variances, Vail Town Code, a request for a variance from
the prescribed standards of the Town's adopted sign regulations (e.g. traffic control
signs larger than 4 square feet in area) shall be reviewed by the Planning and
Environmental Commission.
The colors, materials, location, lighting, landscaping, design, and general aesthetics of
the proposed traffic control signs are being reviewed by the Town of Vail Design Review
Board with the associated design review application.
A vicinity map (Attachment A) and the applicant's request (Attachment B) have been
attached for review.
III. BACKGROUND
The design review application associated with this variance request was conceptually
reviewed by the Town of Vail Design Review Board at its May 4, 2011 public hearing
and has tentatively been scheduled for a final review at the Board's May 18 public
hearing.
IV. APPLICABLE PLANNING DOCUMENTS
Staff believes that the following provisions of the Vail Town Code are relevant to the
review of this proposal:

TITLE 11: SIGN REGULATIONS (in part)
11 -1: DESCRIPTION, PURPOSE, AND APPLICABILITY (in part)
11 -1 -2: Purpose:
A. General Purpose: These regulations are enacted for the purpose of promoting
the health, safety, morals, and general welfare of the Town of Vail and to
promote the coordinated and harmonious design and placement of signs in the
town in a manner that will conserve and enhance its natural environment and its
established character as a resort and residential community of the highest
quality.
B. Specific Purpose: These regulations are intended to achieve the following
specific purposes:
1. To describe and enable the fair and consistent enforcement of signs in the
town of Vail.
2. To encourage the establishment of well designed, creative signs that enhance
the unique character of Vail's village atmosphere.
3. To preserve a successful and high quality business environment that is aided
by signs that identify, direct, and inform.
4. To aid in providing for the growth of an orderly, safe, beautiful, and viable
community.
11 -2 -1: DEFINITIONS (in part)
TRAFFIC CONTROL SIGN (For Private Property): A sign permitted by the town
of Vail to identify private parking areas and to direct the flow of traffic on private
property-
11-7-7 TRAFFIC CONTROL SIGNS FOR PRIVATE PROPERTY
A. Description: A traffic control sign shall be placed in order to relieve vehicular
and pedestrian traffic congestion and promote the safe and expedient flow and
parking of traffic on private property.
1. Size: All vehicular traffic control signs shall not exceed one square foot except
for multipurpose signs which shall not exceed four (4) square feet and except for
private parking signs which shall not exceed two (2) square feet. All pedestrian
traffic control signs shall not exceed one square foot, except multipurpose signs,
which shall not exceed four (4) square feet, subject to design review.

2. Height: No part of the sign shall extend above six feet (6) from existing grade.
3. Number: Subject to design review.
4. Location: Location shall be subject to design review, with approval from the
town engineer for any sign placed adjacent to a public street or way.
5. Design: Subject to design review.
6. Lighting: Subject to design review.
7. Landscaping: Subject to design review.
8. Special Provisions:
a. May be either freestanding or wall mounted, with same size requirements.
b. No sign shall contain any advertising, but may identify the owner by name.
11 -10: VARIANCES AND APPEALS (in part)
11 -10 -1: Variances
A. Purpose: A variance from the sign regulations constitutes relief from the strict
interpretation of the standards and may be granted by the Planning and
Environmental Commission (PEC) in cases where there exists a physical
limitation that prevents the existence, placement, or operation of a sign in
compliance with the standards of this title.

VII. REVIEW CRITERIA
The review criteria for a request of this nature are established by Section 11 -10 -1,
Variances, Vail Town Code.
1. Special circumstances or conditions must exist that apply to the land,
buildings, topography, vegetation, sign structures, or other matters on adjacent
lots or within the adjacent right of way, that would substantially restrict the
effectiveness of the sign in question. However, such circumstances must be
unique to the subject site.
The Vail Valley Medical Center is a unique land use within the Town of Vail. There is
generally a higher volume of year -round daily traffic to and from the medical center than
other businesses in Vail. This traffic includes ambulances and patient vehicles involved
in emergency situations. Since the main entrance and the emergency entrances to the
medical center building are not located along, or visible from, the public street; Staff
believes traffic control signs are critical for traffic to safely and efficiently navigate the
medical center site.
In addition to the number of medical center elements needing direction and their
importance, Staff believes the locations and configurations of the existing medical
center building, the medical center emergency entrances, the existing parking lot, and
the existing landscaping planter areas; collectively create the circumstances necessary
to allow two traffic controls signs larger than 4 square feet in area to effectively direct
traffic through this site. Therefore, Staff believes the applicant is requesting a sign area
variance that is consistent with this review criterion.
2. The applicant shall not have created the circumstances that have necessitated
the variance request.
Staff does not believe the relocation of the emergency entrance during business hours
from the north side of the medical center to the west main building entrance necessarily
creates the circumstances necessary for this variance request. Instead, Staff believes
the number of medical center elements needing direction, the importance of the medical
center elements needing direction, plus the locations and configurations of the existing
medical center building, the medical center emergency entrances, the existing parking
lot, and the existing landscaping planter areas, all create the circumstances necessary
to allow two traffic controls signs larger than 4 square feet in area. Therefore, Staff
believes the applicant is requesting a sign area variance that is consistent with this
review criterion.
3. The applicant must demonstrate that the granting of the variance will be in
general harmony with the purposes of this title.
Staff believes the applicant is proposing traffic control signs of an appropriate size to
safely and efficiently direct traffic through the medical center site. Staff believes this

variance request is consistent with the general purposes of the Town's sign regulations
and the specific description of the traffic control signs identified below. Therefore, Staff
believes this variance request meets this criterion.
Pursuant to Section 11- 1 -2 -13: Specific Purpose, Vail Town Code, purposes of the
Town's sign regulations are:
"I. To describe and enable the fair and consistent enforcement of signs in the
Town of Vail.
2. To encourage the establishment of well designed, creative signs that enhance
the unique character of Vail's village atmosphere.
3. To preserve a successful and high quality business environment that is aided
by signs that identify, direct, and inform.
4. To aid in providing for the growth of an orderly, safe, beautiful, and viable
community."
Pursuant to Section 11- 7 -7 -A, Description, Vail Town Code, Traffic Control Signs are
described as follows:
"A traffic control sign shall be placed in order to relieve vehicular and pedestrian
traffic congestion and promote the safe and expedient flow and parking of traffic
on private property."
VIII. RECOMMENDATION
The Community Development Department recommends approval, with conditions, of
the applicant's review of a variances from Title 11, Sign Regulations, Vail Town Code,
pursuant to Chapter 11 -10, Variances, Vail Town Code, to allow for the installation of
new signs at the medical center, located at 181 West Meadow Drive/ Lots E & F, Vail
Village Filing 2, and setting forth details in regard thereto. This recommendation is
based upon the review of the criteria outlined in Section VII of this memorandum and
the evidence and testimony presented.
Should the Planning and Environmental Commission choose to approve this variance
request with a condition, the Community Development Department recommends the
Commission pass the following motion:
"The Planning and Environmental Commission approves, with conditions, the
request for a variances from Title 11, Sign Regulations, Vail Town Code,
pursuant to Chapter 1140, Variances, Vail Town Code, to allow for the
installation of new signs at the medical center, located at 181 West Meadow
Drive/ Lots E & F, Vail Village Filing 2, and setting forth details in regard thereto."
Should the Planning and Environmental Commission choose to approve this variance
request, the Community Development Department recommends the Commission pass
the following condition:

"1. This sign variance approval is contingent upon the applicant obtaining Town
of Vail design review approval for this proposal."
Should the Planning and Environmental Commission choose to approve this variance
request with conditions, the Community Development Department recommends the
Commission makes the following findings:
'Based upon a review of Section Vll of the Staff's May 9, 2011 memorandum to
the Planning and Environmental Commission, the site visit, and the evidence and
testimony presented, the Planning and Environmental Commission finds:
1. Special circumstances and conditions, unique to the subject site, exist that
apply to the land, buildings, topography, vegetation, and sign structures that
would substantially restrict the effectiveness of the sign in question.
2. The applicant did not create the circumstances that have necessitated this
variance request.
3. The applicant has demonstrated that granting of this variance is in general

Rachel Dimond made a presentation per the Staff memorandum.
Matt Mire, Town Attorney, further explained the proposed regulation amendments and was available for
questions.
Commissioner Pierce clarified which zone districts already include similar enabling regulations today.
Commissioner Kurz clarified that the proposed language allows the Town to impose a fee, but does not
require the Town to impose fees. He is concerned not only about costs to the Town, but also costs being
prohibitive to developers. He does not believe public art is generally a local government concern, but it
may be a legitimate concern on large scale projects.
Matt Mire noted that the Town only has studies addressing fees for housing, transportation, and fire. For
the town to impose a fee in the future for other impacts, the Town would need to produce additional
studies.
Commissioner Kurz noted that fees such as traffic are quantitative, but he is concerned about qualitative
issues such as public art or impacts to schools.
Matt Mire reiterated that these amendments still only allow fees for housing, transportation, and fire, unless
new studies are done.
Commissioner Rediker noted that he does not believe a definition of infrastructure or a list of infrastructure
types of impacts needs to be defined in the proposed ordinance.
Commissioner Pratt asked what property taxes are used for in the Town of Vail. He asked if increased
property taxes from redevelopment mitigated impacts such as fire.
Commissioner Pratt asked if some zone districts should be exempt from future exactions. He also noted
that there is no exemption for redevelopment built within the standards of the existing zone districts.

Rachel Dimond noted that this regulation would then only be applicable to special development districts.
Commissioner Pratt noted that the Town granted additional density with one hand, but took away rights
with the other hand.
Commissioner Pierce agreed with Commissioner Pratt's points about redevelopment.
Matt Mire noted that a primary intent of the proposed text protects the Commissioners and Council
Members to work within the scope of their office.
Commissioner Cartin noted concern about granting authority to apply exactions to all districts.
Commissioner Kurz recommended residential districts be exempt.
Rachel Dimond clarified that the proposed text grants authority, but does require exactions to be imposed.
Commissioner Hopkins asked about impacts from residential development on wetlands, steep lots, or
projects that heat their driveways. She also asked about impacts to water quality.
Commissioner Pratt noted concern about allowing the Council or PEC the authority to establish future
impact fees. He is concerned about developers being required to pay for the studies associated with
exactions.
Commissioner Rediker asked for clarification about the timing of exaction studies.

specifically addressed the Town's need and ability to use funds and supported a pay -in -lieu option. He
noted that units currently owned by locals will continue to be purchased by second home owners in years
to come. The Authority recommends keeping the process as simple as possible for the owner to
understand and for the Town to administer. If an EHU is only occupied on paper, there is no need to have
the restrictions.
Galen Aasland, homeowner, requested that the Commission modifies the memorandum to reflect the
difference between his deed restricted unit and other EHUs.
Commissioner Rediker asked for clarification about the changes from the last public hearing. He asked
why the staff does not support an EHU bank for these units.

Commissioner Pierce clarified which zone districts already include similar enabling regulations today.
Commissioner Kurz clarified that the proposed language allows the Town to impose a fee, but does not
require the Town to impose fees. He is concerned not only about costs to the Town, but also costs being
prohibitive to developers. He does not believe public art is generally a local government concern, but it
may be a legitimate concern on large scale projects.
Matt Mire noted that the Town only has studies addressing fees for housing, transportation, and fire. For
the town to impose a fee in the future for other impacts, the Town would need to produce additional
studies.
Commissioner Kurz noted that fees such as traffic are quantitative, but he is concerned about qualitative
issues such as public art or impacts to schools.
Matt Mire reiterated that these amendments still only allow fees for housing, transportation, and fire, unless
new studies are done.
Commissioner Rediker noted that he does not believe a definition of infrastructure or a list of infrastructure
types of impacts needs to be defined in the proposed ordinance.
Commissioner Pratt asked what property taxes are used for in the Town of Vail. He asked if increased
property taxes from redevelopment mitigated impacts such as fire.
Commissioner Pratt asked if some zone districts should be exempt from future exactions. He also noted
that there is no exemption for redevelopment built within the standards of the existing zone districts.

Rachel Dimond noted that this regulation would then only be applicable to special development districts.
Commissioner Pratt noted that the Town granted additional density with one hand, but took away rights
with the other hand.
Commissioner Pierce agreed with Commissioner Pratt's points about redevelopment.

Members to work within the scope of their office.
