The Commissioners discussed whether or not a site visit was necessary. It was determined that
the photographs in the materials and the familiarity of the Commissioner with the building did not
warrant a site visit.
Commissioner Kurz inquired as to the employee housing mitigation requirement for this project.

Bill Gibson explained the Inclusionary Zoning requirements
Dominic Mauriello, representing the applicant, gave a PowerPoint presentation detailing the
requests. He highlighted the 250 addition, height variance, and major exterior alteration
requests which would allow for the enclosure of an existing deck on the top floor.
Commissioners Bird and Pratt inquired into the applicant's sun/shade analysis.
Dominic Mauriello clarified what was being shown on the plans and which document was from
the 1989 project and which document was for the current proposal.
Commissioner Rediker inquired about the zoning analysis on page 9 of the staff memorandum
and how the 250 and Interior Conversion related to the allowable GRFA.
Bill Gibson clarified the relationship of the GRFA policies.
Commissioner Bird stated that additional detail on the architectural drawings would be helpful in
understanding the proposal.
Dominic Mauriello stated that plans with a higher level of detail will be submitted with the
associated design review application; but if necessary he would bring more detailed drawings to
the Commission's next hearing. He spent some time explaining the design intent of the
proposal.
Commissioner Kurz asked if the proposed addition will match the exterior of the existing building
Dominic Mauriello confirmed that the proposed addition will match the existing building exterior
materials.
Commissioner Pierce stated that in terms of bulk and mass and consistency with the master
plan, the existing building looks terrible and has for some time. He believes the proposed
addition will not enhance the building and will not benefit the town. He further stated that the
proposed addition does not create the desired roof forms and the proposed deck columns are
not appropriate.
There was no public comment.
Commissioner Pratt agreed with Commissioner Pierce's concerns that the proposed addition is
not an improvement to the existing building, but he supports allowing the project to move forward
to the design review process.

Bill Gibson gave a presentation on the approved changes and noted that the Design Review
Board has approved the associated design application. He stated that the Town has not
received any comments from the adjacent property owners who were notified of the change.
The Commissioners discussed the need to see before and after images to fully understand the
proposed changes.
Jim Lamont, Vail Homeowners Association, asked if the change to the restroom location
negatively affected East Betty Ford Way, the road adjacent to the restroom change.
Bill Gibson answered that the restroom change does not change the new alignment of East Betty
Ford Way. He clarified that the proposed change creates additional queuing space between the
new restroom and the east concession stand.
The Commission called up this administrative action and asked to see a more comprehensive
site plan that shows the before and after conditions.

Bill Gibson gave a presentation per the staff memorandum. He highlighted the process followed
to allow for an administrative approval of the amendment to the conditional use permit.
Pedro Campos, Zehren and Associates, representing the applicant, described in detail the
changes to this phase of the Ford Park Amphitheater project. He highlighted the shift of the
restroom building to the north to allow for increased space between the restroom and
concessions stand at the east entry. He added that the shift of the restroom to the north resulted
in more of the restroom building being tucked into the slope.
Commissioner Pierce asked how close the restroom roof would be to grade and would it need a
railing to prevent people from accessing the roof and falling off?
Pedro Campos explained that the roof had a parapet wall and boulders were being used to block
access to the rooftop. He continued by describing changes to the alignment of the steps in the
lawn seating area. Approval had been granted to place three stairs in the redesigned lawn area,
but after further discussion they were reducing the number of stairs back to two. The two sets of
stairs would be aligned with the large support columns that the covered portion of the
amphitheater thus placing the stairs in the previously undesirable seating areas with blocked
stage views.
Commissioner Pierce stated that Commissioner Hopkins, who was not present, raised the issue
of aligning the stairs with the roof support columns during the previous Commission review. He
was glad the design had been revised to address this issue.

Commissioner Bird asked about the existing donor engraved pavers and flagstone at the east
entry to the amphitheater along East Betty Ford Way.
Pedro Campos explained that all the engraved pavers and flagstone were carefully taken up and
put on pallets for temporary storage during construction until they can be re -installed. The Vail
Valley Foundation is considering installing the pavers at the south entry plaza, so they'll be in a
more prominent location.
Commissioner Bird inquired about grade changes at the current east entrance to the
amphitheater.
Pedro Campos described how grades have been manipulated to address the required slopes for
ADA access.
Commissioner Pierce pointed out a concern about the restroom plumbing vent and its close
proximity to the patrons on the lawn seating area.
Pedro Campos stated that the design team has been working with a mechanical engineer to
address and avoid any potential negative impacts caused by the bathroom venting on the
adjacent seated public.

action approving a request for an amendment to an existing conditional use

plans for the new east restroom building at the Gerald R. Ford Amphitheater,
located at 540 South Frontage Road East (Ford Park)/Unplatted, and setting

I. SUMMARY
The Town of Vail Staff has administratively approved an amendment to the conditional
use permit for the Ford Park improvement project to allow for changes to the new east
restroom building at the Gerald R. Ford Amphitheater. The restroom building was
administratively approved to be relocated approximately 9-'/2 feet to the northeast of its
originally approved location to create additional space between the new restroom and
the existing east concessions area. This review was completed pursuant to the
development review procedures outlined in Section 12-16-10, Amendment Procedures,
Vail Town Code, and was reported to the Planning and Environmental Commission at
its November 26, 2012, public hearing.
At its November 26, 2012, hearing, the Planning and Environmental Commission
requested that additional architectural plans be provided to clarify the changes to the
amphitheater restroom building location. Attached for review are the previously
approved plans (Attachment A) and the subject administratively approved plans
(Attachment B).
The design review application associated with the amphitheater restroom building
changes was reviewed and approved by the Design Review Board at its October 3,
2012, public hearing.
