CONDITION(S):

Planner Batcheller presented the application per the staff memorandum. Staff walked through
the proposed conditions of approval and the criteria applicable to this review.
Commissioner Cartin asked for clarification related to the moving of the business entrance.
Planner Batcheller spoke to the definition of 1St floor in the Vail Town Code and the origin of this
condition.
Commissioner Cartin spoke to his feelings that moving the door was not necessary to be a 2nd
floor location.
Commissioner Pratt requested clarification regarding the proposed condition #1.

I. SUMMARY
The applicant, Lazier Lionshead LLC, represented by Jay Petersen, is requesting a
conditional use permit for a business office at 500 East Lionshead Circle. Based upon
Staff's review of the criteria outlined in Section VII of this memorandum and the
evidence and testimony presented, the Community Development Department
recommends approval, with conditions, of this application subject to the findings
noted in Section VIII of this memorandum.
II. DESCRIPTION OF REQUEST
The applicant, Lazier Lionshead LLC, is proposing to open a business office on the
second floor of the Lion's Pride Building, located at 500 East Lionshead Circle. The
business will operate as a showroom for the purpose of gauging the market viability for
a potential boutique hotel, which would be located on-site if successful. Exterior
changes to the building would include relocating the entrance farther west and new
signage, which would be part of a separate design review application. A vicinity map
(Attachment A) and the applicant's request (Attachment B) have been attached for
review.
III. BACKGROUND
The Lion's Pride Building was approved for construction in 1974 and completed in 1975.
IV.
It was built to house offices on the upper levels and retail on the lowest level. The
particular space relating to this conditional use permit has been vacant for three
months. Prior to that, it was used as a spa for several years. In 1990, the Lionshead
Trading Company opened in the space. In May of that year, Staff determined that the
space was a second floor location, which effected manner in which sign area was
calculated. Staff's letter dated, May 23, 1990, has been attached for review (Attachment
D), as has a more recent determination in a letter written by the Community
Development Director, George Ruther, dated December 3, 2014 (Attachment C).
APPLICABLE PLANNING DOCUMENTS
Title 12, Zoninq Regulations, Vail Town Code (in part)
12-2-2. DEFINITIONS OF WORDS AND TERMS.-
FIRST
ERMS.
FIRST FLOOR OR STREET LEVEL. For the purposes of implementing horizontal
zoning, first floor or street level shall be any floor, or portion of any floor, of a structure
located at or nearest to (either above or below) the level of the adjacent vehicular or
pedestrian way, as determined by the administrator. More than one floor, or portions of
a floor or floors, may be defined as basement or garden level within a single structure.
For the purposes of determining floor level, the following factors may be
considered. site topography, location of building entrances and facades relative
to the adjacent vehicular or pedestrian ways, interior building layout, proximity to
adjacent vehicular or pedestrian ways and relationships to other floors in the
structure.
ARTICLE 12-7H. LIONSHEAD MIXED USE I (LMUI) DISTRICT
12-7H-1; PURPOSE.
The Lionshead mixed use 1 district is intended to provide sites for a mixture of multiple -
family dwellings, lodges, hotels, fractional fee clubs, timeshares, lodge dwelling units,
restaurants, offices, skier services, and commercial establishments in a clustered,
unified development. Lionshead mixed use 1 district, in accordance with the Lionshead
redevelopment master plan, is intended to ensure adequate light, air, open space and
other amenities appropriate to the permitted types of buildings and uses and to maintain
the desirable qualities of the zone district by establishing appropriate site development
standards. This zone district is meant to encourage and provide incentives for
redevelopment in accordance with the Lionshead redevelopment master plan.

VI. CONDITIONAL USE PERMIT REVIEW CRITERIA
Before acting on a conditional use permit application, the Planning and Environmental
Commission shall consider the following factors with respect to the proposed use:
1. Relationship and impact of the use on the development objectives of the Town.
Business offices are listed as a conditional use in many zone districts within the Town of
Vail. As such, a business person interested in operating an office must first obtain a
conditional use permit from the Town of Vail Planning and Environmental Commission.
According to the Section 12-16-1, Purpose, Limitations, Vail Town Code,
"In order to provide the flexibility necessary to achieve the objectives of this title,
specified uses are permitted in certain districts subject to the granting of a
conditional use permit. Because of their unusual or special characteristics,
conditional uses require review and evaluation so that they may be located
properly with respect to the purposes of this title and with respect to their effects
on surrounding properties. The review process prescribed in this chapter is
intended to assure compatibility and harmonious development between
conditional uses and surrounding properties and the town at large. Uses listed as
conditional uses in the various districts may be permitted subject to such
conditions and limitations as the town may prescribe to ensure that the location
and operation of the conditional uses will be in accordance with development
objectives of the town and will not be detrimental to other uses or properties.
Where conditions cannot be devised to achieve these objectives, applications for
conditional use permits shall be denied. "
Staff believes the proposed use will have a positive impact on the development
objectives of the Town. As suggested by the Town's Zoning Regulations, staff believes
that certain conditions should be placed upon the use, however, in order to assure that
it is compatible and harmonious with surrounding properties and the Town at large.
Staff recommends that the following conditions be placed upon the approval of the
requested condition use permit:
1) The applicant shall not be allowed to display any advertising signs within the
bay windows on the east fagade of the Lion's Pride Building. Said bay
windows may be used for the purpose of displaying art or merchandise for
other businesses located within the Lion's Pride Building.
2) The applicant shall relocate the entrance farther west to the third window
pane from the existing entrance in order to create greater distance from the

platted pedestrian easement to the east and to more clearly distinguish the
space as being on the second level.
3) The applicant shall not use the office space for purpose of real estate
transactions at anytime.
4) Business operations within the office space shall be for the exclusive purpose
of displaying goods and materials related to the redevelopment of the site (Lot
1, Block 1, Vail Lionshead Filing 1).
Any failure to comply with said conditions shall be cause to revoke the conditional use
permit, subject to a finding of non-compliance by the Town of Vail Planning &
Environmental Commission.
2. The effect of the use on light and air, distribution of population, transportation
facilities, utilities, schools, parks and recreation facilities, and other public
facilities needs.
Because the proposal replaces a vacant space with a business office within an existing
building, Staff believes it will not have any effect on light and air, distribution of
population, transportation facilities, utilities, schools, parks and recreation facilities and
other public facilities needs.
3. Effect upon traffic with particular reference to congestion, automotive and
pedestrian safety and convenience, traffic flow and control, access,
maneuverability, and removal of snow from the street and parking areas.
The Lion's Pride Building is located in Lionshead — an area dominated by pedestrians.
In Lionshead, people typically frequent more than one business in the same trip. Some
trips originate from hotels in the area, while others originate outside of Lionshead.
Those arriving to Lionshead by automobile are expected to park in the nearby
Lionshead Parking Structure. This is the typical arrangement for businesses in
Lionshead, which is located within the parking fee -in -lieu district used to off -set on-site
parking needs. For people who work in the Lion's Pride Building, parking is available on-
site and is shared amongst the neighboring properties. There are currently two
dedicated loading and delivery spaces for the Lion's Pride Building. Loading and
delivery is not anticipated to increase with the proposed use.
For these reasons, Staff finds that the proposal will not have any effect on traffic,
automotive and pedestrian safety, traffic flow and control, access, maneuverability and
removal of snow.
4. Effect upon the character of the area in which the proposed use is to be
located, including the scale and bulk of the proposed use in relation to
surrounding uses.

As a business office, this commercial space will maintain the character of the area,
eliminating a vacant space last held by a spa. Exterior changes to the building would
include relocating the entrance farther west and new signage. Thus, there would be no
effects on scale and bulk due to the nature of the exterior changes to the Lion's Pride
Building.
VII. STAFF RECOMMENDATION
Based upon the review of the criteria outlined in Section VII of this memorandum and
the evidence and testimony presented, the Community Development Department
recommends the Planning an Environmental Commission approves, with conditions,
this conditional use permit to allow for a business office, located at 500 East Lionshead
Circle (Lion's Pride Building)/Lot 1, Block 1, Vail Lionshead Filing 1, and setting forth
details in regard thereto.
Should the Planning and Environmental Commission choose to approve this conditional
use permit request, the Community Development Department recommends the
Commission passes the following motion:
"The Planning and Environmental Commission approves this request for a
conditional use permit, pursuant to Section 12-7H-4, Permitted and Conditional
Uses, Second Floor and Above, Vail Town Code, in accordance with the
provisions of Chapter 12-16, Conditional Uses, Vail Town Code, to allow for a
business office, located at 500 East Lionshead Circle (Lion's Pride Building)/Lot
1, Block 1, Vail Lionshead Filing 1, and setting forth details in regard thereto."
Should the Planning and Environmental Commission choose to approve this conditional
use permit request, the Community Development Department recommends the
Commission imposes the following conditions:

Addendum
I. Narrative. The application for a conditional use is for a Business Office to be located on
the second floor of the Lions Pride Building located at 500 East Lionshead Circle.
(Attached is a letter from the Community Development Department making a
determination that the space is located on the second floor of the building.)
II. Modification to the space upon approval of the Conditional Use Application.
A. The existing entry door (see attached photograph) will be re -located to the west to
the third windowpane and the existing entry door replaced with a matching
windowpane.
B. The existing bay windows on the east side (see photograph) will be retained and
artwork or merchandise from a nearby business will be placed in the bay
windows.
III. Current Use. The space is currently vacant and has been for some time. The prior use for
the past several years has been for a spa operation offering massages. The business has
had at least two separate owners and has never been successful and offered little in the
way of improving business for the surrounding businesses.
IV. Future Use. Upon approval of the Conditional Use Permit the Business Office will be a
showroom for a proposed new building to be located on the site of the existing building
and parking structure. It will allow the residents of and visitors to Vail a chance to look
at schematics of a possible new project in Lionshead.
Much like the showroom of Vail's New Dawn, the idea is to create enthusiasm for the
continued upgrade of Vail/Lionshead. The Vail's New Dawn showroom was wildly
successful and led to the re-creation of Lionshead. We intend to build on that success
with a new project that replaces an aging (and, yes, ugly) building and 40+ year old open
parking structure that is in need of replacement.
V. Compatibility with other properties. The use is compatible with all other second floor
uses and will draw visitors to the other businesses located on that floor.
VI. Development objectives of the Town. The continuing objective of the Town under the
Lionshead Master Plan is to create incentives for the redevelopment of aging facilities
which will meet the demands of future visitors. The showroom will enhance the
opportunity for the redevelopment of the site.
VII. The effect on traffic. There is no effect on traffic and pedestrian access is off of
Lionshead Mall. All parking on the surface and in the structure adjacent to the proposed
use is controlled and visitors to the showroom will be parking in the Lionshead structure
as they do today for all businesses in the area.

VIII. Effect on the character of the area. There is no change of scale or size of the existing
space and the proposed use will allow people to see and comment on another upgrade to
Vail/Lionshead.
IX. Title report is attached.
X. What the proposal is not. This will not be a real estate office and no sales will occur in
the space. The timeframe for the conditional use will be for two years or the demolition
of the building, whichever occurs first.
The approval requested is for a business office/showroom to highlight the redevelopment
possibilities for the site.
We are not requesting any approval to the carried over to the new building.
XI. Other submittal requirements are not relevant to this submittal.
