REQUEST The Marriott's Mark Resort is requesting a sign variance to allow a second business identification sign that has a total square footage that exceeds the allowable area for the sign by 11 square feet. Sign Description: 2'4" wide x 8'2" long = 19 sf; redwood, white lettering Marriott"; uplighting from lights mounted on the ground below the sign; location, northwest corner of the Marriott building (see enclosed drawing) Presently the Marriatt's Mark has one & foot x 2 foot sign at the entrance to the hotel. The Mark may have up to 20 square feet in total for both signs. This results in an additional 8 square feet being available for the second sign. The applicant is requesting to have a second sign that is 19 square feet. Therefore, the variance requested is far an additional 11 square feet of signage far the second sign, The applicant is requesting a variance from the following section of the Tawn of Vail. sign code: Section 16.20.050 Freestanding/Wall or Projecting Signs: Single Business Use, B. Size, One square foot far each five front lineal feet of building with a maximum area of 20 square feet, with a horizontal dimension no greater than 10 feet....combined maximum area for mare than one sign shall not exceed 20 square feet. The applicant has made the following statement in support of the sign variance request: "Many people who are unfamiliar with Vail have told us that they have a difficult time locating the Marriott when they turn off of the South Frontage Road onto Lionshead Circle by the Enzian. Since our only existing sign is a low, landscaped sign at our front entrance, it • is not visible at the intersection of Lionshead Circle and Lionshead Place, We are proposing to install a 19 square foot sign on the side of the building at this intersection." • II. FTNDTNGS AND STAFF RESPONSES Before the board acts on a variance application, the applicant must prove physical hardship and the board must find that, A. There are special circumstances or conditions applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or conditions are unique to the particular business or enterprise to which the applicant desires to draw attention and do not apply generally to all businesses or enterprises. Staff Response The Marriott Mark does have an idenficatian problem due to the largeness of the building and the fact that for the entire project they are allowed only two signs having a combined total area of 20 square feet. The Raintree Inn and Holiday Tnn are hotels that have also recently received sign variances due to the size of their projects. Staff feels that the Marriott has similar special circumstances that warrant a slight increase in the combined square footage for the two signs. B. That special Circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: Special circumstances were not created by the applicant. C. That the granting of the variance wi11 be in general harmony with the purpose of this title and will not be materially detrinentP.l to the persons residing or working in the vicir~a_~y, to adjacent property, to the neighborhood, or tc~ i:he public welfare in general. Given the size of this building, staff feels that the applicant is not requesting a departure from the provisions of the sign code any more than is truly required to identify the applicant's business. III. STAFF RECOMMENDATION The staff supports the variance request for the 11 square feet. Staff believes that the sign is harmonious with the sign code's requirement that signage not call undue attention to itself. Also, the request for the additional 11 square feet does not depart drastically from the signage allowed within the sign code. REQUEST Colorado Mountain College is requesting a sign variance to allow a sign of approximately 31 square feet that will read, "Colorado Mountain Collage" to be mounted on the CMC building in the Cascade Village complex. The sign will consist of cut-out wood letters painted forest green, 10 inches in height and approximately 37 feet lang. The Town of Vail sign code would allow Colorado Mountain College building the following signage: A 20 foot square foot building identification sign. This sign could state the name of the building, be it • Colorado Mountain College or Cascade Wing {whatever the owners would desire to call the building). As a multi-tenant building, there is opportunity through the sign code for up to 20 square feet of signage for each business within the building depending on their frontage. Those businesses include Clancy's Bar and Restaurant and the Cascade Theater as well as Colorado Mountain College. Tt should be noted that at the entrance to Cascade Village along the South Frontage Raad there is a large entrance/ directory sign that states, "Cascade Village, The Westin Hotel, Colorado Mountain College." TT. FTNDTNGS AND STAFF RESPONSES Before the board acts on a variance application,the applicant must prove physical hardship and the board must find that: A. There are special circumstances or conditions applying to the land, buildings, topography, vegetation, sign structures or other matters an adjacent lots or within the adjacent right-of-waY which would substantially restrict the effectiveness of the sign in question; provided, however{ that such special circumstances or conditions are unique to the particular business or enterprise to which the applicant desires to draw attention and do not apace generally to all businesses or enterprises. Staff Response: Colorado Mountain College does currently have an identification problem within the Westin Hotel/CMC complex due to the lack of any signage at all. Visitors to CMC are directed off the Frontage Road by the entrance/directory sign at the intersection of Westhaven Drive and the South Frontage Road. However, upon entering the Westin/CMC area, there is no further signage related to CMC to orient a visitor. The staff does not feel that there are any special circumstances involved in this area that would require a variance from the allowable signage as provided through Town of Vail regulations. The Westin Hotel is in compliance with the Town of Vail sign code and seems to function adequately. The staff believes that a sign designed within the confines of the sign code could adequately identify the CMC building and its entrances. B. That special circumstances were not created by the applicant or anyone in privy to the applicant. staff Response: Special circumstances were not created by the applicant. C. That the granting of the variance will be in general harmony with the purpose of this title and wi11 not be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. Staff Response: Generally, the staff agrees that the sign is harmonious with the surrounding setting and that the size is not incompatible with the scale of the existing building. However, we see no reason or hardship that a sign of 2q square feet cannot fulfill the needs of Colorado Mountain College. . D. The variance applied for does not depart from the provisions of this title any more than is required to identify the applicant's business or use. Staff Response: The applicant is requesting signage that is approxi- mately ten feet greater than what is allowed. We feel that given the directory sign at the Frontage Road and the visibility of this proposed sign location from the parking structure, there is no requirement far a sign larger than what is allowed through the provisions of the sign code. IIr. STAFF RECOMMENDATION Staff recommends denial oP the requested sign variance for Colorado Mountain College. We believe that the signage requirements for Colorado Mountain College can be easily met through the provisions of the sign code. There is no physical hardship far departing from the provisions of the sign code. T. REQUEST The Doubletree Hotel is requesting a sign variance to allow an additional building identification sign of 20 square feet to be placed approximately 65 feet above grade on the north elevation of the existing building. The sign would be identical in size and design to the existing sign located on the east elevation of the building. The request requires a variance from the size, height, and number of signs that the sign code permits. The Doubletree Hotel, as a single business use, is allowed up to two wall signs with a maximum combined square footage of 20 square feet. The height allowable is 25 • feet above existing grade. The Doubletree currently displays two wall signs, a 20 square foot sign on the east elevation facing the South Frontage Road and a sign of approximately five square feet on the southwest portion of the building. This sign is oriented toward the pedestrian pathway that leads down to the bus stop by the ice arena. There is also a sign marking the western entrance to the Doubletree Hotel parking lot along the Frontage Road. The request for additional signage requires a variance from the combined maximum square foot of 20. The total square footage with the proposed addition would be approximately ~5 square feet. The request also requires a variance from the number of signs. The request is far a total of 3 wall signs, along with the entrance/traffic control sign. A third variance is requested for height. The sign location is approximately 65 feet above grade, although its distance above the level of the Frontage Road is approximately only 25 feet. Attached is the applicant's statement in support of the request. TT. FINDINGS AND STAFF RESPONSES Before the board acts on a variance application, the applicant must prove physical hardship and the board must find that: A. There are special circumstances or conditions applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or conditions are unique to the particular business or enterprise to which the applicant desires to draw attention and do not apply generally to all businesses nr enterprises. Staff Response: The Doubletree Hotel does have a legitimate identifi~ cation problem due to the size and various exposures of the building and the fact that for the entire project they are allowed only two signs with a combined total allowable area of 20 square feet. The Raintree Inn, Holiday Inn, and Marriott Mark are hotels that have also recently received sign variances due to the size of their projects. Staff feels that the Doubletree Hotel has similar special circumstances that warrant this increase in the combined square footage for signage. We also recognize that due to the design of the Doubletree, it is difficult to utilize one wall sign that has effective exposure to both east and west-bound travelers on the South Frontage Road. We feel that it is a legitimate request to have two signs relating to this exposure, and that it is also in the interest of the community to have signage oriented to the pedestrian area that relates to the Tawn of Vail bus route. With regard to the variance for height, while the sign itself is approximately &5 feet above grade, the Frontage Road is substantially higher than the finished grade of the Doubletree parking lot, and that circumstance mitigates the impact of the height request. B. That special circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: Special circumstances were not created by the applicant. • C. That the granting of the variance will be in general harmony with the purpose of this title and will not be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. Staff Response: Generally, the staff feels that the sign is in harmony with the purposes of this title. staff believes that the size, location and height are harmonious with the surrounding setting and will be compatible with the scale of the existing building. The size of the sign is in scale with the rest of the building and will not draw undue attention to itself. D. The variance applied for does not depart from the provisions of this title any mare than is required to identify the applicant's business ar use. Staff Response: The applicant is requesting an additional 20 square feet of signage beyond that which is existing and approximately 25 feet beyond what is allowed by the sign code. Given the size of this building and the difficulty orienting signage to the exposures of this building, staff feels that the applicant is not requesting a departure from the provisions of the sign code any more than is truly required to identify the applicant's business. III. STAFF RECOMMENDATION Staff supports the variance request for size, number of signs and height. Staff believes that the proposal is harmonious with the sign code's requirement that signage not call undue attention to itself. We feel that the request for the additional square footage does not depart drastically from signage allowed within the code and that the height request does not depart radically from the intent of that section of the code. We do feel that the height could be further mitigated by placing the sign as low as possible on the building face. Staff recommends approval of the request, recognizing that the applicant has a difficult site and has made a reasonable attempt to work with the sign code. ~ I3LETR~F; SIGNAGL~: PROPOSI;I DOU bTM Vail, Inc. desires to erect an additional building identification sign at the I7aubletree Hote]_. This sign would be Located on the north face of the building and would serve to identify the building to those approaching the building from the north and the west. Currently the only identification of the building visible from the Frontage Road occurs on the east side and is visibly only to those approaching the building from the eaJt• TI~e existing signage is proposed to remain. The existing signage consists of one sign an the east wall of the building, one sign near the pool on the southwest portion of the building and one small freestanding sign located near one of the entry drives to the hotel. The new sign would be consistent with the design of the Pxisting signs and would be located an a wall which is currently blank. (see attached sketch). The size of the proposed sign would he twenty (7..4} square feet which would be appropriate to the scale of the building and the wall face to which it would be attacr~ed. REQUEST The Vail Conoco station will be located at the site of the former Exxon station on the South Frontage Road in West Vail. As an Exxon station as recently as a month ago the station displayed 320 square feet of signage, that signage was split between two separate free standing signs. One 70 to 90 feet in the air and the other 14 feet in the air. The Conoco station is requesting a total of 48 square feet of signage to be split between two different signs, a free standing sign adjacent to the frontage road is 14 feet in height and is a dimension of 12 x 3.3 feet 7 inches which is approximately 44 square feet. The second sign will be a 3 1/2 foot x 1 foot sign mounted on the wall of the building adjacent to the entry, this sign will total 3 1/2 square feet for the total square footage of approximately 48 square feet. The Sign Code allows for a single business use, signage up to 20 square feet, and in the case of this building having only one pedestrian or vehicular way only one sign would be allowed. The height of a free standing sign is restricted to 8 feet above grade. This request would require a variance from size, height, and number criteria of section 16.20.050 of the Sign Code. II. FINDINGS AND STAFF RESPONSES Before the board acts on a variance application, the applicant must prove physical hardship and the board must find that: A. There are special circumstances ar conditions applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way which would substantially restrict the effectiveness or the sign in question; provided, however, that such special circumstances or conditions are unique to the particular business or enterprise to which the applicant desires to draw attention and do not apply generally to all businesses . or enterprises. Staff Response: Gasoline service stations as businesses directly oriented to vehicular traffic traditionally display signage above and beyond what would be allowed through the Vail Sign Code. The West Vail area consisting of the Phillips 66 and the West Vail Texaco stations display signage comparable to what was previously existing on this site as an Exxon station. That signage, as nonconforming through the Town of Vail Sign Code, has an amortization period of five years. Due to the recent de-annex and re~annexations of this area the clock has started over again for the five year amortization period of that signage. The gas stations at the Main Vail interchange as well as the Chevron station located at the edge of Lianshead, do meet the Town of Vail Sign Code. These stations are oriented mainly to local traffic. The operators of the Vail Conoco station feel that they relate more closely to the West Vail stations as an I-70 interchange oriented service station. They feel that they would be severally restricted in Competition with the existing gas stations by complying with the Town of Vail Sign Code. They have submitted a proposal that they feel will meet needs, • which is substantially reduced from the previous Exxon signage on this site. As a staff, we feel that the applicants have responded to their needs and the Town of Vail Sign Code by presenting a responsible request. B. That special Circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: While the operators of this service station stay the same, the fact that they have changed from Exxon to Conocn, requires them to come into compliance with the sign Cade. They therefore do not benefit from the annexation actions as the other West Vail stations do. While the change in product requiring the change in signage is a circumstance created by the applicant, we feel that this situation of dealing with this competition is a circumstance that was not created or Controlled by the applicant. • C. That the granting of the variance will be in general harmony with the purpose of this title and will not be materially detrimental to the persons residing ar working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. Staff Response: Generally, the Town of Vail Sign Code is oriented to pedestrian and slow moving local vehicular traffic. The Town of Vail Sign Coda does not really address the needs of interchange oriented businesses such as a service station. We feel that this applicants request given the signage of other existing interchange gas stations, and the previous signage displayed at this site, is reasonable and therefore harmonious with the purpose of this title. D. The variance applied for does not depart from the provisions of this title any more than is reauired to identify the applicant's business or use. Staff Response: we feel that the applicant has presented a proposal that is sensitive to the environment of the Tawn of Vail and to the Sign Cade and Design restrictions of the Town. While this is a substantial variance from the Town code, we do feel that this does not depart from the provisions of the title any more than is required in order to meet the applicants needs. III. STAFF RECOMMENDATION Staff supports the variance request for size, number of signs and height. Staff believes that the proposal is harmonious with the sign code's requirement that signage not call undue attention to itself, while the request for additional square footage does depart somewhat from the signage allowed in the code, the nature of this business dictates somewhat of a departure from the Town of Vail sign code. Staff recommends approval of the request. The mural is not a generic overall project mural. Tt is directly related to the shop. If the shop changed, the mural would have to change in order to be appropriate. 2. Several members definitely thought the mural was advertising. Their opinion was that is was net an architectural enhancement. 3. The mural does not meet the purpose section of the Sign Gade which states that: To provide for decoration applied to building walls so as to enhance the appearance of the building's architectural character. (Section 16.20.060A). 4. Some members felt that the scale of the mural was to large. • .~ 5. There was concern about maintenance of the mural. Due to the fact that the lease holder is not primarily responsible for building maintenance, it was felt that there would have to be some provision in the approval to provide for maintenance of the mural. 6. Members recommended that perhaps a mural could be located in the niche by the stairs going up to the Toymarker's Trail. 7. There was not a consensus on whether or not a mural around Toymaker's Trail door would be appropriate. The mural's graphics, theme, scale, and subtleness would all have to be considered. Until a drawing was submitted, it would be difficult to state their opinion on a mural in this location. 8. Members liked the awning treatment. 9. One member suggested that more open wall space be maintained around the mural.. It was felt that the solid infill of the wall with paint made the mural appear to heavy. • At the meeting, you decided to table the item. There is no need for publishing due to the tabling. I. THE REQUEST The Vail Conoco Station is located at the site of the former Exxon station on the South Frontage Road in West Vail. The Conoco station was recently remodeled and has been reopened for approximately three weeks. In July of this year, the Conoco station received a sign variance allowing them to display a freestanding sign of 44 square feet that is 14 feet in height. This variance resulted in a square footage allowance of 24 feet above and beyond the square footage allowed in the sign code and 6 feet above the height allowance designated in the sign code for freestanding signs. The applicant is now requesting a variance in order to locate a freestanding price sign in a small landscaped berm in front of the station. This request requires a variance from the allowed number of signs, bringing the total signage on the site to two signs and also increases the square footage of signage on the site and thus requires a further variance from the square footage provisions of the sign code. The sign being requested by the applicant is approximately 8 feet in height, 5'-7" wide and contains approximately 39 square feet of signage area. II. FTNDTNGS AND STAFF RESPONSES Before the board acts on a variance application,the applicant must prove physical hardship and the board must find that: A. There are special circumstances or conditions applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or conditions are unique to the • particular business or enterprise to which the applicant desires to draw attention and do not apply generally to all businesses or enterprises. • Staff Response: The staff recognizes that gasoline service stations, as businesses directly oriented to the vehicular traffic, traditionally display signs above and beyond that which is allowed through the Vail sign code. The service stations in the West Vail area certainly are no exception. The Phillips 66 and West Vail Texaco under nonconforming status display nonconforming signage and price signs. We recognize that pricing signs are a common part of gasoline service station signage and feel that perhaps the variance procedure is the best method to deal with this type of signage. The Vail Chevron station was granted the ability to display a price sign as a part of their resigning proposals several years ago. The staff feels strongly, however, that the sign submitted and requested by the applicant exceeds the size necessary to convey this message to the Frontage Road business. Approval of this sign would then give the applicant 83 square feet of signage, 63 square feet more than is allowed by the sign code. The staff does feel that this is excessive and that the applicant could convey his pricing information in a . similar manner with much less square footage. B. That special circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: As the staff discussed in the previous variance memo for the existing Conoco sign, some special circumstance that may be in effect here is the traditional signing of gasoline stations and the competition of the nonconforming stations that are also located in West Vail. This situation was not created or controlled by the applicant. C. That the granting of the variance wi11 be in general harmony with the purpose of this title and will not be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. Staff Response: Generally, the Town of Vail sign code is oriented to pedestrian and slow moving local vehicular traffic. While we are recognizing that service station price signs are not addressed in the sign code and are recognizing the need for service stations, we feel that the concept zs in harmony with the purpose o~ the sign Code. We feel that the price sign should be a maximum of 20 square feet. We feel that the 39 square feet requested by the applicant far exceeds what is needed to convey information to the local traveler. D. The variance applied for does not depart from the provisions of this title any mare than is required to identify the applicant's business or use. Staff Response: We feel the applicant has made a legitimate presentation in location and design of the sign. The sign is incorporated within the landscape berm that will add attractiveness to the site and has presented an argument that shows the concept is harmonious with the sign code. We feel, however, that the size applied for does depart from the provisions of the title more than is required to identify the business or use. We feel that this proposed sign should be a maximum of 20 square feet. III. STAFF RECOMMENDATION Staff supports the variance request for size and number of signs in concept. Staff believes that the concept of the proposal is harmonious with the sign code's requirements. However, we cannot support this sign proposal as presented because of the 39 square feet of signage. Staff recommendation is for denial of the sign as presented.
