THE REQUEST The Marriott's Mark Resort is requesting a sign variance for the number of signs and total sign square footage. The sections of the code which relate to the variance request are listed below: 16.20.054 Signs, Single Business Use B. Size. One square foot for each five front lineal feet of building with a maximum area of 20 square feet, with a horizontal dimension no greater than 10 feet....combined maximum area for more than one sign shall not exceed 20 square feet. D. Number. One sign per vehicular street or major pedestrian way which the business abuts as determined by the administrator, with a maximum of two signs, subject to review by the Design Review Board. According to the sign code, the Marriott's Mark is allowed a maximum of two signs having a combined total square footge of 20 square feet. The development's existing signage includes: One 19 square fact wall sign on the east elevation One 12 square foot free standing sign at the entry Total square footage existing: 3]. square feet. * A variance was granted in 1987 to allow for the additional 11 square feet above the allowed total square footage of 20 square feet. The applicant is requesting one additional Sian and 22 square feet of signage above what is allowed under the sign code. The proposal includes: One new 20 square foot wall sign on the west elevation. One new three square foot freestanding sign at the entry that is built into the existing freestanding sign. The existing sign square footage is merely decreased from 12 square feet to 3 square feet. * Please note that the existing 12 square foot sign at the entrance to the Mark would be removed and that the existing 19 square foot sign on the east elevation remains. Total square footage, 42 square feet. Please see the attached drawings for descriptions and specific locations of the signage, as well as the applicant's rationale for the variance. II. FINDINGS AND STAFF RESPONSES Before the Board acts on a variance application, the applicant must prove physical hardship and the Board must find that, A. There are special circumstances or conditions, applying to the land, buildings. topography, vegetation, sign structures or other matters on adjacent lots or within the adiacent right-of-way • which would substantially restrict the effectiveness of the sign in question; provided, howeverL that such special circumstances or conditions are unique to the. particular business or enterprise to which the applicant desires to draw attention and do not apply generally to all businesses or enterprises. Staff Response The Marriott's Mark does have an identification problem due to the largeness of the building and the fact that for the entire project, they are allowed only two signs having a combined area of 20 square feet. Similar large hotel projects such as the Raintree Inn, Holiday Inn, and Doubletree have also received sign variances due to the size of their projects. Staff feels that the Marriott has similar special circumstances that warrant an increase in the combined square footage and number of signs. The existing sign at the entry way (12 square feet) will be removed and a three foot sign added. Staff believes that the three square foot sign is reasonable and necessary to indicate that this is the entry for the project. • 2 B. That special circumstances were not created by the, applicant or anyone in privy to the applicant. Staff Response: Special circumstances were not created by the applicant. C. That the granting of the variance will be in general harmony with the purpose of this title and will nat. be materially detrimental to the persons residing or working in the vicinity, to adjacent nroperty, to the neighborhood. or to the public welfare in general. Staff Response: Staff feels that the proposed signage is in harmony with the purposes of the sign code which states that the "sign location, configuration, design, materials and colors should be harmonious with the majestic mountain setting and the alpine village scale of the town." Section 16.16.010. The proposed sign wall be back lit so that the silhouette of the letters is visible on the west elevation. The lighting effect will be similar to the Holiday Inn wall sign in that light will not shine through the letters. The small . sign at the entryway is subtle in its design and is also compatible with the sign code's general purpose. The scale of both signs is appropriate for their purpose and location within the project. D. The variance applied for does not depart from the provisions of this title any more than is required to identify the applicant's business or use.. Staff Response: The applicant is requesting an additional 22 square feet beyond the allowable 20 square feet. The Town Council approved a variance for the Marriott Mark which created an additional 11 square feet beyond the allowable square footage. Staff believes that one 19 square foot sign and one 20 square foot sign are not unreasonable square footages to request for a building of this size. In addition, the three square foot sign at the entry is necessary to identify the entry point for guests. The applicant is not requesting a departure from the provisions of the sign code any more than is truly required to identify the business. • III. STAFF RECOMMENDATION: The staff supports the variance request for one 20 square foot sign and one three square foot sign. Staff believes that the sign is harmonious with the sign code's requirement that signage not call undue attention to itself. The square footage request also does not depart drastically from the allowed signage. We recommend approval and feel that the applicant has made a strong attempt to work with the staff to develop an acceptable sign variance request. Due to the recent increased number of submittals for sign variance requests for large lodges, the staff feels it will be appropriate to adjust the sign code to allow for same additional signage for these types of projects. In reviewing these variance requests, staff has tried to maintain continuity in our decision making and rec~~~~~~.endations to the Design Review Board and Council. However, in the long term, we feel that the best solution is to adjust the sign code so that it is in tune with the needs of these types of developments. T0: Design Review Board FROM: Community Devel~~~«ent Department DATE: May 18, 1988 SUBJECT: A request for a sign variance for the Vantage Point Condominiums Applicant: Vantage Point Condominium Association I. THE REQUEST The Vantage Point Condominium Association is requesting sign variances for the total sign square footage and required height of wall signs. Vantage Point has 27 square feet of signage in three signs, one of which is a logo. They are proposing to remove all existing signs and replace them with two signs totalling 28 square feet. One sign containing 8 square feet would be located above the garage entrance on the east side of the building. The other sign containing 20 square feet would be on the north elevation at a height of 38 feet from existing grade. The sections of the code which relate to the variance request are Listed below: • 1.8.20.210 Wall Signs B. Size. One square foot for each five front lineal feet of the building, with a maximum area of 20 square feet. C. Height No part of the sign shall extend above twenty-five feet from existing grade. According to the sign code, the Vantage Point Condominiums are allowed a maximum of 20 square feet of combined total square footage. Vantage Point is requesting a total of 28 square feet of signage in two signs, 8 square feet above the allowable. The sign code restricts the signage to be located no more than 25 feet above grade. The request is to place the sign on the north elevation 38 feet above Grade, 13 feet above the allowable height. * Please: see attached drawings for location and detail. • • II. FINDINGS AND STAFF RESPONSES Before the Berard acts on a variance application, the applicant must prove physical hardship and the Board must find that, A. There are special circumstances or conditions, applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way which would substantially restrict the effectiveness of the sign in question ,• provided, however that such special circumstances or conditions are unique to the, particular business or enterprise to which the applicant desires to draw attention and do not apply generally to all businesses or enterprises. Staff Response • The Vantage Point Condominiums do have an identification problem due to the size of the building and the tact that for the entire project, they are allowed only two signs having a combined area of 20 square feet. Similar large projects such as the Raintree Inn, Holiday Inn, Marriott Mark, and Doubletree have also received sign variances related to total amount of signage due to the size of their projects. Staff feels that the Vantage Point Condominiums have similar special circumstances that warrant an increase in the combined square footage of signage. The staff does not feel, however, that the Vantage Point Condominiums should be allowed to place one sign at 38 feet from grade, There are no special circumstances or conditions that are unique to the project that do not apply generally to all businesses. Tt is true that the Doubletree Hotel was given a variance to place their sign facing the Frontage Road at a height of 55 feet. The reasons for granting the variance as indicated in the memo dated June 17, 1987, was that the size of the sign was in scale with the rest of the building and the fact that the building was situated below the grade of the Frontage Road, mitigating the height of the sign. To the west of the Vantage Point Condominiums is the Landmark Hotel whose sign is 15 feet above the required 25 feet. When the Landmark constructed this sign in 1984, they were replacing an existing sign with a new one at the same height as the old sign. l.J The Enzian is another building along the Frontage Road which has signs higher than 25 feet above grade. The records do not show approval of these signs, so the staff must surmise that these signs were painted onto the building at a very early date; this would make the signs legal nonconforming. The staff feels that, in general, the circumstances the Vantage Point condominiums face are not unique to other buildings along the South Frontage Road, and therefore the height of the Vantage Point signage should not exceed 25 feet above grade. B. That special circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: Special circumstances were not created by the applicant. C. That the granting of the variance will be in general harmony with the purpose of this title and will not be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. • Staff Response: Staff feels the proposed signage with respect to size is in harmony with the purposes of the sign code. The signage will be lit by a light source separated from the sign. The 8 foot sign above the garage entry is also compatible with the sign code's general purpose. The staff feels that this sign is important to help motorists identify where to enter the garage. The scale of both signs is appropriate for their purpose and location within the project. The staff does not feel that granting the height variance is in harmony with the sign code. There are many buildings along the Frontage Road whose signage conforms to the sign code with respect to .height and whose signs are adequate to identify the buildings. D. The variance applied for does not depart from the provisions of this title any more than is required to identify the applicant's business or use. • Staff Response: The applicant is foot sign beyond believes that one square foot sign to request for a requesting an additional 8 square the allowed 20 square feet. The staff does feel that the 20 square sign on the north elevation will identify the building adequately when placed 25 feet from grade, and that a height variance to place this sign at 48 feet is not warranted. XI2. STAFF RECOMMENDATION: The staff supports the variance request to allow an additional 8 square feet over the 20 square feet allowed in the sign code. Staff believes that the signs are consistent with the sign codes requirement that signage not call undue attention to itself. The square footage request also does not depart drastically from the allowed signage. We rec...«r~.end approval of the request for a variance from the amount of total signage allowed. However, the staff does not support the requested sign . height variance. We feel the Vantage Point Condominiums will be adequately identified with two signs that are placed no higher than 25 feet. Due to the recent increased number of submittals for sign variance requests for large lodges, the staff feels it will be appropriate to adjust the sign code to allow for some additional signage for these types of projects. Tn reviewing these variance requests, staff has tried to maintain continuity in our decision making and recommendations to the Design Review Board and Council. However, in the long term, we feel that the best solution is to adjust the sign code so that it is in tune with the needs of these types of developments. Frontage Road Vail, Colorado 8165$ Dear Betsy: • With regard to the height of the Vantage Point sign on the north side of the elevator shaft, we feel that 25 feet above ground level will not be high enough. Since Vantage Point sits well below the level of the So. Frontage Road, we feel a minimum of 38 feet above ground level is necessary to make the sign clearly visible. We have recently planted a row of cottonwood trees along the south side of the frontage road that wi11 grow quite ta11 over the years. As it is now these trees wi11 block the view of a siwn mounted at 25 feet above ground level. After looking at some of our neighboring condominiums namely the Landmark to our west and the Doubletree to our east, we do not feel 38 feet above ground level is at all unreasonable. Since this wi11 be our only sign on the north side of the building we do feel it should be clearly visible from I-70 and the So. Frontage Road. I would like the opportunity to have soneone from the sign review committee and/or the design review board to come out and look at our situation in order to make a fair evaluation. I. THE REQUEST The Vail Chevron station is located in the Arterial Business District just west of Lionshead and the Marriott Mark Resort. The current signage far the Chevron station consists of a 17 square foot Chevron logo sign. The sign is free-standing and Less than eight feet in height. This is currently in compliance with the Town of Vail Sign Code. The operators of Chevron are requesting a variance from total square footage allowable, number of signs, and height provisions of the Sign Code, in order to raise the Chevron sign to 18 feet in height, and to add a 17 square foot price sign mounted below the Chevron sign. Total size requested is 34 square feet. The Sign Code allows for single business use signage up to 20 square feet. As in the case of this building having only one pedestrian or vehicular way, only one sign would be allowed. Afree-standing sign is restricted to eight feet in height. This request, as a variance from size, height, and number of sign criteria of Section 16.20.050 of the Sign Code, is similar to the request made by the Vail Conoco station which was approved in July 1987. II. FINDINGS AND STAFF RESPONSES Before the Board acts on a variance application, the applicant must prove physical hardship and the Board must find that, A. There are special circumstances or conditions applying to the land, buildings, topoaraphv. vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way which would substantially restrict the effectiveness of the sign in question; provided, however! that such special circumstances or conditions are unique to the particular business or enterprise to which the applicant desires to draw attention and do not apply generally to all businesses or enterprises. • Staff Response Gasoline service stations as businesses directly oriented to vehicular traffic traditionally display signage above and beyond what would be allowed through the Vail Sign Code. The West Vail area, in particular, consisting of the Phillips 66 and the West Vail Texaco stations display signage is grandfathered into the Vail Siqn Code. That signage greatly exceeds the allowances as described in the Sign Code. The Vail Conoco station, located in West Vail, has received a variance for a request very similar to that made by the Vail Chevron station. The request basically consists of raising the existing Chevron sign to a height of 18 feet so that it may be more visible from the Frontage Road and adding below that a price sign indicating products available and prices. During the variance review of the Vail Conoco station, the staff recognized the importance of a price sign to a gasoline station, as well as the ongoing enforcement problems that previously existed at Vail Conoco and currently exists at Vail Chevron. We feel the best way to handle this situation is to properly legitimize, through a review process, these price signs. As a staff, we feel the applicants have responded to their needs and the Town of Vail Sign Code by presenting a responsible request. B. That special circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: Staff feels that the traditional signage display of a gasoline station includes product price information. We also feel that the precedent for approving a price sign has been set with the action of Vail Conoco. We feel that was a good solution to a signage enforcement problem on that location. We feel that it is also a good solution to a signage problem at the Chevron location, and feel that any circumstances involved were not created by the applicant. C. That the granting of the variance will be in general harmony with the purpose of this title and will not be materially detrimental to the persons residing or working in the vicinity. to adiacent property, to the neighborhood, or to the public welfare in general. • Staff Response: Generally, the Town of Vail Sign Code is oriented to pedestrian and slow moving local vehicular traffic. The Sign Code does not really address the needs of a specific automobile oriented business, such as a service station. The existing signage at the site is in compliance with the Sign Code and is, according to the applicant, proving to be ineffective for their business needs. The parking of automobiles and design of the adjacent bridge restricts the visibility of the existing sign. We feel that the request for raising the sign and adding a price sign is reasonable and, therefore, harmonious with the purpose of this title. D. The variance applied for does not depart from the provisions of this title anv more than is required to identify the applicant's business or use. Staff Response: We feel that the applicant has presented a proposal that is sensitive to the environment of the Town of Vail, to the Sign Code, and to the design restrictions of the c~..,.~.unity. While this is a substantial variance from the Town Code, we do feel that this does not depart from the provisions of the title any more than is required in order to meet the applicant's needs. IIZ. STAFF RECONfMENDATION: Staff supports the variance request for size, number of signs and height. Staff feels that two signs, with a total of 34 square feet and a total height of 18 feet above grade, is harmonious with the Sign Code requirements. The nature of this business dictates somewhat of a departure from the Town of Vail Sign Code, yet, the proposal maintains harmony with the intent of the Code itself. The signage for the Vista Rahn in Vail Village went through a similar variance process. Vail Associates requested a total of 47 square feet and the Design Review Board, due to concerns expressed by a neighboring property owner, approved a reduced signage program that consisted of 32 square feet. The proposal for the Born Free Express is identical in size to the signage that was requested for the Vista Bahn, with the inclusion of three Vail Associates logos. The request is for 3 each Born Free Express signs of 16 inch letters, for a total of 42 square feet, 3 each Vail Associates, Inc. logos, for a total of 12 square feet, and 3 each numeral 8 16" letters for a total of 3 square feet. When added up, these signs create a total square foot signage request of 57 square feet. The east, west and north elevations of the Born Free Express would each contain one Vail Associates logo, one Born Free Express sign, and one numeral 8 for a total signage of 19 square feet per elevation. II. FINDINGS AND STAFF RESPONSES Before the Board acts on a variance application, the applicant must prove physical hardship and the Board must find that, A. There are special circumstances or conditions applying to the land, buildings, topographer vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of- way which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or - conditions are or enterprises draw attention businesses or Staff Response unique to the particular business to which the applicant desires to and do not apply generally to all enterprises. Staff does feel that the Born Free Express deserves special consideration due to the fact that it is a structure and use that is not addressed in the Town of Vail sign code. The Barn Free Express must be easily identified by many visitors to Vail who are often unfamiliar with the layout of the ski mountain and the base area. Staff considers the Born Free Express to be a special circumstance that is unique to the business of running the ski resort. The new signage communicates effectively the name of the lift without drawing undue attention to-the structure. The proposed signage is in scale with the lift structure. Staff believes that there are special circumstances which justify allowing this signage for the Born Free Express. B. That special circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: Some type of variance is necessary in order to allow any type of signage for the Born Free Express. Staff does feel that the Born Free Express is a special circumstance. C. That the granting of the variance will be in general harmony with the purpose of this title, will not be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general. Staff Response: The 57 square feet of signage is compatible with the intent of the sign code. Distribution of 19 square feet per elevation is in scale with the building and presents the information adequately. The code states: Section 36.16.010 Harmonious with Town scale. Sign location, configuration, design, materials and colors should be harmonious with the majestic mountain setting and the alpine village scale of the Town. Section 16.16.020 Not dominating. The sign should not visually dominate the structure to which it belongs or call undue attention to itself. Section 16.16.140 Architectural Harmony The sign and its supporting structure should be in harmony architecturally with the surrounding structures. Staff feels that the signs are in harmony with the purposes of this title. D. The variance applied for does not depart from, the provisions of this title anv more than is required to identifv the applicant's business or use. Staff Response: Staff agrees that the proposed variance is within the general intent of the sign code. Signage must be visible from several sides of the structure, as skiers are arriving at the lift from many different _ directions. The Signage is also in scale with the size of the structure. TII. STAFF RECOMMENDATION: The Community Development Department recommends approval of the 57 square foot sign variance for the Born Free Express. Staff agrees with the applicant that there are special circumstances unique to this particular structure due to the fact that the name of the lift must be clearly identifiable to skiers in the general vicinity of the Born Free Express. I. THE REQUEST The Raintree Inn is requesting a sign variance in order to amend the design of the existing signage currently displayed at the hotel. The current signage was approved through a variance procedure by the Town of Vail several years ago. The variance received was for size (90 square feet allowed}, height (as existing} and number of signs (2, one "Raintree Inn", one "Best Western"}. The Raintree Inn has now ended their Best Western affiliation and therefore is eliminating that sign from the building. They are requesting to maintain the existing height allowance, and existing size allowance, and amend the design to a double-sided projecting sign as is shown on the attached drawing. ' II. FINDINGS AND STAFF RESPONSES Before the Board acts on a variance application, the applicant must prove physical hardship and the Board must find that, A. During the original variance application for the Raintree Tnn, there was much discussion involving the size and scale of the building, its highway orientation and the general business orientation and climate for the West Vail area. Staff and Council at that time discussed amending the sign code and adding a special section for the West Vail area. A subsequent de-annexation alleviated the urgency of this project. Staff feels that many of those conditions discussed at that time are still valid, and therefore the staff is comfortable with the proposal. D. The variance applied for does not depart from the provisions of this title anv more than is required to identify the applicant's business or use. • Staff Response: Again, this application does greatly exceed the provisions of the sign code, yet, in previous discussions of the Raintree Inn and the West Vail area in general, we have felt that this size and height of signage is not more than is required to identify the applicant's business or use. III. STAFF RECOMMENDATION: Several years ago, the staff spent a great deal of time working with the West Vail businesses and the Town of Vail sign code. A lot of time and discussion was involved in the original Raintree Tnn variance that was subsequently granted by the Design Review Board and the Town Council. This variance determined the allowable size and height of the existing signage at the Raintree Inn, This application does not amend the height, or size but changes the design. The staff is therefore supportive of this request. We would like to note, however,.. that in our review of the application, we did feel that the original variance approval was, in part, based on the design of the existing sign as a wall sign. It is our belief that a wall sign is much less obtrusive that a projecting or hanging sign, especially at the magnitude of size that is being currently requested by the applicant. T. THE REQUEST The Safeway Stores are requesting variances from the sign code with regard to the allowed number of signs and the amount of square footage permitted for signage. Safeway would like to add the word, "Marketplace" under the word, "Safeway." At present, the Safeway building has 3 signs. One sign is the "Safeway" sign of 19 square feet and two are logos of 32 square feet each for a total existing square footage of 83 square feet. Safeway proposes to remove one logo of 32 square feet with the addition of "Marketplace" of 19 square feet, thereby reducing the total square footage by 13 square feet to a total of 70 square feet and reducing the number of signs from 3 to 2. In June of 1985, Safeway replaced a rooftop sign with the present "Safeway" wall sign. The application for the new wall sign contained a statement from the Town staff to the • effect that the two remaining logos would require a variance approval or must be removed by December 31, 1985. Before the end of 1985, this area of the Town was de- annexed and was re-annexed on January 28, 198. At present, the number of signs and amount of square footage are nonconforming. In January of 1991, the signage must conform to the Town of Vail sign code, or a variance must be obtained. TI. FiNDTNGS AND STAFF RESPONSES Before the Board acts on a variance application, the applicant must prove physical hardship and the Board must find that, A. There are special circumstances or conditions applvinc~ to the land, buildings, topography1 vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of- way which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or conditions are unique to the particular business or enterprises to which the applicant desires to draw attention and do not apply generally to all businesses or enterprises. • Staff Response s The Staff feels that the size and location of the Safeway building are special conditions. The staff does feel that when the new sign is in place, it would actually be reducing existing signage and thus visibility. B. That special circumstances were not created by the applicant or anyone in privy to the applicant. Staff Response: The Safeway store was deannexed and then reannexed to the Town of Vail. These circumstances were not created by the applicant. The store will be permitted 2 signs and 32 extra square feet until January 28, 1991 when the sign amortization will end, at which time Safeway must apply for a sign variance or conform to the sign code. C. That the granting of the variance will be in general harmony with the purpose of this title, will not be materially detrimental to the persons residing or working in the vicinity, to ad-iacent property, to the neighborhood, or to the public welfare in general. Staff Response: The following section of the sign code relates to the harmony of the sign: Section 16.16.010 Harmonious with Town scale. Sign location, configuration, design, materials and colors should be harmonious with the majestic mountain setting and the alpine village scale of the Town. Section 16.16.020 Not dominating. The sign should not visually dominate the structure to which it belongs or call undue attention to itself. Section 16.16.140 Architectural Harmony The sign and its supporting structure should be in harmony architecturally with the surrounding structures. Staff feels that the sign change becomes more in • harmony with the purposes of this title, D. The variance applied for does not depart from the provisions of this title any more than is required to identify the applicant's business or use, Staff Response: The amount of signage is being reduced substantially, and will identify the business adequately. Although the staff does feel the other logo should be removed, this will happen when the sign amortization ends. III. STAFF RECOMMENDATION: The staff recommends approval of the sign variance.
