HomeMy WebLinkAbout2015-03 Amending Sections 3-3-2 and 3-3-3 of TOV Code to Reduce the Minimum Required Number of Arts Board Members from Nine to SevenORDINANCE NO. 3 SERIES 2015 AN ORDINANCE AMENDING SECTIONS 3-3-2 and 3-3-3 OF THE VAIL TOWN CODE TO REDUCE THE MINIMUM REQUIRED NUMBER OF ARTS BOARD MEMBERS FROM NINE TO SEVEN WHEREAS, the Town Code currently requires a minimum of nine (9) board members to sit on the Arts Board at any given time; and WHEREAS, the Town Council desires to reduce the minimum required number of Arts Board members to seven (7). NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Section 3-3-2 of the Vail Town Code is hereby amended to read as follows: 3-3-2: Appointment: The town council hereby appoints the Vail arts board composed of seven siRe (97) members who shall act in accordance with the charter, this chapter, the direction of the town council, the ordinances of the town and shall be appointed and serve as provided in this chapter. Sectiop 2. Section 3-3-3 of the Vail Town Code is hereby amended to read as follows: 3-3-3: Membership; Terms: The arts board shall consist of seven Pine (79) members appointed by the town council. In addition, the arts board may consist of honorary advisory members who shall not have the power to vote on issues which come before the board. The number and term of such advisory members shall be at the discretion of the town council. All members of the arts board shall be individuals who have demonstrated interest or expertise in architecture, art criticism, art education, art history, foreign arts, graphic arts, interior design, landscape architecture, town planning, or other art and design related fields, or who have demonstrated a strong interest in the visual arts and civic improvement. All members shall either be residents of the town, or own property within the town. The terms of the arts board shall be two (2) years on an overlapping basis and shall expire on March 31 of the year of termination. Section 3. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it Ordinance No. 3, Series of 2015 would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 4. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 5. The amendment of any provision of the Town Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision amended. The amendment of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 6. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore repealed.
