HomeMy WebLinkAbout1966- 4 Creating the Office and Position of Police Magistrate for the TOV. ,, ' I~ ~ O~~~e ~ ~NO b b4 j ~~• AN ORDINANCE CREATING THE OFFICE AND POSITION OF POLICE MAGISTRATE FOR THE TOWN OF VAIL AND SETTING FORTH THE JURISDICTION, DUTIES, RESPONSIBILITIES AND QllALIFICATI0N5 OF SAID POSITION oRp~l~~~ BE IT ~~~~H BY ~'HE BOARD OF TRUSTEES OF THE TOWN OF PAIL : SEC~`ION 1., OFFICE The Board of Trustees of the Town of Vail hereby creates and establishes the office and position of Police Magistrate who shall preside over the police court fox the Town of Vail. SECTION 2. JURISDICTION AND POWERS The Police Magistrate sha11 have jurisdiction within the territorial limits of the Town of Vail. of all cases arising under the ordinances of the Town. The Police Magistrate shall have fu11 power and authority to make and adopt rules and regulations for conducting the business of his office, and shall have all powers incident to a court of record in the State of Colorado in relation to the attendance of witnesses, the punishment of contempt, and enforcing all orders made by him; provided that na imprisonment for contempt shall exceed five days, and no fine for contempt shall exceed one hundred dollars ($140.00). The Police Magistrate sha11 have full power and authority to perform all functions of police magistrates for towns as provided by state Taw. ` SECTION 3. SESSIONS The Police Magistrate shall hold regular sessions of his court for the hearing and trial of Cases on at least ane i a ' ~ ~ E f t ~ t day each week and at such other times as may be necessary for properly conducting the judicial. business of the Town, provided that the times the Police Magistrate will be sitting each calendar week shall be posted on the outer c~aor of the room or rooms provided for his use by the Town not later than Priday preceding the cal®ndar week fox which the schedule is pasted. SECTION 4. PROCESS All processes Issued from nr out of the police court shall run in the name of the people of the state of Colarado, and be signed or attested by the police Magistrate. SECTION S, FINES PAID TO CITY TREASURER All fines and penalties collected in the police court far the violation of any of the ordinances of the Town, sha~.l be reported by the Police Magistrate and paid to the Town Treasurer of the Town monthly. SECTION fi. QUALIFICATION OF MAGISTRATION The Police Magistrate shall be an elector of Eagle County, State of Colorado, and may be a County Judge. SECTION 7. TERM AND APPOINTMENT The term of the Police Magistrate shall commence at 12:00 o'clock noon on the seventh day,aftex the members of the Board of Trustees have qualified for office following each biennial election prescribed by law and shall extend until IZ:00 o'clock noon on the seventh day after the member of the Board of Trustees have qualified far office following the next sub- sequent regular election.. At such time the Police Magistrate 2 - •f f ~ ~ i i may be reappointed. The Police Magistrate shall be appointed by the Board of Trustees. The Police Magistrate may only be removed from office during his term for goad cause shown after notice and hearing and upon the vote of two-thirds of the members of the Board of Trustees for his dismissal. SECTION 8. COMPENSATION The Board of Trustees shall provide by ordinance for the salary of the Police Magistrate. SECTION 9. BOARD OF TRUSTEES TO FURNISH SUPPLIES, The Board of Trustees sha11 furnish the necessary books, stationery, blanks, furniture and fuel required for the use of the Police Magistrate in the performance of his duties as herein prescribed, together with a suitable room or rooms for the proper conducting of the business of the police court. SECTION l0. EFFECTIVE DATE This ordinance shall be in full force and effect within thirty days after its approval by the Board of Trustees and final publication as prescribed by law. SECTION 11. SEVERABILITY ` "It is the intention of the Board of Trustees that this ordinance ox any part or provision thereof, sha11 be considered severable and, if any provision of this ordinance or the applica- tion thereof to any person or circumstance is held invalid, such invalidity sha11 not affect other provisions or applications of - 3 - .~ . ; w the ordinance which can be given effect without the invaiid pxo- visian or application, and to this end the provisions of this or- dinance are deciaxed to be severable," ~_ . _ ~ ~ t ~~ ~ .
