HomeMy WebLinkAbout1966- 6 Creating a Town Planning Commission for the TOV.:;` , i -. ! u ~ I ~ i ~~ ~ } R y Series of 196b ORDINANCE N0. b AN ORDINANCE C~tEATING A TOWN PLANNING COMMIS5i0N FOR THE TOWN OF VAIL, AND SETTING FORTH THE NUMBER OF MEMBERS OF SAIb COMMISSION, THE QUA#.IFICATIDNS FOR APPOINTMENT, THE PROCEDURES FOR THE SELECTION OF SUCH MEMBERS, AND SETTING FORTH THE POWERS, RESPONSIBILITIES AND DUTIES OF SAID COMMISSION. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAIL: SECTION 1, CREATION OF COMMISSION There is hereby created by the Board of Trustees of the Town of Vail a "Town Planning Commission" compased of five members who sha11 act in an advisory capacity to the Board of Trustees on matters herein set forth and shall be appointed and serve as herein provided, SECTION 2. PERSONNEL OF THE COMMISSION The Planning Commission shall have five members, consisting of the Mayor, one member of the Board of Trustees to be selected by the Board of Trustees (both of whom shall serve as exofficfo members), and three other persons who sha11 be appointed by the Mayor. A1I, members of the commission sha11 be bonafide residents of the Town, and if any member ceases to reside in the Town, his membership on the commission sha11 immediately terminate. All members of the commission shall serve as such without compensation. The members appointed by the Mayor shall hold no other ' ~ r municipal office except that one such member may be a member of the Zoning Board of adjustment or appeals. SECTION 3. TERMS OP OFFICE The terms of ex officio members shall correspond to their respective official t~nuxes. The term of each member appointed by the Mayor sha11 be sax years or until his successor takes office except that the respective terms of the members first appointed by the Mayor shall be six (~} years, four (4} years and two (2} years. The Mayor shall determine who shall receive the d3.fferent initial terms. SECTION 4. REMOVAL FROM OFFICE Members appointed by the Mayor may be removed, after public hearings, by the Mayor fox inefficiency, neglect of duty, or malfeasance in office. The Mayor shall fife a written statement of reasons for such removal. SECTION S. VACANCIES Vacancies occurring otherwise than through the expiration of term shall be filled for the remainder of the unexpired term by the Mayor in the case of members selected or appointed by him, and by the Board of Trustees in the case of the trustee member. SECTION b. ORGANIZATION ANA RULES The commission shall elect its chairman from among the members appointed by the Mayor and create and fill such other of its offices as it may determine. The term of the chairman shall be one year with eligibility for xe~electian. The commission shall hold at least one - Z regular meeting each month. It shall adopt rules for transaction of business and shall. keep a record of its resolutions, transactions, findings and determinations, which record s#~ail be a public recard kept in the office of the Town Clerk. SECTION 7'. pINANCE5 AND STAFF A11 expenditures of the commission shall be determined and appropriated by the Board of Trustees. ' The Board shall provide the funds, equipment and accommodations necessary far the commission's work. The expenditures of the commission shall not exceed the amount determined and appropriated for its use by the Board of Trustees. The c~~.r,;..fission may appoint such employees as it may deem necessary for its work, whose appointment, pro- motion, demotion and removal shall be subject to the same provisions of law as govern other corresponding civil employees of the Town. SECTION 8, MASTER PLAN It shall be the function and duty of the commission to make and adopt a master plan, for approval by the Board of Trustees, for the physical development of the Town, including any areas outside of its boundrfies, subject to the approval of the legislative or governing body having jurisdiction thereof, which in the commission's judgment bear relation to the planning of the Town. Such .. ~ ~, i • • plan, with the accompanying maps, plats, charts and descriptive matter, shall show the commission's recommendations for the development of said territory. The adoption, enforcement and status of said master plan shall be in compliance with state law. SECTION 9. ZONING The Commission shall prepare for the approval of the Board of Trustees, a Zaning Ordinance with appropriate regulations accompanied by a map recammending the boundries of the various zoning d~.stricts. Said zoning ardi.nance shall not be adopted before the adoption of the master plan and shall be based on said master plan. The adoption, enforcement, status and alteration of said zoning ordinance shall be in compliance with the law as set forth in the state statutes. SECTION 10. SUBDIVISION REGULATIONS The Planning Commission shah adopt for approval by the Board of Trustees such subdivision regulations as said commision deems proper according to law. SECTION 11. The Planning Commission shall consider any other matters pertaining to said commission as provided by law, shall act in an advisory capacity to the Board of Trustees when so requested, and shall have all powers and perform all function which it is authorized to have and perform by ordinance and state law. - 4 - ~ • • ~ ~i SECTION 12. EFFECTIVE DATE This ordinance sha11 be in full force and effect within thirty days after its approval by the Board of Trustees and final publication as prescribed by law. SECTION 13. SAFETY CLAUSE "The Board of Trustees hereby finds, determines, and declares that this ordinance is necessary and proper to provide for the safety, preserve the health, promote the prosperity, improve the morals, order, comfort and convenience of the Town of Vail and the inhabitants thereof." SECTION 14. SEVERABILITY "It is the Intention of the Board of Trustees that this ordinance or any part or provision thereof, shall be considered severable and, if any provision of this ardiannce or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applicatians of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable." 5 - j } Finally passed, adopted and approved on this /~ day of ~/~~~/PiYYI~ Z96,~.
