AN ORDINANCE FOR THE ADOP'T'ION RY REFERENCE OF THE
"UNIFORM BUILDING COhF, " 1964 FL~ITION, REGULATING THE CONSTRUC-
TION, .ALTERATION, REPAIR, RFMOVA.L, DEMOLITION, EQUIPMENT, USE
AND OCCUPANCY, LOCATION ANL M?.INTFNANCF OF PUILL'INGS OR OTHER
STRUCTURES HERETOFORE OR HEREAFTER ERECTED IN THE TOWN OF

5ECTIONI. ADOPTION OF THE BUILDING CODE
Pursuant to Chapter 1 39, ~ rticle 34, Colorado Revised Statutes 1963,
there is hereby ado~~ted as thF Building Code of the Town of Vail for regulating
the construction, alteration, rena.ir, removal, demolition, equipment, use and
occupancy, location and maintenance of buildings or other structures heretofore
or hereafter erected in the Town of Vail, that certain document, three (3) certified
copies of which are on file in the office of the Town Recorder, Town of Vail, Colo-
rado, being titled, marked and designated as the Uniform Building Code, 1964
Edition, published by the International Conference of Puilding Officials, and here-
inafter referred to as the Building Code.
SECTION 2. EXCEPTIONS
P11 of Chapter 13 in the "Appendix" of the Building Code is hereby excepted
from this adoption by reference.
SECTION 3. AMFNDMF.NT, OFFICE OF BUILDING OFFICIAL
Section 20l of the Building Code is hereby amended to read as follows:

"The Board of Trustees of the Town of Vail hereby creates the office and position
of Fuilding Official. The Building official shall be appointed by, and serve at the
pleasure of the Board of Trustees of the Town of Vail, but in no event shall his
appointment continue beyond one week after the qualification of the members of
the Board of Trustees for office following their election as prescribed by lavv.
At such time the Building Official may be reappointed. The functions, responsi-
bilities and duties of the I~uilding Official shall be the same as those set forth
in the Building Code.
SECTION 4. AMENDMENT, BOARD OF FPPEALS
Chapter 2, Section 204 titled "Board of Pnpeals" is hereby amended to
read as follows: In order to determine the suitability of alternate materials and
types of construction and to provide for reasonable interpretations of the provi-
sions of the Building Code, there shall be and is hereby created a Poard of
Pnpeals, consisting of five members. The Puilding Official shall be an ex-officio
non-voting member of the Board of P*~peals and shall act as Secretary of the Board.
The Board of Ppneals shall be appointed by, and hold office at the pleasure of, the
Board of Trustees. The Board of Appeals shall adopt reasonable rules and regu-
lations for conducting its investigatio?is and shall render all decisions and findings
to the Building Official with a duplicate copy to the appellant and. may recommend
to the Roard of Trustees such new legislation as is consistent therewith.
SECTION 5. DECL,ARA,TION OF VIOLPTION
It shall he unlawful for any person, firm or corporation to construct,
alter, repair, remove, demolish, eq:~in, use, occupy or maintain any building

or structure in the T~~wn of Vail, or cause the same to be done, contrary to or
in violation of any of the provisions of the Puilding Code.
SECTION 6. PFNA LTIFS
~` ny person, firm, or corporation violating any of the provisions of the
Building Code or of this ordinance, shall be deemed guilty of a misdemeanor, and
each such person shall be deemed f;uilty of a. separate offense for each and every
clay or portion thereof during; w~~ich any violation of any of the provisions of the
Building Code, or of this ordinance, is committed, continued, or permitted, and
upon conviction of any such violation such person shall be punishable by a fine of
not more than $300, or by imprisonrrent for not more than 90 days.
SECTION 7. FILING COPIES
.F~f.ter the effective date of the adoption of the building Code, three conies
certified to be true conies by the Mayor and. the Town R: corder shall he filed in
the office of the Town Recorder where they shall be kept for public inspection
during the re;ular office hours while this ordinance is in force.
SECTION S. li'FFFCTIVE DATE
This ordinance shall be in full force and effect within thirty days after its
approval by the Board of Trustees and final publication as prescribed by law.
SECTION 9. SAFETY CLAUSE
"The Board of Trustees hereby finds, determines, and declares that
this ordinance is necessary and proper to provide for the safety, preserve the
health, nrornote the prosperity, improve the morals, order, comfort and the

convenience of the Town of Vail and the inhabitants thereof. "
SECTION 10. SEVERP BILITY
"It is the intention of the Board of Trustees that this ordinance or any
part or provision thereof, shall be considered severable and, if any provis ion
of this ordinance or the application thereof to any person or circumstance is
held invalid, such invalidity shall not affect other provisions or applications of
~he ordinance which can be given effect without the invalid provision or applica-
lion, and to this end the provisions of this ordinance are declared to be severable. "
